Der Fall thematisiert klassische und neuartige Probleme der Rechtfertigungsdogmatik im Strafrecht. Neben dem Fehlen eines subjektiven Rechtfertigungselements sind Probleme des § 32 StGB zu bewältigen, die darauf beruhen, dass (scheinbar) weder auf der Seite des Angreifers noch auf der Seite des Angegriffenen ein Mensch unmittelbar am Konflikt beteiligt ist.
Für deutsche Kinder, die sich im Gebiet des sog. Islamischen Staats aufhalten, kann sich aus Art. GG Artikel 2 Abs. GG Artikel 2 Absatz 2 Satz 1 GG i.V.m. Art. GG Artikel 1 Abs. GG Artikel 1 Absatz 1 Satz 2 GG ein Anspruch auf Rückholung ergeben. Bei der Erfüllung der dem Anspruch zugrunde liegenden Schutzpflicht steht der Bundesregierung jedoch ein weiter Ermessenspielraum zu. Genaueren Aufschluss über weitergehende Anhaltspunkte zur Konkretisierung der Schutzpflicht geben die Spruchpraxen deutscher Gerichte und der UN-Menschenrechtsvertragsorgane, denen sich auch Hinweise für eine mögliche Erstreckung der Schutzpflicht auf Personen ohne deutsche Staatsangehörigkeit entnehmen lassen.
In February 2020, the Inter-American Court of Human Rights (IACtHR) delivered a landmark decision in which it held Argentina responsible for the violation of several rights of 132 indigenous communities inhabiting a certain area in the province of Salta. In the Case of the Indigenous Communities of the Lhaka Honhat (Our Land) Association v. Argentina the IACtHR declared for the first time an autonomous violation of the right to a healthy environment and other DESCA (Economic, Social, Cultural and Environmental rights). Thereby, it further developed its case law on the direct justiciability of DESCA on the basis of Article 26 of the American Convention on Human Rights (ACHR) that was first established in Lagos del Campo in 2017. Focusing on the right to a healthy environment and the right to water the authors critically examine how the Court derived the direct justiciability of DESCA. In the following, the contribution examines to what extent the right to a healthy environment has been specified in the current judgment compared to the initial outline of this right by the Court in its Advisory Opinion No. 23. The analysis also deals with the question whether the facts of the case were at all suitable for such a specification and what general value could be added by an autonomous examination of DESCA. Finally, the contribution ends with a mixed conclusion on the significance of the judgment and a thoughtful outlook on the future development of the case law on Art. 26 ACHR.
§ 250 StGB ist Teil einer »heillos durcheinander geratenen Qualifikationslandschaft bei Raub und Diebstahl« (Eidam, NStZ 2018, 280). Neuere Entscheidungen zum Merkmal »Verwenden« in § 250 Abs. 2 Nr. 1 StGB zeigen, wie Recht der Kollege hat. Divergierende Stellungnahmen in der Literatur tragen dazu bei, dass man gegenwärtig von einer Klärung noch weit entfernt ist. Der vorliegende Text wird daran nur dann etwas ändern, wenn er alle, die anderer Meinung sind, überzeugt. Damit ist erfahrungsgemäß nicht zu rechnen.
Zahlreiche aktuelle Gerichtsentscheidungen haben der strafrechtswissenschaftlichen Diskussion über den Beginn des Versuchs beim Wohnungseinbruchsdiebstahl neue Impulse gegeben. Dabei geraten sogar strafrechtsdogmatische Lehrsätze, die eine feste Verankerung zu haben scheinen, ins Wanken. Da Diebstahl in allen Variationen zum Kernbereich des strafrechtlichen Examensstoffes gehört, sollten Studierende über diese Entwicklung informiert sein. Denn klausurtaugliche Sachverhalte realer Fälle kehren oft nach einiger Zeit als Prüfungsaufgabe wieder. Damit fließen auch neue Vorschläge der strafrechtlichen Lehre, die durch derartige Fälle inspiriert wurden, in das Prüfungsgeschehen ein. Nicht alles muss man kennen, wenn man im Examen Erfolg haben will. Aber umfassende Informiertheit über herrschende und abweichende (Minder-)Meinungen schadet nicht. Der Beitrag erklärt, worauf es bei der Prüfung des versuchten Wohnungseinbruchsdiebstahls nach bislang herrschender Lehre ankommt und auf welche argumentativen Neuerungen man sich möglicherweise einstellen muss.
