Humanizing the Laws of War
(2017)
Over the past 150 years, the International Committee of the Red Cross (ICRC) has been one of the main drivers of progressive development in international humanitarian law, whilst assuming various roles in the humanization of the laws of war. With select contributions from international experts, this book critically assesses the ICRC's unique influence in international norm creation. It provides a detailed analysis of the workings of the International Red Cross, Red Crescent Movement and ICRC by addressing the milestone achievements as well as the failures, shortcomings and controversies over time. Crucially, the contributions highlight the lessons to be learnt for future challenges in the development of international humanitarian law. This book will be of particular interest to scholars and students of international law, but also to practitioners working in the field of international humanitarian law at both governmental and non-governmental organizations
Over the years, the Security Council has on several occasions dealt with humanitarian assistance issues. However, it is Security Council Resolution 2165(2014), related to the situation in Syria, that has brought the role of the Security Council to the forefront of the debate. It is against this background that the article discusses the legal issues arising from Security Council action facilitating humanitarian assistance to be delivered in situations of non-international armed conflict.
Following a brief survey of relevant practice of the Security Council related to humanitarian assistance, the article considers the relevance, if any, of Article 2(7) of the Charter of the United Nations (UN) to humanitarian assistance to be delivered in such situations. It then moves on to analyse whether a rejection by the territorial state of humanitarian aid to be delivered by third parties may amount to a situation under Article 39 of the UN Charter. It then considers in detail whether (at least implicitly) Resolution 2165 has been adopted under Chapter VII and, if this is not the case, whether it can be still considered to be legally binding.
The article finally considers what impact the adoption of Security Council Resolution 2165 might have on the interpretation of otherwise applicable rules of international humanitarian law and, in particular, the right of third parties to provide humanitarian assistance in a situation of a non-international armed conflict in spite of the absence of consent by the territorial state, and the obligations that members of the Security Council, permanent and non-permanent, have under Common Article 1 of the Geneva Conventions when faced with a draft resolution providing for the delivery of humanitarian assistance, notwithstanding the absence of consent by the territorial state.
Die körperschaftsteuerliche Organschaft setzt den Abschluss eines Gewinnabführungsvertrages i.S.v. § 291 AktG zwischen Organgesellschaft und Organträger voraus und bedingt so Verflechtungen von Steuer- und Gesellschaftsrecht, die Anlass für Kritik an der Organschaft und für Bestrebungen zu deren grundlegender Modernisierung unter Verzicht auf den Gewinnabführungsvertrag geben.
Die Arbeit untersucht, welche kapital- und konzerngesellschaftsrechtlichen Problemstellungen zu Tage träten, sollte ein Gruppenbesteuerungssystem implementiert werden, das keinen Gewinnabführungsvertrag verlangt. Die Untersuchung erfolgt für verschiedene Reformmodelle, die – wie die Organschaft – nach der Zurechnungsmethode arbeiten oder eine Steuerkonsolidierung durch Leistung so genannter Gruppenbeiträge zulassen. Die auftretenden gesellschaftsrechtlichen Konfliktlagen und Lösungswege werden für Gruppenmitglieder in der Rechtsform der GmbH und der AG getrennt systematisch dargestellt.
Dem Unternehmenskauf geht eine langwierige Planungs- und Verhandlungsphase voraus. Dabei steht vor allem der gegenseitige Informationsaustausch beider Parteien im Vordergrund. Der Grundsatz der informationellen Selbstverantwortung zwingt zunächst jede Partei, die vorherrschende Informationsasymmetrie auf eigenes Risiko zu beseitigen. Das wird seitens der Rechtsprechung stets anhand von außervertraglichen Aufklärungspflichten zugunsten des Käufers korrigiert, wenn Treu und Glauben es im Einzelfall gebieten. Die Untersuchung widmet sich der Konkretisierung des Inhalts, der Reichweite und Rechtsfolgen der vorvertraglichen Aufklärungspflichten unter Auswertung bisher ergangener Rechtsprechung und Beiträgen im Schrifttum. Ein besonderes Augenmerk wird dabei neben dem Institut der culpa in contrahendo auf die Voraussetzungen der §§123, 444 BGB gelegt. Ferner wird die Bedeutung von Treu und Glauben gem. §242 BGB für die Entstehung von Aufklärungspflichten vor dem Hintergrund der spezifischen Interessenlage der Parteien und der Besonderheiten des Unternehmenskaufs beleuchtet.
