In diesem Text soll zweierlei gezeigt werden. Erstens, weil Menschen Rechte haben, gibt es wenigstens einige Tiere, die Rechte haben (I.). Zweitens, wir können die Rechte von Tieren nicht willkürfrei auf die Art begrenzen, die wir selber bilden; Menschen sind nicht die einzigen Tiere, die Rechte haben (II.).

Zusammenfassung – nichtamtliche Leitsätze:
• Ein allgemeines Burkaverbot in der Öffentlichkeit verstößt nicht gegen Art. 8 oder 9
EMRK.
• Das Tragen einer Burka unterfällt als private Lebensführung dem Schutzbereich des
Art. 8 EMRK sowie als Religionsausübung dem Schutzbereich des Art. 9 EMRK.
• Ein allgemeines Burkaverbot in der Öffentlichkeit zum Schutz der Sicherheit verfolgt
ein legitimes Ziel, ist in Ermangelung einer allgemeinen Gefahr aber nicht erforderlich
und damit unverhältnismäßig.
• Der Schutz des Respekts für die Gleichheit von Mann und Frau oder für die Menschenwürde
lässt sich nicht als legitimes Ziel für ein Burkaverbot heranziehen.
• Der Schutz des Respekts für die Minimalbedingungen gesellschaftlichen Zusammenlebens
stellt ein legitimes Ziel für ein Burkaverbot dar. Das Burkaverbot ist angesichts
des breiten staatlichen Ermessensspielraums in einer solchen Frage nicht unverhältnismäßig.

Das MenschenRechtsZentrum der Universität Potsdam (MRZ) beging im Jahr 2014 sein zwanzigjähriges Bestehen. Aus diesem Grund beschäftigt sich der aktuelle Jahresbericht nicht nur – wie ansonsten üblich – mit der spezifischen Organisationsstruktur und der Arbeit im Berichtszeitraum, sondern gibt einleitend einen knappen Überblick über die umfangreiche Tätigkeit des MRZ seit seiner Gründung. Diese Bilanz wird durch eine ausführliche Liste der Veranstaltungen und Schriftenreihen im Anhang vervollständigt.

Die Beziehungen zwischen den Vereinten Nationen und nichtstaatlichen Akteuren
haben seit den 1990er Jahren einen radikalen Wandel erlebt. Nach der
Rio-Konferenz über Umwelt und Entwicklung 1992 stand in den Vereinten Nationen
zunächst die Frage im Vordergrund, wie der gewachsenen Bedeutung
der Nichtregierungsorganisationen (NGOs) in der Arbeit und den Strukturen der
Weltorganisation Rechnung getragen werden könnte. Seit Ende der 1990er Jahre
dominierten innerhalb der Vereinten Nationen und einiger ihrer Spezialorgane
und Sonderorganisationen zunehmend die Bemühungen, Privatunternehmen
und ihre Interessenvertreter aktiver in die Arbeit der Vereinten Nationen zu integrieren.
Dies geschah zum einen in Form unterschiedlichster bilateraler Kontakte
und Kooperationsvorhaben zwischen Unternehmen und UN-Akteuren, zum anderen
im Rahmen von Dialogveranstaltungen und gemeinsamen Initiativen von
Regierungen, zwischenstaatlichen Gremien, Wirtschaftsvertretern und NGOs, für
die im Folgeprozess der Rio-Konferenz der Begriff der Multistakeholder-Partnerschaften
geprägt wurde.
Der folgende Beitrag nimmt diese Entwicklung kritisch unter die Lupe. Er
zeichnet im Zeitraffer nach, wie sich die Beziehungen zwischen den Vereinten
Nationen und nichtstaatlichen Akteuren gewandelt haben, beschreibt das Ausmaß
und die Bandbreite der neuen Partnerschaftsansätze, erörtert Risiken und
Nebenwirkungen dieses Paradigmenwechsels in der internationalen Politik und
skizziert zum Schluss, welche Konsequenzen sich daraus für die Vereinten Nationen
abzeichnen.
Mit Kinderschuhen im Gepäck

Zu kleine Kinderschuhe zwängen ein, zu große geben keinen Halt. Liebe, Fürsorge und Mitgefühl helfen, die jeweils passenden Kinderschuhe zu finden. In ihnen lernt das Kind am besten, seine individuellen Fähigkeiten zu entfalten, sie in die Gemeinschaft einzubringen und seinen eigenen Weg zu finden.
Der Band spannt einen Bogen von neurowissenschaftlichen Erkenntnissen und Grundfragen des Biografierens über Porträts von Persönlichkeiten bis hin zu gelebten menschenrechtlichen Werten.
Die Autoren und Autorinnen, Studierende der Universität Potsdam, gehen auf Spurensuche und fragen, wie die von ihnen vorgestellten Menschen zu denen wurden, die sie waren oder sind, ob und wie sie sich selbst fanden, ihre persönlichen Fähigkeiten entfalteten und anderen halfen. Sie stoßen auf kraftschenkende Kindheiten und erlebtes Glück, auf Authentizität, Verantwortung und Gleichwürdigkeit ebenso wie auf Schicksalsschläge, Ablehnung und Unrecht, auf Wünsche und Sehnsüchte, innere Zerrissenheit und Schmerz, vor allem aber auf die individuellen und sozialen Stärken dieser Persönlichkeiten.

Belastung und Arbeitsfähigkeit des Europäischen Gerichtshofs für Menschenrechte: neuere Entwicklungen - Extraterritoriale Anwendbarkeit der Rassendiskriminierungskonvention - Globale Verantwortlichkeit oder traditionelles Souveränitätsdenken – Gründe für die Haltung zur “Responsibility to Protect” von nicht-westlichen Staaten
Die zwölfte Konferenz des Forschungskreises Vereinte Nationen wurde am 28. Juni 2014 an der Universität Potsdam veranstaltet und stand unter dem Thema „Konzepte für die Reform der Vereinten Nationen“. Dabei wurde das komplexe Verhältnis zwischen Reformnotwendigkeit und Machbarkeitserwartungen einerseits und ausgebliebenen weitreichenden Strukturreformen und erfolgten „kleineren“, pragmatischen Reformschritten andererseits deutlich. Mit den vier Referaten stellte die Konferenz in der Tradition der Potsdamer UNO-Konferenzen die Verbindung von Wissenschaft und Praxis unter Beteiligung unterschiedlicher Disziplinen her.
Mit der Broschüre soll allen Interessierten die Möglichkeit gegeben werden, Einblick in ausgewählte Schwerpunkte der Reformdiskussion zu erhalten:
An ein Grundsatzreferat zu bisherigen Reformprozessen im UN-System insgesamt schließen sich drei Texte an, die das Verhältnis zwischen den Vereinten Nationen und den nichtstaatlichen Akteuren in den Blick nehmen, die relativ neue Institution des Menschenrechtsrates als Teil der Reformbemühungen betrachten und schließlich Ergebnisse und Trends bei den Reformen der Arbeitsmethoden des Sicherheitsrates erörtern.