Volle Zufriedenheit hat der Gesetzgeber mit der Einführung des neuen § 192a StGB in der Gemeinde der Strafrechtler nicht erzeugt. Bezweifelt wird, ob die Strafbarkeitslücken, die die Vorschrift schließen soll, tatsächlich existierten. Auf der anderen Seite wird beanstandet, dass der neue Tatbestand selbst lückenhaft ist. Tatsache ist, dass das sprachliche Erscheinungsbild der Norm nicht zufriedenstellt. Der unausgegorene Gesetzestext wirft zahlreiche Fragen auf, die mit den Mitteln der Auslegung kaum zu beantworten sind. Taten werden strafbar gestellt, deren Strafwürdigkeit fragwürdig ist. Andererseits öffnen sich Räume der Straflosigkeit für Taten, die in Relation zu den vom Gesetzestext erfassten Fällen nur unter Missachtung des Gleichbehandlungsgebots (Art. 3 Abs. 1 GG) von der Strafbarkeit verschont bleiben können.
Der Beitrag knüpft unmittelbar an den in JA 10/2022, 830 ff. veröffentlichten ersten Teil (Anwendungsbereich, Stufenverhältnisse und unechte Wahlfeststellung) an und führt diesen fort. Idealerweise führen Sie sich zum Einstieg noch einmal die unechte Wahlfeststellung vor Augen, um die Unterschiede zu vergegenwärtigen: Diese ist zu treffen, wenn unklar ist, durch welche von mehreren nach den Erkenntnissen möglichen Handlungen der Täter den identischen Straftatbestand verwirklicht hat – also der Straftatbestand klar, lediglich die diesen erfüllende Handlung unklar ist.
Wenn auch der Begriff ab und an anklingt, so fristet der Nötigungsnotstand doch weitgehend ein Schattendasein in der juristischen Ausbildung. Dabei wartet er in der Klausur mit zahlreichen Problemen auf, welche von der mittelbaren Täterschaft über eine Rechtfertigung oder Entschuldigung bis hin zu einem Erlaubnistatbestandsirrtum reichen können. Bereits deshalb dürfte der Nötigungsnotstand viele Klausurersteller in Versuchung führen – und viele Studierende in die Verzweiflung treiben. Dieser Beitrag will daher die klausurrelevanten Problemkreise des Nötigungsnotstands darstellen, um so Sicherheit für die Klausurbearbeitung zu gewinnen.
Der erste Teil der Aufgabe (Ausgangsfall) hat den Schwierigkeitsgrad einer anspruchsvollen Klausur in der Fortgeschrittenen-Übung im Strafrecht. Ihre erfolgreiche Bewältigung setzt neben soliden Rechtskenntnissen im thematischen Bereich des Rücktritts vom Versuch vor allem genaue Erfassung aller relevanten Sachverhaltsangaben und präzise Subsumtion voraus. Mit der Abwandlung hat die Aufgabe Umfang und Schwierigkeitsgrad einer mittelschweren Klausur in der ersten Juristischen Prüfung.
„Die Gerichtssprache ist deutsch“ heißt es in § 184 S. 1 GVG. Alle Verfahrensbeteiligten müssen also ihre mündliche oder schriftliche Kommunikation in deutscher Sprache führen. Soweit eine Person, die sich im Verfahren äußern will oder muss, die deutsche Sprache nicht beherrscht, wird ein Dolmetscher hinzugezogen, § 185 Abs. 1 S. 1 GVG. Dasselbe gilt, wenn jemand Anspruch auf rechtliches Gehör gem. Art. 103 Abs. 1 GG hat, die in deutscher Sprache gemachten Ausführungen der anderen Verfahrensbeteiligten aber nicht versteht. Die Mitwirkung eines Dolmetschers kann interessante materiell-strafrechtliche Probleme im Bereich der Aussagedelikte (§§ 153 ff. StGB) erzeugen. Der vorliegende Text will zum Nachdenken darüber anregen.
