Der russische Angriffskrieg auf die Ukraine hat auch die Europäische Menschenrechtsarchitektur ins Wanken gebracht. Der Europarat reagierte schnell und beendete die Mitgliedschaft der Russischen Föderation. Aus diesem Anlass blickt der Beitrag zurück auf die wechselvolle Geschichte der Mitgliedschaft Russlands im Europarat. Seit dem Beitritt vor 26 Jahren haben Konfrontationen die – oftmals kurzen– Phasen der Kooperation überschattet. Das wirft die Frage auf, inwieweit die „Politik des Dialogs“ gegenüber der Russischen Föderation geeignet war, die Menschenrechtslage in Russland zu verbessern. Der Beitrag legt zudem die rechtlichen Grundlagen von Beitritt und Ende der Mitgliedschaft dar und untersucht, wie sich der Ausschluss auf die Anwendbarkeit der Europäischen Menschenrechtskonvention (EMRK) auswirkt. Der Ausschluss Russlands stellt einen Wendepunkt dar. Zwar wird damit ein potenziell gefährlicher Präzedenzfall geschaffen. Jedoch entsteht durch die geschlossene Reaktion der restlichen Mitgliedstaaten auch ein Momentum für Reformen und eine Rückbesinnung auf das Gründungsziel des Europarates – die kollektive Durchsetzung der Menschenrechte.

Die Locarno-Verträge haben in der völkerrechtlichen Literatur der 1920er und 1930er Jahre viel Aufmerksamkeit erfahren. Auch die zeitgenössische Publizistik beschäftigte sich ausführlich mit diesem Thema, wobei das Verhältnis von Verständigung mit den Nachbarn und Revision der Grenzregelungen im Mittelpunkt der Debatte stand.
Später gehörte Locarno zur Geschichte der Zwischenkriegszeit und wurde im Rahmen der Völkerbundsgeschichte, der Völkerrechts- und Diplomatiegeschichte und der Geschichte der Weimarer Republik behandelt. Für die politikwissenschaftliche Literatur spielte Locarno fast ausschließlich auf dem Gebiet der Sicherheits- und Abrüstungspolitik eine Rolle; eine (system)theoretische Erörterung steht bislang aus.
In diesem Beitrag sollen nach einem kurzen Überblick über das Vertragswerk zunächst die geschichtliche Ausgangslage knapp umrissen und Vorgeschichte und Ergebnis der Konferenz von Locarno skizziert werden. Anschließend werden Inhalte und Lösungsansätze des Vertragswerkes beleuchtet, bevor zum Schluß eine kurze Einordnung in das System des Völkerbundes erfolgt.
Privatheit gehört angesichts der neuen technischen Möglichkeiten und des von diesen (mit-)determinierten Verhaltens vieler Menschen zu den großen Themen des beginnenden 21. Jahrhunderts. Die vielfältigen Beiträge des Bandes nehmen die damit verbundenen Fragen in den Blick und untersuchen die sozialen Dimensionen des Privaten (Beate Rössler) auf der einen sowie die nationalen und internationalen Rechtsgrundlagen zum Schutz des Rechts auf Privatheit (Stephanie Schiedermair) auf der anderen Seite. Diese Sichtweisen werden durch Einbeziehung der internationalen Debatten über das Recht auf Privatheit (Norman Weiß) und den Rückgriff auf die literarische Behandlung der Unterscheidung von privat und öffentlich (Detlef von Daniels) ergänzt.
Die Autorinnen und Autoren machen wichtige Markierungen für künftige Debatten durch die Zusammenschau von historischen Entwicklungen und gesellschaftlichen Veränderungen sichtbar und verdeutlichen, inwieweit die Thematik „Privatheit im digitalen Zeitalter“ mit dem Einzug in diverse Lebensbereiche zunehmend an Bedeutung gewinnt.
Global commons form a comparatively new part of international law, since the term appeared in international discussions and codifications only in the second half of the 20th century. The Common Heritage of Mankind is the corresponding legal principle that can establish an international regime to determine the legal status of non-sovereign territories and to allocate exploitation rights. Its main aim is to balance competing national claims by emphasising mankind’s common interest in the preservation and controlled exploitation of natural re-
sources. Against this background, the chapter sheds a critical light on attempts to transfer the institute of the Common Heritage of Mankind to the sphere of communication. Taking debates revolving around the New World Information and Communication Order in the framework of UNESCO since the late 1970s as a starting point, the author analyses the pitfalls and limits of attempts to establish governance structures for a global information order, including recent attempts to govern the internet.
2013 jährte sich das Inkrafttreten der Europäischen Menschenrechtskonvention zum 60. Mal. Seit ihrem Bestehen hat die Konvention insbesondere durch den auf ihrer Grundlage gegründeten Gerichtshof den Schutz der Menschenrechte in Europa wesentlich gestärkt. Mit ihren mittlerweile 47 Vertragsparteien ist sie zu einem gesamteuropäischen Grundrechtsschutzsystem geworden, dessen Akzeptanz sich nicht zuletzt an den in den vergangenen Jahren rasant gestiegenen Fallzahlen zeigt. Dennoch steht die EMRK auch in der Zukunft vor besonderen Herausforderungen. Dieser Band stellt den Versuch einer Bilanz der vergangenen 60 Jahre dar und enthält die Beiträge der Vortragenden des Workshops „60 Jahre Europäische Menschenrechtskonvention – die Konvention als ‚living instrument‘“, der anlässlich des Jubiläums durch das MenschenRechtsZentrum der Universität Potsdam veranstaltet wurde. Schwerpunktmäßig beschäftigen sich die Beiträge mit der Rechtsfortbildung durch den EGMR, insbesondere mittels einer dynamischen Auslegung der Konvention, der konstitutionellen Dimension der EMRK, der Durchsetzung seiner Urteile sowie dem Reformbedarf aufgrund gestiegener Arbeitsbelastung.
The nineteenth century witnessed restoration and reformation, the heyday of the nation state in Europe and inter-state cooperation at the same time. Driven by technical progress, communication across borders became an everyday phenomenon demanding transnational cooperation and regulation. Whereas in the political field irregular conferences turned out to be an appropriate instrument for governing transnational cooperation, a more constant and institutionalised matter proved to be adequate for technical cooperation.
In 1865, the International Telegraph Convention set up a relevant administrative union which merged in 1932 with the International Radiotelegraph Union from 1906 to form the newly labelled International Telecommunication Union (ITU). The parties to the ITU met regularly in so-called plenipotentiary conferences every 3 years. Already in 1875 the International Telegraph Convention was completely redrafted and the organisation’s structure changed. The contracting parties created an instrument that paved the way for a modern form of international standard setting. The new, simplified convention contained only general provisions of a policy nature that would remain in effect for an “indeterminate length of time” (Art. 20), detailed rules of a transitory and specific nature that might be subject to frequent changes with the progress of technology were put into the “Regulations for international service” (also known as the Telegraph Regulations). The newly established “administrative conferences” attended by technical experts from the member states were responsible for revising the regulations when necessary.
This was an early example of the transferral of power from sovereign nation states to an international organisation in order to govern transnational communication effectively. The administrative unions, as the first examples in modern history, show the ability of self-interested rational agents to overcome collective action dilemmas, i.e. situations where cooperation avoids sub-optimal outcomes for cooperators. The newly created institutions shaped a spirit of cooperation and the practice of standard setting proved that cooperation is effective. Furthermore, they show the spill-over effects of cooperation: increased cooperation in one area leads to increased cooperation in other areas.

