Kurz vor ihrem sechzigsten Geburtstag ist die europäische Union mit inneren und äußeren Herausforderungen konfrontiert und befindet sich in einer tiefen Krise. Am 1. März 2017 legte Kommissionspräsident Juncker das „Weißbuch über die Zukunft der Europäischen Union“ vor, in dem er verschiedene Szenarien darlegt und zur Diskussion über die anste-henden Entscheidungen einlädt. Diese Papier versteht sich als ein solcher Diskussionsbei-trag.

Der Forschungskreis Vereinte Nationen veranstaltete am 25. Juni 2016 seine dreizehnte Konferenz in Kooperation mit dem „Forum internationale Ordnung“ des Auswärtigen Amtes. Die Potsdamer UNO-Konferenzen stellen in ihrem Programm traditionell eine Verbindung von Wissenschaft und Praxis her unter Beteiligung unterschiedlicher Disziplinen.
Die Konferenz 2016 widmete sich dem Thema „Die Rolle der Vereinten Nationen in der multilateralen Entwicklungszusammenarbeit“.
Entwicklung als wichtiges Ziel der Vereinten Nationen und ihrer Mitgliedstaaten ist auch für andere Handlungs- und Politikfelder wichtig. Bilanz und Ausblick, die auf der Konferenz unternommen wurden, betrafen deshalb nicht nur die Entwicklungspolitik im eigentlichen Sinne – hier standen die 2015 beschlossenen Nachhaltigkeitsziele (SDGs) zur Debatte –, sondern bezogen auch umweltpolitische und menschenrechtliche Aspekte mit ein.
Die Referate zum Thema Entwicklung wurden eingerahmt von zwei Vorträgen zu aktuellen UN-politischen Fragen: der Wahl des neuen Generalsekretärs der Vereinten Nationen in New York nach einem reformierten Wahlverfahren, das mehr Transparenz und für UN-Mitgliedstaaten und NGOs mehr Beteiligungsmöglichkeiten bietet, und die Neuorganisation innerhalb des Auswärtigen Amtes, was die Vereinten Nationen betrifft.

Vorwort: Im vorliegenden Heft der Studien zu Grund- und Menschenrechten wird der Vortrag dokumentiert, den Prof. Dr. Georg Lohmann von der Ottovon- Guericke-Universität Magdeburg am 12. Editorial: Wir greifen im vorliegenden Heft eine Reihe von eher praxisorientierten Fragestellungen auf, behandeln aber auch grundlegende Themen. Carolin König widmet sich in ihrem Beitrag über das TRIPS-Übereinkommen menschenrechtlichen Implikationen des geistigen Eigentums, wie sie vor allem für den Handel mit und die Entwicklung von Medikamenten von Bedeutung sind. Johannes Freudenreich und Florian Ranft liefern eine statistische Analyse der 29 Wahrheitskommissionen, die ihre Arbeit beendet haben. Dabei werden Variablen zu Ressourcen, Mandat, Inhalt und Ergebnis von Wahrheitskommissionen untersucht. Die Autoren wollten herausfinden, ob es ein Standardmodell für Wahrheitskommissionen gibt, kommen aber zu dem Ergebnis, dass sich ein solches noch nicht erkennbar herausgebildet hat. Unter dem Titel „Rechtsstaatlichkeit in Europa: Dogmatik im (Kon)text“ beschäftigen sich Philippe Gréciano und Norman Weiß mit dem diesbezüglichen Entwicklungsstand der Europäischen Union und versuchen, aus rechtsvergleichender Perspektive Anregungen für die weitere Entwicklung zu gewinnen. Silke Bruchmüller untersucht in ihrem Beitrag die Aktivitäten des Deutschen Bundestages im Zusammenhang mit der „Terrorismusbekämpfung in der 14. und 15. Legislaturperiode“. Der Beitrag „Menschsein als Teilhabe an innerer und äußerer Würde“ von Linda Pickny behandelt das Thema Menschenwürde aus rechtsphilosophischer Sicht. Anne Dieter ruft dazu auf, die „Menschenrechte leben [zu] lernen“, und erinnert so daran, den wohlweislich bereits in der Präambel der Allgemeinen Erklärung der Menschenrechte geforderten fortschreitenden Prozess der Anerkennung und Verwirklichung von Menschenrechten voranzutreiben. Der Dokumentationsteil enthält den traditionellen Bericht über die Arbeit des Menschenrechtsausschusses der Vereinten Nationen im Jahre 2008. Der erste Teil, verfasst von Anne Foith, behandelt vorrangig das Staatenberichtsverfahren. Corinna Dau und Gunda Meyer führen die Reihe „Mitgliedstaaten des Europarates“ mit einem Artikel über Lettland fort. Alexander Dietz und Frank Martin Brunn beschreiben Inhalte und Strukturen der „Interdisziplinäre[n] Forschung zum Thema Menschenwürde an der Universität Heidelberg“. Dem Problem der „Zirkulären Migration“ ist schließlich der Bericht von Julia Vespermann gewidmet. Buchbesprechungen runden das Heft ab, bei dessen Herstellung uns Jutta Wickenhäuser und Tim Reiß redaktionell unterstützt haben. Gunda Meyer scheidet mit diesem Heft aus der Redaktion aus, um sich ganz auf das Referendariat zu konzentrieren. Ihre Nachfolgerin, Anne Foith, gehört bereits zum Kreis unserer Autorinnen und Autoren. Wir wünschen unseren Lesern eine anregende Lektüre.

