Mit dieser Arbeit zeigt der Autor die vielfältigen Wege der politischen Willensbildung im Bundestag einschließlich außerparlamentarischer Einflussnahmen auf und misst sie speziell am Grundgesetz.
Aufgrund der Fülle der im Parlament behandelten Thematiken kann nicht jeder Abgeordnete auf jedem Gebiet über ausreichende Sachkenntnisse verfügen. Dies zieht eine Zusammenarbeit der Abgeordneten in Fraktionen und Ausschüssen sowie Kontakte zu außerparlamentarischen Dritten nach sich. Beides dient auch dazu, fremde Wissensressourcen zu erschließen. Wenngleich dies nicht die einzige Ursache für außerparlamentarische Zusammenarbeit ist, zeigt sich hieran, dass Praktiken der Kooperation nicht grundsätzlich unlauter sein können. Der Autor zeigt die Grenzen/Bedingungen der Zulässigkeit auf.
Suchmaschinen spielen eine überragend wichtige Rolle für den Informationszugang im Internet und damit für die individuelle und kollektive Meinungsbildung. Gleichzeitig wird der Suchmaschinenmarkt nahezu vollständig von einem einzigen Anbieter beherrscht – Google. Angesichts dessen wird vermehrt eine Regulierung von Suchmaschinen zur Sicherung der für die Demokratie unabdingbaren Meinungsvielfalt gefordert. Die Untersuchung geht der Gebotenheit und den Grenzen einer solchen Regulierung nach und stellt die Frage nach einem kommunikationsverfassungsrechtlichen Schutz von und vor Suchmaschinen.
Genossenschaften haben wieder Konjunktur. Sie betätigen sich in einer Vielzahl von Einsatzfeldern, die herkömmlicherweise den kommunalen Selbstverwaltungsaufgaben zufallen. Darüber hinaus ergänzen und ersetzen Genossenschaften das kommunale Leistungsangebot durch die Erledigung von Aufgaben, auf deren Erbringung die Kommunen selbst verzichten. In der Praxis haben sich hybride Kooperationsmodelle gebildet, die eine Vielzahl unterschiedlicher Akteure vereinen und damit für die lokale Leistungserbringung im kommunalen Interesse fernab einer einseitigen Bindung an „Staat“ oder „Privat“ einen „Dritten Weg“ eröffnen. Davon ausgehend untersucht der Verfasser, ob und unter welchen Voraussetzungen es sich bei der Genossenschaft um einen nachhaltigen Partner der Kommunen bei der Aufrechterhaltung kommunaler Infrastrukturen handeln kann.
Eine Vergabesperre ist der längerfristige Ausschluss eines Unternehmens von der öffentlichen Auftragsvergabe. Sie geht damit in ihrer Intensität deutlich über den Einzelfallausschluss hinaus und kann für die betroffenen Unternehmen gegebenenfalls sogar existenzbedrohend sein. Obwohl die Verhängung von Vergabesperren seit langem praktiziert wird, hat sie auch im Zuge der Vergaberechtsreform im Jahr 2016 keine eindeutige Regelung erfahren. Diese Arbeit untersucht daher die rechtliche Zulässigkeit solcher Vergabesperren.
Die öffentliche Auftragsvergabe, die originär lediglich Beschaffungszwecken dient, wird seit einigen Jahren verstärkt zur Verfolgung anderer, häufig politischer Ziele eingesetzt. Schwerpunkt der Arbeit ist daher die Frage, ob eine Vergabesperre zur Verfolgung solcher öffentlicher Zwecke verhängt werden darf, die keinen unmittelbaren Zusammenhang zur Auftragsvergabe aufweisen. Von besonderer Bedeutung ist dabei der Einsatz der Vergabesperre als Sanktionsmittel.
