Ein wichtiges Anliegen aller Privatrechtsordnungen ist die Sicherheit und Verlässlichkeit des Gütertransfers. In einer entwickelten Wirtschaft, die auf Arbeitsteilung und Umsatz basiert, gibt es lange Lieferketten. Person A liefert ein Gut an B, dann liefert B an C und immer so weiter. Die einzelnen Glieder in der Kette müssen das Gut sicher und verlässlich erwerben können. Wenn nun aber das Geschäft zwischen A und B von Anfang an ungültig ist oder nachträglich hinfällig wird, stellt sich die Frage, wem das Gut gehört. Das deutsche Recht begegnet dieser Frage unter anderem mit dem Trennungs- und Abstraktionsprinzip: Kauf und Übereignung sind zwei gesonderte Verträge, und die Wirksamkeit der Übereignung ist unabhängig vom Bestand und von der Wirksamkeit des Kaufvertrag. Das wird von deutschen Juristen als Schlüssel wissenschaftlichen Rechtsdenkens hochgehalten, stößt aber außerhalb Deutschlands und speziell in Frankreich auf Unverständnis. Denn im französischen Recht sind Kauf und Übereignung Eins.
Im Folgenden geht es nicht so sehr um die geistige Qualität des deutschen Trennungs- und Abstraktionsprinzips, die unbestreitbar ist, sondern vor allem um die Frage, ob diese Prinzi-pien im Vergleich zur französischen Einheit von Kauf und Übereignung praktische Vorteile haben. Die Untersuchung konzentriert sich auf die Übertragung von beweglichen Sachen und von Rechten. Das Grundstücksrecht bleibt dagegen ausgeklammert, denn es ist wegen seiner Formalien schwerer zu vergleichen und trägt keine grundlegend neuen Erkenntnisse bei.

School attacks are attracting increasing attention in aggression research. Recent systematic analyses provided new insights into offense and offender characteristics. Less is known about attacks in institutes of higher education (e.g., universities). It is therefore questionable whether the term “school attack” should be limited to institutions of general education or could be extended to institutions of higher education. Scientific literature is divided in distinguishing or unifying these two groups and reports similarities as well as differences. We researched 232 school attacks and 45 attacks in institutes of higher education throughout the world and conducted systematic comparisons between the two groups. The analyses yielded differences in offender (e.g., age, migration background) and offense characteristics (e.g., weapons, suicide rates), and some similarities (e.g., gender). Most differences can apparently be accounted for by offenders’ age and situational influences. We discuss the implications of our findings for future research and the development of preventative measures.
Although politicization is a perennial research topic in public administration to investigate relationships between ministers and civil servants, the concept still lacks clarification. This article contributes to this literature by systematically identifying different conceptualizations of politicization and suggests a typology including three politicization mechanisms to strengthen the political responsiveness of the ministerial bureaucracy: formal, functional and administrative politicization. The typology is empirically validated through a comparative case analysis of politicization mechanisms in Germany, Belgium, the UK and Denmark. The empirical analysis further refines the general idea of Western democracies becoming ‘simply’ more politicized, by illustrating how some politicization mechanisms do not continue to increase, but stabilize – at least for the time being.
Die staatsangehörigkeitsrechtliche Optionspflicht des § 29 StAG für in Deutschland geborene Kinder ausländischer Eltern, die jus soli die deutsche Staatsangehörigkeit erworben haben, bildete eine der Kernfragen des letzten Bundestagswahlkampfes. Im zwischen CDU/CSU und SPD abgeschlossenen Koalitionsvertrag ist vorgesehen, dass für in Deutschland geborene und aufgewachsene deutsche Kinder ausländischer Eltern in Zukunft der Optionszwang entfallen soll und die Mehrstaatigkeit akzeptiert wird, während es im Übrigen beim geltenden Staatsangehörigkeitsrecht bleiben soll. Der Beitrag untersucht vor diesem Hintergrund und im Lichte der nunmehr insoweit vorliegenden Entwürfe die sich aus diesen politischen Vorgaben ergebenden staatsangehörigkeitsrechtlichen Regelungsoptionen und -probleme.
