In den USA und auch in Deutschland fordern Schwarze Menschen ihr verfassungsmäßiges Recht ein, nicht durch den Staat diskriminiert, verfolgt und ermordet zu werden. Sie wollen, dass Schwarze Leben in weiß dominierten Gesellschaften zählen. In der öffentlichen Diskussion jedoch scheint daran gezweifelt zu werden, dass Rasse als Rechtsbegriff und Marker von Zugehörigkeit von Bedeutung ist – was sich auch in den Forderungen widerspiegelt, den Begriff aus dem Grundgesetz zu streichen.
Draft Article 15 of the International Law Commission’s project on crimes against humanity — dealing with the settlement of disputes arising from a proposed convention — attempts to strike a balance between state autonomy and robust judicial supervision. It largely follows Article 22 of the Convention on the Elimination of All Forms of Racial Discrimination, which renders the jurisdiction of the International Court of Justice (ICJ) conditional upon prior negotiations. Hence, the substance of the clause can be interpreted in light of the recent case law of the ICJ, especially in the case Georgia v. Russia. In addition, this contribution discusses several issues regarding the scope ratione temporis of the compromissory clause. It advances several proposals to improve the current draft, addressing its relationship with state responsibility — an explicit reference to which is currently missing — as well as the relationship between the ICJ and a possible treaty body. It also proposes to recalibrate the interplay of the requirement of prior negotiations with, respectively, the possibility of seizing a future treaty body and the indication of provisional measures by the ICJ.

In its Burmych and Others v. Ukraine judgment of October 2017 the European Court of Human Rights dismissed more than 12,000 applications due to the fact that they were not only repetitive in nature, but also mutatis mutandis identical to applications covered by a previous pilot judgment rendered against Ukraine. This raises fundamental issues as to the role of the Court within the human rights protection system established by the European Convention on Human Rights, as well as those concerning the interrelationship between the Court and the Committee of Ministers.
Compliance with EU biofuel targets in South-Eastern and Eastern Europe: Do interest groups matter?

The European Union requires its member states to establish national targets for the biofuel content of all diesel and petrol supplies for transport placed on the market. This study explores the adoption of this European Union policy across South-Eastern and Eastern Europe between 2003 and 2012. In theoretical terms, we are specifically interested in examining the role of interest groups for policy adoption. We argue that the oil industry in general and the producers of biofuels in particular will support the establishment of national biofuel targets because they expect economic gains. By contrast, we expect environmental groups with international and regional ties to oppose such targets because biofuels have come under attack for their potential environmental impact including deforestation, a loss in biodiversity, and food insecurity. Empirically, we concentrate on policy adoptions in 21 South-Eastern and Eastern European states with varied relations to the European Union and the Energy Community. Our analysis supports our main arguments in suggesting that a stronger presence of environmental groups decreases the chances of adopting national biofuel targets across our country sample while producer interests tend to increase adoptions. This finding holds true also when controlling for a country's European Union membership and accession perspective, membership in the Energy Community, and additional domestic-level factors. These results add more generally to our understanding about compliance with European Union policies and environmental governance.

Cyber warfare is a timely and relevant issue and one of the most controversial in international humanitarian law (IHL). The aim of IHL is to set rules and limits in terms of means and methods of warfare. In this context, a key question arises: Has digital warfare rules or limits, and if so, how are these applicable? Traditional principles, developed over a long period, are facing a new dimension of challenges due to the rise of cyber warfare. This paper argues that to overcome this new issue, it is critical that new humanity-oriented approaches is developed with regard to cyber warfare. The challenge is to establish a legal regime for cyber-attacks, successfully addressing human rights norms and standards. While clarifying this from a legal perspective, the authors can redesign the sensitive equilibrium between humanity and military necessity, weighing the humanitarian aims of IHL and the protection of civilians-in combination with international human rights law and other relevant legal regimes-in a different manner than before.

Das Aufenthaltsrecht der Studenten, die Unionsbürgerschaft und intertemporales Gemeinschaftsrecht

Nach einer kurzen Einführung in das Thema (I.) setzen sich die Verfasser mit der Entstehung des neuen Fraktionsgesetzes auseinander (II.). Im Anschluss geben sie einen Überblick über den Gesetzesinhalt und zeigen bedeutsame Änderungen auf (III.). Weiter gehen sie auf die finanzielle Ausstattung der Fraktionen im Brandenburger Landtag ein (IV.). Bevor sie dann zur Zusammenfassung und zum Ausblick kommen (VI.), erfolgt ein Rückblick auf den ersten Gesetzesentwurf zum neuen Fraktionsgesetz (V.).
Das Parlament stellt den zentralen Ort politischer Entscheidungsbildung dar.1 Die Erfüllung seiner Aufgaben der Gesetzgebung, der Wahl und Kontrolle der Regierung und anderer Verfassungsorgane, des Haushaltsbeschlusses und schließlich auch der Mitwirkung an der Verfassungsänderung sind unabdingbar für das Gelingen des demokratischen Rechtsstaates. Auch unter den Gefahren einer Pandemie ist daher unter allen Umständen die Funktionsfähigkeit des Parlaments aufrecht zu erhalten (I.). Dabei bieten sich neben technischen (II.) auch rechtliche (III.) Lösungen an, was zur Forderung nach einem parlamentarischen Notausschuss führt (IV.). Eine Zusammenfassung rundet die Darstellung ab (V.).
Der Gründungszuschuss wurde 2011 umfassend reformiert. Insgesamt ist das Arbeitsmarktinstrument weiterhin ein Erfolg: Die meisten Geförderten sind auch knapp dreieinhalb Jahre nach der Gründung noch selbstständig. Die Förderung erhöht ihren Arbeitsmarkterfolg und ihre Jobzufriedenheit deutlich, aber bei ihrer sozialen Absicherung besteht Verbesserungsbedarf.
In February 2020, the Inter-American Court of Human Rights (IACtHR) delivered a landmark decision in which it held Argentina responsible for the violation of several rights of 132 indigenous communities inhabiting a certain area in the province of Salta. In the Case of the Indigenous Communities of the Lhaka Honhat (Our Land) Association v. Argentina the IACtHR declared for the first time an autonomous violation of the right to a healthy environment and other DESCA (Economic, Social, Cultural and Environmental rights). Thereby, it further developed its case law on the direct justiciability of DESCA on the basis of Article 26 of the American Convention on Human Rights (ACHR) that was first established in Lagos del Campo in 2017. Focusing on the right to a healthy environment and the right to water the authors critically examine how the Court derived the direct justiciability of DESCA. In the following, the contribution examines to what extent the right to a healthy environment has been specified in the current judgment compared to the initial outline of this right by the Court in its Advisory Opinion No. 23. The analysis also deals with the question whether the facts of the case were at all suitable for such a specification and what general value could be added by an autonomous examination of DESCA. Finally, the contribution ends with a mixed conclusion on the significance of the judgment and a thoughtful outlook on the future development of the case law on Art. 26 ACHR.

