Currently a political debate is ongoing in Germany as to whether Germany should, following the example of several other European countries such as France and the Netherlands, adopt a Supply Chain Act (Lieferkettengesetz). If adopted, the act in question would impose due diligence obligations on German corporations to prevent human rights violations taking place in their respective global supply chains. It is against this background that the article examines the preconditions that must be met in order for such act to be eventually compatible with both, German constitutional and international law. The authors further deal with the question whether Germany might even be obliged under international, as well as under German constitutional law, to enact such a supply chain law in order to protect the human rights of workers employed by companies forming part of the global supply chains of German companies. As far as German constitutional law is concerned the article notably deals with the question whether it is the Federal parliament that may adopt such a law also taking into account the competencies of the European Union in the field, and what are the requirements of legal specificity and proportionality in order for the draft law to stand constitutional scrutiny. The authors further offer detailed suggestions how corporate due diligence standards might be best provided for in the envisaged law and propose a risk analysis approach that varies not only according to specific countries and sector-specific characteristics, but that by the same token also takes into account the ability of the respective German company to exercise an appropriate due diligence standard when it comes to human rigths issues arising within the framewok of their supply chain. As far as the substantive human rights standards are concerned that should serve as benchmarks for the envisaged Supply Chain Act the authors propose to rely on, and refer to, those instruments such as the ICCPR and the CESCR, as well as the ILO treaties containing core labour standards, that enjoy almost universal acceptance and reflect customary international law.

This paper consists of two parts: In the first part, some of the challenges with which the Internationaal Criminal Court is currently confronted are being presented. First of all, the article will describe the current state of the International Criminal Court and the Rome Statue. Afterwards, the article analyses the Court’s efforts to deal with cases against third-country nationals and the challenges it is facing in that regard. In addition, the Court’s case law will be analyzed in order to determine an increasing ‘emancipation’ of the case law of the International Criminal Court from international humanitarian law. The second part of the paper will briefly discuss the role of domestic international criminal law and domestic courts in the further development and enforcement of international criminal law. As an example of the role that domestic courts may have in clarifying classic issues in international law, the judgment of the German Supreme Court of January 28, 2021 (3 StR 564/19), which deals with the status of costumary international law on functional immunity of State officials before domestic courts, shall be assessed.

As part of the current process of de-formalization in international law, States increasingly chose informal, non-legally binding agreements or 'Memoranda of Understanding' ('MOUs') to organize their international affairs. The increasing conclusion of such legally non-binding instruments in addition to their flexibility, however, also leads to uncertainties in international relations. Against this background, this article deals with possible indirect legal consequences produced by MOUs. It discusses the different legal mechanisms and avenues that may give rise to such secondary legal effects of MOUs through a process of interaction with, and interpretation in line with, other (formal) sources of international law. The article further considers various strategies how to avoid such eventual possible unintended or unexpected indirect legal effects of MOUs when drafting such instruments and when dealing with them subsequent to their respective 'adoption'.

Nach Art. 7 Abs. 1 S. 1 des Vertrages zur abschließenden Regelung in Bezug aufDeutschland vom 12. September 1990 (Zwei-plus-Vier-Vertrag)1beendeten die Fran-zösische Republik, die Union der Sozialistischen Sowjetrepubliken, das VereinigteKönigreich Großbritannien und Nordirland und die Vereinigten Staaten von Ameri-ka„ihre Rechte und Verantwortlichkeiten in Bezug auf Berlin und Deutschland alsGanzes“. Dies hatte, wie in dessen Art. 7 Abs. 1 S. 2 ausdrücklich niedergelegt, zurFolge, dass„die entsprechenden, damit zusammenhängenden vierseitigen Verein-barungen, Beschlüsse und Praktiken beendet und alle entsprechenden Einrichtun-gen der vier Mächte aufgelöst“wurden.2Art. 7 Abs. 2 Zwei-plus-Vier-Vertrag stelltdemgemäß fest, dass das vereinte Deutschland volle Souveränität über seine inne-ren und äußeren Angelegenheiten erhalten habe. Draft Article 15 of the International Law Commission’s project on crimes against humanity — dealing with the settlement of disputes arising from a proposed convention — attempts to strike a balance between state autonomy and robust judicial supervision. It largely follows Article 22 of the Convention on the Elimination of All Forms of Racial Discrimination, which renders the jurisdiction of the International Court of Justice (ICJ) conditional upon prior negotiations. Hence, the substance of the clause can be interpreted in light of the recent case law of the ICJ, especially in the case Georgia v. Russia. In addition, this contribution discusses several issues regarding the scope ratione temporis of the compromissory clause. It advances several proposals to improve the current draft, addressing its relationship with state responsibility — an explicit reference to which is currently missing — as well as the relationship between the ICJ and a possible treaty body. It also proposes to recalibrate the interplay of the requirement of prior negotiations with, respectively, the possibility of seizing a future treaty body and the indication of provisional measures by the ICJ.
Angesichts der dramatischen Lage in der Ukraine untersucht der folgende Beitrag, auf welchem Wege, vor welchen völkerrechtlichen Gerichten, in welchem Umfang und mit welcher Aussicht auf Erfolg die Ukraine oder einzelne ukrainische Staatsangehörige Sicherheitsschutz vor der russischen Invasion und/oder den im Zusammenhang damit bereits begangenen oder noch bevorstehenden Völkerrechtsverstößen Rechtsschutz erlangen können. Im Einzelnen handelt es sich hierbei um zwei anhängige Verfahren vor dem Internationalen Gerichtshof, mehrere Staaten- sowie eine große Vielzahl von Individualbeschwerden vor dem Europäischen Gerichtshof für Menschenrechte; ein Verfahren vor dem Internationalen Seegerichtshof; zahlreiche Investitionsverfahren vor internationalen Schiedsgerichten sowie schließlich zwei "Situationen" vor dem Internationalen Strafgerichtshof. Abschließend wird die Option der Schaffung eines ad-hoc-Tribunals für das Verbrechen der Aggression behandelt.