2013 jährte sich das Inkrafttreten der Europäischen Menschenrechtskonvention zum 60. Mal. Seit ihrem Bestehen hat die Konvention insbesondere durch den auf ihrer Grundlage gegründeten Gerichtshof den Schutz der Menschenrechte in Europa wesentlich gestärkt. Mit ihren mittlerweile 47 Vertragsparteien ist sie zu einem gesamteuropäischen Grundrechtsschutzsystem geworden, dessen Akzeptanz sich nicht zuletzt an den in den vergangenen Jahren rasant gestiegenen Fallzahlen zeigt. Dennoch steht die EMRK auch in der Zukunft vor besonderen Herausforderungen. Dieser Band stellt den Versuch einer Bilanz der vergangenen 60 Jahre dar und enthält die Beiträge der Vortragenden des Workshops „60 Jahre Europäische Menschenrechtskonvention – die Konvention als ‚living instrument‘“, der anlässlich des Jubiläums durch das MenschenRechtsZentrum der Universität Potsdam veranstaltet wurde. Schwerpunktmäßig beschäftigen sich die Beiträge mit der Rechtsfortbildung durch den EGMR, insbesondere mittels einer dynamischen Auslegung der Konvention, der konstitutionellen Dimension der EMRK, der Durchsetzung seiner Urteile sowie dem Reformbedarf aufgrund gestiegener Arbeitsbelastung.
Übungen im Privatrecht

Das vorliegende Übungsbuch soll dem Studienanfänger im Rahmen einer dreibändigen Reihe unter dem Titel „Übungen im Privatrecht“ die Methodik der Fallbearbeitung verständlich machen. Es wendet sich dabei sowohl an den Jura-Studenten als auch an Studierende, die juristische Vorlesungen beispielsweise im Rahmen von Schlüsselqualifikationen oder in einem speziellen Bachelor-Zweitfachstudiengang absolvieren. In diesem Band I geht es zunächst einmal darum, dem anfänglich meist desorientierten Studierenden der Rechtswissenschaft den Weg zum allgemeinen Verständnis des Bürgerlichen Rechts zu weisen. Im Mittelpunkt stehen hier der Allgemeine Teil des BGB und das Sachenrecht, also die Bücher 1 und 3 des BGB. Als „Hauptakteure“ der Übungsfälle begegnen Ihnen demzufolge - wie im realen Leben - Rechtssubjekte und Rechtsobjekte. In dem ebenfalls bereits erschienenen Band II wird das Schuldrecht - insbesondere das Vertragsrecht - (Buch 2 des BGB) behandelt. In Vorbereitung ist der Band III, der sich schließlich mit dem Handels- und Gesellschaftsrecht beschäftigt. Dieser erste Band erscheint nunmehr in einer überarbeiteten 2. Auflage, in die zahlreiche Vorschläge meiner Studierenden eingeflossen sind und an deren Gestaltung meine beiden wissenschaftlichen Mitarbeiterinnen – Sotiria Iakovi und Nicole Leicher – tatkräftig mitgewirkt haben, wofür ich mich an dieser Stelle ganz herzlich bedanke. Ebenso wie mein Lehr- und Lernbuch „Kompendium des Wirtschaftsprivatrechts“ – in dem vor allem die wirtschaftsrelevanten Bezüge des Privatrechts in Form einprägsamer Schaubilder dargeboten werden – sollen auch diese drei Übungsbände wesentliche Grundfertigkeiten im Umgang mit rechtlichen Problemen vermitteln. Dabei wird von der Grundthese ausgegangen, dass es beim Studium des Rechts nicht vorrangig um Wissen und Kennen im Sinne eines Auswendiglernens, sondern um Verständnis und Können in Bezug auf die sichere Handhabung rechtlicher Regelungen geht. Insofern sollen vor allem die Hinweise in der Einführung dieses ersten Bandes als