Cyber warfare is a timely and relevant issue and one of the most controversial in international humanitarian law (IHL). The aim of IHL is to set rules and limits in terms of means and methods of warfare. In this context, a key question arises: Has digital warfare rules or limits, and if so, how are these applicable? Traditional principles, developed over a long period, are facing a new dimension of challenges due to the rise of cyber warfare. This paper argues that to overcome this new issue, it is critical that new humanity-oriented approaches is developed with regard to cyber warfare. The challenge is to establish a legal regime for cyber-attacks, successfully addressing human rights norms and standards. While clarifying this from a legal perspective, the authors can redesign the sensitive equilibrium between humanity and military necessity, weighing the humanitarian aims of IHL and the protection of civilians-in combination with international human rights law and other relevant legal regimes-in a different manner than before.
This introductory essay is structured as follows: First of all, several forms of urbanisation (I.) are introduced and the processes of urbanisation and dis-urbanisation (II.) are defined. Then four fields of law which are deeply affected by urbanisation are put into the focus. These are, local government law (III.), but also public building law (IV.), civil service law (V.) and public finance law (VI.). Afterwards the effects of the corona pandemic on these fields of law are contemplated, taking account of the process of urbanisation (VII.). Finally, the main results are summarised (VIII.).
Landesrechtsverordnungen auf bundesgesetzlicher Grundlage und verordnungsvertretende Landesgesetze

Bislang gehört Art. GG Artikel 80 Abs. GG Artikel 80 Absatz 4 GG zu den vergessenen Normen des Grundgesetzes. Er ermöglicht, dass anstelle einer Landesrechtsverordnung auf der Grundlage eines Bundesgesetzes auch ein Landesgesetz erlassen werden kann. Einst eingefügt, um die Landesparlamente zu stärken, erwacht er erst im Zuge der Coronakrise aus seinem Dornröschenschlaf. Angesichts immer neuer grundrechtseinschränkender Verordnungen der Landesregierungen stellen sich gerade angesichts dieser Vorschrift die Fragen, ob und wann der jeweilige Landtag darüber zu informieren ist, welche weiteren Mitwirkungsrechte ihm zustehen und ob zum verordnungsvertretenden Landesgesetz gegriffen werden sollte.
Das Parlament stellt den zentralen Ort politischer Entscheidungsbildung dar.1 Die Erfüllung seiner Aufgaben der Gesetzgebung, der Wahl und Kontrolle der Regierung und anderer Verfassungsorgane, des Haushaltsbeschlusses und schließlich auch der Mitwirkung an der Verfassungsänderung sind unabdingbar für das Gelingen des demokratischen Rechtsstaates. Auch unter den Gefahren einer Pandemie ist daher unter allen Umständen die Funktionsfähigkeit des Parlaments aufrecht zu erhalten (I.). Dabei bieten sich neben technischen (II.) auch rechtliche (III.) Lösungen an, was zur Forderung nach einem parlamentarischen Notausschuss führt (IV.). Eine Zusammenfassung rundet die Darstellung ab (V.).
Die Corona-Pandemie stellt nicht nur eine medizinische, sondern auch eine ökonomische Notlage dar. Möglicherweise mündet sie auch in eine juristische Krise ein, wenn es nicht gelingen sollte, ihre finanziellen Auswirkungen rechtlich adäquat zu bewältigen. Dies betrifft nicht nur Arbeitnehmer, die in Kurzarbeit gehen, sondern gerade auch die Inhaber von Betrieben, die pandemiebedingt schließen müssen.
Im Folgenden sollen überblicksartig die Möglichkeiten untersucht werden, eine Entschädigung für solche Betriebsschließungen zu erhalten. Zu diesem Zweck werden zunächst die Ansprüche nach dem Infektionsschutzgesetz erörtert (I.), bevor die gefahrenabwehrrechtlichen Ansprüche (II.) sowie Ansprüche aus dem allgemeinen Staatshaftungsrecht (III.) untersucht werden. Dies leitet zu den Fragen über, ob zumindest Bestimmungen aus dem Infektionsschutzgesetz analog angewandt werden können (IV.) oder ob die Betriebsinhaber allein auf die staatlichen Hilfsprogramme zu verweisen sind (V.). Eine Schlussbetrachtung rundet die Darstellung ab (VI.).
Der doppelte Abgeordnete