Die kanadische Immobiliengesellschaft ROI Land Investment Ltd. beschäftigte einen Deutschen (FD) als stellvertretenden Vizepräsidenten im Bereich Finanzkommunikation. Kurz darauf beschlossen die Parteien, ihr Vertragsverhältnis auf eine noch zu gründende Schweizer Gesellschaft zu überführen, deren Muttergesellschaft die ROI Land bildete. Drei Monate später wurde FD Direktor der neuen Schweizerischen Aktiengesellschaft, er arbeitete aber in Stuttgart. Mit der ROI Land schloss er noch eine Patronatsvereinbarung, wonach die kanadische Immobiliengesellschaft für die Verbindlichkeiten der neugegründeten Schweizer AG ihm gegenüber haftete. Nach nur fünf Monaten kündigte die Schweizer Gesellschaft den Arbeitsvertrag. FD griff die Kündigung zwar erfolgreich an, konnte aber das Urteil gegen die inzwischen insolvente Schweizer Gesellschaft nicht vollstrecken, weshalb er die kanadische Immobiliengesellschaft aus der Patronatsvereinbarung verklagte.
Auf Basis einer Umfrage unter 300 Beschäftigten im öffentlichen Dienst untersucht dieser Beitrag, welche möglichen Auswirkungen die Digitale Transformation auf das Tätigkeitsprofil von Mitarbeiterinnen und Mitarbeitern im öffentlichen Sektor haben kann. Zum einen finden sich erste Hinweise auf signifikante Effizienzpotenziale durch Automatisierung im öffentlichen Sektor. Zum anderen wird deutlich, dass die Mitarbeiterinnen und Mitarbeiter dieser Entwicklung mehrheitlich positiv gegenüberstehen und sie aktiv an der Verbesserung von Dienstleistungen mitwirken wollen. Aus diesen Erkenntnissen können zahlreiche Handlungsimplikationen für Veränderungsprojekte in der Praxis abgeleitet werden. Gleichzeitig ruft dieser Beitrag dazu auf, die Folgen der Digitalen Transformation für Mitarbeiterinnen und Mitarbeiter noch besser zu erforschen.
Die Hausarbeit beinhaltet Probleme des Allgemeinen Teils des BGB sowie des Schuldrechts. Sie wurde in geringfügig abgewandelter Form als Ferienhausarbeit für Anfänger im Bürgerlichen Recht im Wintersemester 2018/2019 an der Universität Würzburg gestellt. Der Notendurchschnitt lag bei 6,25 Punkten, die Hausarbeit wurde von 18,75 % der Studierenden nicht bestanden.

Gegenstand der anspruchsvollen Examensübungsklausur ist im ersten Teil ein aufsehenerregendes Urteil des OLG Hamm zu einer sog. cold-water-Challenge (NJOZ 2018, 1289). Eine große Herausforderung besteht zunächst in der Wahl eines übersichtlichen Aufbaus, der vollständig ist und zugleich Redundanzen vermeidet. Darüber hinaus eignet sich die Aufgabenstellung angesichts ihrer Stofffülle hervorragend zum Einüben der Schwerpunktsetzung. Im Detail bietet sich immer wieder die Möglichkeit, sich »nach oben abzusetzen«. Für eine gute Bewertung müssen nicht alle Einzelfragen diskutiert werden. Inhaltlich ist mit den Verkehrspflichten ein deliktsrechtlicher Klassiker zu bewerkstelligen, und eher unbekanntere Anspruchsgrundlagen aus dem Deliktsrecht wollen erkannt und subsumiert werden. Insoweit sind Auslegungs‑ und Argumentationsvermögen unter Beweis zu stellen. Sodann erfolgt ein Streifzug durch das Schadensrecht, wenn es um die Erstattung von Besuchskosten geht. Abschließend geht es im zweiten Teil um eine Entscheidung des BGH zu den umstrittenen Anforderungen an einen Kündigungsgrund nach dem Eintritt von Haushaltsangehörigen in den Mietvertrag infolge des Todes der Mieterpartei (BGHZ 217, 263 = NJW 2018, 2397), deren Kenntnis von Studierenden nicht erwartet werden kann. Die Grundzüge des Mietrechts müssen beherrscht und mit einem geschickten Argumentationsvermögen verbunden werden.