Orientierungshilfe nützlich sein. Bitte verzagen Sie nicht! Auch wenn Ihnen anfangs alles verwirrend, unstrukturiert und damit kaum verständlich erscheint. Glauben Sie mir, es gibt kaum etwas, was so viel Struktur und innere Logik enthält, wie das Recht. Sie müssen nur den Willen haben, diese Strukturen zu erkennen und zu begreifen. Ein wichtiger Schritt dazu sollte Ihr fester Plan sein, sich an den angebotenen Vorlesungen und Übungen regelmäßig aktiv zu beteiligen. Niemandem ist es bisher jemals gelungen, ohne professionelle Anleitung und Unterstützung das Recht quasi im „Alleingang“ zu begreifen. Auch wenn es manchmal schwer fällt, halten Sie sich an diese Studienregel. Studieren leitet sich eben nach wie vor aus dem Lateinischen („studere“) ab und bedeutet nichts anderes, als „etwas eifrig zu betreiben“. Seien Sie also voller Eifer und guten Willens! Das Übungsbuch soll Ihnen in diesem Bestreben gute Dienste leisten.
Obwohl in den unionalen Verträgen bis heute keine Vorschrift bezüglich einer Staatshaftung der Mitgliedstaaten für Entscheidungen ihrer Gerichte existiert, hat der Gerichtshof der Europäischen Union (EuGH) in einer Reihe von Entscheidungen eine solche Haftung entwickelt und präzisiert. Die vorliegende Arbeit analysiert eingehend diese Rechtsprechung mitsamt den sich daraus ergebenden facettenreichen Rechtsfragen. Im ersten Kapitel widmet sich die Arbeit der historischen Entwicklung der unionsrechtlichen Staatshaftung im Allgemeinen, ausgehend von dem bekannten Francovich-Urteil aus dem Jahr 1991. Sodann werden im zweiten Kapitel die zur Haftung für judikatives Unrecht grundlegenden Entscheidungen in den Rechtssachen Köbler und Traghetti vorgestellt. In dem sich anschließenden dritten Kapitel wird der Rechtscharakter der unionsrechtlichen Staatshaftung – einschließlich der Frage einer Subsidiarität des unionsrechtlichen Anspruchs gegenüber bestehenden nationalen Staatshaftungsansprüchen – untersucht. Das vierte Kapitel widmet sich der Frage, ob eine unionsrechtliche Staatshaftung für judikatives Unrecht prinzipiell anzuerkennen ist, wobei die wesentlichen für und gegen eine solche Haftung sprechenden Argumente ausführlich behandelt und bewertet werden. Im fünften Kapitel werden die im Zusammenhang mit den unionsrechtlichen Haftungsvoraussetzungen stehenden Probleme der Haftung für letztinstanzliche Gerichtsentscheidungen detailliert erörtert. Zugleich wird der Frage nachgegangen, ob eine Haftung für fehlerhafte unterinstanzliche Gerichtsentscheidungen zu befürworten ist. Das sechste Kapitel befasst sich mit der Ausgestaltung der unionsrechtlichen Staatshaftung für letztinstanzliche Gerichtsentscheidungen durch die Mitgliedstaaten, wobei u.a. zur Anwendbarkeit der deutschen Haftungsprivilegien bei judikativem Unrecht auf den unionsrechtlichen Staatshaftungsanspruch Stellung genommen wird. Im letzten Kapitel wird der Frage nachgegangen, ob der EuGH überhaupt über eine Kompetenz zur Schaffung der Staatshaftung für letztinstanzliche Gerichtsentscheidungen verfügte. Abschließend werden die wichtigsten Ergebnisse der Arbeit präsentiert und ein Ausblick auf weitere mögliche Auswirkungen und Entwicklungen der unionsrechtlichen Staatshaftung für judikatives Unrecht gegeben.
