• In der niederbayerischen Metropole Passau sowie einigen weiteren Städten der Region ist gegenwärtig in der Bevölkerung eine heftige Auseinandersetzung über ein Lied im Gang, das regelmäßig auf Volksfesten und ähnlichen Veranstaltungen aufgeführt und gesungen wird. Es handelt sich um das „Donaulied“, das die Initiatoren einer Petition – Studenten der Universität Passau – wegen sexistischer Textpassagen verbieten lassen wollen, während es ihre Widersacher als Ausdrucksform bayerischer Volkstümlichkeit für unantastbar erklären. „Weg mit dem Donaulied“ und „Hände weg vom Donaulied“ könnte man die konträren Standpunkte propagandistisch zugespitzt etikettieren. Die Trumpfkarte des Strafrechts wird in diesem Streit von den Gegnern des Liedes zur Bekräftigung ihrer Forderungen offenbar noch nicht ausgespielt. Das kann daran liegen, dass diese Karte (noch) nicht sticht, weil das Strafrecht in Bezug auf diesen Gegenstand seine vielgepriesene Fragmentarität zeigt, also eine Strafbarkeitslücke aufweist. Aber die Analyse des geltenden Strafrechts wird bestätigen, dass hier tatsächlich noch eine strafrechtsfreie Nische existiert. Die nunmehr öffentlich wahrgenommene Anstößigkeit des Donaulieds könnte also im wahrsten Sinne des Wortes Anstoß sein zu einer Gesetzgebungsinitiative. Ob es dieser aber wirklich bedarf, sollte gründlich überlegt werden.…

It is the „Donaulied“, which the initiators of a petition – students of the University of Passau – want to have banned because of sexist lyrics, while their opponents declare it to be inviolable as an expression of Bavarian folklore. „Away with the Donaulied“ and „Hands off the Donaulied“ you/one could label the opposing positions propagandistical pointedly. The trump card of criminal law is apparently not played out yet in this dispute by the opponents of the song in support of their demands. This may be due to the fact that this card does not sting (yet), because criminal law shows its much-vaunted fragmentary character with regard to this subject, that means there is a gap in punishability. But an analysis of the existing criminal law will confirm, that there is still a niche here that is free of criminal law. The offensiveness of the Donaulied, which is now perceived publicly, could be the impuls for a legislative initiative. If this is really necessary, should be thoroughly considered.…
