Ein Schwerpunkt des Kinderehenbekämpfungsgesetzes liegt in der Beurteilung von Ehen, die im Ausland mit Minderjährigen geschlossen worden sind. Die Entscheidungen der deutschen Gerichte hierzu sind im Regelfall einzeln kommentiert worden. Ein Gesamtüberblick fehlt. Der folgende Beitrag will diese Lücke schließen.
Der Brexit ist Realität geworden. Als das Vereinigte Königreich am 31.1.2020 um Mitternacht aus der EU ausgetreten ist, begann der Übergangszeitraum, auf den man sich im Austrittsabkommen geeinigt hatte. Während dieses Zeitraums galt das Unionsrecht in der justiziellen Zusammenarbeit in Zivilsachen im Verhältnis zum und im Vereinigten Königreich fort. Der Übergangszeitraum endete am 31.12.2020. Die folgende Abhandlung beschreibt die Rechtslage in der justiziellen Zusammenarbeit in Zivilsachen vom 1.1.2021 an.
Nachtrag: Als der Beitrag geschrieben wurde, war noch offen, ob es zwischen der EU und dem Vereinigten Königreich zu einem Handels- und Kooperationsübereinkommen kommen würde. Mittlerweile liegt das entsprechende Handels- und Kooperationsabkommen vom 24.12.2020 vor. Es ist nach den Beschlüssen der zuständigen Gremien seit dem 1.1.2021 für einen begrenzten Zeitraum vorläufig und ab seinem regulären Inkrafttreten dauerhaft anzuwenden. Es enthält keine zusätzlichen Regelungen für die justizielle Zusammenarbeit in Zivilsachen zwischen dem Vereinigten Königreich und der Europäischen Union. Daraus ist zu schließen, dass der vorliegende Beitrag den mit dem Handels- und Kooperationsabkommen geschaffenen aktuellen Rechtsstand wiedergibt (Rolf Wagner).
Die EuGVVO wird zwar zu Recht viel gelobt. Einfach zu handhaben ist sie aber nicht. Denn die Verordnung enthält ein „Knäuel“ von Regelungen zur internationalen bzw. zur örtlichen Zuständigkeit. Der folgende Beitrag will dieses „Knäuel“ entflechten und dem Rechtsanwender darüber hinaus Hilfestellungen bei der Anwendung der zuständigkeitsrechtlichen Verweisungsnormen in dieser Verordnung geben.
Zwar war der Gesetzgeber im Jahr 2020 wenig aktiv, die Gerichte haben jedoch eine Vielzahl bedeutender urheberrechtlicher Entscheidungen getroffen. Dieser Bericht widmet sich im Anschluss an Nordemann/Waiblinger (NJW 2020, NJW Jahr 2020 Seite 737) der einschlägigen Rechtsprechung des EuGH und des BGH im Urheberrecht. Die wichtigsten Entscheidungen der Instanzgerichte werden, wie üblich, demnächst in GRUR-RR dargestellt.
Eine am Computer mittels elektronischer Befehle erstellte Abbildung eines virtuellen Gegenstandes stellt kein Erzeugnis iSd § URHG § 72 UrhG dar, das ähnlich wie ein Lichtbild hergestellt wird. Dies gilt auch dann, wenn die Grafik wie eine Fotografie wirkt, da es auf das Ergebnis des Schaffensprozesses nicht entscheidend ankommt. Maßgeblich ist vielmehr allein das Herstellungsverfahren und insoweit die Vergleichbarkeit der technischen Prozesse. (Leitsätze des Gerichts)
Im Rahmen sog. Datenstrategien auf nationaler und europäischer Ebene wird die Schaffung eines gesetzlichen Rahmens für den Umgang und den Handel mit nicht-personenbezogenen Daten auf Hochtouren vorangetrieben. Auch ohne gesetzlichen Rahmen spielt das Vertragsrecht bei der Datennutzung bereits eine herausragende Rolle. Die vertragliche Regelung des Zugangs und der Nutzung nicht-personenbezogener Daten im B2B-Bereich ist tagtägliche Praxis. Nichtsdestotrotz hinterlassen die wenigen existierenden gesetzlichen Vorgaben und die Novität des Vertragsgegenstands bei vielen Juristen Sorgenfalten auf der Stirn. Dem will dieser Beitrag gegensteuern. Mit dem Ziel einer interessengerechten Lösung für beide Vertragsparteien bespricht er die grundlegenden Bausteine eines Datennutzungsvertrags und stellt Lösungsmöglichkeiten für die wichtigsten praktischen Probleme und Fragestellungen vor.

