Der anthropogene Klimawandel führt zu einem weltweiten Temperaturanstieg, in dessen Folge es (statistisch betrachtet) zu vermehrten, schadensbegründenden Wettereignissen, wie Stürmen, Überschwemmungen und Dürren, kommt. Realisiert sich das insofern bestehende Risiko, trifft es den Einzelnen hart und verdeutlicht die Notwendigkeit einer klimapolitischen Kursänderung. Diese versuchen zunehmend private, von staatlichen Lösungsansätzen enttäuschte Akteure im Wege der (Haftungs-)Klage herbeizuführen, deren Erfolgsaussichten indes recht kontrovers beurteilt werden. Der vorliegende Beitrag möchte die insoweit geführte Diskussion hinsichtlich der wesentlichen Fragestellungen um eine unaufgeregte Betrachtung ergänzen.
Die Verbindung eines Antrags auf Erlass eines (zweiten) Versäumnisurteils mit der Änderung des Streitgegenstands stellt ein in der wissenschaftlichen Diskussion wenig beachtetes, in der täglichen Praxis jedoch verschiedentlich anzutreffendes Phänomen dar. Vorliegend soll der hieraus resultierenden, noch nicht umfassend geklärten Frage nachgegangen werden, wie mit dem Begehren, den Einspruch gegen das erste Versäumnisurteil zu verwerfen, umzugehen ist, wenn die Klage nach dessen Erlass erweitert oder, in Ansehung zwischenzeitlicher Teilerfüllung, beschränkt wurde und prozessualer und titulierter Anspruch nicht mehr übereinstimmen.