Mehr als 15 Jahre, nachdem eine neue digitale Post-NPM Ära ausgerufen wurde, fehlt es der Digitalisierungsforschung weiterhin an Tiefe. Während interne Prozesse und Verfahren oft unbeachtet blieben, lag der Fokus in der Vergangenheit auf der Untersuchung digitaler Dienstleistungen an der Schnittstelle zwischen Verwaltung und Bürger. Um Forschung in diesem Bereich zu konsolidieren, schlägt dieser Debattenbeitrag vor, klassische Ansätze für die Digitalisierungsforschung „fit“ zu machen. Anschließend sollten Effekte der Digitalisierung, insbesondere auf die Effizienz von Organisationen (auch negative Auswirkungen z.B. durch Digital Red Tape), innerhalb der Verwaltung analysiert werden. Dafür muss jedoch beantwortet werden, wie Digitalisierung gemessen und operationalisiert werden kann.

Die Corona-Pandemie hat im Frühjahr 2020 auch die öffentliche Verwaltung gezwungen, die Arbeit zu einem großen Teil ins Homeoffice zu verlagern. Dieser Beitrag stellt die Ergebnisse einer Studie vor, die mittels qualitativer Interviews und einer Online-Befragung (N=1.189) Beschäftigte öffentlicher Organisationen zum Umgang mit der Krise und den Erfahrungen mit dem Homeoffice befragt hat.

Scholars have recently devoted increasing attention to the role and function of international bureaucracies in global policymaking. Some of them contend that international public officials have gained significant political influence in various policy fields. Compared to other international bureaucracies, the political leeway of the Secretariat of the United Nations Framework Convention on Climate Change has been considered rather limited. Due to the specific problem structure of the policy domain of climate change, national governments endowed this intergovernmental treaty secretariat with a relatively narrow mandate. However, this article argues that in the past few years, the United Nations Framework Convention on Climate Change Secretariat has gradually loosened its straitjacket and expanded its original spectrum of activity by engaging different sub-national and non-state actors into a policy dialogue using facilitative orchestration as a mode of governance. The present article explores the recent evolution of the United Nations Framework Convention on Climate Change Secretariat and investigates the way in which it initiates, guides, broadens and strengthens sub-national and non-state climate actions to achieve progress in the international climate negotiations. <br /> Points for practitioners <br /> The Secretariat of the United Nations Framework Convention on Climate Change has lately adopted new roles and functions in global climate policymaking. While previously seen as a rather technocratic body that, first and foremost, serves national governments, the Climate Secretariat increasingly interacts with sub-national governments, civil society organizations and private companies to push the global response to climate change forward. We contend that the Climate Secretariat can contribute to global climate policymaking by coordinating and steering the initiatives of non-nation-state actors towards coherence and good practice.

Private international law (PIL) might seem disconnected from peacebuilding and peacekeeping efforts. However, this perception falls short. PIL, contrary to public international law’s direct peacekeeping potential, indirectly contributes to peace by fostering mutual respect between states. The relationship between PIL and peace stems from the recognition and respect states show for each other’s legal systems. PIL operates on the principle of comity, where states acknowledge the applicability of foreign laws to resolve cases. In essence, while PIL’s impact on peace is indirect and modest, its emphasis on mutual respect and fair treatment contributes to peaceful relations between states, making it an important element in the broader context of peacebuilding and peacekeeping efforts. Private international law (PIL) does not determine substantive fairness for parties but focuses on localizing cases at a meta-level of conflict-of-laws. This localization is guided by party, trade, and regulatory interests, and is rooted in neutrality and respect for other legal systems. While the principle of equivalence and neutrality remains foundational in PIL, exceptions and limitations have been established over time to address specific scenarios, ensuring a balanced approach that respects both foreign legal systems and fundamental legal principles.