Anknüpfend an den letztjährigen Bericht des Autors (Wagner NJW 2020, NJW Jahr 2020 Seite 1864) informiert dieser Beitrag die Praxis wiederum über die jüngsten rechtsvereinheitlichenden Arbeiten in Brüssel in der justiziellen Zusammenarbeit in Zivilsachen sowie über den Stand der deutschen „Begleitgesetzgebung“. Kurz thematisiert wird außerdem das Verhältnis zum Vereinigten Königreich nach dem Brexit. Darüber hinaus wird ein Blick in die Pläne zur justiziellen Zusammenarbeit in Zivilsachen geworfen und die aktuelle Rechtsprechung des EuGH auf diesem Rechtsgebiet vorgestellt.
The article discusses a court ruling of the Higher Regional Court of Hamm on jurisdiction concerning the “Diesel emission scandal”. The plaintiff had his domicile in Bielefeld (Germany). He bought a car in Cologne (Germany) where the seller had his domicile. Later on, the plaintiff brought an action for damages and for a declaratory judgment against the seller, the importer of the car (domicile: Darmstadt, Germany) and the producer of the car (domicile: in the Czech Republic) before the District Court of Bielefeld. The plaintiff argued that the producer of the car had used illegal software to manipulate the results of the emissions tests. He based his claim on tort. Against the first defendant he also claimed his warranty rights. In order to sue all three defendants in one trial the plaintiff requested the District Court of Bielefeld to ask the Higher Regional Court of Hamm to determine jurisdiction. In its decision the Court in Hamm took into account Article 8 No. 1 of the Brussels Ibis Regulation and § 36 I No. 3, II of the German Code of Civil Procedure.

Die Sars-CoV-2-Virus-Epidemie hat die Welt in die größte Krise seit dem zweiten Weltkrieg gestürzt. Die einen Staaten kommen mit dieser Krise besser zurecht als die anderen. Wie es mit der „Bekämpfung“ dieses neuen Virus weitergeht, kann niemand präzise vorhersagen. Die Aussagen zur Frage, wann ein Impfstoff vorliegen könnte, gehen weit auseinander. Mitunter wird bezweifelt, dass es in absehbarer Zeit überhaupt einen Impfstoff geben wird. Zukünftige Epidemien desselben Ausmaßes aufgrund anderer Viren werden für möglich erachtet.
Die zivilrechtliche Aufarbeitung der derzeitigen Epidemie steckt noch in den Anfängen. Im Zivilrecht geht es darum, in Einzelfällen zivilrechtliche Schadensersatzansprüche für diejenigen zu „konstruieren“, die mit dem Sars-CoV-2-Virus von einer anderen Person infiziert worden sind. Dass dies nicht einfach ist, liegt auf der Hand. Wer sich näher damit beschäftigt, stellt schnell fest, dass hierbei ganz unterschiedliche Fallkonstellationen denkbar sind.
Sofern solche Schadensersatzansprüche aus Vertrag oder aus unerlaubter Handlung gerichtlich durchgesetzt werden sollen, stellt sich als erstes die Frage nach dem zuständigen Gericht. Die Antwort hierauf ist in Sachverhalten mit Auslandsberührung alles andere als leicht zu geben. Der folgende Beitrag soll daher Hilfestellungen bei der komplexen Suche nach einem international und örtlich zuständigen Gericht geben, wenn in einem Sachverhalt mit Auslandsberührung ein Schadensersatzanspruch aus Vertrag bzw. unerlaubter Handlung aufgrund einer Infektion mit dem Sars-CoV-2-Virus oder (zukünftig) einem neuen Virus vor Gericht geltend gemacht werden soll.