Das Abgeordnetenmandat hat sich in den letzten Jahrzehnten von einer Honoratiorentätigkeit zu einem Beruf gewandelt, was zu der Frage führt, ob Abgeordnete zugleich Mitglied in mehreren Parlamenten sein können (I), welche das BVerfG im Jahre 1976 noch bejahte (II). Im Lichte neuerer Entwicklungen ist diese Rechtsprechung jedoch kritisch zu beleuchten (III), woraus Folgerungen für eine ausdrückliche verfassungsrechtliche Regelung zu ziehen sind (IV).
Not kennt kein Gebot, aber Kreditaufnahme kennt Grenzen. Im Zuge der Corona-Pandemie ist es unter Berufung auf diese außergewöhnliche Notsituation zu Kreditaufnahmen des Bundes in bislang ungeahnter Höhe gekommen. Dies wirft vor dem Hintergrund der grundgesetzlichen Schuldenbremse und ihrer formellen Vorgaben die Frage auf, welche zeitlichen, sachlichen und weiteren Grenzen der Kreditaufnahme bei Notsituationen und Naturkatastrophen gelten. In diesem Zusammenhang kommen dem Subsidiaritätsprinzip, föderalen Gesichtspunkten und der europarechtlichen Überformung der Kreditaufnahme besondere Bedeutung zu.
Die Grundsteuer erbringt derzeit etwa 14 Mrd. € jährlich für die Gemeindekassen. Zugleich stellt ihre verfassungskonforme Ausgestaltung angesichts des Urteils des BVerfG vom 10.04.2018, mit dem die bisherigen Bewertungsregelungen für verfassungswidrig erklärt wurden, eine besondere Herausforderung dar. Im Folgenden werden zunächst die Ausgangslage dieser Entscheidung (I.) und das Urteil selbst skizziert (II.), bevor auf die sich daraus ergebende Grundgesetzänderung (III.) und das neue Grundsteuer- und Bewertungsrecht des Bundes (IV.) eingegangen wird. Es folgt eine Darstellung der verschiedenen teils bereits beschlossenen, teils noch im Gesetzgebungsverfahren befindlichen Landesgesetze (V. bis VII.). Sodann werden weitere Folgen der Grundsteuerreform angesprochen (VIII.) und schließlich die wesentlichen Aussagen dieses Beitrages zusammengefasst (IX.).
Das öffentliche Finanzrecht ist für viele Studierende ein Buch mit sieben Siegeln. Da die Corona-Krise sich aber auch zu einer Krise der öffentlichen Haushalte entwickelt, erscheint es umso dringender, zumindest einige Schneisen in das Dickicht dieses Rechtsgebiets zu schlagen. So werden im Folgenden zunächst die wesentlichen Inhalte des öffentlichen Finanzrechts skizziert (I.) und seine Hauptaufgabe, die Erfüllung der öffentlichen Aufgaben dauerhaft zu gewährleisten, beschrieben (II.). Es folgen Überblicke über die Verteilung der staatlichen Ausgaben (III.) und Einnahmen (IV.). Beide sind zum Ausgleich zu bringen, was die Aufgabe des Haushaltsrechts ist (V.). Schließlich wird der Finanzausgleich zwischen Bund und Ländern als ergänzendes Instrument des öffentlichen Finanzrechts umrissen (VI.). Eine Zusammenfassung rundet die Darstellung ab (VII.). Ausgeblendet werden muss dabei an dieser Stelle das Europäische Finanzrecht.
This chapter consists of three parts. In the first part, I will give a short overview about the integration of the protection of the environment into German constitutional law. This section will start with the presentation of the relevant provision, Art. 20a BL. Then, I will elaborate on its legal character. In the second part, I will make some brief remarks on the practical implications of Art. 20a BL. Finally, I will present some preliminary conclusions.
Would the world be a better place if one were to adopt a European approach to state immunity?