Cross-national variation in the relationship between welfare generosity and single mother employment

Reform of the U.S. welfare system in 1996 spurred claims that cuts to welfare programs effectively incentivized single mothers to find employment. It is difficult to assess the veracity of those claims, however, absent evidence of how the relationship between welfare benefits and single mother employment generalizes across countries. This study combines data from the European Union Labour Force Survey and the U.S. Current Population Survey (1992-2015) into one of the largest samples of single mothers ever, testing the relationships between welfare generosity and single mothers’ employment and work hours. We find no consistent evidence of a negative relationship between welfare generosity and single mother employment outcomes. Rather, we find tremendous cross-national heterogeneity, which does not clearly correspond to well-known institutional variations. Our findings demonstrate the limitations of single country studies and the pervasive, salient interactions between institutional contexts and social policies.
Gary Jacobsohn and Yaniv Roznai’s (2020) book Constitutional Revolution offers a sophisticated conceptual framework with a fascinating description of empirical occurrences of substantive revolutions in the practice and understanding of constitutionalism in Germany, India, Hungary, and Israel. While the conceptualization in the book and its empirical illustration clearly draw from regime transformations or substantive changes within democratic regimes, we know little about the extent to which substantive constitutional reforms are possible and meaningful in autocratic regimes. As their concept of constitutional revolution is ambiguous and requires a substantive engagement with an individual case at hand, we cannot sim- ply expect concept equivalence when expanding its use beyond a transitory or democratic context. Hence, in this contribution I ask, What constitutes a constitutional revolution in an autocratic regime? To shed light on this question, I rely on the expectation that we do not find important differences in the substance of autocratic constitutions compared to democratic constitutions. Autocratic elites, also, under- stand the possibilities of constitutional change and respond to them as they offer regime stability and simply more power, but that is not a revolution. Therefore, I argue that the substantive meaning of an amendment must be a departure from the inherent logic of the constitution, especially outside the standard procedures for autocratic ruling. Thus, in this paper I discuss the theoretical implications of a constitutional revolution under autocracy without a regime transition and provide empirical evidence from various constitutional amendments and de facto reforms in Russia. I show that a constitutional revolution is not always the most important or most discussed constitutional change—at least, not in an autocratic context. This discussion has important implications for understanding constitutionalism and autocratic stability and the largely overlooked relationship between substance and process in nondemocratic settings.

The Paris Agreement enshrines the triad of mitigation, adaptation and resilience. In this connection, climate protection lawsuits are increasingly being filed. The question for the courts is whether or not they are functionally overburdened in view of the dimension of climate change and transformation. They will have to find a path between non-functional activism and misplaced restraint. Adapted from the usual introductory question for civil law cases, «Who wants what out of what from whom?», an overview of the subjects of dispute will be provided. Subsequently, the challenges of the courts of lower instance and the Federal Constitutional Court with regard to the separation of powers and the principle of democracy are presented. Particular attention is paid to the climate decision of the Federal Constitutional Court of March 24th, 2021.
Activating norm collisions

This article puts forward a constructivist-interpretivist approach to interface conflicts that emphasises how international actors articulate and problematise norm collisions in discursive and social interactions. Our approach is decidedly agency-oriented and follows the Special Issue’s interest in how interface conflicts play out at the micro-level. The article advances several theoretical and methodological propositions on how to identify norm collisions and the conditions under which they become the subject of international debate. Our argument on norm collisions, understood as situations in which actors perceive two norms as incompatible with each other, is threefold. First, we claim that agency matters to the analysis of the emergence, dynamics, management, and effects of norm collisions in international politics. Second, we propose to differentiate between dormant (subjectively perceived) and open norm collisions (intersubjectively shared). Third, we contend that the transition from dormant to open – which we term activation – depends on the existence of certain scope conditions concerning norm quality as well as changes in power structures and actor constellations. Empirically, we study norm collisions in the area of international drug control, presenting the field as one that contains several cases of dormant and open norm collisions, including those that constitute interface conflicts. For our in-depth analysis we have chosen the international discourse on coca leaf chewing. With this case, we not only seek to demonstrate the usefulness of our constructivist-interpretivist approach but also aim to explain under which conditions dormant norm collisions evolve into open collisions and even into interface conflicts.