Der brandenburgische Landtag beschloss im Dezember 2019 kurz vor Beginn der uneingeschränkten Geltung der grundgesetzlichen Schuldenbremse für die Länder ab dem 01.01.2020 mit den Stimmen der neuen Regierungskoalition aus SPD, CDU und BÜNDNIS 90/DIE GRÜNEN die Errichtung eines vollständig kreditfinanzierten Sondervermögens »Zukunftsinvestitionsfonds des Landes Brandenburg«, dessen Mittel in Höhe von einer Mrd. Euro in den kommenden Jahren zur Verbesserung der Infrastruktur eingesetzt werden sollen (I.). Dies wirft die Frage auf, ob die verfassungsrechtlichen Haushaltsgrundsätze der stetigen Aufgabenerfüllung (II.), der Einheit und Vollständigkeit des Haushalts (III.), der Haushaltsklarheit und Haushaltsöffentlichkeit (IV.), der Sparsamkeit und Wirtschaftlichkeit (V.), des Jährlichkeitsprinzips (VI.) und nicht zuletzt des Haushaltsausgleichs (VII.) gewahrt worden sind. Letztlich steht das Budgetrecht des Parlaments selbst in Frage (VIII.). Hinzu treten etwaige europarechtliche Verwerfungen (IX.). Nach einer Darstellung der prozessualen Möglichkeiten, gegen dieses Sondervermögen vorzugehen (X.), rundet eine Zusammenfassung die Darstellung ab (XI.).

Das Abgeordnetenmandat hat sich in den letzten Jahrzehnten von einer Honoratiorentätigkeit zu einem Beruf gewandelt, was zu der Frage führt, ob Abgeordnete zugleich Mitglied in mehreren Parlamenten sein können (I), welche das BVerfG im Jahre 1976 noch bejahte (II). Im Lichte neuerer Entwicklungen ist diese Rechtsprechung jedoch kritisch zu beleuchten (III), woraus Folgerungen für eine ausdrückliche verfassungsrechtliche Regelung zu ziehen sind (IV).

Pyramiden gibt es nicht nur in Ägypten, sondern auch in der
deutschen Rechtsordnung. Dieser Beitrag soll die Feinheiten
des Pyramidenbaus näher beleuchten und ihre Geheimnisse
lüften. Zu diesem Zweck werden zunächst der in der Praxis
besonders bedeutsame klassische Stufenbau des Bundes-
rechts (I.) und dessen Erweiterungen (II.) vorgestellt, bevor
einerseits das Landesrecht (III.) und andererseits das Recht
der Europäischen Union (IV.) betrachtet werden. Sodann
wird untersucht, ob auch ein vergleichbarer Stufenbau des
Innenrechts besteht (V.). Nachdem die Veränderungen des
formellen Rangs von Regelungen (VI.) betrachtet wurden,
schließt der Beitrag mit einer Zusammenfassung (VII.).

Mit der zunehmenden Fragmentierung des Parteienwesens wird es auch auf Bundesebene nach Wahlen immer häufiger notwendig werden, Koalitionen mit mehr als zwei Partnern zu bilden. Dies führt nicht nur zu der bereits in den Sondierungsverhandlungen nach Bundestagswahl 2021 aufgeworfenen Frage, ob der Bundeskanzler schon aus Gründen der Koalitionsarithmetik auch mehr als einen Stellvertreter erhalten kann, sondern rückt generell die Möglichkeiten, aber auch die Begrenzungen der Funktion des Vizekanzlers in den Blickpunkt. Im Folgenden wird zunächst der Zweck der Kanzlervertretung erörtert (I.), bevor die Bestimmung des Vertreters (II.) und dessen Kompetenzen (III.) betrachtet werden. Danach sind die Beendigung der Vertreterfunktion (IV.) und das Verhältnis zur geschäftsführenden Bundesregierung (V.) zu untersuchen. Schließlich werden prozessuale Folgerungen gezogen (VI.) und die wesentlichen Ergebnisse zusammengefasst (VII.).