This chapter argues not only that there is no European Sonderweg (or ‘special way’) when it comes to the law of state immunity but that there ought not to be one. Debates within The Hague Conference on Private International Law in the late 1990s and those leading to the adoption of the 2002 UN Convention on Jurisdictional Immunities of States, as well as the development of the EU Brussels Regulation on Jurisdiction and Enforcement, as amended in 2015, all demonstrate that state immunity was not meant to be limited by such treaties but ‘safeguarded’. Likewise, there is no proof that regional European customary law limits state immunity when it comes to ius cogens violations, as Italy and (partly) Greece are the only European states denying state immunity in such cases while the European Court of Human Rights has, time and again, upheld a broad concept of state immunity. It therefore seems unlikely that in the foreseeable future a specific European customary law norm on state immunity will develop, especially given the lack of participation in such practice by those states most concerned by the matter, including Germany. This chapter considers the possible legal implications of the jurisprudence of the Italian Constitutional Court for European military operations (if such operations went beyond peacekeeping). These implications would mainly depend on the question of attribution: if one where to assume that acts undertaken within the framework of military operations led by the EU were to be, at least also, attributable to the troop-contributing member states, the respective troop-contributing state would be entitled to enjoy state immunity exactly to the same degree as in any kind of unilateral military operations. Additionally, some possible perspectives beyond Sentenza 238/2014 are examined, in particular concerning the redress awarded by domestic courts ‘as long as’ neither the German nor the international system grant equivalent protection to the victims of serious violations of international humanitarian law committed during World War II. In the author’s opinion, strengthening the jurisdiction of international courts and tribunals, bringing interstate cases for damages before the International Court of Justice, as well as providing for claims commissions where individual compensation might be sought for violations of international humanitarian law would be more useful and appropriate mechanisms than denying state immunity.
Legal shades of grey?

As part of the current process of de-formalization in international law, States increasingly chose informal, non-legally binding agreements or 'Memoranda of Understanding' ('MOUs') to organize their international affairs. The increasing conclusion of such legally non-binding instruments in addition to their flexibility, however, also leads to uncertainties in international relations. Against this background, this article deals with possible indirect legal consequences produced by MOUs. It discusses the different legal mechanisms and avenues that may give rise to such secondary legal effects of MOUs through a process of interaction with, and interpretation in line with, other (formal) sources of international law. The article further considers various strategies how to avoid such eventual possible unintended or unexpected indirect legal effects of MOUs when drafting such instruments and when dealing with them subsequent to their respective 'adoption'.
This paper examines the attempts of implement-ing components of the concept called Civiliza-tional Hexagon as a pathway to civilizing conflict in the Sub-Saharan Africa in the post-Cold War period. Despite significant decline in the violent conflict and substantial progress socio-economic aspects in the period, most states in the region have been facing challenges in their way to civilize conflict related to absence of inclusive political system, weak state unable to monopolize the use of violence in its territory, and social injustice. On the other hand, states like Botswana and Mauritius managed to civilize conflict through significant improvement in democratic consolidation. Besides their relative success in implementing six elements, these states enabled to integrate traditional institutions with modern state apparatus that helped them to fill the gap created as result of exogenous state formation process and the resulting unfinished nation-building project. Additionally, traditional institutions contributed to managing diversity.
Die Gestaltungsfreiheit des Steuerpflichtigen steht in einem Spannungsverhältnis zu einer effektiven Missbrauchsbekämpfung durch den Gesetzgeber. Besonders ausgeprägt ist dieses im Bereich der steuerlichen Verlustnutzung. Dabei gerät die verfassungsrechtliche Verankerung der Verlustnutzung zunehmend aus dem Blick. Am Beispiel des § 2 Abs. 4 UmwStG untersucht die Arbeit die verfassungsrechtlichen Grenzen von Verlustverrechnungsbeschränkungen. Es wird die enge Verknüpfung zu § 8c KStG herausgearbeitet und die Vorschrift vor dem Hintergrund der europäischen Missbrauchskonzeption beleuchtet. Die gewonnenen Ergebnisse münden in einen Vorschlag für eine Neufassung des § 2 Abs. 4 UmwStG, der nationalen und europäischen Vorgaben Rechnung trägt.
Digitalisierung ist das Schlagwort unserer Zeit und kaum ein Lebensbereich bleibt davon unberührt. Für den Einzelnen, die Gesellschaft, die Unternehmen und den Staat bietet sie immense Chancen. Die weiterhin nicht überstandene COVID-19-Pandemie führt dazu, dass dem digitalen Wandel in bisher ungeahnter Geschwindigkeit eine enorme praktische Bedeutung zukommt. Vor diesem Hintergrund erfolgt mit der Untersuchung ein Rechtsvergleich der Besteuerungsverfahren Österreichs und Deutschlands. Ziel ist es, über das Verfahren im Nachbarland zu informieren und die Unterschiede zum deutschen Recht pointiert herauszuarbeiten. Für Deutschland resultiert daraus die Chance, Konzepte und Lösungen der österreichischen Finanzverwaltung bei der Fortentwicklung von E-Government auszuwerten und sowohl von den positiven wie auch negativen Erfahrungen zu profitieren. So können konkrete Reformvorschläge für das deutsche Besteuerungsverfahren erarbeitet und die daraus resultierenden Chancen dargestellt werden.

