Was misst TIMSS?

Bei der Erstellung und Interpretation mathematischer Leistungstests steht die Frage, was eine Aufgabe mißt. Der Artikel stellt mit der strukturalen oder objektiven Hermeneutik eine Methode vor, mit der die verschiedenen Dimensionen der von einer Aufgabe erfassten Fähigkeiten herausgearbeitet werden können. Dabei werden fachliche Anforderungen, Irritationsmomente und das durch die Aufgabe transportierte Bild vom jeweiligen Fach ebenso erfasst wie Momente, die man eher als Testfähigkeit bezeichnen würde.Am Beispiel einer TIMSS-Aufgabe wird diskutiert, dass das von den Testerstellern benutzte theoretische Konstrukt kaum geeignet ist, nachhaltig zu beschreiben, was eine Aufgabe misst.
Internationales Privatrecht der ehelichen Vermögensbeziehungen mit Berührungen zu Polen : Teil I

Der Beitrag ist der erste Teil einer zweiteiligen Serie über kollisionsrechtliche Fragen im Verhältnis zwischen Deutschland und Polen in Bezug auf die vermögensrechtlichen Beziehungen zwischen zwei Ehegatten, die entweder dieselbe oder eine unterschiedliche Staatsangehörigkeit besitzen und die sich entweder gemeinsam oder allein in einem anderen Staat aufhalten. Im vorliegenden Teil werden das Ehewirkungs-, das Scheidungs- und das Güterrechtsgesetz behandelt, wobei anhand von kurzen Beispielfällen verschiedene Rechtsfragen zur objektiven Anknüpfung, zur Rechtswahl und weiteren kollisionsrechtlichen Aspekten erörtert werden. In diesem Zusammenhang geht die Autorin auch auf die Überleitungsregelungen des Art. 220 Abs.3 und Art. 236 $ 3 EGBGB ein.
Verfasserin bespricht ein Urteil, in dem das Gericht über die Vollstreckbarkeit der Entscheidung eines türkischen Gerichtes zum Kindesunterhalt im Scheidungsverbund zu entscheiden hatte. Hierbei war auch die Frage nach der Aktivlegitimation maßgeblich. Die Autorin geht auf das Problem der Prozessführungsbefugnis ein und verdeutlicht die Unterschiede zwischen deutschem und türkischem Recht. Sie schildert die unterschiedlichen Rechtsauffassungen zu der aufgeworfenen Frage und zeigt die Konsequenzen auf.
Die Verfasserin setzt sich kritisch mit einem Beschluss des BGH vom 2001, V ZR 306/99, auseinander, der sich mit der Frage des anwendbaren Rechts für die Erbrechtsnachfolge im Bereich des innerdeutschen Kollisionsrechts befasst. Im Mittelpunkt steht dabei die Frage, unter welchen Vorsaussetzungen es zu einer Nachlassspaltung kommt. In seiner Entscheidung geht der BGH auf die Frage der Rechtsfähigkeit einer Erbengemeinschaft ein und auf die Frage, ob es sich bei einem Erbanteil am unbeweglichen Vermögen um bewegliches Vermögen handelt.

Der Beitrag beschäftigt sich im Anschluss an NotBZ 2001, 52, als zweiter Teil einer Fortsetzungsserie zu vermögensrechtlichen Fragen des internationalen Familienrechts im deutsch-polnischen Verhältnis mit dem Bereich des Unterhaltsrechts und mit ausgewählten Qualifikationsproblemen. Die Ausführungen werden durch kurze Beispielfälle ergänzt.
Electronic intensity and frequency modulation of diode lasers enables new perspectives for highly sensitive analytical in-situ techniques. For analyis of "heterogeneous" media, which may consist of coexisting gaseous, liquid, and solid phases and often show multiple light scattering, non-invasive techniques with outstanding performance characteristics can be developed. Analysis of photon density waves launched by intensity-modulated lasers provide an elegant way for the determination of absorption and scattering coefficients of multiple scattering media. The absorption coefficient can be used for qualitative and quantitative analysis of chemical constituents (which absorb in the range of the laser wavelengths). The scattering coefficient allows characterization of physical and morphological properties of the sample. In the current work, applicability of appropriate radiation transport models was investigated with simple light scattering solutions and compared with results obtained from the treatment according to the theory of Kubelka and Munk. Measurements of human blood samples are discussed. A new method for determination of water vapor partial pressure in a polyurethane foam with a frequency-modulated external cavity diode laser is discussed.

Impacts of agricultural land use on the environment are various and do not contribute to modifications of the ecology of central European landscapes. They do not only cause a progressive reduction of the number of plant ans animal specis typical for central Europe. Ever since the increasing intensification of farming, from the application of large amounts of fertilizers and pesticides to the use of increasingly larger machinery and progressive specialization there has also been an increase of other, hitherto little noticed environmental impacts. Heavy machinery and cultivation during disadvantageous weather will provoke soil compaction. Unvarying crop rotation systems and plouging of terrain too steep for it will increase water erosion. Due to groundwater lowering former peat lands are increasingly prone to desiccation and thus extremely susceptible to wind erosion. High rates of fertilizer application contiuously increase the risk of nitrate eluviation into the groundwater. These hazards are explained and measures of reduction are shown. The latter are indeed compatible with the aims of intensive farming but with less negative consequences for the environment. Above all they make sure that future generations will be able to continue farming the agricultural lands of central Europe that have been under cultivation for thousands of years.
The "Weighting Process" in Land Use Planning - Discussion of the Present Practice of "Weighting Out". Owing to the revision of the Building Code from January 1998 the impact regulation in land use planning is now established in the Building Law. This means the local governments have decision-making powers how to precisely implement the impact regulation. This, however, does not mean - as had been said in practice - that the concerns of nature and landscape can be "weighted out". On the contrary, the decision-making process has to include a detailed differentiation depending on the case, according to a verdict of the Supreme Administrative Court from 1997. The concerns of nature and landscape cannot be moved back as "not of furhter relevance". Only precisely described and insurmontable constraints allow cutbacks. Since compensation measures now can be carried out on the ground of adjacent local communities, a lack of sites available cannot be accepted as a reason. The paper makes clear why also in urban land use planning interference into nature has to be fully compensated for.

Organic Farming as a Compensatory Measure German's agricultural land is not only being gobbled up by development; whole sections are being bought up in compensation for interventions made elsewhere, thus rapidly decimating the countrie's farming land resources. For this reason, calls are being made to take land that is converted from conventional to organic farming and add it to the pool of "compensation" areas, thus killing two birds - one of them being the establishment of more organic farming - with one stone. Various German regions have adopted the approach. Although organic farming serves both agricultural and environmental objectives, it cannot cover all the requirements of nature conservation. For example, it benefits abiotic resources such as soil and water through its use of natural fertilizers and erosion-combating cultivation, but can do little to protect highly endangered species and biotopes. Moreover, organic farms do not necessarily meet the legal requirement that compensation land must fulfil a similar function to the land it is "compensating" for. In other words, land converted to organic farming cannot necessarily ameliorate or compensate for impact on biotopes and species elsewhere. Regarding this approach as a solution to the rapid disappearance of farming land simply diverts attnetion away from the real cause: Urban sprawl and road building.
