• Der Text analysiert den Gesetzesentwurf des Kriminalpolitischen Kreises zur Regelung des Notwehrexzesses und des Putativnotwehrexzesses, veröffentlicht unter Hoven/Mitsch in GA 2023, S. 241 ff., ausgehend vom aktuellen Diskussionsstand in Rechtsprechung und Literatur. Im Schwerpunkt widmet er sich dem Anwendungsbereich des Regelungsvorschlags, insbesondere der Reichweite des intensiven Notwehrexzesses, der Erfassung des extensiven Notwehrexzesses sowie den Voraussetzungen eines entschuldigenden Putativnotwehrexzesses. Er beruht auf einem Kommentar, den die Verfasserin im Juni 2023 auf dem Online-Workshop „Ein neues Konzept der Notwehr“ des kriminalpolitischen Kreises gehalten hat. Der Vortragsstil wurde beibehalten.
• Based on the current state of discussion in jurisprudence and literature, the text analyses the proposed regulation on “Notwehrexzess” (excess of self-defence) and “Putativnotwehrexzess” (excess of putative self-defence), as drafted by the Kriminalpolitischer Kreis and published under Hoven/Mitsch in GA 2023, p. 241 ff. It focuses on the scope of application of the proposed regulation, in particular the breadth of the intensive “Notwehrexzess”, the inclusion of the extensive “Notwehrexzess” as well as the preconditions of an excusable “Putativnotwehrexzess”. It is based on a commentary given by the author in June 2023 at the online workshop „A new concept of self-defence“ of the Kriminalpolitischer Kreis. The style of the presentation has been maintained.
