Currently a political debate is ongoing in Germany as to whether Germany should, following the example of several other European countries such as France and the Netherlands, adopt a Supply Chain Act (Lieferkettengesetz). If adopted, the act in question would impose due diligence obligations on German corporations to prevent human rights violations taking place in their respective global supply chains. It is against this background that the article examines the preconditions that must be met in order for such act to be eventually compatible with both, German constitutional and international law. The authors further deal with the question whether Germany might even be obliged under international, as well as under German constitutional law, to enact such a supply chain law in order to protect the human rights of workers employed by companies forming part of the global supply chains of German companies. As far as German constitutional law is concerned the article notably deals with the question whether it is the Federal parliament that may adopt such a law also taking into account the competencies of the European Union in the field, and what are the requirements of legal specificity and proportionality in order for the draft law to stand constitutional scrutiny. The authors further offer detailed suggestions how corporate due diligence standards might be best provided for in the envisaged law and propose a risk analysis approach that varies not only according to specific countries and sector-specific characteristics, but that by the same token also takes into account the ability of the respective German company to exercise an appropriate due diligence standard when it comes to human rigths issues arising within the framewok of their supply chain. As far as the substantive human rights standards are concerned that should serve as benchmarks for the envisaged Supply Chain Act the authors propose to rely on, and refer to, those instruments such as the ICCPR and the CESCR, as well as the ILO treaties containing core labour standards, that enjoy almost universal acceptance and reflect customary international law.

Eingebettet in die aktuelle Open-Government-Debatte gewinnen E-Bürgerdienste weiter an Bedeutung. Zu den Vorreitern internetbasierter Bürgerdienste wird der Brandenburger Bürgerservice Maerker gezählt, da dieser eine einfache Möglichkeit der Kommunikation zwischen Bürger und Verwaltung über Infrastrukturprobleme in der Gemeinde bietet. Auf der Grundlage von Experteninterviews und einer Umfrage unter den teilnehmenden Kommunen evaluieren die Autoren die Einführung und Umsetzung des Maerker Brandenburgs. Im Ergebnis zeigen sich neben einer großen Breite an Akzeptanz und Zustimmung unter den beteiligten Akteuren auch unausgeschöpfte Potenziale zur Verbesserung der Prozesse innerhalb der Verwaltung. Dieser Artikel stellt die Ergebnisse der Evaluation des Maerkers dar und gibt einen Ausblick auf weitere Entwicklungspotenziale.
Die Digitalisierung unseres Lebens löst die Grenzen zwischen Privat- und Berufsleben immer weiter auf. Bekanntes Beispiel ist das Homeoffice. Arbeitgeber begegnen aber auch zahlreichen weiteren Trends in diesem Zusammenhang. Dazu gehören „workation“, also die Verbindung zwischen Arbeit („work“) und Urlaub („vacation“) ebenso wie „bleisure“, dh die Verbindung von Dienstreisen („business“) und Urlaub („leisure“). Der Beitrag geht den rechtlichen Rahmenbedingungen hierfür nach.
Die Wasserknappheit in einigen Regionen Asiens, Afrikas und Südamerikas geht nicht nur auf den Klimawandel und die damit verbundene Erderwärmung zurück, sondern ist oft auch Folge der Ansiedlungspolitik global agierender Konzerne, die für ihre Produktionsstandorte in den Entwicklungsländern große Mengen an Nutzwasser brauchen. Nicht immer wird dabei auf die wasserwirtschaftlichen Interessen der einheimischen Bevölkerung Rücksicht genommen. Zur Rechtfertigung verweisen die Konzerne gern auf die positiven wirtschaftlichen Effekte für den Gaststaat. Dieses als „Water Grabbing“ bezeichnete Verhalten ist aus rechtlicher Perspektive bislang noch nicht problematisiert worden, wozu es jedoch großen Anlass gibt.
Die Präsentation von Werbung im TV setzt auf technisch immer ausgefeiltere Methoden, um dem Zuschauer die jeweilige Werbebotschaft zu vermitteln. Zu diesem Zweck wird gelegentlich darauf hingewirkt, den Zuschauer nicht erkennen zu lassen, ob gerade noch das redaktionell-gestaltete Programm oder aber die ausschließlich kommerziellen Interessen dienende Werbung läuft. Diese bewusste Aufweichung der gebotenen Trennung von Programm und Werbung überschreitet klare medienrechtliche Grenzen, die der nachfolgende Beitrag thematisiert.

