Dieses Buch zeichnet das Leben und Wirken des bedeutenden Strafrechtswissenschaftlers Karl Peters nach, wobei ein Schwerpunkt auf der Zeit des Nationalsozialismus liegt. Als Staatsanwalt seit 1932 tätig, auf Grund seiner katholischen Konfession erst 1942 zum Ordinarius in Greifswald ernannt, von 1946 bis 1962 Professor in Münster und sodann bis 1972 in Tübingen tätig. Peters‘ Wirken beeindruckt durch seine Bandbreite. Neben einer intensiven Auseinandersetzung mit dem Strafprozess, -vollzugs- und Jugendstrafrecht forschte er in den Bereichen dermKriminologie, Soziologie, Psychologie, Medizin und Pädagogik. Getragen von christlichen Grundanschauungen stellte Peters hohe Anforderungen an sich und den (Straf-)Juristen. Die Beschäftigung mit Justizirrtümern und dem Wiederaufnahmeverfahrensrecht wurde zu seinem Hauptanliegen.

There has been considerable movement in German licensing law for some years now. Based on the fate of the license in the case of the granting of sub-licenses and in the case of insolvency of one of the contracting parties involved, a number of court decisions have been handed down which mainly deal with the legal nature of licenses and their mode of operation.
Moreover, there is now an internationally significant development in licensing law, namely the increasing independence of patents used in standards, which have increasingly become the subject of economic considerations – and not only of the companies or inventors filing them. zur Fussnote 1 These so-called standard essential patents (SEPs) are the subject of numerous legal disputes and legislative activities and constitute a scientific discourse around the globe.
In 2015, the European Court of Justice (ECJ) created the first leading case for the EU with regard to SEPs in its highly regarded Huawei/ZTE ruling. zur Fussnote 2 Although an abundance of decisions of the courts of first instances are now available, many questions still remain unanswered since the fundamental decision of the ECJ. There is controversy both over the dogmatic classification of the FRAND declaration and the legal consequences of the declaration’s binding effect. It is particularly unclear what happens to the FRAND declaration when the SEP is transferred to a third party and whether, how and to what extent the acquirer is bound by this declaration of the transferor. In a decision that can certainly be described as bold, a Higher Regional Court has now ruled on some of these issues for the first time, thus providing further food for discussion.
Die Entwicklungen der unter- und obergerichtlichen Rechtsprechung zum Urheberrecht im Jahr 2020

Im Urheberrecht war auch das Jahr 2020 wieder durch die höchstrichterliche Rechtsprechung von EuGH und BGH geprägt. Daneben gab es aber auch eine Vielzahl bemerkenswerter Entscheidungen der Instanzgerichte. Der vorliegende Beitrag verschafft einen Überblick über die ober- und unterinstanzliche Rechtsprechung. Gegenstand sind Entscheidungen, die im Jahr 2020 in Zeitschriften veröffentlicht wurden.
Zwar war der Gesetzgeber im Jahr 2020 wenig aktiv, die Gerichte haben jedoch eine Vielzahl bedeutender urheberrechtlicher Entscheidungen getroffen. Dieser Bericht widmet sich im Anschluss an Nordemann/Waiblinger (NJW 2020, NJW Jahr 2020 Seite 737) der einschlägigen Rechtsprechung des EuGH und des BGH im Urheberrecht. Die wichtigsten Entscheidungen der Instanzgerichte werden, wie üblich, demnächst in GRUR-RR dargestellt.
Die Rechtsfolgen einer fehlgeschlagenen Anteilsabtretung stellen ein rechtspraktisches Problem des GmbH-Rechts dar, dessen Lösungswege üblicherweise im Schuldrecht gesucht werden. Der Anwendung der schuldrechtlichen Rechtsinstitute im Rahmen des § 16 Abs. 1 GmbHG geht die Frage voran, ob das durch die Legitimationswirkung charakterisierte Auseinanderfallen von Herrschaftsrecht und Herrschaftsmöglichkeit zur Anwendung des Eigentümer-Besitzer-Verhältnisses führen kann. Der Übertragbarkeit der drei Komponenten der Vindikationslage – Sache, Eigentum, Besitz – und deren Interdependenzen auf die durch die Legitimationswirkung hervorgerufene Situation widmet sich diese Arbeit. Im Wege des systematischen Vergleichs der Rechtsbeziehungen weist der Autor eine Vergleichbarkeit nach und schlägt eine analoge Anwendung des Eigentümer-Besitzer-Verhältnisses vor. Im Mittelpunkt stehen die Rechtsgegenständlichkeit der Mitgliedschaft und die Ausdehnung des Besitzbegriffs auf unkörperliche Rechtsprodukte.
Das Regulierungsermessen