Mit der Erbrechtsverordnung (EuErbVO) hat der Europäische Gesetzgeber in vielerlei Hinsicht juristisches Neuland betreten. Es ist daher nicht verwunderlich, dass die Instanzgerichte immer wieder mit der Auslegung dieser facettenreichen Verordnung befasst sind. Nachdem nunmehr bereits die erste Entscheidung des BGH zur EuErbVO vorliegt, gibt der folgende Beitrag einen Überblick über die aktuelle deutsche Rechtsprechung zu dieser Verordnung (einschließlich des IntErbRVG).
Anknüpfend an den letztjährigen Bericht des Autors (Wagner NJW 2019, NJW Jahr 2019 Seite 1782) informiert dieser Beitrag die Praxis über die jüngsten rechtsvereinheitlichenden Arbeiten in Brüssel in der justiziellen Zusammenarbeit in Zivilsachen sowie über den Stand der deutschen „Begleitgesetzgebung“. Darüber hinaus wird die aktuelle Rechtsprechung des EuGH zur justiziellen Zusammenarbeit in Zivilsachen vorgestellt.
In dieser Zeitschrift ist bereits darauf hingewiesen worden, dass eine Person, die mit dem Sars-CoV-2-Virus infiziert worden ist, in bestimmten Fällen daran denken kann, gegen die Person, die sie infiziert hat, oder gegen eine andere Person einen zivilrechtlichen Schadensersatzanspruch geltend zu machen. zur Fussnote 1 Derartige Schadensersatzansprüche können sich aus der Nichtbeachtung von Hygiene-, Abstands- und Quarantäneregelungen sowie von Regelungen zum Mund- und Nasenschutz ergeben. Im Vorbericht zur Fussnote 2 ist bereits geklärt worden, welche Gerichte anzurufen sind, wenn der Sachverhalt eine Auslandsberührung aufweist. Mit der Bestimmung des international zuständigen Gerichts hat es in diesen Sachverhalten aber nicht schon sein Bewenden. Denn wenn das zuständige Gericht feststeht, darf dieses nicht sogleich prüfen, ob der geltend gemachte Schadensersatzanspruch besteht. Vielmehr muss es in Sachverhalten mit Auslandsberührung erst einmal ermitteln, welches Recht auf den Schadensersatzanspruch anwendbar ist. Der folgende Beitrag widmet sich dieser Frage. Die Ausführungen sind nicht nur für die Geltendmachung von Schadensersatzansprüchen aufgrund Infektionen mit dem Sars-CoV-2-Virus von Nutzen, sondern auch dann, wenn zukünftig zivilrechtliche Schadensersatzansprüche aufgrund Infektionen mit anderen, ggfs. auch neu auftretenden, Viren geltend gemacht werden sollen.
When the original version of the Brussels II Regulation was adopted in 2000, it was not certain whether this regulation would be such a success. In the meantime, the regulation has become one of the most important legal instruments for judicial cooperation in civil matters. The regulation has recently been revised for the second time. Data Act

Der Data Act ist das Herzstück und der vorläufige Abschluss der Vorschläge zur EU-Datenregulierung. Der lang erwartete Entwurf ist ein Paukenschlag: Das Verhältnis zwischen Datenproduzenten, Dateninhabern und Dateninteressenten wird von Grund auf neu austariert. Die EU-Kommission will Datenzugangsrechte, weitreichende Regelungen zu Datenverträgen und Cloud-Services sowie spezifische Interoperabilitätsregelungen normieren. Der Beitrag gibt einen Überblick über die geplanten Regelungen und ordnet diese ein.
Zu den priorisierten Legislativvorhaben der EU-Kommission zählten zuletzt vor allem auch solche, welche die Nutzbarkeit von Daten zur Wohlfahrtssteigerung im Binnenmarkt zum Gegenstand haben. Der Data Governance Act ist bereits in Kraft; nun liegt der Vorschlag für einen Data Act vor. Dieser Beitrag behandelt dessen Verhältnis zum EU-Datenschutzrecht. Hierbei wird deutlich, wie schmerzlich eine ausgefeilte sekundärrechtliche Konkurrenzlehre fehlt.