Over the years, the Security Council has on several occasions dealt with humanitarian assistance issues. However, it is Security Council Resolution 2165(2014), related to the situation in Syria, that has brought the role of the Security Council to the forefront of the debate. It is against this background that the article discusses the legal issues arising from Security Council action facilitating humanitarian assistance to be delivered in situations of non-international armed conflict.
Following a brief survey of relevant practice of the Security Council related to humanitarian assistance, the article considers the relevance, if any, of Article 2(7) of the Charter of the United Nations (UN) to humanitarian assistance to be delivered in such situations. It then moves on to analyse whether a rejection by the territorial state of humanitarian aid to be delivered by third parties may amount to a situation under Article 39 of the UN Charter. It then considers in detail whether (at least implicitly) Resolution 2165 has been adopted under Chapter VII and, if this is not the case, whether it can be still considered to be legally binding.
The article finally considers what impact the adoption of Security Council Resolution 2165 might have on the interpretation of otherwise applicable rules of international humanitarian law and, in particular, the right of third parties to provide humanitarian assistance in a situation of a non-international armed conflict in spite of the absence of consent by the territorial state, and the obligations that members of the Security Council, permanent and non-permanent, have under Common Article 1 of the Geneva Conventions when faced with a draft resolution providing for the delivery of humanitarian assistance, notwithstanding the absence of consent by the territorial state.
Zur Wiedergutmachung nationalsozialistischen Unrechts garantiert Art. 116 Abs. 2 GG Abkömmlingen von in diskriminierender Weise ausgebürgerten Deutschen die deutsche Staatsangehörigkeit. Dadurch soll der Zustand wiederhergestellt werden, der ohne die Ausbürgerung bestehen würde. Daher wird insoweit regelmäßig auf das geltende Staatsangehörigkeitsrecht abgestellt. § 4 Abs. 4 StAG hat im Jahr 2000 eine Beschränkung der Weitergabe der deutschen Staatsangehörigkeit für im Ausland geborene Kinder deutscher Staatsangehöriger eingeführt, die selbst bereits im Ausland geboren wurden. Dadurch wird möglicherweise der Anwendungsbereich des Art. 116 Abs. 2 GG dauerhaft signifikant eingeschränkt; unter Umständen wird die Norm gar obsolet. Vor diesem Hintergrund wird das Spannungsverhältnis zwischen der uneingeschränkten Anwendung des § 4 Abs. 4 StAG mit dem verfassungsrechtlich verbürgerten Recht auf Wiedereinbürgerung von Kindern zu Unrecht ausgebürgerter Deutscher erörtert.
The article analyses whether the Palestinian-Israeli conflict has served as a catalyst for the development of international law, as well as whether international law has been instrumental in attempting to find solutions for the said conflict.
In several ways, this conflict has made a significant contribution to understanding and interpreting the UN Charter. It also brought along important developments about the role of third parties, both under the Geneva Conventions and under the law of state responsibility, which provides for an obligation of not recognizing as legal, or not rendering aid or assistance to situations caused by serious violations of jus cogens.
International judicial institutions (and also domestic ones) play a rather limited role in this respect, due both to a lack of courage to address fundamental questions, and/or a disregard of the outcome of the proceedings by at least one of the parties to the conflict. Other reasons are Israel's reluctance of accepting the jurisdiction of either the ICJ or the ICC, and its view on the non-applicability of human rights treaties outside of its territory, as well as Palestine's uncertain status in the international community limiting its access to international courts. However, the ICJ's 2004 (formally non-binding) advisory opinion on the Israeli Wall provided answers to some of the most fundamental questions related to the conflict, unfortunately without having any immediate impact on the situation on the ground. Given Palestine's accession to the Rome Statute in early 2015, time has yet to show which role in the process will be played by the ICC.
Other issues arising from the conflict, and examined by this article, are that of (Palestinian) statehood, going beyond the traditional concept of statehood and including the consequences of the jus cogens-character of the right of self-determination, as well as questions of treaty succession and succession in matters of State responsibility with regard to acts committed by the PLO.
The adoption, in Kampala in June 2010, of amendments to the Rome Statute on the crime of aggression was hailed as a historic milestone in the development of the international Criminal Court (ICC). However, the manner in which these amendments are supposed to enter into force runs the risk of undermining the rules of the international law of treaties, as well as the legality and acceptability of the Kampala compromise itself The author examines the relevant amendment procedures provided for in the ICC Statute and the compatibility with them of the amendment procedure chosen in Kampala and ultimately warns of the legal consequences which may follow from the Review Conference's somewhat-Alexandrian solution.
La Convention de Vienne de 1978 traite d’un problème intemporel dans la vie internationale des États, à savoir leurs mutations territoriales. Il s’agit là d’une réalité internationale qui survit au phénomène de la décolonisation, mutation territoriale hautement typée et délimitée historiquement. Les exemples sont innombrables. L’on peut mentionner la réunification de l’Allemagne, l’éclatement de l’Union soviétique, le démembrement de la Yougoslavie, la séparation entre la Tchéquie et la Slovaquie, la sécession de l’Erythrée de l’Ethiopie, la séparation du Timor oriental de l’Indonésie, la sécession du Pakistan oriental (Bangladesh) du Pakistan. La pratique récente, relative au Kosovo notamment, qui a déclaré son indépendance le 17 février 2008, met en exergue l’actualité juridique du sujet. Des cas de succession d’États dans un futur proche ou lointain ne sont donc pas à exclure. Les régions sécessionnistes et les pulsions séparatistes sont nombreuses, même si très généralement non reconnues par la communauté internationale. Pourtant, la succession d’États n’est toujours pas dotée d’un régime juridique cohérent complet. Il convient dès lors de s’intéresser à cette lacune juridique en partant du traité-clef en la matière qu’est la Convention de 1978. Un commentaire exhaustif, article par article, de cette Convention se révèle donc être nécessaire. Cet ouvrage contient une analyse serrée des apports et des lacunes de cette Convention à la lumière des travaux préparatoires ainsi que de la pratique récente. Il permet ainsi d’identifier les éléments de codification de la Convention de Vienne de 1978, mais aussi de voir en quoi celle-ci a pu donner naissance à des principes et règles coutumières en la matière. Il a pour ambition de remettre au goût du jour cette Convention et d’offrir aux chercheurs intéressés, mais également aux États et sujets concernés et à la communauté internationale une vue d’ensemble détaillée, analytique et systématique du droit actuel en matière de succession d’États et de découvrir ainsi les éléments de continuité et de rupture qui la caractérisent.
Would the world be a better place if one were to adopt a European approach to state immunity?