This cross-country comparison of administrative responses to the COVID-19 pandemic in France, Germany and Sweden is aimed at exploring how institutional contexts and administrative cultures have shaped strategies of problem-solving and governance modes during the pandemic, and to what extent the crisis has been used for opportunity management. The article shows that in France, the central government reacted determinedly and hierarchically, with tough containment measures. By contrast, the response in Germany was characterized by an initial bottom-up approach that gave way to remarkable federal unity in the further course of the crisis, followed again by a return to regional variance and local discretion. In Sweden, there was a continuation of ‘normal governance’ and a strategy of relying on voluntary compliance largely based on recommendations and less – as in Germany and France – on a strategy of imposing legally binding regulations. The comparative analysis also reveals that relevant stakeholders in all three countries have used the crisis as an opportunity for changes in the institutional settings and administrative procedures.
This introduction and the special issue are a contribution to comparative intergovernmental studies and public administration. This introduction provides an analytical overview of the intergovernmental relations policy responses to the Covid-19 pandemic across ten European countries, focussing on the early waves of the disease. These policy responses are analysed in terms of three types of IGR process: (1) a predominantly multi-layered policy process involving limited conflict, (2) a centralised policy process as the central government attempts to suppress conflict and (3) a conflicted policy process where such attempts are contested and tend to contribute to poor policy outcomes. The conclusion, then, reviews the difficulties and trade-offs involved in attaining a balanced multi-layered, intergovernmental process.
This article is aimed at analysing local and intergovernmental responses to the COVID-19 pandemic in Germany during the ‘first wave’ of the pandemic. It will answer the question of how the intergovernmental system in Germany responded to the crisis and to what extent the pandemic has changed patterns of multi-level governance (MLG). The article argues that the coordination of pandemic management in Germany shifted between two ideal types of multi-level governance. While in the first phase of the pandemic the territorially defined multi-level system with the sub-national and local authorities as key actors of crisis management was predominant, in the second phase a more functional orientation with increased vertical coordination gained in importance. Later on, more reliance was given again on local decision-making. Based on this analysis, we will draw some preliminary conclusions on how effective MLG in Germany has been for coordinating pandemic management and point out the shortcomings.
This article provides a conceptual framework for the analysis of COVID-19 crisis governance in the first half of 2020 from a cross-country comparative perspective. It focuses on the issue of opportunity management, that is, how the crisis was used by relevant actors of distinctly different administrative cultures as a window of opportunity. We started from an overall interest in the factors that have influenced the national politics of crisis management to answer the question of whether and how political and administrative actors in various countries have used the crisis as an opportunity to facilitate, accelerate or prevent changes in institutional settings. The objective is to study the institutional settings and governance structures, (alleged) solutions and remedies, and constellations of actors and preferences that have influenced the mode of crisis and opportunity management. Finally, the article summarizes some major comparative findings drawn from the country studies of this Special Issue, focusing on similarities and differences in crisis responses and patterns of opportunity management.
Deutschland landet in europäischen Rankings zur Verwaltungsdigitalisierung regelmäßig im hinteren Mittelfeld. Die bisherige Bilanz der Digitalisierung für die deutsche öffentliche Verwaltung ist trotz verstärkter Anstrengungen aller föderaler Ebenen, wie sie insbesondere in der Umsetzung des Onlinezugangsgesetzes (OZG) zum Ausdruck kommen, nach wie vor als eher ernüchternd einzuschätzen. Vor diesem Hintergrund beschäftigt sich der vorliegende Beitrag mit der Umsetzung, den Hürden und ausgewählten Wirkungsaspekten der Verwaltungsdigitalisierung auf kommunaler Ebene. Die empirische Basis bildet eine 2019 abgeschlossene Studie zur digitalen Transformation in einem Schlüsselbereich bürgerbezogener Leistungserbringung, den städtischen Bürgerämtern, welche die am meisten nachgefragten kommunalen Dienstleistungen bereitstellen. Aus der Analyse lassen sich wichtige Erkenntnisse für die zukünftige Entwicklung der Digitalisierung öffentlicher Leistungserbringung in Deutschland ableiten.