Die Vollstreckung eines Titels, gerichtet auf die Herausgabe von Daten "an sich", hat regelmäßig über § 887 I ZPO zu erfolgen. § 857 I ZPO ist unter Zugrundelegung der Domain-Rechtsprechung auf Daten anwendbar. § 811 ZPO nimmt den Aspekt der Personenbezogenheit von Daten nur unzureichend auf. Datenschutzrechtliche Erwägungen lassen sich jedoch unter Anknüpfung an die Übertragbarkeit iSd § 851 I ZPO berücksichtigen. Daten fallen gem. § 35 I InsO in die Insolvenzmasse. Jedoch ist die Ausdehnung des Massebegriffs aus § 36 II InsO teleologisch zu reduzieren, wenn und soweit die Personenbezogenheit von Daten der Verwertung entgegensteht. Zum Zwecke der Inbesitznahme, Verwaltung und Information gilt § 36 II InsO jedoch ohne Einschränkung auch für Daten.
Der Beitrag befasst sich mit der Frage, ob und inwieweit es bei der Insolvenz von Reiseveranstaltern eine Begrenzung der Insolvenzabsicherungspflicht geben sollte – eine Problematik, die sich durch die Insolvenz von Thomas Cook zuletzt deutlich verschärft hat und die im Zuge der „Coronakrise“ erneut virulent geraten könnte. Die Verfasser argumentieren vor dem Hintergrund der Richtlinienwidrigkeit der deutschen lex lata für eine ersatzlose Streichung der Haftungshöchstsumme.
Das EU-Datenwirtschaftsrecht nimmt langsam Form an. Dabei gilt es sich zu vergegenwärtigen, dass sich dieses neue Teilrechtsgebiet letztlich auf „digitalisierte Informationen“ bezieht (I.). Es gesellt sich – mit einigen Schnittmengen – „neben“ das Datenschutzrecht (II.). Nachdem sich zunächst v. a. die Rechtswissenschaft mit Fragen zur besseren Nutzbarkeit, Zugänglichkeit und Handelbarkeit von Daten mit oder ohne Personenbezug beschäftigt hat, ist insofern nunmehr insbesondere der EU-Gesetzgeber als Treiber der Materie auszumachen (III.). Dies unterstreicht die Praxisrelevanz der zugrundeliegenden Fragen.
Auch und gerade in der Finanzwirtschaft gelten Blockchain-Anwendungen als taugliches Instrument zur Transaktionsabsicherung sowie Effizienzsteigerung. Wegen ihrer technischen Ausgestaltung, die – zumindest im Ausgangspunkt – eine dezentrale Struktur aufweist und rückwirkende Änderungen sowie v. a. Löschungen grundsätzlich nicht zulässt, was jeweils vertrauensschaffende Wirkungen zeitigen kann, ergeben sich jedoch kaum lösbare Friktionen mit datenschutzrechtlichen Vorgaben. Dies gilt zumindest dann, wenn man die Vorzüge der Blockchain nicht aufgeben bzw. ihr technisches Design nicht stark aufweichen möchte. Die Problematik gipfelt letztendlich in der grundlegenden Frage, ob Recht vor bestimmten Technologien, welche die normativen Vorgaben qua Design nicht umsetzen können, kapitulieren sollte. Damit im engen Zusammenhang steht der noch zu selten diskutierte Aspekt, dass es den bisher erwogenen Anwendungsfällen der Blockchain (v. a. außerhalb von FinTech-Szenarien) womöglich an substantiellem Mehrwert mangelt, der es rechtfertigen würde, etwa bei datenschutzrechtlichen Vorgaben de lege lata und de lege ferenda Milde walten zu lassen.
Legal Tech im Reiserecht

Mit dem Schlagwort„Legal Tech“ verbinden sich große Hoffnungen und Faszination, aber auch Existenzängste, gar Verachtung. Losgelöst davon, wie man nun zur viel diskutierten Thematik steht - die wenigsten Reiserechtspraktiker dürfte sie emotional gänzlich kalt lassen. Denn eins erscheint sicher: Legal Tech-Produkte verändern den Reiserechtsmarkt in nicht unerheblicher Art und Weise - und diese Entwicklung wird (zumindest in ihren großen Linien) unumkehrbar sein.