The anniversaries of the 1970 Warsaw and the 1990 2+4 Treaties give occasion to revisit the matter of minority protection in German-Polish relations. The interwar system established a problematic unevenness that tainted its acceptance, particularly from the Polish perspective. After 1990 the minority issues achieved an increased, albeit moderate, relevance in German-Polish relations. To some extent the 1991 Polish-German Treaty on Good Neighbourly Relations and Friendly Co-operation retains the unevenness of the inter-war period, as Art. 20(1) recognizes a German minority in Poland, but refuses to acknowledge a Polish minority in Germany. However, currently the thorniest issues concern various situations related to the “Silesians” in Poland, which the Polish government does not recognize as a protected minority under the European Council Framework Convention for the Protection of National Minorities.

Volle Souveränität?

Nach Art. 7 Abs. 1 S. 1 des Vertrages zur abschließenden Regelung in Bezug aufDeutschland vom 12. September 1990 (Zwei-plus-Vier-Vertrag)1beendeten die Fran-zösische Republik, die Union der Sozialistischen Sowjetrepubliken, das VereinigteKönigreich Großbritannien und Nordirland und die Vereinigten Staaten von Ameri-ka„ihre Rechte und Verantwortlichkeiten in Bezug auf Berlin und Deutschland alsGanzes“. Dies hatte, wie in dessen Art. 7 Abs. 1 S. 2 ausdrücklich niedergelegt, zurFolge, dass„die entsprechenden, damit zusammenhängenden vierseitigen Verein-barungen, Beschlüsse und Praktiken beendet und alle entsprechenden Einrichtun-gen der vier Mächte aufgelöst“wurden.2Art. 7 Abs. 2 Zwei-plus-Vier-Vertrag stelltdemgemäß fest, dass das vereinte Deutschland volle Souveränität über seine inne-ren und äußeren Angelegenheiten erhalten habe. Nach dem Wortlaut des Vertrageshaben die Alliierten damit jegliche Rechte in Bezug auf Deutschland abgegeben,rechtliche Auswirkungen der Besatzungsgeschichte Deutschlands noch bis in dieheutige Zeit scheinen danach zunächst ausgeschlossen.In dem folgenden Beitrag soll diese aus heutiger Sicht selbstverständlich er-scheinende Hypothese kritisch hinterfragt und der Frage nachgegangen werden, obund inwieweit die Besatzungsgeschichte Deutschlands noch immer rechtliche Fol-gen zeitigt. Hierbei soll insbesondere auf Fragen der Fortgeltung alliierten Rechts,Eigentumsfragen sowie auf Fragen der Nachfolge in völkerrechtlichen Verträgeneingegangen werden.
Digitales Versammlungsrecht?

Das Grundrecht der Versammlungsfreiheit ist bekanntermaßen entwicklungsoffen. Geschützt werden also nicht nur historisch gewachsene „klassische“ Versammlungstypen. Immer wieder zeigen sich neuartige Erscheinungsformen, die es in den Schutzbereich des Art. GG Artikel 8 GG einzuordnen gilt. Aus jüngerer Zeit sind etwa Flashmobs oder Demonstrationen auf Schienen zur Fussnote 1 und mit Wohnmobilen zur Fussnote 2 zu nennen. Diskutiert werden auch Online-Versammlungen, bei denen die Teilnehmenden vollständig auf ein körperliches Zusammentreffen verzichten und sich nur virtuell via Computer oder Smartphone zusammenschalten. Angesichts absoluter und relativer Versammlungsverbote in coronabedingten Lockdowns zur Fussnote 3 steht mehr denn je die verfassungsrechtliche Dimension dieserart nichtphysischer Zusammentreffen im Streit. Der Beitrag befasst sich daher mit der Frage, ob die Versammlungsfreiheit des Art. GG Artikel 8 GG im digitalen Zeitalter auch eine virtuelle Seite hat.