This chapter argues not only that there is no European Sonderweg (or ‘special way’) when it comes to the law of state immunity but that there ought not to be one. Debates within The Hague Conference on Private International Law in the late 1990s and those leading to the adoption of the 2002 UN Convention on Jurisdictional Immunities of States, as well as the development of the EU Brussels Regulation on Jurisdiction and Enforcement, as amended in 2015, all demonstrate that state immunity was not meant to be limited by such treaties but ‘safeguarded’. Likewise, there is no proof that regional European customary law limits state immunity when it comes to ius cogens violations, as Italy and (partly) Greece are the only European states denying state immunity in such cases while the European Court of Human Rights has, time and again, upheld a broad concept of state immunity. It therefore seems unlikely that in the foreseeable future a specific European customary law norm on state immunity will develop, especially given the lack of participation in such practice by those states most concerned by the matter, including Germany. This chapter considers the possible legal implications of the jurisprudence of the Italian Constitutional Court for European military operations (if such operations went beyond peacekeeping). These implications would mainly depend on the question of attribution: if one where to assume that acts undertaken within the framework of military operations led by the EU were to be, at least also, attributable to the troop-contributing member states, the respective troop-contributing state would be entitled to enjoy state immunity exactly to the same degree as in any kind of unilateral military operations. Additionally, some possible perspectives beyond Sentenza 238/2014 are examined, in particular concerning the redress awarded by domestic courts ‘as long as’ neither the German nor the international system grant equivalent protection to the victims of serious violations of international humanitarian law committed during World War II. In the author’s opinion, strengthening the jurisdiction of international courts and tribunals, bringing interstate cases for damages before the International Court of Justice, as well as providing for claims commissions where individual compensation might be sought for violations of international humanitarian law would be more useful and appropriate mechanisms than denying state immunity.
Das Völkerstrafrecht steht fast zwanzig Jahre nach dem Inkrafttreten des Römischen Statuts – der völkervertraglichen Grundlage des Internationalen Strafgerichtshofs – angesichts einer inzwischen deutlich veränderten Weltlage an einem Scheideweg. Daher erscheint es geboten, wenn nicht gar zwingend, die Herausforderungen, mit denen sich der Internationale Strafgerichtshof heute konfrontiert sieht, zu analysieren.