Die erste Konferenz im Dezember 1999, die Gründungskonferenz, mündete nach einer intensiven Diskussion über die Situation in der deutschen UN-Forschung in die Gründung des Forschungskreises Vereinte Nationen. Dieser hat sich vor allem die bessere Kommunikation untereinander, die Förderung des interdisziplinären Dialogs und des wissenschaftlichen Nachwuchses in der UN-Forschung zum Ziel gesetzt. Die zweite Konferenz des Forschungskreises fand am 30. Juni und 1. Juli 2000, ebenfalls in den Räumen der Juristischen Fakultät der Universität Potsdam, im Vorfeld einer wichtigen UN-Konferenz, nämlich des Milleni-um-Gipfels im September 2000 in New York statt. Sie widmete sich einer kritischen Bilanz der Rolle der Vereinten Nationen bei der Suche nach Lösungen für die globalen Probleme, in ihren Hauptaufgabengebieten Friedenssicherung, Demokratisierung, Schutz der Menschenrechte und Förderung der wirtschaftlichen und sozialen Entwicklung. Die in dieser Broschüre veröffentlichten Referate der zweiten Konferenz spiegeln zusammen mit den Diskussionen, die zusammenfassend dargestellt werden, die großen Herausforderungen, aber auch die Chancen der Vereinten Nationen bei der Lösung der globalen Probleme, vor die sich die Völker der Welt zum Beginn des neuen Jahrtausend gestellt sehen.

Dieser Jahresbericht umfasst den Berichtszeitraum 2023, in dem Forschung und Lehre wieder in Präsenz stattfinden konnten. Begegnung und Austausch in Hörsaal und Seminarraum, auf Konferenzpaneln und während Kaffeepausen sind wieder möglich, aber die Möglichkeiten von Homeoffice und Onlinekommunikation bleiben weiter bestehen, wie die Erfahrung zeigt.
Das MenschenRechtsZentrum als interdisziplinär arbeitende, zentrale wissenschaftliche Einrichtung der Universität Potsdam hat es im Berichtszeitraum erneut unternommen, juristische, philosophische, geschichts- und kultur- sowie politikwissenschaftliche Perspektiven auf das Thema Menschenrechte in Forschung und Lehre miteinander zu verbinden.
Die Wissenschaftler*innen des MenschenRechtsZentrums lehren an den Fakultäten, denen sie angehören. Hier werden daher nur diejenigen Aktivitäten angeführt, die einen Bezug zur Arbeit des MenschenRechtsZentrums sowie zu menschenrechtlichen Fragestellungen haben; weitergehende Informationen finden sich auf den Homepages der jeweiligen Personen.

