Nachdem sich das BVerfG 2005 auf eine verfassungsrechtliche Garantie einer zwingenden, bedarfsunabhängigen Mindestbeteiligung der nächsten Angehörigen am Nachlass festgelegt hat, ist die Diskussion um das Pflichtteilsrecht abgeebbt. Ein radikaler Vorschlag aus dem Schrifttum könnte den Diskurs jetzt neu entfachen: An die Stelle des Quotenpflichtteils soll ein bedarfsabhängiger Angehörigenschutz in Form eines passiv vererblichen Unterhaltsanspruchs treten. Der Beitrag greift diesen Ansatz auf, beleuchtet Vorzüge und Schwächen des vorgelegten Konzepts und formuliert Fragen für die weitere rechtspolitische Debatte. Ergänzt werden die Überlegungen durch den Entwurf eines gesetzlichen Pflegevermächtnisses. De lege ferenda wird für einen vollständigen Systemwechsel von der zwingenden Mindestbeteiligung naher Angehöriger zu einer von den Gedanken der Alimentation und der Äquivalenz getragenen Nachlassteilhabe plädiert.
Die Regeln über den gutgläubigen Erwerb beweglicher Sachen sind unebenes Gelände, denn sie führen in das Recht des Besitzes und namentlich des mittelbaren Besitzes, und hier ist vieles schwankender Boden. Oft geht es um widerstreitende Übereignungsgeschäfte im Zusammenhang mit der Kreditsicherung, so wie die Sicherungsübereignung von Vorbehaltsgut oder die mehrfache Sicherungsübereignung derselben Sache. Wenn ein Vorbehaltskäufer die ihm noch nicht gehörende Sache einer Bank zur Sicherheit übereignen will und ihr den Besitz zu vermitteln verspricht, erwirbt die Bank zwar kein Eigentum (§ 933 BGB). Aber wenn man der Bank den mittelbaren Besitz zuspricht, kann von ihr später ein anderer Sicherungsnehmer durch die Abtretung des aus dem Sicherungsvertrag entspringenden Herausgabeanspruchs der Bank gegen den Vorbehaltskäufer gutgläubig Eigentum erwerben (§ 934 Fall 1 BGB). So sehen es jedenfalls die meisten, und auch der Bundesgerichtshof hat 1968 in dem vielerörterten »Fräsmaschinen-Urteil« so entschieden.
Der vorliegende Beitrag gibt den Leserinnen und Lesern einen Überblick über die Planung und Durchführung einer erfolgreichen Vorbereitung auf die Erste Juristische Prüfung. Ausgangspunkt ist die Darstellung der verschiedenen Strategien der Examensvorbereitung sowie der Vorgehensweisen zur Erstellung eines Stoff- und Zeitplanes. Daran knüpfen Ausführungen zur Lernphase an, d. h. im Einzelnen zur Strukturierung des Lernalltags und zum Klausurentraining. Abschließend folgen Erläuterungen zum Ablauf der mündlichen Prüfung und zur zugehörigen Vorbereitung. Die Darstellung zielt darauf ab, die Studierenden bei der Planung ihrer persönlichen Examensvorbereitung zu unterstützen.

Der Beitrag befasst sich mit kartellrechtlichen Herausforderungen im Sportbetrieb und soll aufzeigen, welche kartellrechtlichen Kernvorgaben Akteure (FN * ) im Sportsektor bei der Ausgestaltung ihrer Compliance-Programme beachten sollten. Die wachsende wirtschaftliche Bedeutung des Profisports führt immer häufiger zu Entscheidungen durch Kartellbehörden und Gerichte. Hier zeigt sich, dass Sportclubs und Sportverbände in Europa zwar durchaus eine besondere Rolle einnehmen, allerdings mitnichten von den Vorgaben des Unionskartellrechts befreit sind.
Im Rahmen der EuGVVO hat der Kläger seine Klage grundsätzlich in dem Staat zu erheben, in dem der Beklagte seinen Wohnsitz hat. Ausnahmen hiervon gibt es insbesondere in Versicherungs-, Verbraucher- und Arbeitssachen. Der Versicherungsnehmer und der Verbraucher können gegen den Versicherer bzw. gegen den Unternehmer insbesondere an ihrem Wohnsitz gerichtlich vorgehen. Der Arbeitnehmer kann seine Klage gegen den Arbeitgeber zwar nicht an seinem Wohnsitz, aber an dem Ort erheben, an dem oder von dem aus er gewöhnlich seine Arbeit verrichtet (gewöhnlicher Arbeitsort). Zuständigkeitsrechtliche Probleme ergeben sich, wenn der Versicherungsnehmer, der Verbraucher oder der Arbeitnehmer seine Forderung an einen Dritten abtritt. Dann ist in erster Linie zu klären, ob der Dritte die abgetretene Forderung auch an seinem Wohnsitz bzw. an seinem gewöhnlichen Arbeitsort erheben kann. Diese Problematik ist Gegenstand des Beitrags.
Europäischer Beschluss zur vorläufigen Kontenpfändung und Arrest mit nachfolgender Kontenpfändung