Mit Inkrafttreten der NFA 2008 hat die Schweiz ihren Finanzausgleich umfassend reformiert und erstmals auch einen direkt umverteilenden Ausgleich zwischen den Kantonen geschaffen. Diese Reform blieb auf deutscher Seite weitgehend unbeachtet. Der Autor vergleicht zunächst die finanzverfassungsrechtlichen Grundstrukturen in beiden Ländern und erläutert das bestehende und das ab 2020 geltende deutsche System. Dem folgt eine umfassende Analyse des sekundären Finanzausgleichs in der Schweiz, sog. Finanzausgleich im engeren Sinn, mit ausführlicher Darstellung des Ressourcenausgleichs sowie des geografisch-topografischen und soziodemografischen Lastenausgleichs. Im Anschluss werden nach Problemschwerpunkten gegliedert Reformoptionen für Deutschland aufgezeigt. Der Autor plädiert insbesondere für einen nach Schweizer Vorbild gestalteten indikatorbasierten Lastenausgleich, um dem verfassungsrechtlichen Benennungs- und Begründungsgebot bei Sonderlasten besser gerecht zu werden.
Der konsularische Schutz

Anlässlich der Zunahme von Entführungen deutscher Staatsangehöriger im Ausland und des im Jahr 2009 ergangenen Urteils des Bundesverwaltungsgerichts zu diesem Thema legt die vorliegende Arbeit eine detaillierte und umfassende Analyse der Rechtsgrundlagen für die Gewährung konsularischen Schutzes durch die Auslandsvertretungen der Bundesrepublik Deutschland vor.
Das erste Kapitel beinhaltet eine detaillierte Darstellung der sich aus dem Völker-, Europa- und Verfassungsrecht sowie aus dem Konsulargesetz ergebenen staatlichen Handlungspflichten sowie möglicher damit einhergehender Individualansprüche auf die Ausübung konsularischen Schutzes im Einzelfall.
Im zweiten Kapitel werden die Voraussetzungen der Gewährung konsularischen Schutzes nach dem Konsulargesetz dargestellt. Den Schwerpunkt bildet hierbei die Bestimmung des Anwendungsbereiches des § 5 Abs. 1 Satz 1 Konsulargesetz unter Berücksichtigung des Urteils des Bundesverwaltungsgerichtes vom 28.05.2009, welches nach Auffassung der Verfasserin den Anwendungsbereich dieser Norm verkennt. Bei § 5 Abs. 1 Satz 1 Konsulargesetz handelt es sich um eine besondere sozialhilferechtliche Norm außerhalb der SGB XII, welche die konsularische Hilfe allein in wirtschaftlichen Notlagen regelt.
Das dritte Kapitel analysiert die bestehenden Regelungen über die Erstattung der im Rahmen der Gewährung konsularischen Schutzes entstandenen Kosten und erklärt deren Systematik. Ferner erfolgt ein Ausblick auf die künftigen Regelungen der Kostenerstattung nach dem Bundesgebührengesetz sowie der damit einhergehenden Rechtsverordnung.
Zum Abschluss werden die Ergebnisse anhand eines historischen Falles zusammengefasst sowie ein Gesetzesvorschlag vorgestellt, welcher die gefundenen Unklarheiten und Unstimmigkeiten im Konsulargesetz beheben kann.
Die Arbeit beschäftigt sich mit den Grundsätzen der wirtschaftlichen Betrachtungsweise im Steuerrecht, insbesondere im Grunderwerbsteuerrecht. Hierbei werden die historischen, dogmatischen und verfassungsrechtlichen Gesichtspunkte der wirtschaftlichen Betrachtungsweise beleuchtet. Im Anschluss werden diese Ergebnisse auf die Besonderheiten des Grunderwerbsteuergesetzes bezogen. Neben einer allgemeinen Darstellung grunderwerbsteuerrechtlicher Vorschriften, steht die Entwicklung und die verfassungsrechtliche Rechtfertigung der wirtschaftlichen Betrachtungsweise am Beispiel des § 1 Abs. 2a GrEStG im Mittelpunkt der Analyse. Die Gesetzesänderungen zu § 1 Abs. 2a GrEStG sowie die Entscheidungen des Bundesfinanzhofs aus den Jahren 2013, 2014 und 2015 werden in diesem Zusammenhang eingehend dargestellt und in Bezug auf die wirtschaftliche Betrachtungsweise und ihrer Bedeutung im Grunderwerbsteuergesetz erläutert.
Fluthilfe 2013

Die Abhandlung „Fluthilfe 2013 – Finanzierung der Hochwassernachsorge“ erläutert im ersten Hauptteil die verfassungsrechtlichen Probleme im Zusammenhang mit der Errichtung von staatlichen Sondervermögen, da der Bund solche Fonds jeweils nach den Hochwasserkatastrophen der Jahre 2002 und 2013 errichtete und mit einem Milliardenbudget ausstattete. Der zweite Hauptteil überprüft am Beispiel des Sondervermögens Aufbauhilfe 2013 die Kompetenzen von Bund und Ländern bei der Milderung und Beseitigung von öffentlichen und privaten Flutschäden. Daneben finden in der vorliegenden Abhandlung europarechtliche Bezüge, die Hochwasserprävention und -vorsorge sowie die Rechte und Pflichten von Staat und Bürgern im Falle einer Flutkatastrophe Berücksichtigung. Die Arbeit endet mit konkreten Änderungsvorschlägen zur verfassungsrechtlichen Kompetenzverteilung für den Bereich Hochwassernachsorge.
