Application and Acceptance of the Habitats Directive in Germany and France - Comparison of Selected Areas. Since 1992, when the Habitats Directive (92/43/EWG) came into effect, all EU member states are obligated to contribute to the establishment of a coherent ecological framework of special protection areas, called Natura 2000. The guideline states both protection objects and protection aims more precisely but its implementation is, to a large extent, left to the member states. In the neighbouring states Germany and France the organisation report strategy, and area management of the Natura 2000 areas differ significantly. Based on these conditions, in both countries two exemplary regions (mountain range and low mountain range) with 3 Natura 2000-areas were selected. In exemplary municipalities the local decision-makers and other relevant activists were interviewed regarding their acceptance of Natura 2000. The results showed altogether a higher acceptance in the 12 German municipalities than in the 12 French but at the same time an extensive insecurity regarding the new obligations on order to implement the protection system. In the French examples the lack of public participation organised by the state government contributed to a reduced acceptance during the first years of the implementation of the Habitats Guideline. Besides, crucial elements for a local acceptance of the Natura 2000 system in both states were the land owners, existing plans and development aims of the municipality, land use and a possibly existing protection status of the area. Additionally the study showed that a transparent establishment of a management plan offers the opportunity to co-ordinate different land use and protection interests. The designation of a separate area co-ordinator for each Natura 2000-area, at the same time contact for the local community like in France, can provide a valuable, confidence-building measure.
Impacts of agricultural land use on the environment are various and do not contribute to modifications of the ecology of central European landscapes. They do not only cause a progressive reduction of the number of plant ans animal specis typical for central Europe. Ever since the increasing intensification of farming, from the application of large amounts of fertilizers and pesticides to the use of increasingly larger machinery and progressive specialization there has also been an increase of other, hitherto little noticed environmental impacts. Heavy machinery and cultivation during disadvantageous weather will provoke soil compaction. Unvarying crop rotation systems and plouging of terrain too steep for it will increase water erosion. Due to groundwater lowering former peat lands are increasingly prone to desiccation and thus extremely susceptible to wind erosion. High rates of fertilizer application contiuously increase the risk of nitrate eluviation into the groundwater. These hazards are explained and measures of reduction are shown. The latter are indeed compatible with the aims of intensive farming but with less negative consequences for the environment. Above all they make sure that future generations will be able to continue farming the agricultural lands of central Europe that have been under cultivation for thousands of years.

Für Natur und Landschaft beeinträchtigende Vorhaben sind aufgrund der Vorgaben des Bundesnaturschutzgesetzes Ausgleichs- und Ersatzmaßnahmen durchzuführen. Für sie fallen beträchtliche Flächenanteile an, die sinnvoll in die Landschaftsentwicklung eingebunden werden sollten. Auch sollte der Vollzug durch neue Organisationsformen optimiert werden. Vor diesem Hintergrund hat das Bundesamt für Naturschutz (BfN) das Erprobungs- und Entwicklungsvorhaben "Entwicklung und modellhafte Umsetzung einer regionalen Konzeption zur Bewältigung von Eingriffsfolgen am Beispiel der Kulturlandschaft Mittlere Havel" (E+E-Vorhaben "Mittlere Havel") ins Leben gerufen. Dieses Vorhaben wird durch den Lehrstuhl für Landschaftsplanung (am Institut für Geoökologie) der Universität Potsdam wissenschaftlich begleitet. Fragestellungen und erste Ergebnisse dieser wissenschaftlichen Begleitung werden kurz vorgestellt. Deutlich wird ein umfassender Forschungsansatz, in dem sich planerisch-methodische Aspekte mit geoökologischen Untersuchungen verbinden.
The "Weighting Process" in Land Use Planning - Discussion of the Present Practice of "Weighting Out". Owing to the revision of the Building Code from January 1998 the impact regulation in land use planning is now established in the Building Law. This means the local governments have decision-making powers how to precisely implement the impact regulation. This, however, does not mean - as had been said in practice - that the concerns of nature and landscape can be "weighted out". On the contrary, the decision-making process has to include a detailed differentiation depending on the case, according to a verdict of the Supreme Administrative Court from 1997. The concerns of nature and landscape cannot be moved back as "not of furhter relevance". Only precisely described and insurmontable constraints allow cutbacks. Since compensation measures now can be carried out on the ground of adjacent local communities, a lack of sites available cannot be accepted as a reason. The paper makes clear why also in urban land use planning interference into nature has to be fully compensated for.
Tasks and Content of Landscape Management Planning and Landscape Implementation Planning - Requirements in terms of feasibility of re-checks Zusammenfassung Vor dem Hintergrund in Nachkontrollen vielfach festgestellter Abweichungen des Landschaftspflegerischen Ausführungsplans (LAP) von den Aussagen des Landschaftspflegerischen Begleitplans (LBP) werden Aufgabenverteilung und "Abschichtung" zwischen beiden Planwerken kritisch beleuchtet. Im Landschaftspflegerischen Ausführungsplan nachträglich vorgenommene Anpassungen von z.B. Zielen und räumlicher Lage von Ausgleichs- und Ersatzmaßnahmen können u.U. auch Auswirkungen auf die im LBP zu erstellende Bilanz der Beeinträchtigungen und Kompensationswirkungen und damit auf die Genehmigungsvoraussetzungen haben. Verschiedene Fallbeispiele belegen, dass immer dann, wenn Ausgleichs- und Ersatzmaßnahmen im Landschaftspflegerischen Begleitplan nicht hinreichend konkretisiert werden, der Bezug zu den Beeinträchtigungen schnell verloren geht. Durchgeführte Maßnahmen entsprechen dann zwar i.d.R. noch den Zielen von Naturschutz und Landschaftspflege im betroffenen Naturraum, aber häufig nicht mehr den rechtlichen Anforderungen der Eingriffsregelung. Nachkontrollen sind nur noch im Hinblick auf die korrekte Durchführung, nicht mehr jedoch auf die Funktionserfüllung der Maßnahmen möglich. Als Konsequenz aus den Ergebnissen wird der Vorschlag einer klaren Aufgabenteilung von Landschaftspflegerischem Begleit- und Ausführungsplan entwickelt. Er beinhaltet neben einer hinreichenden Zieldefinition für die Kompensation im Landschaftspflegerischen Begleitplan eine durchgängige Beibehaltung der Maßnahmenbezeichnungen in beiden Planwerken sowie eine gesonderte Darlegung im Landschaftspflegerischen Ausführungsplan vorgenommener Änderungen.

