Die Verbindung eines Antrags auf Erlass eines (zweiten) Versäumnisurteils mit der Änderung des Streitgegenstands stellt ein in der wissenschaftlichen Diskussion wenig beachtetes, in der täglichen Praxis jedoch verschiedentlich anzutreffendes Phänomen dar. Vorliegend soll der hieraus resultierenden, noch nicht umfassend geklärten Frage nachgegangen werden, wie mit dem Begehren, den Einspruch gegen das erste Versäumnisurteil zu verwerfen, umzugehen ist, wenn die Klage nach dessen Erlass erweitert oder, in Ansehung zwischenzeitlicher Teilerfüllung, beschränkt wurde und prozessualer und titulierter Anspruch nicht mehr übereinstimmen.
Mit der bevorstehenden Entscheidung des Bundesverfassungsgerichts in der Sache Pechstein neigt sich eine scheinbar endlose Geschichte dem Ende entgegen. Es bleibt zu hoffen, dass auf die Frage der (un-)zulässigen Inanspruchnahme verfahrensgestaltender Marktmacht schlussendlich eine überzeugende Antwort gefunden wird, die bestehende Defizite benennt, die schutzwürdigen Athletenrechte stärkt und den Anstoß für eine sach- und interessengerechte Strukturreform in der Sportschiedsgerichtsbarkeit gibt.
Der anthropogene Klimawandel führt zu einem weltweiten Temperaturanstieg, in dessen Folge es (statistisch betrachtet) zu vermehrten, schadensbegründenden Wettereignissen, wie Stürmen, Überschwemmungen und Dürren, kommt. Realisiert sich das insofern bestehende Risiko, trifft es den Einzelnen hart und verdeutlicht die Notwendigkeit einer klimapolitischen Kursänderung. Diese versuchen zunehmend private, von staatlichen Lösungsansätzen enttäuschte Akteure im Wege der (Haftungs-)Klage herbeizuführen, deren Erfolgsaussichten indes recht kontrovers beurteilt werden. Der vorliegende Beitrag möchte die insoweit geführte Diskussion hinsichtlich der wesentlichen Fragestellungen um eine unaufgeregte Betrachtung ergänzen.

Das EBV stellt die Grundlage zahlreicher komplexer wie prüfungsrelevanter Fragen dar, deren zufriedenstellende Lösung ein hohes Maß an Systemverständnis und Problembewusstsein voraussetzt. Der Beitrag bietet insofern dogmatische Hilfestellung, indem er die Binnenstruktur der §§ 985 ff. sowie deren Einordnung in das Gesamtgefüge des BGB offenlegt.

Begriffe wie „Industrie 4.0“, „Internet der Dinge“ und „Big Data“ haben unlängst Eingang in den allgemeinen Zeitgeist gefunden und stehen synonym für die zahlreichen, durch Digitalisierung sowie Automatisierung angestoßenen Veränderungen des menschlichen (Zusammen-)Lebens und der juristischen Bewertung. Namentlich der Einsatz autonomer, auf der Grundlage künstlicher Intelligenz agierender Systeme lässt die Anknüpfungspunkte eines Verschuldensvorwurfes schwinden und damit technische Innovation und tradiertes Verschuldensprinzip wie unversöhnliche Kinder verschiedener Zeiten wirken. Tatsächlich aber gewährleistet allein die Verknüpfung von Ausgleichspflicht und Sorgfaltswidrigkeit eine hinreichende Freiheitsgewähr sowie eine interessen- und einzelfallgerechte Schadenszuweisung und entspricht damit dem sozialen Gerechtigkeitsempfinden.