Die staatsangehörigkeitsrechtliche Optionspflicht des § 29 StAG für in Deutschland geborene Kinder ausländischer Eltern, die jus soli die deutsche Staatsangehörigkeit erworben haben, bildete eine der Kernfragen des letzten Bundestagswahlkampfes. Im zwischen CDU/CSU und SPD abgeschlossenen Koalitionsvertrag ist vorgesehen, dass für in Deutschland geborene und aufgewachsene deutsche Kinder ausländischer Eltern in Zukunft der Optionszwang entfallen soll und die Mehrstaatigkeit akzeptiert wird, während es im Übrigen beim geltenden Staatsangehörigkeitsrecht bleiben soll. Der Beitrag untersucht vor diesem Hintergrund und im Lichte der nunmehr insoweit vorliegenden Entwürfe die sich aus diesen politischen Vorgaben ergebenden staatsangehörigkeitsrechtlichen Regelungsoptionen und -probleme.

In 2009, 'Palestine' lodged a declaration recognizing the jurisdiction of the ICC under Article 12(3). However, in April 2012, the OTP determined that this declaration had not brought about the result, of providing for the ICC's jurisdiction, pending clarification from the political organs of the UN concerning the legal status of Palestine within the organization. On 29 November 2012, the General Assembly granted Palestine the status of a non-member observer state within the UN framework, thereby fulfilling the condition mentioned by the OTP in April 2012. It is against this background that the article considers the current legal effects of the 2009 Palestinian declaration. In particular, it addresses the issue of whether the declaration, when read in conjunction with the 29 November 2012 decision, possesses retroactive effect, i.e. whether it provides, as claimed, for the Court's temporal jurisdiction from 1 July 2002 onwards or rather starting only from 29 November 2012.