Im Dezember 2021 hat die Europäische Kommission einen Richtlinienentwurf zur Verbesserung der Arbeitsbedingungen in der Plattformarbeit vorgelegt. Dadurch soll auf das Problem reagiert werden, dass Plattformtätige häufig nicht als Arbeitnehmer im Sinne des europäischen und nationalen Arbeitsrechts zu qualifizieren und deshalb weitgehend schutzlos sind. Im vorliegenden Beitrag wird der Richtlinienentwurf kritisch analysiert. Im Zentrum stehen die Regelungen zum Beschäftigtenstatus von Plattformtätigen.
Der vorliegende Beitrag gibt den Leserinnen und Lesern einen Überblick über die Planung und Durchführung einer erfolgreichen Vorbereitung auf die Erste Juristische Prüfung. Ausgangspunkt ist die Darstellung der verschiedenen Strategien der Examensvorbereitung sowie der Vorgehensweisen zur Erstellung eines Stoff- und Zeitplanes. Daran knüpfen Ausführungen zur Lernphase an, d. h. im Einzelnen zur Strukturierung des Lernalltags und zum Klausurentraining. Abschließend folgen Erläuterungen zum Ablauf der mündlichen Prüfung und zur zugehörigen Vorbereitung. Die Darstellung zielt darauf ab, die Studierenden bei der Planung ihrer persönlichen Examensvorbereitung zu unterstützen.
Die Verbindung eines Antrags auf Erlass eines (zweiten) Versäumnisurteils mit der Änderung des Streitgegenstands stellt ein in der wissenschaftlichen Diskussion wenig beachtetes, in der täglichen Praxis jedoch verschiedentlich anzutreffendes Phänomen dar. Vorliegend soll der hieraus resultierenden, noch nicht umfassend geklärten Frage nachgegangen werden, wie mit dem Begehren, den Einspruch gegen das erste Versäumnisurteil zu verwerfen, umzugehen ist, wenn die Klage nach dessen Erlass erweitert oder, in Ansehung zwischenzeitlicher Teilerfüllung, beschränkt wurde und prozessualer und titulierter Anspruch nicht mehr übereinstimmen.
Mit der bevorstehenden Entscheidung des Bundesverfassungsgerichts in der Sache Pechstein neigt sich eine scheinbar endlose Geschichte dem Ende entgegen. Es bleibt zu hoffen, dass auf die Frage der (un-)zulässigen Inanspruchnahme verfahrensgestaltender Marktmacht schlussendlich eine überzeugende Antwort gefunden wird, die bestehende Defizite benennt, die schutzwürdigen Athletenrechte stärkt und den Anstoß für eine sach- und interessengerechte Strukturreform in der Sportschiedsgerichtsbarkeit gibt.
Der anthropogene Klimawandel führt zu einem weltweiten Temperaturanstieg, in dessen Folge es (statistisch betrachtet) zu vermehrten, schadensbegründenden Wettereignissen, wie Stürmen, Überschwemmungen und Dürren, kommt. Realisiert sich das insofern bestehende Risiko, trifft es den Einzelnen hart und verdeutlicht die Notwendigkeit einer klimapolitischen Kursänderung. Diese versuchen zunehmend private, von staatlichen Lösungsansätzen enttäuschte Akteure im Wege der (Haftungs-)Klage herbeizuführen, deren Erfolgsaussichten indes recht kontrovers beurteilt werden. Der vorliegende Beitrag möchte die insoweit geführte Diskussion hinsichtlich der wesentlichen Fragestellungen um eine unaufgeregte Betrachtung ergänzen.
Das EBV stellt die Grundlage zahlreicher komplexer wie prüfungsrelevanter Fragen dar, deren zufriedenstellende Lösung ein hohes Maß an Systemverständnis und Problembewusstsein voraussetzt. Der Beitrag bietet insofern dogmatische Hilfestellung, indem er die Binnenstruktur der §§ 985 ff. sowie deren Einordnung in das Gesamtgefüge des BGB offenlegt.