Flussauen stellen in der Bundesrepublik Deutschland seit langem ein gemeinsames Handlungsfeld von Naturschutz und Wasserwirtschaft dar. Nachdem mit der EG-Wasserrahmenrichtlinie (WRRL) eine Neuausrichtung der Gewässerentwicklung in den Mitgliedsstaaten eingeleitet worden ist, stellt sich auch die Frage, welche neuen Ansätze sich den Beteiligten in Bezug auf die Flussauen eröffnen. Welche Bedeutung hat das Gewässerumfeld und mit ihm die Flussauen - für das Erreichen der von der WRRL gesteckten Umweltziele, und wie verändert die Umsetzung der WRRL die Voraussetzungen für den Naturschutz in Flussauen? Da die Wasserrahmenrichtlinie den Begriff "Flussaue" nicht verwendet, werden zunächst die relevanten Regelungen der Richtlinie herausgearbeitet, die einen deutlichen Bezug zu den Naturschutzbelangen in Flussauen erkennen lassen. An zwei Beispielgebieten mit verschiedenen naturräumlichen Bedingungen und unterschiedlichem Ausbauzustand der Gewässer, der "Unteren Havelniederung" und dem "Südlichen Oberrhein", werden - bezogen auf die Anforderungen der WRRL - Gemeinsamkeiten und Unterschiede der Handlungsansätze von Wasserwirtschaft und Naturschutz veranschaulicht. Darauf aufbauend werden schließlich 16 Empfehlungen für die Zusammenarbeit von Naturschutz und Wasserwirtschaft bei der Umsetzung der WRRL formuliert. Die Handlungsempfehlungen richten sich gleichermaßen an den behördlichen Naturschutz und die Naturschutzverbände wie auch an die mit der Umsetzung der Wasserrahmenrichtlinie befassten Behörden der Wasserwirtschaft. Es zeichnet sich ab, dass Naturschutz und Wasserwirtschaft sich bei der Umsetzung ihrer Ziele in Flussauen gegenseitig unterstützen können. Die Beteiligten erhalten konkrete Anregungen, wie die vorhandenen Synergiepotenziale bestmöglich ausgeschöpft werden können.
Umweltprüfung für Bauleitpläne : Stellungnahme des BDLA zum Referentenentwurf für ein EAG Bau

