Animal Welfare Versus Commercial Animal Use. Commercial Use of Animals Outside Agriculture: The forms of commercial animal use beyond agriculture are diverse. This includes, for example, circuses and working with film animals. However, the associated animal welfare problems have so far not been discussed in great detail. The authorities work mainly with non-binding expert opinions instead of legal regulations. The various instruments of the executive branch in this area will be dealt with, as well as possible new perspectives for animal protection law - and its limits.

While public–private partnerships (PPPs) have surged worldwide since the 1990s, they have been met with growing skepticism during the last years. A recent revision of Germany’s constitutional rules on motorway construction and observations on the use of PPPs published by both the German and the European Courts of Auditors illustrate this new caution. These two examples fit into a general trend towards a revival of the public sector, which can be summarized under the cross-level umbrella term “publicization.” It would, however, be remiss to replace the uncritical euphoria that once surrounded privatization with a similarly undifferentiated euphoria regarding publicization. Rather, it is crucial to identify the most appropriate solution for the fulfilment of each public task from the “toolbox” of publicization on the one hand and privatization on the other hand in order to ensure the most effective completion of public functions.
In February 2020, the Inter-American Court of Human Rights (IACtHR) delivered a landmark decision in which it held Argentina responsible for the violation of several rights of 132 indigenous communities inhabiting a certain area in the province of Salta. In the Case of the Indigenous Communities of the Lhaka Honhat (Our Land) Association v. Argentina the IACtHR declared for the first time an autonomous violation of the right to a healthy environment and other DESCA (Economic, Social, Cultural and Environmental rights). Thereby, it further developed its case law on the direct justiciability of DESCA on the basis of Article 26 of the American Convention on Human Rights (ACHR) that was first established in Lagos del Campo in 2017. Focusing on the right to a healthy environment and the right to water the authors critically examine how the Court derived the direct justiciability of DESCA. In the following, the contribution examines to what extent the right to a healthy environment has been specified in the current judgment compared to the initial outline of this right by the Court in its Advisory Opinion No. 23. The analysis also deals with the question whether the facts of the case were at all suitable for such a specification and what general value could be added by an autonomous examination of DESCA. Finally, the contribution ends with a mixed conclusion on the significance of the judgment and a thoughtful outlook on the future development of the case law on Art. 26 ACHR.
Der BGH schreibt die ueberlieferte Rechtsfigur der verdeckten Sasheinlage im Aktienrecht noch einmal zusammenfassend fest. Tilman Bezzenberger (JZ 2007, 946) stimmt dem Urteil im Ergebnis und in der Begruendung zu, ruft aber auch in Erinnerung, dass der Gerechtigkeitsgehalt der zu Grunde liegenden Gesetzesregeln fragwuerdig ist.
Der Beitrag legt dar, dass Kitas und Schulen während der Corona-Pandemie von Behörden undGerichten wie andere grundrechtlich geschützte Lebensbereiche behandelt wurden. Im Zweifelrechtfertigte die staatliche Schutzpflicht für Leben und Gesundheit schwere Grundrechtsein‐griffe. Kitas und Schulen sind jedoch in einem Land, dessen Wohlstand vom Erziehungs- und Bildungsgrad seiner Bevölkerung abhängt und dessen Gesellschaft in vielerlei Hinsicht hetero‐gen ist, eine besonders wichtige Infrastruktur, deren Funktionen im Rahmen behördlicher undgerichtlicher Entscheidungen zur Pandemiebekämpfung genauer ermittelt und stärker gewichtet werden müssen, als dies bisher geschehen ist.
Das Bundes-Klimaschutzgesetz (KSG) sieht jährlich sinkende Treibhausgasemissionsmengen vor. Gemäß § KSG § 3 Abs. KSG § 3 Absatz 2 Satz 1 KSG soll 2045 Netto-Treibhausgasneutralität erreicht sein, d.h. ein Gleichgewicht zwischen den anthropogenen Emissionen von Treibhausgasen aus Quellen und dem Abbau solcher Gase durch Senken. Unausgesprochene Grundlage der Vorgaben ist ein auf Deutschland entfallendes CO 2 -Budget. Der Sachverständigenrat für Umweltfragen (SRU) empfiehlt der Bundesregierung, ein solches Budget zu benennen, um die gesetzlichen Klimaschutzmaßnahmen besser bewerten zu können. Fraglich ist jedoch, wie groß dieses Budget ist, ob es verbindlich festgelegt ist und ob es sich um ein Instrument der Freiheitssicherung handelt oder die Gefahr der Freiheitsstrangulierung besteht.