Bereits seit 2017 ist die außergerichtliche einvernehmliche Scheidung vor dem Notar in Griechenland zulässig. Es wird dazu ein Gesetz aus dem Jahr 2020 mit einigen Änderungen vorgestellt, die Anlass zu einem Gesamtüberblick der griechischen einvernehmlichen Scheidung geben. Einleitend wird auf die Historie des Gesetzes erklärend eingegangen. Folgende Themen- und Regelungsbereiche werden vertiefend erläuternd erörtert: Die außergerichtliche einvernehmliche Scheidung nach griechischem Recht (Vereinbarung der Ehegatten über die Auflösung ihrer Ehe - Bestätigung der Eheauflösung und Beurkundung durch den Notar - Eintragung der Scheidung in das Eheregister des zuständigen Standesamts); Schutz der Ehegatten und der gemeinsamen minderjährigen Kinder; Anerkennung der griechischen einvernehmlichen Scheidung in Deutschland (Geltung der Brüssel IIa-VO - Geltung der Brüssel IIb-VO); Geltung der Rom III-VO). Abschließend wird festgestellt: Die in Griechenland 2017 eingeführte einvernehmliche Scheidung unterliege mit Ausnahme des Konsenses der Ehegatten keinen weiteren materiellen Voraussetzungen. Allerdings sei es erforderlich, dass die Ehegatten Regelungen über die elterliche Sorge, den Umgang und den Unterhalt der gemeinsamen minderjährigen Kinder treffen. Dabei sei nicht immer sicher, dass zur Ermöglichung einer schnellen Scheidung das Wohl der Kinder stets bestmöglichst berücksichtigt werde. Auch berge die einvernehmliche Scheidung vor dem Notar familien-verögensrechtliche Gefahren. Hierzu wird näher ausgeführt.

Zu BGH vom 15.2.2022, VI ZR 937/20 (BeckRS 2022, 6623). Das System der taggenauen Bemessung des Schmerzensgeldes zeigt einen Weg auf, die Schmerzensgeldbemessung (neu) zu ordnen. Dabei handelt es sich im Ansatz um einen lohnenden Vorstoß – „hin zu mehr Rechtsgleichheit, -sicherheit und -akzeptanz“. Im Sinne eines produktiven Dialogs über methodische Fragen der Schmerzensgeldbemessung bleibt zu bemängeln, dass an Maßstäben festgehalten wird, bloß weil diese sich etabliert haben. Dies gilt auch für die Entscheidung des BGH. Der Senat setzt sich vor allem mit der Begründung der Ablehnung der taggenauen Bemessung auseinander, ohne dabei näher auf die kritischen Aspekte der herkömmlichen Bemessung einzugehen. Nach dieser Entscheidung darf wohl infrage gestellt werden, ob sich weiter mit einer derart grundlegenden Anpassung der Schmerzensgeldbemessung befasst werden wird.
Die §§ 315 bis 319 BGB sind als solche zwar nicht besonders prüfungsrelevant, veranschaulichen aber einen Regelungsmechanismus, dessen Verständnis dazu angetan ist, nicht nur unbekanntes Terrain auch in der Fallbearbeitung leichter zu erschließen, sondern den klassischen Pflichtfachstoff besser zu verstehen. Daher konzentriert sich die Darstellung auf diese Berührungspunkte.
Das grundsätzliche Verbot des Erfolgshonorars gilt nicht für Inkassounternehmen. Anwältinnen und Anwälte dürfen dagegen nur in Ausnahmefällen ein Erfolgshonorar vereinbaren. In der Lexfox- bzw. Wenigermiete.de-Entscheidung des BGH hat dieser Widerspruch keine Rolle gespielt (BGH, AnwBl Online 2020, 63). Die Begründung für eine Diff erenzierung vermisst man allerdings. Das könnte schlicht daran liegen, dass es keine (verfassungsrechtlich ausreichende) gibt. So wird der Beitrag der Autorin und des Autors zum Plädoyer, über eine Neuordnung des Erfolgshonorars nachzudenken.

