Zur Wiedergutmachung nationalsozialistischen Unrechts garantiert Art. 116 Abs. 2 GG Abkömmlingen von in diskriminierender Weise ausgebürgerten Deutschen die deutsche Staatsangehörigkeit. Dadurch soll der Zustand wiederhergestellt werden, der ohne die Ausbürgerung bestehen würde. Daher wird insoweit regelmäßig auf das geltende Staatsangehörigkeitsrecht abgestellt. § 4 Abs. 4 StAG hat im Jahr 2000 eine Beschränkung der Weitergabe der deutschen Staatsangehörigkeit für im Ausland geborene Kinder deutscher Staatsangehöriger eingeführt, die selbst bereits im Ausland geboren wurden. Dadurch wird möglicherweise der Anwendungsbereich des Art. 116 Abs. 2 GG dauerhaft signifikant eingeschränkt; unter Umständen wird die Norm gar obsolet. Vor diesem Hintergrund wird das Spannungsverhältnis zwischen der uneingeschränkten Anwendung des § 4 Abs. 4 StAG mit dem verfassungsrechtlich verbürgerten Recht auf Wiedereinbürgerung von Kindern zu Unrecht ausgebürgerter Deutscher erörtert.
In November 2015, the 14th Session of the Assembly of States Parties to the Rome Statute of the International Criminal Court (ICC) adopted, by consensus, an amendment providing for the deletion of Article 124 of the ICC Statute, which so far enables contracting parties, when joining the Statute, to opt out from the ICC’s treaty-based war crimes-related jurisdiction. After considering the genesis of the provision and the practice arising under Article 124 of the ICC Statute so far, this article considers the arguments for and against the deletion of Article 124 in light of the increasingly small number of accessions to the ICC Statute that have been forthcoming in the last few years. It also analyses the quite strict requirements for the entry into force of the amendment, as well as the effect of the entry into force of the amendment on possible declarations having been made pending such entry into force. It ends by considering the positive effect a continued applicability of Article 124 may have on states so far being reluctant to accede to the ICC Statute.

Der Internationale Pakt für politische und bürgerliche Rechte ist der wichtigste völkerrechtliche Vertrag zur Garantie universeller Menschenrechte und damit für die politische Betätigungsfreiheit. Politische Parteien nehmen für die Verwirklichung dieser Freiheit eine entscheidende Rolle ein, da sie individuelle Meinungen in staatliche Entscheidungen hineintragen können. Unter Bezugnahme auf die Vereinigungsfreiheit, das Wahlrecht, das Selbstbestimmungsrecht der Völker und den Minderheitenschutz zeigt Julian Rössler, dass die Parteienfreiheit auf universeller Ebene umfassend gewährleistet wird. Die völkerrechtliche Parteienfreiheit ist als Garant für eine Pluralität von Parteien und damit auch für politische Meinungsvielfalt in den Vertragsstaaten zu verstehen. Der Zivilpakt ist Grundlage für eine internationale Gemeinschaft von pluralistisch demokratischen Staaten.
In der modernen Kampfführung ist ein steigender Trend zu unbemannten und autonomen Systemen zu beobachten. Doch inwieweit gelingt es dem Recht, mit den technischen Entwicklungen Schritt zu halten? Ist der Einsatz vollautonomer Systeme noch mit dem geltenden Völkerrecht vereinbar? Die Autorin untersucht zunächst die rechtlichen Rahmenbedingungen einer Programmierung von vollautonomen Systemen und geht, sofern möglich, hierbei bereits auf technische Umsetzungsmöglichkeiten ein. Zugleich werden Grenzen der autonomen Entscheidungsfindung, wie z. B. bei der Bestimmung der Verhältnismäßigkeit eines Angriffs, aufgezeigt. In einem zweiten Teil untersucht die Autorin die Problematik der Entscheidungs- und Legitimitätskette bei Einsätzen autonomer Systeme. Waren bisher stets einzelne Soldaten bzw. ihre Befehlshaber für Kriegsverbrechen verantwortlich, so stellt sich bei vollautonomen Systemen die Frage der Verantwortlichkeit im Falle eines rechtswidrigen Einsatzes. Inwieweit kann ein technischer Defekt oder die Fehlprogrammierung eines Systems noch zu einer strafrechtlichen Verantwortlichkeit von Befehlshabern und militärischem Personal führen? Hierbei werden die Lücken des geltenden Völkerstrafrechts deutlich, welches bisher nur begrenzt eine Strafbarkeit für Fahrlässigkeit und Unterlassen vorsieht.

In gewaltsamen Auseinandersetzungen mit nicht staatlichen Akteuren setzen Staaten zunehmend bewaffnete unbemannte Flugsysteme, sogenannte Drohnen, ein. Oft verläuft der Einsatz über Staatsgrenzen hinweg und ist von einer starken Asymmetrie zwischen der staatlichen und der nicht staatlichen Konfliktpartei geprägt. Der Verfasser untersucht derartige Einsätze vor dem Hintergrund des Rechts des nicht internationalen bewaffneten Konflikts. Er setzt sich kritisch mit den Problemen auseinander, die die Verwendung von Drohnen in solchen Auseinandersetzungen mit sich bringt: Inwieweit droht die Ausweitung des geografischen Anwendungsbereichs kriegsrechtlicher Standards zulasten der Menschenrechte, welche Modelle zur räumlichen Einhegung des Kriegsrechts sind denkbar? Dürfen zivile Opfer damit gerechtfertigt werden, dass unbemannte Systeme das Risiko für deren Verwender reduzieren? Wie beeinflusst die vermeintliche Präzision von Drohnen die Einhaltung der Pflicht zu Vorsichtsmaßnahmen? Bewertet werden auch spezifische Einsatztaktiken, etwa sogenannte „signature strikes“ oder die Ortung einer Zielperson mithilfe von Mobilfunkdaten.
Heute sind die Themen Frauen und Frieden auf der Ebene der Sicherheitspolitik der Vereinten Nationen als Resultat von Resolution 1325 (2000) eng miteinander verbunden. Welche rechtlichen und tatsächlichen Konsequenzen haben sich aus dieser Entwicklung einerseits für die Arbeit der Vereinten Nationen selbst, andererseits für die Mitgliedstaaten ergeben und wie steht es um ihre Umsetzung? Die Studie zeichnet die WPS-Agenda nach und diskutiert die diesbezüglichen Aktivitäten der Vereinten Nationen. Die Umsetzungsmaßnahmen Deutschlands werden im Anschluss untersucht und bewertet.
