Das Öffentliche Medienrecht basiert auf verfassungs-, verwaltungs- und unionsrechtlichen Rechtsgrundlagen. Es bezieht sich im Kern auf die klassischen Medien des Rundfunks, der Presse und des Films, muss aber auch beweisen, dass es den Wandel hin zu den neuen Medien sachgerecht zu bewältigen versteht. Die Grundfragen dieses abwechslungsreichen Rechtsgebiets werden in dieser Klausur thematisiert.

Influencer-Marketing ist ein Phänomen der Werbebranche, dessen immense wirtschaftliche Bedeutung in reziproker Relation zu seiner rechtlichen Durchdringung steht. Während die Umsätze kontinuierlich steigen,1 steht die juristische Strukturierung erst am Anfang.2 Die rechtliche Einordnung dieser etwa seit 2007 existierenden Werbestrategie hat jedoch kürzlich durch drei parallele BGH-Urteile vom 09.09.2021 deutlichere Flankierungen erfahren.3 Hierdurch gewinnt die Thematik eine erhebliche Aktualität, die durch die nachfolgenden Ausführungen illustriert werden soll.
So richtig schlüssig finden die Medienrechtler Marcus Schladebach und Hans-Christian Gräfe den Vorschlag der EU-Kommission für den Europäischen Media Freedom Act nicht. Unter einer überpathetischen Überschrift regelt er fiktive Fragen, die eigentlich keiner Regelung bedürfen. Zudem ohne Kompetenz auf dem Gebiet der Medienpolitik.