Der Beitrag befasst sich mit dem Einsatz von Legal Tech zur Verbesserung der menschlichen Rechtsanwendung. Die Verfasser weisen zunächst darauf hin, dass die Anwendung des Rechts Aufgabe des Menschen sei, woran sich auch künftig wenig ändern werde. Es wird erörtert, dass anlässlich der fortschreitenden Digitalisierung die Befürchtung bestehen würde, dass menschliche Juristen durch Legal Tech ersetzt werden könnten. Im Folgenden wird hinterfragt, welche Effizienzgewinne Legal Tech bewirken könne und welche Gefahren hiermit in Verbindung stehen würden. Weiter nennen die Autoren Stärken der Menschen gegenüber aktuellen technischen Möglichkeiten. So könnten repetitive und standardisierte juristische Arbeit durch Digitalisierung sicherer sowie effizienter werden. Abschließend beschäftigt sich der Beitrag mit Möglichkeiten der Verwaltungsautomatisierung. Die Verfasser kommen zu dem Ergebnis, dass Legal Tech erhebliche Effizienzgewinne erreichen könne, wobei es hierzu programmierte rechtliche Regelungen sowie vergleichbare Sachverhalte bedürfe.
In der folgenden Klausur geht es um das alte Problem der Kollision eines verlängerten Eigentumsvorbehalts mit der Globalzession von Forderungen. Die Fallkonstellation ist allerdings ungewöhnlich, so dass man die Zusammenhänge neu überdenken und überlieferte Wissenselemente neu zusammenfügen muss. Dem Format nach entspricht das Ganze ungefähr einer Klausuraufgabe für den Erwerb des großen BGB-Scheins, wobei die inhaltlichen Anforderungen eher hoch sind und schon in Richtung Staatsexamen gehen.

Wenn ein Bürgschaftsgläubiger vertragsschlussbezogene Aufklärungspflichten gegenüber dem Bürgen verletzt, kann der Bürge sich von der Bürgschaft lossagen, sei es durch Arglistanfechtung (§§ 123, 142 Abs. 1 BGB) oder im Wege des Naturalschadensersatzes aus culpa in contrahendo (§§ 311 Abs. 2, 241 Abs. 2, 280 Abs. 1, 249 Abs. 1 BGB). Inwieweit vertragsschlussbezogene Aufklärungspflichten des Bürgschaftsgläubigers bestehen, ist allerdings alles andere als klar. Es gibt hierzu interessante Rechtsprechung, aber oberhalb der Einzelfallebene sind die Begründungszusammenhänge dünn.
Die folgenden Fallstudien wollen Standardwissen zu klassischen Themen des allgemeinen Schuldrechts in Erinnerung rufen und vor allem die Systematik der Falllösung deutlich machen. Man darf sich nicht dazu verleiten lassen, alles auf einmal lösen zu wollen, sondern muss auf die einzelnen Ansprüche blicken und sich fragen: (1) Was wird aus dem primären Erfüllungsanspruch auf die gestörte Leistung? (2) Gibt es Schadensersatzansprüche, die als Sekundäransprüche an die Stelle des Primäranspruchs oder neben ihn treten? Und schließlich (3): Was ist mit dem Anspruch auf die Gegenleistung? Vom Schwierigkeitsgrad her ist das Folgende ungefähr im Bereich einer gehobenen Zwischenprüfungsklausur anzusiedeln.

Die Fallstudie thematisiert ein zentrales Element des GmbH-Rechts, nämlich das Stammkapital und den Gesetzessatz: »Das zur Erhaltung des Stammkapitals erforderliche Vermögen der Gesellschaft darf an die Gesellschafter nicht ausgezahlt werden« (§ 30 Abs. 1 Satz 1 GmbHG). Wenn man diesen Satz versteht, hat man Kapitalgesellschaftsrecht verstanden. Im Folgenden wird diese Regel thematisiert, und es wird aufgezeigt, dass sich das Gebot der Stammkapitalerhaltung nicht nur an die Gesellschafter richtet, sondern auch an den Geschäftsführer. Die einen dürfen nicht nehmen, und der anderen darf nicht geben. Außerdem gibt es im GmbH-Recht noch weitere Rechtsschutzbehelfe zum Schutz des Gesellschaftsvermögens gegenüber Gesellschaftern und Organmitgliedern, die ebenfalls zur Sprache kommen.

