Im Berichtszeitraum standen nicht so sehr einzelne Menschenrechte im Fokus, sondern die komplexe und sektorübergreifende Verletzung von Menschenrechten durch unternehmerisches Handeln einerseits und durch den menschengemachten Klimawandel andererseits.
In einem Interview vom 4. April 2020 äußerten sich Andreas Zimmermann und Norman Weiß gegenüber der Pressestelle der Universität Potsdam zur Einschränkung von Grund- und Menschenrechten im Rahmen der Pandemiebekämpfung und gelangten dabei zu dem Ergebnis, dass sich die damaligen Maßnahmen verfassungsrechtlich und völkerrechtlich im Rahmen des Zulässigen bewegten. Bei internen Beratungen wurde beschlossen, das Thema fundiert im Jahr 2022 aufzuarbeiten.

Recht im Ausnahmezustand

Viele Länder weltweit haben im Bemühen, die Ausbreitung des Corona-Virus zu stoppen oder wenigstens zu verlangsamen, drastische Maßnahmen ergriffen: Schulen, Universitäten und kulturelle Einrichtungen sind geschlossen, öffentliche Plätze dürfen nicht betreten und das Zuhause nur in dringenden Fällen verlassen werden. Damit schränken einige der Maßnahmen sogar fundamentale Menschenrechte ein. Matthias Zimmermann sprach mit Prof. Dr. Andreas Zimmermann, dem Direktor des Potsdamer MenschenRechtsZentrums (MRZ), und Prof. Dr. Norman Weiß, der seit vielen Jahren am MRZ tätig ist, über die Menschenrechte im Ausnahmezustand.
Menschenrechte lassen sich begreifen als Antworten auf exemplarische Unrechtserfahrungen, und ihr Grundanliegen ist es, die natürliche Freiheit des Menschen gegenüber ungerechtfertigten Beschränkungen durch die von Staaten und heute auch von supranationalen Organisationen ausgeübte Hoheitsgewalt zu schützen. Sie sind somit nicht nur elementare Rechtsverbürgungen. Sie künden auch von der Rolle des Individuums in der Gemeinschaft, und in ihnen spiegelt sich die Vorstellung vom Staat. Menschenrechte gelten als Errungenschaft der Neuzeit. Die geistesgeschichtlichen Wurzeln dieser mit der Natur des Menschen untrennbar verknüpften Rechte reichen jedoch weit zurück. Das vorliegende Werk zeichnet die historische Entwicklung der Menschenrechte von der Antike bis in die heutige Zeit nach.
