Hugo Grotius: Mare Liberum

Im März 1609 erschien die Schrift „Mare Liberum“. Das aus diesem Anlaß durchgeführte Podiumsgespräch „Hugo Grotius: Mare Liberum – Zur Aktualität eines Klassikertextes“ erörterte zunächst den Typus des Klassikertextes und untersuchte Aspekte der Grotius-Rezeption. Danach wurde erörtert, inwieweit der Protestant Grotius von Ideen des Katholiken de Vitoria beeinflußt war und was dies für die Webersche Einordnung des Kapitalismus bedeutet. Abschließend stellte das Podiumsgespräch dann den Bezug zur heutigen Situation her und behandelte die Bedrohung der Freiheit der Meere durch Piraterie und setzte sich mit den Gegenmaßnahmen der Europäischen Union auseinander. Die Publikation enthält die ersten drei Beiträge aus der Feder von Markus Kotzur, Johannes Thumfart und Norman Weiß. Kotzur entwickelt den Begriff des Klassikertexts und macht an den verschiedenen Kategorien – literarische Texte, philosophische, staats- und gesellschaftstheoretische Entwürfe, politische Texte und spezifische Rechtstexte – die jeweiligen Wirkungsmöglichkeiten anschaulich. Er schildert sodann die Besonderheit der spezifisch juristischen Wirkweisen aller Kategorien von Klassikertexten in der völkerrechtlichen Theorie und Praxis gleichermaßen. Weiß schildert die Entstehungshintergründe von „Mare liberum“ und geht darauf ein, wie und warum ein für den konkreten Einzelfall entstandenes Parteigutachten bereits nach wenigen Jahren zum allgemein bedeutsamen Rechtstext werden konnte. In einem zweiten Schritt wird kurz angerissen, wie sich die Rezeption dieses Klassikertexts im zwanzigsten Jahrhundert darstellt. Thumfart unternimmt es, die These Max Webers, der Kapitalismus sei durch den Protestantismus begünstigt worden, um die eigene These zu ergänzen, auch die katholische Religion habe sich förderlich erwiesen: Grotius habe seine Idee eines universalen, natur- und gottgewollten Rechts auf Freihandel in Abhängigkeit von dem katholischen Missionsgedanken entwickelt, wie er knapp sechzig Jahre vor Grotius von dem spanischen Dominikaner Francisco de Vitoria formuliert wurde.
Die achte Konferenz des Forschungskreises Vereinte Nationen wurde am 28. Juni 2008 an der Universität Potsdam veranstaltet. Das Thema der Konferenz lautete „Die Vereinten Nationen in den internationalen Beziehungen“. Für die „Potsdamer UNO-Konferenzen“ sind die Verbindung von Wissenschaft und Praxis auf der einen und die Beteiligung unterschiedlicher Disziplinen auf der anderen Seite kennzeichnend. Die vier Referate, die in der vorliegenden Broschüre dokumentiert werden, blicken aus unterschiedlichen Perspektiven auf die Vereinten Nationen. Diese Broschüre soll allen Interessierten die Möglichkeit geben, wichtige Aspekte der Diskussion über das Engagement und die Handlungsspielräume der UN-Mitgliedstaaten Deutschland und Schweiz kennenzulernen. Außerdem werden die Rolle des UN-Generalsekretärs und die Rolle von Regionalorganisationen bei der Friedenssicherung beleuchtet. Das Referat, das Dr. Inge Kaul zum Thema „Die Vereinten Nationen und ihre Konkurrenten im internationalen System“ bei der Konferenz gehalten hat, wurde leider nicht zur Drucklegung eingereicht. Die vier Referattexte werden ergänzt durch einen Bericht des Koordinators des Forschungskreises Dr. Helmut Volger über die Arbeit des Forschungskreises Vereinten Nationen, der ursprünglich im MenschenRechtsMagazin 2007 veröffentlicht worden ist. Er soll die Leser über die inhaltlichen Schwerpunkte und Erfahrungen bei der Arbeit des Forschungskreises informieren.
Das vorliegende Heft 13 der Reihe Studien zu Grund- und Menschenrechten enthält die überarbeitete Fassung einer Arbeit, die der Autor im Jahr 2005 für das Deutsche Institut für Menschenrechte erstellt hat. Im Vordergrund stand dabei die Frage, inwiefern das Verhältnis zwischen Menschenrechten und humanitärem Völkerrecht geklärt ist oder ob es noch weiteren Klärungsbedarf hierzu gibt. Der Autor kommt zu dem Ergebnis, dass das Verhältnis im Einzelnen und viele der damit zusammenhängenden Fragen weiterhin kontrovers diskutiert werden und ein Abschluss dieser Diskussion derzeit nicht absehbar ist. Die Studie fasst die Hauptproblemfelder des Verhältnisses dieser beiden Rechtsgebiete, einschließlich der Frage der exterritorialen Geltung von Menschenrechtsverträgen, in sehr gelungener Weise zusammen und weist auf weitere wichtige Fragen hin. Wir freuen uns, dass es möglich ist, diese wichtige Studie in der Schriftenreihe des MenschenRechtsZentrums der Universität Potsdam, an dem der Verfasser derzeit tätig ist, publizieren zu können.