In der Klausuraufgabe geht es vordergründig um das Bürgschaftsrecht und eine besondere Form der Bürgschaft, nämlich die Globalbürgschaft. Bei ihr bezieht sich die Bürgenhaftung nicht nur auf eine bestimmte einzelne Verbindlichkeit des Hauptschuldners, sondern auch auf künftig mögliche weitere Verbindlichkeiten; das ist schon bedenklich. Aber letzten Endes geht es wie in den meisten juristischen Klausuraufgaben nicht so sehr um diese oder jene Einzelfrage, sondern um einen größeren Zusammenhang, der sich hier auf das allgemeine Vertragsrecht erstreckt. Vom Schwierigkeitsgrad und Umfang her liegt die Aufgabe zwischen einer anspruchsvollen Zwischenprüfungs-Klausur und einer eher leichten Klausur im Rahmen der Fortgeschrittenenübung zum Erwerb des großen BGB-Scheins.

Das Führen eines Fahrzeugs wird seit jeher als ein menschengesteuerter Vorgang angesehen. Entsprechend etablierte sich in der Gesetzgebung das Dogma der menschlichen Fahrzeugführung, welches sich jedoch seit der Existenz von hoch- und vollautomatisierten Fahrerassistenzsystemen auf dem Prüfstand befindet. Der Autor nimmt sich dem in strafrechtlicher Hinsicht mit Blick auf die Führungsdelikte des StGB unter reflektierender Betrachtung der Regelungen des StVG an. Rechtlicher Ausgangspunkt ist die Auswertung der uneinheitlichen und kasuistischen Rechtsprechung zum Fahrzeugführen. Die daraus abgeleitete Notwendigkeit einer analytischen Betrachtung der Arbeitsaufgabe der Fahrzeugführung mündete schließlich in die Entwicklung eines neuen Definitionsvorschlags. Dessen Mehrwert wird anschließend an der Strafrechtsdogmatik, insbesondere am Eigenhändigkeitsdogma und der unechten Unterlassungsstrafbarkeit, gemessen und durch die Bezugnahme von sog. Use-Cases des automatisierten Fahrens verdeutlicht.
Ziel dieser Arbeit war, das Wesen der deutschen Steuerdisziplin und des ivorischen Steuersystems, welches aufgrund der Kolonialzeit auch als Erbe Frankreichs angesehen wird, historisch auszuarbeiten. Besonders betrachtet wurde der steuerrechtliche Rahmen, da dieser in hohem Maße dem Schutz der Ehe und Familie dient. Anhand der unterschiedlichen Steuersysteme werden Verbesserungsvorschläge für das Steuersystem Deutschlands und der Elfenbeinküste gegeben, um die Ehe und die Familie besser zu schützen. Das Hauptaugenmerk liegt bei meinen Betrachtungen immer auf dem Schutz des/der Kindes/r. Insbesondere wird dabei auf die Stellung der Frau und deren Wandlung in den letzten Jahrzehnten eingegangen und es werden Vorschläge gemacht, wie vor allem Alleinerziehende und berufstätige Mütter sowohl in Deutschland als auch in der Elfenbeinküste steuerlich entlastet werden können und verfügt daher über einen hohen aktuellen Bezug.

Die als Digitalisierung bezeichnete umfassende gesellschaftliche bzw. kulturelle Transformation lässt auch das Grundgesetz nicht unberührt. Die Fortentwicklung der Lehre vom Verfassungswandel ermöglicht es, die verfassungsrechtlichen Dynamiken als einen strukturellen Verfassungswandel zu beschreiben, der sich am Leitbild digitaler Souveränität orientiert. Das Leitbild steht für die Verantwortung und die Legitimität des Staates unter den Bedingungen der Digitalisierung. Enrico Peuker entfaltet es exemplarisch in den verfassungsrechtlichen Kontexten der digitalen Infrastrukturen sowie der "digitalen" Grundrechte. Er plädiert für eine erweiterte Lesart der staatlichen Infrastrukturverantwortung als Optimierungsrecht hinsichtlich des Breitbandausbaus und der IT-Sicherheit und verortet die Grundrechtsentwicklungen in einem Drei-Stufen-Modell aus Interpretation, Innovation und Kodifikation.