Der Gründungszuschuss wurde 2011 umfassend reformiert. Insgesamt ist das Arbeitsmarktinstrument weiterhin ein Erfolg: Die meisten Geförderten sind auch knapp dreieinhalb Jahre nach der Gründung noch selbstständig. Die Förderung erhöht ihren Arbeitsmarkterfolg und ihre Jobzufriedenheit deutlich, aber bei ihrer sozialen Absicherung besteht Verbesserungsbedarf.
Anne-Katrin Wolf beschäftigt sich mit der Aktivlegitimation im Individualbeschwerdeverfahren der UN-Menschenrechtskonventionen. Sie gibt einerseits eine leitfadenartige Übersicht zum Zulässigkeitskriterium der Aktivlegitimation. Andererseits zeigt sie, dass die Auslegungspraxis der UN-Ausschüsse zu dessen Voraussetzungen derzeit an einigen Stellen zu eng gefasst ist, um einen effektiven Menschenrechtsschutz zu gewährleisten. Im Zentrum steht dabei die Kategorisierung der UN-Menschenrechtskonventionen anhand der jeweiligen Regelungsmaterie und die daran anknüpfende, unterschiedlich weit reichenden Beschwerdemöglichkeiten von Individuen und Kollektiven wie Verbänden oder Nichtregierungsorganisationen. Sofern eine Ausgestaltung durch die Ausschüsse selbst noch nicht erfolgt ist oder die Autorin bisher angewendeten Kriterien als defizitär bewertet, entwickelt sie Vorschläge zu einer möglichen Ausformung des Kriteriums der Aktivlegitimation in der Zusammenschau mit dem jeweiligen Schutzgehalt der Konvention.
Durch Art. 20 Abs. 1 des Grundgesetzes wird die Bundesrepublik Deutschland als demokratischer und sozialer Bundesstaat insbesondere dem Föderalismus verpflichtet. Er ist neben der Demokratie eine der Säulen unseres Staatswesens. Im Bewusstsein dieser Grundentscheidung unserer Verfassung fällt mit Art. 115f Abs. 1 Nr. 2 GG eine Vorschrift auf, die hiervon im Verteidigungsfall eine weitreichende Ausnahme zu ermöglichen scheint. Die Bundesregierung soll dann unter bestimmten Voraussetzungen außer der Bundesverwaltung auch den Landesregierungen und Landesbehörden Weisungen erteilen können. Es stellt sich in Anbetracht eines solchen Ausnahmerechts die Frage, wie sich dieses Weisungsrecht der Bundesregierung in unser Rechtssystem einfügt.
Der Autor nähert sich dieser Frage zunächst über die geschichtlichen Hintergründe, die zur Einfügung der Vorschrift geführt haben. Er geht detailliert auf die Voraussetzungen dieses Weisungsrechts der Bundesregierung ein und stellt es in seinen systematischen Zusammenhang. Neben einer Darstellung des Weisungsbegriffs als Möglichkeit der Einflussnahme auf die Bundesverwaltung und die Länder, werden auch die damit umschriebenen Weisungsadressaten näher untersucht. Auch den Fragen, welchen Gegenstand Weisungen nach dieser Vorschrift haben können, wie sie zu erlassen sind und welche Wirkungen sich aus ihnen ergeben, wird in der Untersuchung detailreich nachgegangen. Daneben behandelt der Autor die sich daraus ergebenden Anschlussfragen, welcher Rechtsschutz gegen derartige Weisungen besteht, wer damit verbundene Aufgaben zu finanzieren hat und wer für eventuelle Schäden zu haften hat. Das Werk schließt mit einer Erörterung, ob es sich bei dieser Vorschrift um eine verfassungswidrige Verfassungsnorm handelt, und einem Blick auf internationale Vorschriften, die Einfluss auf das Weisungsrecht nehmen könnten.
This book provides for an extensive legal analysis of the international drug control system in light of the growing challenges and criticism that this system faces. In the current debate on global drug policy, the central pillars of the international drug control system – the UN Drug Conventions as well as its institutions – are portrayed as outdated, suppressive and seen as an obstacle to necessary changes. The book’s objective is to provide an in-depth and positivist insight into drug control’s present legal framework and thus provide for a better understanding of the normative assumptions upon which drug control is currently based. This is attained by clarifying the objectives of the international drug control system and the premises by which these objectives are to be achieved.
The objective of the current global framework of international drug control is the limitation of drugs to medical and scientific purposes. The meaning of this objective and its concrete implications for States’ parties as well as its problems from the perspective of other regimes of international law, most notably international human rights law, are extensively analysed. Additionally, the book focuses on how the international drug control system attempts to reach the objective of confining drugs to medical and scientific purposes, i.e. by setting up a universal system that exercises a rigid control on drug supply. The consequences of this heavy focus on the reduction of drug supply are outlined, and the book concludes by making suggestions on how the international drug control system could be reformed in the near future in order to better meet the existing challenges.
The analysis occurs from a general international law perspective. It aims to map the international drug control system within a wider context of international law and to understand whether the problems that the international drug control system faces are exemplary for the difficulties that institutionalized systems of global scope face in the twenty-first century.

Um auch vor dem Hintergrund jüngerer höchstrichterlicher Entscheidungen den Blick für dieses Rechtsinstitut zu schärfen, kennzeichnet der Verfasser zunächst das nicht ohne Weiteres aus dem Gesetz ablesbare Wesen der Umdeutung und grenzt diese von anderen Instrumenten zur Interpretation, Korrektur und Aufrechterhaltung von Verwaltungsakten ab. Sodann stellt er im Einzelnen die Voraussetzungen und Ausschlussgründe des § 47 VwVfG vor.

Zunächst stellt der Verfasser die Erkenntnisobjekte "Verwaltungswissenschaft" und "Öffentliche Verwaltung" vor. Sodann vermittelt er dem Leser Aufgaben, Kulturen, Reformen und die Kontrolle der Verwaltung. Im zweiten Teil werden Verwaltungsbehörden als Organisationen und Handlungssysteme näher beleuchtet. Die betreffenden Kapitel behandeln die Aufbauorganisation, das Personal, die Koordination, das Verfahren und die Entscheidung.