Die Apartheid in Südafrika war ein Unrechtssystem. Zu den Grausamkeiten des Regimes zählten Massaker, Folter, Mord, Freiheitsberaubung, Zwangsumsiedlung, ökonomische Benachteiligung und alltägliche Diskriminierung. Was nach dem Ende eines solchen Unrechtssystems bleibt, ist die Frage nach dem Umgang mit der Vergangenheit. Die drei grundlegenden Möglichkeiten der Vergangenheitsbewältigung sind die rein justiziare Aufarbeitung, eine Generalamnestie oder ein drittes Modell, das zum Ziel hat, die Vorteile der beiden anderen Strategien zu vereinen. In Südafrika versuchte man, auch als Kompromiss aller Beteiligter, diesen dritten Weg mit der Einrichtung der Wahrheits- und Versöhnungskommission, die mittlerweile weltweit zum Sinnbild dieser Form der Vergangenheitsbewältigung geworden ist. Das Ziel der Studie war dabei zu klären: War die Wahrheits- und Versöhnungskommission in Südafrika als Strategie der Vergangenheitsbewältigung erfolgreich? Im Einzelnen widmete sich die TRC in drei Hauptausschüssen (Menschenrechtsausschuss, Amnestieausschuss und Wiedergutmachungsausschuss) den folgenden Zielen: Aufklärung der Menschenrechtsverletzungen, Klärung des Verbleibs verschwundener Personen, Klärung dessen, was während der Apartheid und der Übergangsphase zerstört wurde um die Verbrechen zu verschleiern, Wiedergutmachung für die Opfer und Amnestierung der Täter bei politisch motivierten Taten. Dieser letzte Punkt war jedoch an die völlige Offenlegung der Tat und ein öffentliches Eingeständnis gebunden. Zum einen zeigt die Analyse die großen Erfolge der Wahrheits- und Versöhnungskommission in Südafrika. Sie hat mehr und vor allem genauere Informationen über die Apartheid zusammengetragen, als je eine andere Untersuchung es geschafft hat. Mit der starken Beteiligung der Bevölkerung am Prozess der Aufklärung konnte sie einen Prozess in Gang bringen, der zur Entstehung einer neuen Menschenrechtskultur beitrug und auch einen Anstoß zur Versöhnung gab. Durch die intensive Aufarbeitung der Vergangenheit in einem gesamtgesellschaftlichen Prozess schaffte es die TRC auch, eine politische Kultur anzuregen, die unentbehrlich ist, will man nach einem Unrechtssystem eine demokratische Zukunft aufbauen. Das Verständnis oder zumindest eine Ahnung von dem was Menschenrechtsverletzungen bedeuten, wurde in dieser Zeit tief im Bewusstsein der meisten Südafrikaner verankert. Es wurde eine „operative Wahrheit“ geschaffen, die, wenn auch unter Protesten aller Parteien, letztlich anerkannt wurde und somit ein zukünftiges Leugnen der Apartheidsverbrechen unmöglich machte. Aber auch die Befreiungsbewegungen mussten brutale Verbrechen eingestehen. Zum anderen wird ebenso deutlich, dass die gestellten Anforderungen bei weitem zu hoch waren. Obwohl große Bereiche der alltäglichen Apartheid komplett unberücksichtigt blieben. Bei der Wahrheitsfindung wurde deutlich, dass die drei Ausschüsse weit von einer wirklichen Aufklärung der Untaten der Apartheid entfernt blieben. Auch in Bezug auf die Täter erreichte die Kommission nur zum Teil ihre Ziele. Verglichen mit den aufgeklärten Verbrechen, beantragte nur ein Bruchteil der Täter Amnestie. Die Logik, durch den Anreiz der Straffreiheit eine rege Beteiligung der Täter am Aufklärungsprozess zu erreichen, ging nicht auf. Bei der Wiedergutmachung zeigte sich, dass es einer der größten Konstruktionsfehler der TRC war, die Umsetzung der Entschädigungen dem Parlament und der Regierung zu überlassen. Der Wiedergutmachungsausschuss erarbeitete lediglich Vorschläge an den Präsidenten. Die wurden jedoch nie in dieser Form umgesetzt und stellten damit die TRC als Ganze bei Teilen der schwarzen und farbigen Bevölkerung in Frage. Einen direkten Zusammenhang zwischen der TRC und einer Befriedung der Bevölkerung herzustellen, wäre vermessen. Noch immer ist Südafrika ein gespaltenes Land. Ähnliches gilt bei der Legitimierung und Konsolidierung der neuen demokratischen Ordnung. Auch hier ist die Kommission ein Baustein, auf den nicht verzichtet werden konnte. Ihr diesen Erfolg, und es ist ein Erfolg im heutigen Südafrika, alleine zuzuschreiben, wäre eine extreme Überschätzung ihrer Möglichkeiten. Unterm Strich bleibt: Die TRC konnte nicht all ihre Ziele erreichen, aber sie hat sich gerade unter den Voraussetzungen des Übergangsprozesses als eine sinnvolle Form der Vergangenheitsbewältigung erwiesen, die grundlegend wichtige Ergebnisse erarbeiten konnte. Sie kann somit trotz der Berücksichtigung einer Vielzahl von Problemen als Erfolg gewertet werden.
