Menschenrechte fangen nicht erst auf der Polizeiwache an, sondern bereits nach dem Frühstück (Sieghart). Der - auf einer Ringvorlesung an der Universität Magdeburg beruhende - Beitrag erläutert die Entwicklung und rechtliche Verankerung wirtschaftlicher, sozialer und kultureller Rechte. Nach einer Beschreibung der zur Verfügung stehenden Kontrollmechanismen wendet er sich aktuellen Streitfragen wie Universalität der Menschenrechte oder sozialen Grundrechten in den Verfassungen einiger deutscher Bundesländer zu.

Die Locarno-Verträge haben in der völkerrechtlichen Literatur der 1920er und 1930er Jahre viel Aufmerksamkeit erfahren. Auch die zeitgenössische Publizistik beschäftigte sich ausführlich mit diesem Thema, wobei das Verhältnis von Verständigung mit den Nachbarn und Revision der Grenzregelungen im Mittelpunkt der Debatte stand.
Später gehörte Locarno zur Geschichte der Zwischenkriegszeit und wurde im Rahmen der Völkerbundsgeschichte, der Völkerrechts- und Diplomatiegeschichte und der Geschichte der Weimarer Republik behandelt. Für die politikwissenschaftliche Literatur spielte Locarno fast ausschließlich auf dem Gebiet der Sicherheits- und Abrüstungspolitik eine Rolle; eine (system)theoretische Erörterung steht bislang aus.
In diesem Beitrag sollen nach einem kurzen Überblick über das Vertragswerk zunächst die geschichtliche Ausgangslage knapp umrissen und Vorgeschichte und Ergebnis der Konferenz von Locarno skizziert werden. Anschließend werden Inhalte und Lösungsansätze des Vertragswerkes beleuchtet, bevor zum Schluß eine kurze Einordnung in das System des Völkerbundes erfolgt.
Der Beitrag übersetzt die Entscheidung des Menschenrechtsausschusses nach dem Internationalen Pakt über bürgerliche und politische Rechte im Fall Faurisson. Der französische Wissenschaftler war strafrechtlich belangt worden, weil er die Existenz von Gaskammern in NS-Konzentrationslagern geleugnet hatte. Der Ausschuß kommt zu dem Ergebnis, daß die Verurteilung eine zulässige Beschränkung der Meinungsäußerungsfreiheit darstelle. In der Anmerkung wird der Fall in die bisherige Rechtsprechung des Menschenrechtsausschusses zur Meinungsäußerungsfreiheit eingeordnet.

Der Aufsatz behandelt die völkerrechtlichen Grundlagen des Folterverbotes sowohl auf internationaler als auch auf regionaler Ebene und erläutert die Möglichkeiten der völkerrechtlichen Überwachungen. Besonderes Gewicht liegt hierbei naturgemäß auf der Arbeit des Ausschusses gegen die Folter und andere grausame, unmenschliche oder erniedrigende Behandlung oder Strafe.
Nach einleitenden Ausführungen über die Maßnahmen zum Schutz von Frauenrechten im Rahmen der Vereinten Nationen insgesamt konzentriert sich der Beitrag auf die Darstellung des Übereinkommens zur Beseitigung jeder Form von Diskriminierung der Frau (CEDAW). Dessen materielle Gewährleistungen werden erläutert und der zugehörige Überwachungsmechanismus vorgestellt. Ein abschließender Ausblick stellt die Neuerungen dar, die mit den Individualbeschwerdeverfahren verbunden sein werden, die durch das inzwischen in Kraft getretene Zusatzprotokoll zu erwarten sind.

Global commons form a comparatively new part of international law, since the term appeared in international discussions and codifications only in the second half of the 20th century. The Common Heritage of Mankind is the corresponding legal principle that can establish an international regime to determine the legal status of non-sovereign territories and to allocate exploitation rights. Its main aim is to balance competing national claims by emphasising mankind’s common interest in the preservation and controlled exploitation of natural re-
sources. Against this background, the chapter sheds a critical light on attempts to transfer the institute of the Common Heritage of Mankind to the sphere of communication. Taking debates revolving around the New World Information and Communication Order in the framework of UNESCO since the late 1970s as a starting point, the author analyses the pitfalls and limits of attempts to establish governance structures for a global information order, including recent attempts to govern the internet.

Der Beitrag beschreibt die geschichtliche Entwicklung des Menschenrechtsschutzes auf der europäischen Ebene und konzentriert sich dann auf seine derzeitige Ausgestaltung. Im Mittelpunkt der Darstellung stehen die im Rahmen des Europarates erarbeiteten menschenrechtlichen Garantien, hier insbesondere die Europäische Menschenrechtskonvention. Der im Rahmen der KSZE/OSZE vermittelte Menschenrechtsschutz wird ebenso be-handelt wie der Bereich der Europäischen Gemeinschaft / Europäischen Union.

Das erste umfassende deutschsprachige Lexikon über die Vereinten Nationen enthält einen menschenrechtlichen Schwerpunktteil. Dieser Beitrag gibt eine grundlegende Einführung in die geistesgeschichtliche Entwicklung der Menschenrechte. Außerdem erläutert er in geraffter Form die Normierung von Menschenrechten auf der universellen Ebene. Abschließend werden verschiedene, häufig diskutierte Problemfelder behandelt. Hierzu zählen Fragen der Universalität von Menschenrechten, das Recht auf Entwicklung und die Durchsetzung und Förderung von Menschenrechten.

Der internationale Menschenrechtsschutz setzt heute zunehmend auch auf die Initiative des einzelnen Menschen, der über seine Rechte wacht und Verletzungen vor internationalen Gremien oder Gerichten rügt. Zu den Menschenrechtsverträgen, die noch kein Beschwerdeverfahren anbieten, gehört der Sozialpakt. Das wird vor allem mit der mangelnden Justitiabilität wirtschaftlicher, sozialer und kultureller Rechte begründet. Dieses Argument ist in dieser Absolutheit nicht stichhaltig; auch wirtschaftliche, soziale und kulturelle Rechte enthalten justitiable Elemente. Ein Beschwerdeverfahren könnte dazu beitragen, diese Gehalte zu konkretisieren, und würde so das Gewicht der in Rede stehenden Rechte stärken.