Editorial: Die Palette menschenrechtlicher Themen ist denkbar breit, wird aber durch die jeweiligen Disziplinen konturiert und von den einzelnen Autoren präzisiert. Aus philosophischer Perspektive behandelt Malte Fabian Büchs die Verknüpfung der Geschichte der Menschenrechte mit derjenigen der Moderne, die unlängst von Etienne Balibar hergestellt wurde. Die Rezeption der Allgemeinen Erklärung der Menschenrechte in den Beratungen des Parlamentarischen Rates über das Grundgesetz für die Bundesrepublik Deutschland nimmt Daniel Eberhardt in den Blick. Während in Heft 2/2008 die Allgemeine Erklärung als Klassikertext in einen breiten Zusammenhang gestellt wurde, erfolgt hier die Einbettung in einen konkreten Akt der Verfassunggebung. Der Beitrag „Konfliktparteien vor dem Europäischen Gerichtshof für Menschenrechte“ von Cornelius Wiesener behandelt das Verhältnis von humanitärem Völkerrecht und Menschenrechten am konkreten Beispiel des Krieges zwischen Rußland und Georgien im Jahr 2008. In Ergänzung des Themenschwerpunktes „Medizin und Menschenrechte“ aus Heft 2/2008 beschäftigt sich Maren Mylius mit der Beteiligung von Medizinern an Menschenrechtsverletzungen in Argentinien und fragt: „Folter unter ärztlicher Aufsicht?“ Unter dem Titel „Aufarbeitung oder Versöhnung in Kambodscha? Eine Justiz für die Roten Khmer“ befassen sich Philippe Gréciano und Birte Kaspers mit dem gemischten Tribunal in Kambodscha, das bestimmte Verbrechen aus der Zeit Pol Pots ahnden soll. Anne Dieter, Marianna Hillmer und Julia Szilat erinnern in der historischen Miszelle an den 140. Geburtstag von Mahatma Gandhi. Der Dokumentationsteil enthält den traditionellen Bericht über die Arbeit des Menschenrechtsausschusses der Vereinten Nationen im Jahre 2008. Der zweite Teil, verfasst von Anne Foith, behandelt das Individualbeschwerdeverfahren. Buchbesprechungen runden das Heft ab, bei dessen Herstellung uns Birte Kaspers redaktionell tatkräftig unterstützt hat. Im Oktober 2009 endet die Amtszeit unserer Direktoren Prof. Dr. Eckart Klein und Prof. Dr. Christoph Menke. Prof. Menke ist an die Johann Wolfgang Goethe-Universität Frankfurt am Main gewechselt und Prof. Klein ist bereits im letzten Jahr in den Ruhestand getreten. Als sein Nachfolger ist Prof. Dr. Andreas Zimmermann an die Juristische Fakultät der Universität Potsdam berufen worden. Er wird zunächst alleiniger Direktor des MRZ werden. Wir wünschen unseren Lesern eine anregende Lektüre.
Das Heft dokumentiert die siebte Konferenz des Forschungskreises Vereinte Nationen, die am 23. und 24. Juni 2006 an der Universität Potsdam stattfand. Unter dem Titel „Ein Jahr nach dem UN-Weltgipfel 2005 – Eine Bilanz der Reformbemühungen “ widmete sich die Konferenz wichtigen strukturellen Fragen und nahm einzelne Tätigkeitsfelder der Weltorganisation in den Blick. Die aus unterschiedlichen Disziplinen und aus Wissenschaft und Praxis kommenden Referentinnen und Referenten ziehen in den Referaten eine kritische Bilanz und untersuchen, was den Erklärungen des feierlichen Weltgipfels vom September 2005 an konkreten Reformschritten gefolgt ist. In für die „Potsdamer UNO-Konferenzen“ typischer Weise wird allen Interessierten die Möglichkeit gegeben, wichtige Aspekte der aktuellen Diskussion kennenzulernen, welche vor allem die Reform der UN-Hauptorgane, Reformen im Entwicklungssystem der Vereinten Nationen und im Bereich der Überwachung von Menschenrechtsverträgen betreffen sowie Fragen der Friedenssicherung und die Beteiligung von Zivilgesellschaft und Parlamentariern. Außerdem würdigt die Broschüre schweizerische Reforminitiativen in den UN und dokumentiert die aktuelle Diskussion über die deutschsprachige UN-Forschung.
