Ehrensache Satire

Satirische Äußerungen und Darstellungen sind weit verbreitet und geben immer wieder zu – leider nicht nur rechtlichen – Auseinandersetzungen Anlass. Durch den seit Jahren schwelenden sogenannten „Karikaturenstreit“, gipfelnd in den Anschlägen von Paris Anfang 2015, hat die Thematik eine geradezu dramatische Brisanz erlangt. Neben dem religiösen Bekenntnis ist klassischer Stein des Anstoßes aber immer noch die Ehre.
Die Untersuchung beleuchtet kritisch die Handhabung des Satirebegriffs in Rechtsprechung und juristischer Literatur und überprüft nach einer wesensgerechten Bestimmung des Satirischen, insbesondere unter Heranziehung der literaturwissenschaftlichen Beurteilung und der Einschätzung der Satiriker selbst, dem dreistufigen Deliktsaufbau folgend und anhand anschaulicher Beispiele, ob und unter welchen Voraussetzungen eine Strafbarkeit durch satirische Ehrbeeinträchtigungen in Betracht kommen kann. Besondere Bedeutung erfährt in diesem Zusammenhang die Frage nach der Einschlägigkeit der Meinungs- oder Kunstfreiheit und deren Einordnung in die strafrechtliche Prüfung sowie die eines möglichen Unrechts- oder Schuldausschlusses unter Berücksichtigung der spezifischen Funktion, welche insbesondere die politische Satire innerhalb der Gesellschaft wahrnimmt.
Dieser Band entstand auf der Basis von Beiträgen, die zum XXIV. Internationalen Kolloquium des Studienkreises ‘Geschichte der Sprachwissenschaft’ vom 22. bis 24. August 2013 vorgetragen wurden. Ausschlaggebend für die Wahl des Themas war nicht ein Befolgen des Zeitgeistes, der immer wieder auf die Krise hinweist, die Europa durchlebt und die sich natürlich auch im metasprachlichen Bewusstsein niederschlägt, sondern die Absicht, eine von der Feststellung von Kontinuitäten in der Entwicklung der Sprachwissenschaft unterschiedene Forschungsperspektive einzunehmen.
Krisenzeiten und Umbrüche führen allerdings tatsächlich auch zu veränderten Diskursstrategien und Bezeichnungsmustern, die auch von linguistischen Laien wahrgenommen und diskutiert werden. Sprachwandeltheorien spiegeln zwar ein Bewusstsein von Phasen sehr dynamischer sprachlicher Entwicklungen wider, nicht jedoch ein Interesse an dem gesellschaftlich bedingten initialen Moment, an dem anfänglichen Auslöser von Sprachwandel. Eine Umbruchkonzeption, die Gesellschafts- und Sprachgeschichte in diesem Sinn aufeinander beziehen würde, wurde bisher nicht entwickelt. ...
Viel mehr als dieser lebensweltliche Bezug des Verhältnisses von Sprache und Krise bildete jedoch die Sichtung der historiographischen Literatur der letzten Jahre und Jahrzehnte den Ausgangspunkt für das Thema dieses Bandes. Immer wieder werden begriffliche Kontinuitäten, Einflüsse zurückliegender Autoren auf spätere und die Verpflichtung moderner Theorien gegenüber früheren Ansätzen konstatiert. Meistens geschieht dies zu Recht, doch das wissenschaftshistorische Interesse für die Innovation oder auch den theoretischen Verlust, mit einem Wort die Diskontinuität, sollte nicht vernachlässigt werden. Dabei gibt es durchaus immer wieder Behauptungen des völlig Neuen in sprachtheoretischen Publikationen, die eine Tradition und die jetzt neue, gültige Theorie, die sogenannte Vorgeschichte eines Theorems und den Beginn der eigentlichen Wissenschaft in Gegensatz zueinander stellen. Doch solche Behauptungen stammen von den Sprachwissenschaftlern selbst, sie dienen meist der Hervorhebung des eigenen Standpunkts und sind keine Ergebnisse professioneller Historiographie.
Der maskierte Voltaire

Voltaire schrieb mit spitzer Feder, doch verbarg er seine Kritik mittels verdeckter Schreibarten. So schlüpft er in der Tischrunde der großen abendländischen Satiriker abwechselnd in die Masken von Lukian, Erasmus und Rabelais, um verwandte Geister miteinander sprechen zu lassen. – Im Drama Mahomet inszeniert er religiösen Fanatismus und Glaubenskriege als die große „Geißel“ der Menschheit. – Candide gerät als autofiktionale Spiegelung Voltaires und des Preußenkönigs Friedrich zu einer versteckten Abrechnung mit dem Freund. – Eine weite Lesart des Candide, eine Neuinterpretation unter dem Aspekt von Heterotopie und Heterologie, rückt die Neue Welt in den Blick. Unter Rückgriff auf das kartographische Imaginaire der Entdecker verwandeln sich geographische Orte in Heterotopien. Aspekte der Kolonialismuskritik und Globalisierung erweisen sich hier erstmals als eine wesentliche Strategie zur Ironisierung der ‚besten aller möglichen Welten‘.