Securitas libertatis

The question of the relationship between freedom and security is characteristic of the discourse in times of crisis. In the coronavirus pandemic, too, society is faced with the challenge of how a democratic order can overcome the security crisis while preserving its fundamental principles, such as individual freedom as a highest value. This article explores this question. Following Axel Honneth, it is based on a social concept of freedom, which understands a social coexistence of people in security as essential for freedom in general. Freedom and security are interpreted dialectically and are accordingly not regarded as bipolar opposites, but as a unity. Considering deontological and consequentialist approaches, the text simultaneously assumes a primacy of social freedom. This is due to its dialectical nature. Because of its social character, freedom also implies mutual responsibility between individuals.
In February 2020, the Inter-American Court of Human Rights (IACtHR) delivered a landmark decision in which it held Argentina responsible for the violation of several rights of 132 indigenous communities inhabiting a certain area in the province of Salta. In the Case of the Indigenous Communities of the Lhaka Honhat (Our Land) Association v. Argentina the IACtHR declared for the first time an autonomous violation of the right to a healthy environment and other DESCA (Economic, Social, Cultural and Environmental rights). Thereby, it further developed its case law on the direct justiciability of DESCA on the basis of Article 26 of the American Convention on Human Rights (ACHR) that was first established in Lagos del Campo in 2017. Focusing on the right to a healthy environment and the right to water the authors critically examine how the Court derived the direct justiciability of DESCA. In the following, the contribution examines to what extent the right to a healthy environment has been specified in the current judgment compared to the initial outline of this right by the Court in its Advisory Opinion No. 23. The analysis also deals with the question whether the facts of the case were at all suitable for such a specification and what general value could be added by an autonomous examination of DESCA. Finally, the contribution ends with a mixed conclusion on the significance of the judgment and a thoughtful outlook on the future development of the case law on Art. 26 ACHR.
§ 4 Kommunalrecht

Vertragsgestaltung ist ein praktisch sehr relevantes Thema, das wegen der Justizorientierung in der Wissenschaft noch weitgehend stiefmütterlich behandelt wird. In dieser Untersuchung wird, zumindest für die besonders delikate Konstellation bei komplexen Kooperationen des Staats mit Privaten (ÖPP/PPP), Abhilfe geschaffen. Dabei gründet die Analyse auf einer fundierten Typisierung und Charakterisierung der Probleme solcher Projekte. Den theoretischen Rahmen liefert eine effizienzorientierte Studie institutionenökonomischer Ansätze, namentlich der Transaktionskostentheorie und der Prinzipal-Agenten-Theorie, rückversichert über die praxisorientierten Grundregeln der vertraglichen Risikoverteilung. So gelingt es praktische Formulierungsvorschläge für Standardprobleme der Vertragsgestaltung, wie Leistungsbestimmungen, Anpassungsmechanismen, Konfliktbeilegungsregeln, Informationsmechanismen und Kündigungsregeln zu finden. Diese werden auch aus den Erfolgsbedingungen erläutert.
Die Organisation der Prüfung der Jahresrechnung in der gesetzlichen Rentenversicherung (Teil 3)

Die in den letzten beiden Heften der SGb abgedruckten Teile I (SGb 2021, 65 ff.) und II (SGb 2021, 135 ff.) des Beitrages haben einen Überblick über den Status quo der Prüfung der Jahresrechnung in der gesetzlichen Rentenversicherung sowie über aktuelle Reformvorschläge des Bundesrechnungshofes (BRH) und der Deutschen Rentenversicherung Bund (DRV Bund) gegeben (s. Der Beitrag hat gezeigt, dass die langjährige Praxis der Prüfung der Jahresrechnung durch die Innenrevisionen der Rentenversicherungsträger verfassungs- und sozialversicherungsrechtlich zulässig ist, wohingegen die Reformvorschläge des BRH (trägerübergreifende Prüfstelle bei der DRV Bund) und der DRV Bund („Koordinierungsstelle“ bei der DRV Bund) gegen geltendes Sozialversicherungsrecht verstoßen und unvereinbar sind mit Verfassungsrecht (s. Ziff. IV. 1. bis 3.). Vor diesem Hintergrund widmet sich Teil III des Beitrages rechtlich zulässigen Alternativen für eine Neuorganisation der Prüfung der Jahresrechnung in der gesetzlichen Rentenversicherung (s. Ziff. IV. 4.). Der Beitrag schließt mit einer Zusammenfassung der Ergebnisse (s. Ziff. V.).