Rechtsschutz gegen die oeffentliche Gewalt wird heute als zentrales Element des Rechtsstaates verstanden. Das Recht aus Art. 19 Abs. 4 GG dient der Verwirklichung der Bindung an die verfassungsmaessige Ordnung sowie an Gesetz und Recht, die Art. 20 Abs. 3 GG den Staatsgewalten auferlegt. Die Konferenz "Rechtsschutz als Element von Rechtsstaatlichkeit" untersuchte im November 2010 in einem historischen ueberblick zunaechst die "Entwicklung von Rechtsschutz gegen die oeffentliche Gewalt in Deutschland und der Europaeischen Union". Ein zweites Referat zum (Individual-)Rechtsschutz gegen Umsetzungsgesetze traegt der gestiegenen Bedeutung von EU-Recht als Eingriffsgrundlage Rechnung. Wird der gebotene Rechtsschutz nicht gewaehrt, ist nach haftungsrechtlichen Konsequenzen zu fragen - die wiederum vor Gericht durchzusetzen sind. Dem geht der Beitrag "Staatshaftung bei Versagung von Rechtsschutz" nach. Gleichzeitig stoesst die Leistungsfaehigkeit des Staates insgesamt und auch der Justiz an ihre Grenzen. Wie weit Beschleunigung und Wirtschaftlichkeitsanspruch gehen koennen, ohne die Justiz ihrer Funktionsfaehigkeit zu berauben, fragt der Beitrag "oekonomisierung von Rechtsschutz".

Der Beitrag zeichnet die völkerrechtlichen Normierungen des Verbotes der Todesstrafe nach und erläutert, welche Beschränkungen der staatlichen Souveränität im Bereich der Todesstrafe auferlegt sind. Als Ergebnis kann festgestellt werden, daß es kein generelles, jeden Staat bindendes Verbot der Todesstrafe gibt. Noch ist es so, daß ein Staat sich direkt und ausdrücklich zur Abschaffung der Todesstrafe bekennen muß solange er dies nicht tut, ist die Verhängung und Vollstreckung der Todesstrafe bei Beachtung bestimmter rechtsstaatlicher Kautelen völkerrechtlich gesehen zulässig.
Der Aufsatz behandelt die völkerrechtlichen Grundlagen des Folterverbotes sowohl auf internationaler als auch auf regionaler Ebene und erläutert die Möglichkeiten der völkerrechtlichen Überwachungen. Besonderes Gewicht liegt hierbei naturgemäß auf der Arbeit des Ausschusses gegen die Folter und andere grausame, unmenschliche oder erniedrigende Behandlung oder Strafe.
Der Beitrag beschreibt die geschichtliche Entwicklung des Menschenrechtsschutzes auf der europäischen Ebene und konzentriert sich dann auf seine derzeitige Ausgestaltung. Im Mittelpunkt der Darstellung stehen die im Rahmen des Europarates erarbeiteten menschenrechtlichen Garantien, hier insbesondere die Europäische Menschenrechtskonvention. Der im Rahmen der KSZE/OSZE vermittelte Menschenrechtsschutz wird ebenso be-handelt wie der Bereich der Europäischen Gemeinschaft / Europäischen Union.