Mit der Kontenpfändungsverordnung (EuKPfVO) hat der europäische Gesetzgeber Neuland betreten. Der Europäische Beschluss zur vorläufigen Kontenpfändung (EuKPfB) steht dem Gläubiger als eine Alternative zu den Maßnahmen zur vorläufigen Pfändung nach dem nationalen Recht zur Verfügung (Art. 1 Abs. 2 EuKPfVO). Auf den ersten Blick weist der EuKPfB eine gewisse Nähe zu einer Kontenpfändung aufgrund eines dinglichen Arrests auf. Im Folgenden soll daher untersucht werden, ob und ggfs. welche konzeptionellen Unterschiede es diesbezüglich gibt. In diesem Zusammenhang ist auch zu klären, was sich hinter dem EuKPfB eigentlich verbirgt.
Anknüpfend an den letztjährigen Bericht des Autors (Wagner NJW 2022, NJW Jahr 2022 Seite 1861) informiert diese Abhandlung die Praxis wiederum über die jüngsten rechtsvereinheitlichenden Arbeiten und Pläne in der justiziellen Zusammenarbeit in Zivilsachen sowie über den Stand der deutschen „Begleitgesetzgebung“. Darüber hinaus wird die aktuelle Rechtsprechung des EuGH zur ziviljustiziellen Zusammenarbeit vorgestellt.
This article provides an overview of developments in Brussels in the field of judicial cooperation in civil and commercial matters from January 2022 until December 2022. It presents newly adopted legal instruments and summarizes current projects that are making their way through the EU legislative process. It also refers to the laws enacted at the national level in Germany as a result of new European instruments. Furthermore, the authors look at areas of law where the EU has made use of its external competence. They discuss both important decisions and pending cases before the CJEU as well as important decisions from German courts pertaining to the subject matter of the article. In addition, the article also looks at current projects and the latest developments at the Hague Conference of Private International Law.

Zu den priorisierten Legislativvorhaben der EU-Kommission zählten zuletzt vor allem auch solche, welche die Nutzbarkeit von Daten zur Wohlfahrtssteigerung im Binnenmarkt zum Gegenstand haben. Der Data Governance Act ist bereits in Kraft; nun liegt der Vorschlag für einen Data Act vor. Dieser Beitrag behandelt dessen Verhältnis zum EU-Datenschutzrecht. Hierbei wird deutlich, wie schmerzlich eine ausgefeilte sekundärrechtliche Konkurrenzlehre fehlt.
Private international law (PIL) might seem disconnected from peacebuilding and peacekeeping efforts. However, this perception falls short. PIL, contrary to public international law’s direct peacekeeping potential, indirectly contributes to peace by fostering mutual respect between states. The relationship between PIL and peace stems from the recognition and respect states show for each other’s legal systems. PIL operates on the principle of comity, where states acknowledge the applicability of foreign laws to resolve cases. In essence, while PIL’s impact on peace is indirect and modest, its emphasis on mutual respect and fair treatment contributes to peaceful relations between states, making it an important element in the broader context of peacebuilding and peacekeeping efforts. Private international law (PIL) does not determine substantive fairness for parties but focuses on localizing cases at a meta-level of conflict-of-laws. This localization is guided by party, trade, and regulatory interests, and is rooted in neutrality and respect for other legal systems. While the principle of equivalence and neutrality remains foundational in PIL, exceptions and limitations have been established over time to address specific scenarios, ensuring a balanced approach that respects both foreign legal systems and fundamental legal principles.

Ein Jahr nach der Gründung der Potsdamer Law-Clinic „Legal-UP“ ziehen die Mitarbeitenden der Universität Potsdam in einem Werkstattbericht Bilanz. Sie stellen ein Projekt vor, das es angehenden Jurist:innen ermöglicht, mit Fokus auf digitale Arbeitsweisen praktische Erfahrungen in der Beratung zu sammeln. Viele Anwält:innen unterstützen die Studierenden als Mentor:innen und sichern die Qualität der studentischen Rechtsberatung. Eine Chance, jungen Menschen den Anwaltsberuf schon in der Ausbildung nahe zu bringen.
Art. 1 Abs. 2 Buchst. b der RL 93/83/EWG des Rates vom 27. September 1993 zur Koordinierung bestimmter urheber- und leistungsschutzrechtlicher Vorschriften betreffend Satellitenrundfunk und Kabelweiterverbreitung ist dahin auszulegen, dass ein Satellitenbouquet-Anbieter, der verpflichtet ist, für eine Handlung in Form der öffentlichen Wiedergabe über Satellit, an der er mitwirkt, die Zustimmung der Inhaber der betreffenden Urheberrechte und verwandten Schutzrechte einzuholen, diese Zustimmung – entsprechend der dem betreffenden Sendeunternehmen erteilten Zustimmung – nur in dem Mitgliedstaat einholen muss, in dem die programmtragenden Signale in die zum Satelliten führende Kommunikationskette eingegeben werden.