Die Arbeit untersucht die Übertragung des zum Telekommunikationsrecht entwickelten Regulierungsermessens auf das Energiewirtschaftsrecht und kommt zu dem Ergebnis, dass es für die dortigen Normstrukturen ungeeignet ist und zu Rechtsschutzeinbußen geführt hat. Da auch die herkömmlichen verwaltungsrechtlichen Dogmen für die methodenbasierten Entscheidungsformen der Regulierungsbehörden keine geeigneten Instrumente bieten, wird das Subsumtionsermessen in den Diskurs eingeführt, um die spezifische, auf quasi Wettbewerbsherstellung gerichtete Verwaltungstätigkeit in der Energieregulierung besser abzubilden. Ohnehin steht die deutsche Energieregulierungspraxis vor einem Umbruch: Der EuGH wird vermutlich die Ansicht der Kommission bestätigen, dass die verordnungsrechtliche Vorsteuerung der Entgeltregulierung gegen Art. 37 Abs. 1 lit. a und Art. 37 Abs. 6 lit. a und b der Richtlinie 2009/72/EG bzw. 2009/73/EG verstößt.
Im Anschluss an eine allgemeine Erläuterung seiner Rechtsgrundlagen analysieren die Autoren die geltende Rechtslage in Bezug auf ausgewählte aktuelle Fragen des steuerlichen Gemeinnützigkeitsrechts. Konkret widmen sie sich den Fragestellungen, ob die Förderung von „Tierrechten“ einen gemeinnützigen Zweck bildet, ob die Anerkennung einer Organisation als gemeinnützig ein rechtstreues Verhalten voraussetzt und insoweit das Verhalten Dritten zugerechnet werden kann und ob die Anerkennung einer Organisation als gemeinnützig binnendemokratische Strukturen und eine prinzipielle Zugangsoffenheit bedingt. Hinsichtlich dieser Fragen werden zudem Empfehlungen für zukünftige Reformen des steuerlichen Gemeinnützigkeitsrechts formuliert.
Rechtsgeschichte

Dieses Lehrbuch richtet sich vor allem an Studierende der Rechtswissenschaft. Es dient der Vorlesungsbegleitung im Grundlagenfach Rechtsgeschichte, kann darüber hinaus jedoch ebenso gewinnbringend zur Vertiefung im Rahmen des einschlägigen Schwerpunktbereichs herangezogen werden. In der Tradition der Vorauflagen wird der Bogen, ausgehend von der römischen Antike, über das Mittelalter und die frühe Neuzeit bis hin zur Wiedervereinigung von DDR und Bundesrepublik gespannt. Der Strafrechtsgeschichte ist dabei ebenso ein eigenes Kapitel gewidmet wie der Verfassungsgeschichte im 19. Jahrhundert, der Weimarer Republik und dem NS-Unrechtsstaat. Für den ersten Einstieg werden neben der Erläuterung von Grundbegriffen auch Hinweise zum Lösen rechtsgeschichtlicher Klausuren oder Verfassen von Hausarbeiten gegeben. Tabellarische Gegenüberstellungen von allgemein historischen und rechtsgeschichtlich besonders bedeutsamen Vorgängen geben einen schnellen Überblick über die jeweils folgenden Kapitel. Die Einarbeitung historischer Quellen – sofern nötig mit Übersetzung – erleichtert das Verständnis für die Epochen und ihre spezifischen Rechtsprobleme. Zahlreiche Querverweise geben Orientierung und verdeutlichen wichtige Zusammenhänge.
Ziel dieser Arbeit war, das Wesen der deutschen Steuerdisziplin und des ivorischen Steuersystems, welches aufgrund der Kolonialzeit auch als Erbe Frankreichs angesehen wird, historisch auszuarbeiten. Besonders betrachtet wurde der steuerrechtliche Rahmen, da dieser in hohem Maße dem Schutz der Ehe und Familie dient. Anhand der unterschiedlichen Steuersysteme werden Verbesserungsvorschläge für das Steuersystem Deutschlands und der Elfenbeinküste gegeben, um die Ehe und die Familie besser zu schützen. Das Hauptaugenmerk liegt bei meinen Betrachtungen immer auf dem Schutz des/der Kindes/r. Insbesondere wird dabei auf die Stellung der Frau und deren Wandlung in den letzten Jahrzehnten eingegangen und es werden Vorschläge gemacht, wie vor allem Alleinerziehende und berufstätige Mütter sowohl in Deutschland als auch in der Elfenbeinküste steuerlich entlastet werden können und verfügt daher über einen hohen aktuellen Bezug.