Grund- und Menschenrechte stehen in einem Spannungsverhältnis zwischen Bürger und Staat. Sie haben sich im Alltag, aber auch in Extremsituationen zu bewähren. Letzteres ist beim Widerstandsrecht der Fall. Für unser heutiges demokratisches und rechtsstaatliches Selbstverständnis sind die folgenden Fragen grundlegend: Was überhaupt ist Widerstand und unter welchen Umständen kann er moralisch gerechtfertigt werden? Wodurch unterscheidet sich politischer Widerstand von bloßem Ungehorsam oder Protest? Woher nimmt er seine Legitimation? Und auf welche historischen Vorbilder darf er sich berufen? Die in diesem Band versammelten Beiträge von Klaus Roth und Bernd Ladwig – beide Autoren sind in der Politischen Philosophie und Ideengeschichte beheimatet – gehen eben diesen grundlegenden Fragen auf dem Wege einer primär ideengeschichtlichen Rückbesinnung auf das Widerstandsthema einerseits (Roth) und einer überwiegend systematisch-philosophischen Begriffsklärung andererseits (Ladwig) nach.
Vorwort: Im vorliegenden Heft der Studien zu Grund- und Menschenrechten wird der Vortrag dokumentiert, den Prof. Dr. Georg Lohmann von der Ottovon- Guericke-Universität Magdeburg am 12. Mai 2004 im Rahmen der neu eingerichteten Reihe „Philosophie der Grund- und Menschenrechte“ an der Universität Potsdam gehalten hat. Die Veranstaltung bot Gelegenheit, die Frage zu erörtern, ob die unterschiedlichen Menschenrechte tatsächlich gleichgestellt sind oder doch eine Hierarchisierung von Menschenrechten stattfindet. Diese Diskussion soll in diesem Heft durch den Abdruck von drei Kommentaren zum Vortrag nachvollzogen werden. Inhalt: Die Menschenrechte: unteilbar und gleichgewichtig? Aus dem Vorwort: Vor wenigen Wochen ist im Heft 13 der „Studien zu Grund- und Menschenrechten“ eine Arbeit von Herrn Schäfer mit dem Titel „Zum Verhältnis Menschenrechte und humanitäres Völkerrecht“ erschienen. Wir haben inzwischen nicht nur zahlreiche faktische Situationen, in denen dieses Verhältnis von Menschenrechten und humanitärem Völkerrecht relevant ist, sondern es gibt zunehmende Äußerungen rechtlicher Instanzen (Internationaler Gerichtshof, Jugoslawien-Tribunal, Menschenrechtsausschüsse), die sich diesem Problem gewidmet haben, von Stimmen aus der Wissenschaft ganz zu schweigen. Herr Schäfer wird versuchen, eine Zwischenbilanz zu ziehen. In vielen Fällen, nämlich stets bei Auslandseinsätzen von Streitkräften, hängt die Frage, wie das Verhalten von Menschenrechten zu Regeln des humanitären Völkerrechts zu beurteilen ist, auch davon ab, ob die menschenrechtlichen Verpflichtungen eines Staates ihn auch dann begleiten, wenn er außerhalb seines Territoriums agiert. Herr Dr. Weingärtner wird sich dieser zentralen Frage stellen, die nicht erst, aber vor allem auch nach der Banković- Entscheidung des Europäischen Gerichtshofs für Menschenrechte aus dem Jahr 2001 vielfach erörtert wird. Die Bundesrepublik Deutschland selbst wurde etwa vom Menschenrechtsausschuß der Vereinten Nationen bei der Diskussion ihres letzten periodischen Berichts mit dieser Frage direkt konfrontiert. An die Einsätze in Afghanistan, Kongo und nun auch vor der libanesischen Küste ist zu erinnern. Gern nehme ich diesen Zusammenhang zum Anlaß, auch auf die Arbeit von Dirk Lorenz „Der territoriale Anwendungsbereich der Grund- und Menschenrechte“ hinzuweisen, die im Jahr 2005 als Band 25 in der vom MRZ herausgegebenen Schriftenreihe erschienen ist. Frau PD Dr. Schmahl behandelt ein Thema, das im engen Zusammenhang mit den beiden vorangegangenen steht. Können Menschenrechtsverletzungen oder Verletzungen von Normen des humanitären Völkerrechts zu individuellen Schadenersatzansprüchen führen? Stichworte wie Zwangsarbeiter, Distomo und vor allem – da die Nachkriegszeit betreffend – Varvarin verweisen auf die gerade auch Deutschland angehende Brisanz dieser Problematik. <img src="http://vg00.met.vgwort.de/na/74333508f5104deb4553" width="1" height="1" alt="">