Der im vorhergehenden Heft der SGb (SGb 2021, 65 ff.) abgedruckte Teil I des Beitrages hat einen Überblick über den Status quo der Prüfung der Jahresrechnung in der gesetzlichen Rentenversicherung sowie über aktuelle Reformvorschläge des Bundesrechnungshofes (BRH) und der Deutschen Rentenversicherung Bund (DRV Bund) gegeben (s. Ziff. I.). Zudem wurden die verfassungsrechtlichen (s. Ziff. II.) und sozialversicherungsrechtliche (s. Ziff. III. 1. bis 4.) Anforderungen an die Prüfung der Jahresrechnung erarbeitet. Teil II des Beitrages knüpft hieran an und widmet sich weiteren sozialversicherungsrechtlichen Anforderungen an die Prüfung der Jahresrechnung (s. Ziff. III. 5. und 6.). Er zeigt, dass die langjährige Praxis der Prüfung der Jahresrechnung durch die Innenrevisionen der Rentenversicherungsträger verfassungs- und sozialversicherungsrechtlich zulässig ist, wohingegen die Reformvorschläge des BRH (trägerübergreifende Prüfstelle bei der DRV Bund) und der DRV Bund (Koordinierungsstelle bei der DRV Bund) gegen geltendes Sozialversicherungsrecht verstoßen und unvereinbar mit Verfassungsrecht sind (s. In der gesetzlichen Rentenversicherung wird die Jahresrechnung in langjähriger Praxis durch die Innenrevision des jeweiligen Trägers geprüft. Der Bundesrechnungshof (BRH) fordert eine Reform der Prüfung der Jahresrechnung und hat deshalb das Bundesministerium für Arbeit und Soziales (BMAS) aufgefordert, den Rentenversicherungsträgern durch Verordnung aufzugeben, ihre Jahresrechnung künftig durch eine unabhängige, bei der Bundesvertreterversammlung der Deutschen Rentenversicherung Bund (DRV Bund) anzugliedernde trägerübergreifende Prüfstelle prüfen zu lassen. Ein alternativer Reformvorschlag der DRV Bund sieht eine Errichtung einer Koordinierungsstelle in ihrem Grundsatz- und Querschnittsbereich vor, welche die wechselseitige Prüfung der Jahresrechnung durch die Rentenversicherungsträger planen und koordinieren soll. Der dreiteilige Beitrag zeigt, dass sich beide Reformvorschläge aus verfassungs- und sozialversicherungsrechtlichen Gründen nicht realisieren lassen, wohingegen der Status quo der Prüfung der Jahresrechnung rechtlich zulässig ist. Teil I des Beitrages schildert zunächst die aktuelle Praxis der Prüfung der Jahresrechnung der Rentenversicherungsträger und stellt Reformvorschläge dar (s. Ziff. I.). Anschließend werden die verfassungsrechtlichen (s. Ziff. II.) und sozialversicherungsrechtliche (s. Ziff. III. 1. bis 4.) Anforderungen an die Prüfung der Jahresrechnung erarbeitet. Teil II des Beitrages setzt mit weiteren sozialversicherungsrechtlichen Anforderungen an die Prüfung der Jahresrechnung fort (s. Ziff. III. 5. und 6.) und zeigt, dass die Jahresrechnungsprüfung durch die Innenrevisionen der Rentenversicherungsträger dem geltenden Verfassungs- und Sozialversicherungsrecht entspricht (Status quo), während die Reformvorschläge des BRH und der DRV Bund verfassungs- und sozialversicherungsrechtlich unzulässig sind (s. Ziff. IV. 1. bis 3.). In Teil III werden rechtlich zulässige Alternativen für eine Neuorganisation der Prüfung der Jahresrechnung entwickelt (s. Ziff. IV. 4.). Werbeblocker berühren zahlreiche, bislang ungeklärte Rechtsfragen. Während Werbeblocker bisher vor allem anhand des Lauterkeitsrechts beurteilt worden sind, zeigt diese Arbeit, dass vielmehr urheberrechtliche Wertungen entscheidend sind. Diese werden mit Blick auf die aktuelle Rechtsprechung des EuGH ausführlich hergeleitet.
Weiterhin wird der Begriff des Mitbewerbers im Lauterkeitsrecht fortentwickelt und mit der Bezugnahme auf die geschäftlichen Entscheidung auf ein neues Fundament gestellt.
Die Arbeit analysiert zudem umfassend die Rechtmäßigkeit der Handlungsalternativen der Webseitenbetreiber und der Reaktionsmöglichkeiten der Werbeblocker aus lauterkeitsrechtlicher und urheberrechtlicher Sicht unter Berücksichtigung der DS GVO.