Das Urheberrecht ist ein wichtiger Bestandteil der Wahlfächer Wirtschaftsrecht und Gewerblicher Rechtsschutz. Gegenstand des Rechtsgebiets sind die Rechte an Werken der Literatur, Wissenschaft und Kunst. Die Materie ist eng mit den Problemen der Informationsgesellschaft verknüpft und unter-liegt gegenwärtig zahlreichen Änderungen. Der Grundriss stellt das Rechtsgebiet kompakt und hochaktuell dar. Insbesondere sind neueste Entscheidungen aus der Rechtsprechung eingearbeitet. Das Werk stellt nicht nur das Urheberrecht im eigentlichen Sinne, sondern auch Teile des Kunsturhebergesetzes, insbesondere das Recht am eigenen Bild, eingehend dar.

This article provides an overview of developments in Brussels in the field of judicial cooperation in civil and commercial matters from December 2019 until December 2020. It provides an overview of newly adopted legal instruments and summarizes current projects that are presently making their way through the EU legislative process. It also refers to the laws enacted at the national level in Germany as a result of new European instruments. Furthermore, the authors look at areas of law where the EU has made use of its external competence. They discuss both important decisions and pending cases before the CJEU as well as important decisions from German courts pertaining to the subject matter of the article. In addition, the article also looks at current projects and the latest developments at the Hague Conference of Private International Law.

Das Recht auf voraussetzungslosen Zugang zu amtlichen Informationen verzeichnet einen stetigen Bedeutungszuwachs. Der staatliche Informationsbestand enthält dabei eine Vielzahl von Informationen auch Privater, insbesondere von Unternehmen. Mit dem Wunsch nach Transparenz auf der einen Seite geht auf der anderen Seite ein natürliches Interesse der betroffenen Dritten an der Geheimhaltung ihrer Daten einher. Diese verfassungsrechtlich garantierten Interessen umfassen den Schutz personenbezogener Daten, des geistigen Eigentums und von Betriebs- und Geschäftsgeheimnissen. Florian Penski stellt eine vergleichende Untersuchung unter dem IFG, UIG und VIG zur Auflösung dieser Spannungsverhältnisse an. Der Schwerpunkt liegt dabei auf möglichen Änderungen durch die erst 2018 in Kraft getretene Datenschutz-Grundverordnung. Zudem wird untersucht, wie ein Privater seine Interessen sowohl gerichtlich als auch außergerichtlich effektiv durchsetzen kann.

Marcel Proust zitiert und erwähnt Tacitus nicht nur in Briefen und seinem unvollendet gebliebenen 'Jean Santeuil', sondern vor allem auch in seinem Hauptwerks 'A la recherche du temps perdu'. Der Autor versucht zu zeigen, dass diese Erwähnungen in die Mitte des Proustschen Werkes führen.

Hass im Netz, Diffamierungen und sogar Morddrohungen sind im Internet mehr Regel als Ausnahme. Der Rechtsstaat hat die ihm obliegende Aufgabe der Rechtsdurchsetzung gegen Hasskriminalität im Netz aufgrund eines offenbar fehlenden Problembewusstseins lange vernachlässigt. Er nähert sich dem Thema auch weiterhin nur zögerlich. Die Würde des Menschen scheint im Internet nicht so „unantastbar“ zu sein, wie es Art. 1 GG und Art. 1 der EU-Grundrechtecharta vorschreiben. Dabei gelten diese Grundrechte im analogen Leben wie Internet gleichermaßen. Die EU geht mit dem Digital Service Act nun einen Schritt voran. Der Bundesgesetzgeber unternimmt mit den Gesetzgebungsverfahren zur Klarnamenpflicht und dem Registermodernisierungsgesetz auch neue Anläufe, um den Rechtsstaat digitaler zu aufzustellen. Gesetze allein helfen allerdings nur wenig. Insbesondere der Kampf gegen Hasskriminalität bedarf größerer personeller Kapazitäten in der Justiz.

Pirmin Emanuel Schreiner vergleicht das Wohnraummietrecht in Deutschland, England und Frankreich per Computersimulation einer Modellstadt. Er schließt damit methodisch an den neueren Diskurs zur sog. "quantitativen Rechtsvergleichung" an. Im ersten Teil erörtert er deren Nutzen für die Rechtsvereinheitlichung, Rechtsarbitrage sowie die ökonometrische Weiternutzung zur policy-Analyse und Rechtsfolgenforschung sowie ihre methodischen Grundlagen besonders im Hinblick auf das Problem der Gewichtung unterschiedlicher Parameter. Im zweiten Teil werden diese methodischen Erkenntnisse zunächst durch einen klassisch-funktionalen Vergleich des Anwendungsbereichs des Wohnraummietrechts, der Mietzinsregulierung (insbesondere auch der sog. "Mietpreisbremsen") und des Kündigungsschutzes einschließlich Räumungsverfahren in den drei genannten Rechtsordnungen angewandt. Übersetzt in Algorithmen münden diese Erkenntnisse in eine Prozesssimulation der drei gewählten Rechtsordnungen.