There has been considerable movement in German licensing law for some years now. Based on the fate of the license in the case of the granting of sub-licenses and in the case of insolvency of one of the contracting parties involved, a number of court decisions have been handed down which mainly deal with the legal nature of licenses and their mode of operation.
Moreover, there is now an internationally significant development in licensing law, namely the increasing independence of patents used in standards, which have increasingly become the subject of economic considerations – and not only of the companies or inventors filing them. zur Fussnote 1 These so-called standard essential patents (SEPs) are the subject of numerous legal disputes and legislative activities and constitute a scientific discourse around the globe.
In 2015, the European Court of Justice (ECJ) created the first leading case for the EU with regard to SEPs in its highly regarded Huawei/ZTE ruling. zur Fussnote 2 Although an abundance of decisions of the courts of first instances are now available, many questions still remain unanswered since the fundamental decision of the ECJ. There is controversy both over the dogmatic classification of the FRAND declaration and the legal consequences of the declaration’s binding effect. It is particularly unclear what happens to the FRAND declaration when the SEP is transferred to a third party and whether, how and to what extent the acquirer is bound by this declaration of the transferor. In a decision that can certainly be described as bold, a Higher Regional Court has now ruled on some of these issues for the first time, thus providing further food for discussion.
In this article, we examine the effects of political change on name changes of units within central government ministries. We expect that changes regarding the policy position of a government will cause changes in the names of ministerial units. To this end we formulate hypotheses combining the politics of structural choice and theories of portfolio allocation to examine the effects of political changes at the cabinet level on the names of intra-ministerial units. We constructed a dataset containing more than 17,000 observations on name changes of ministerial units between 1980 and 2013 from the central governments of Germany, the Netherlands, and France. We regress a series of generalized estimating equations (GEE) with population averaging models for binary outcomes. Finding variations across the three political-bureaucratic systems, we overall report positive effects of governmental change and ideological positions on name changes within ministries.
In the copyright industries of the 21st century, metadata is the grease required to make the engine of copyright run smoothly and powerfully for the benefit of creators, copyright industries and users alike. However, metadata is difficult to acquire and even more difficult to keep up to date as the rights in content are mostly multi-layered, fragmented, international and volatile. This article explores the idea of a neutral metadata search and enhancement tool that could constitute a buffer to safeguard the interests of the various proprietary database owners and avoid the shortcomings of centralised databases.
Auftreten unter falschem Namen in Straf- und Bußgeldverfahren ist gewiss kein alltägliches Ereignis. Existiert die Person tatsächlich, deren Namen ein anderer im Verfahren als Betroffener oder Beschuldigter verwendet, stellt sich vor allem die Frage, wen die verfahrensabschließende Entscheidung (Bußgeldbescheid, Urteil, Beschluss) betrifft. Verschiedene Konstellationen sind denkbar. Das OLG Stuttgart hatte es mit einem Fall zu tun, in dem letztlich der „richtige Täter“ verurteilt wurde. Ob sich das Verfahren auch gegen den „richtigen Betroffenen“ richtete, ist eine andere Frage.

Die Hausarbeit beinhaltet Probleme des Allgemeinen Teils des BGB sowie des Schuldrechts. Sie wurde in geringfügig abgewandelter Form als Ferienhausarbeit für Anfänger im Bürgerlichen Recht im Wintersemester 2018/2019 an der Universität Würzburg gestellt. Der Notendurchschnitt lag bei 6,25 Punkten, die Hausarbeit wurde von 18,75 % der Studierenden nicht bestanden.
