Das Buch zeichnet die Wandlungen des Zusammenspiels zwischen Strafrecht und Gesellschaft vom Frühmittelalter bis 1990 nach. Akzentuiert wird das 20. Jahrhundert, namentlich das dem Terror unterstellte NS-Strafrecht, das sozialistische Umerziehungsstrafrecht der DDR und die bundesdeutsche NS-Aufarbeitung. Zielgruppe sind Jurastudierende sowie jeder interessierte Leser.

Die Aneignung von Falllösungskompetenz im Strafprozessrecht empfiehlt sich nicht nur für Rechtsreferendare, die sowohl in der Strafrechtsstation des Vorbereitungsdienstes als auch im zweiten Staatsexamen über solide Kenntnisse in diesem Rechtsgebiet verfügen müssen. Dieses Lehrbuch informiert umfassend über die examensrelevanten Straftatbestände des StGB, die Vermögen, Eigentum oder sonstige Vermögensgüter schützen. Der Text bereitet den Stoff systematisch auf und hebt dabei schwierige und umstrittene Einzelfragen durch ausführliche Darstellung der dazu vertretenen Meinungen deutlich hervor. Unterstützt wird der Lernprozess mittels zahlreicher Fallbeispiele mit Lösungshinweisen, die dem Benutzer Gelegenheit zu aktiven Übungen an Strafrechtsfällen geben. Der Leser sollte daher zunächst versuchen, die Fälle selbst zu lösen und danach den Text weiter lesen. Auch die am Ende jedes Kapitels gestellten „Kontrollfragen“ sind eine Aufforderung zur Überprüfung des Lernerfolges und gegebenenfalls Wiederholung der Lektüre. Über den Bereich des Besonderen Teils hinausgehende Repetitionseffekte verspricht das Buch dem Leser auf Grund der vielfältigen Bezugnahmen auf das Allgemeine Strafrecht, beispielsweise zu Fragen von Täterschaft und Teilnahme oder Versuch, Vollendung und Beendigung.
Das vorliegende Buch ist der Versuch einer etwas anderen Systematik der Stoffvermittlung, bei der die Vorgehensweise der Bearbeitung eines Strafrechtsfalles die Funktion des leitenden und strukturierenden roten Fadens hat. Die Fülle des strafrechtlichen Stoffes wird hier nicht streng nach AT und BT gegliedert, sondern danach, an welcher Stelle im Prozess der Bearbeitung eines Strafrechtsfalles etwas zum Tragen kommt. Daher sollte die Arbeit mit dem Buch den nicht zu unterschätzenden Nebeneffekt haben, mit der Vermehrung und Verfestigung des Strafrechtswissens zugleich den Rhythmus der strafrechtlichen Fallbearbeitung zu verinnerlichen. Von einem Lehrbuch unterscheidet sich das vorliegende Werk noch in einem zweiten Punkt, der gerade in der heißen Examensvorbereitungsphase von nicht zu unterschätzender Bedeutung ist: der behandelte Stoff wird begrenzt durch die Vorgaben der Juristenausbildungsordnungen der Bundesländer, die sich in dieser Hinsicht jedenfalls im Kern nur unwesentlich unterscheiden. Was nicht prüfungsrelevant ist, bleibt außen vor. Vor allem aus dem Besonderen Teil werden daher manche Tatbestände überhaupt nicht angesprochen, weil sie in allen oder den meisten Bundesländern nicht zum Prüfungsstoff gehören.

Das Lehrbuch behandelt die für Studium und Examen bedeutsamen Verbrechen und Vergehen aus dem Bereich der Nichtvermögensdelikte, wobei stets auch die Bezüge zum Allgemeinen Teil aufgezeigt werden. Die Darstellung erfolgt durchgehend anhand von Fällen und Beispielen und enthält eingehende Problembehandlungen. Band 1 bildet zusammen mit dem ebenfalls neu bearbeiteten Studienbuch Krey/Hellmann/Heinrich, Besonderer Teil, Band 2 (zu den Vermögensdelikten) ein gründliches und aktuelles Standardwerk zum Besonderen Teil. Das Buch richtet sich an Anfänger, denen es eine gründliche Einführung bietet, aber auch an Fortgeschrittene, Referendare und Praktiker zur Wiederholung, Ergänzung und Vertiefung.
Umweltstrafrecht

Die Verwaltungsrechtsakzessorietät ist der prägende Begriff des Umweltstrafrechts. Bei näherem Hinsehen verbergen sich dahinter aber sehr verschiedene Dinge. Die einfachste Aussage könnte lauten: Ohne Umweltrecht kein Umweltstrafrecht. Das besagt für sich genommen aber kaum mehr, als dass sich ein Bereich des Verwaltungsrechts mit der Umwelt beschäftigt und dass das Strafrecht Tatbestände enthält, welche diesen verwaltungsrechtlichen Bereich betreffen. Die Verwaltungsrechtsakzessorietät ist indes weit konkreter und behandelt die Frage, ob und wann und auf welche Weise das Strafrecht an Begriffe und Verfahrensergebnisse des Verwaltungsrechts gebunden ist. Wer aber von dem öffentlich-rechtlichen Umweltrecht keine konkreten Vorstellungen hat, wird schwerlich die Einzelfragen der Akzessorietät im Allgemeinen und anhand des jeweiligen Straftatbestandes im Besonderen beurteilen können. In diesem Sinne gilt der Satz: Ohne Umweltrecht kein Umweltstrafrecht. Da kein einheitliches Umweltgesetzbuch existiert, sieht sich der Rechtsanwender mit verstreuten Vorschriften konfrontiert, die aufgefunden und zueinander ins Verhältnis gesetzt werden wollen. Das wird durch ein Grundverständnis für die Rechtsgebiete und deren Funktionsweise ermöglicht, was insbesondere für den Bereich des Verwaltungsrechts gilt. Aus der Perspektive des Strafrechts flankiert § 330d StGB i. V. m. den jeweiligen Straftatbeständen die zu bewältigende Aufgabe, indem dort für das Strafrecht bedeutsame Anknüpfungspunkte hervorgehoben und modifiziert werden. Ein Gesamtbild ergibt sich aus § 330d StGB und den Delikten aber bei weitem nicht.

Das Recht auf ein faires Verfahren gemäß Art. 6 der Europäischen Menschenrechtskonvention (EMRK) gewährleistet nach der ständigen Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte die Fairness des Verfahrens insgesamt (»overall fairness«). Verkürzungen einzelner Verteidigungsrechte des Angeklagten können danach unter bestimmten Voraussetzungen innerhalb des Verfahrens ausgeglichen werden. Anna H. Albrecht leitet aus diesem Maßstab der Gesamtfairness ab, dass sich das nationale Strafverfahrensrecht und die Anforderungen des Art. 6 Abs. 1 und 3 EMRK an ebendieses wechselseitig beeinflussen. Sie analysiert, inwieweit der Gerichtshof solche Wechselwirkungen anzuerkennen bereit ist, und arbeitet sie am Beispiel des Rechts des Angeklagten auf Anwesenheit in der erstinstanzlichen Hauptverhandlung heraus, indem sie das einschlägige englische und deutsche Recht vergleicht und in Beziehung zu der entsprechenden Gewährleistung in Art. 6 Abs. 1, 3 EMRK setzt.