Zusammenfassung Auf der Grundlage von $ 32 BbgNatschG gesetzlich geschützte Biotope unterliegen einem strengen Schutz vor Veränderungen, von dem nur unter bestimmten Voraussetzungen (nach $ 36 BbgNatSchG) Ausnahmen erteilt werden dürfen. In einer Untersuchung von 79 Bescheiden wurden die Genehmigungspraxis und die Umsetzung von Ausgleichs- und Ersatzmaßnahmen bei der Erteilung von Ausnahmen vom gesetzlichen Biotopschutz in drei Kreisen und zwei kreisfreien Städten Brandenburgs analysiert. Hierbei wurde deutlich, dass bei zwei Dritteln der realisierten Beeinträchtigungen die zur Kompensation beauflagten Maßnahmen nicht oder nur unzureichend umgesetzt wurden. Umsetzungsmängel bestehen in der Art der Herstellung wie auch in der Pflege der Maßnahmen. Gründe können sowohl in unklaren Formulierungen der Bescheide als auch im mangelnden Umsetzungswillen der Antragsteller bestehen. Daneben fällt auf, dass gewisse Bestimmungen (z.B. das Vorliegen einer "Geringfügigkeit" von Beeinträchtigungen als Voraussetzung für die Erteilung einer Ausnahme) uneinheitlich gehandhabt werden. Um den Vollzug der Umsetzung stärker voranzutreiben, müssen Nachkontrollen einen höheren Stellenwert in der Arbeit der Naturschutzbehörden bekommen. Hier kann bei der Formulierung der Bescheide bereits wichtige Vorarbeit geleistet werden. Offizielle Musterbescheide und aktualisierte Vollzugshilfen mit Erläuterungen von Rechtsbegriffen sind ein wichtiger Baustein für die tägliche Verwaltungsarbeit. Wenn die Umsetzung dann wenigstens stichprobenartig begleitet und weiterverfolgt wird, können auch die Antragsteller stärker in die Pflicht genommen werden.
Influence on the admittance of projects in the Context of the FFH-Impact Assessment - Analysis of Procedural Documents. With the impact assessment according to the FFH-Guideline and the regulations based on this guideline very strict standards are applied to the reliability of relevant projects. To provide an overview on the present practice of FFH-impact assessment, procedural documents from the Federal States Bavaria, Brandenburg and Thuringia have been analysed. The survey included the examination of the fields of application of FFH-impact assessments, the evaluation of the relevance of disturbances in the impact regulation and the consideration of the individual examination steps in the following exception procedure for the admittance of projects. The results show that the development of the legal concepts in the reports and the sequence of the separate examination steps display significant insecurity. There are conspicuous tendencies, at least in the examples investigated, towards a practice of the FFH-impact assessment in favour of approval.
Ökologisch orientierte Planung umreisst ein komplexes Geschehen, für das fundiertes (natur)wissenschaftliches Grundverständnis, Kreativität und die Fähigkeit, Planung als Kommunikationsprozess zu gestalten, gleichermaßen notwendig sind. Das Buch gibt einen komprimierten Überblick über die wesentlichen Instrumente und Verfahrensweisen. Für die Erfassung, Analyse, Prognose und Bewertung des Naturhaushalts und des Landschaftsbildes sowie für die Darstellung der Auswirkungen von Raumnutzungen bis hin zur Nachkontrolle stellen die Autoren unterschiedliche Verfahrensweisen und Methoden vor. Für jeden Bereich werden die theoretischen Grundlagen angesprochen, gängige Methodenbausteine erläutert und in ihrer Anwendung auf die Schutzgüter bzw. Raumnutzungen exemplarisch verdeutlicht.

Nachkontrollen in der Eingriffsregelung: Erfahrungen aus 4 Jahren Kontrollpraxis in Brandenburg

Zusammenfassung: Im Auftrag des brandenburgischen Ministeriums für Landwirtschaft, Umweltschutz und Raumordnung wurden in den Jahren 1999 bis 2002 stichprobenhafte Nachkontrollen von Ausgleichs- und Ersatzmaßnahmen ausgewählter Vorhaben vorgenommen. Untersucht wurden im Rahmen einer sog. "Durchführungskontrolle" die Vollständigkeit und die Qualität der Herstellung der betreffenden Maßnahmen sowie die Qualität ihrer Pflege. Mittlerweile sind zusammen 391 Flächen erfasst, die zwar nicht statistisch abgesichert, aber doch in der Tendenz Aussagen zur Praxis der Eingriffsregelung in Brandenburg ermöglichen. Aus den Ergebnissen wird insbesondere deutlich, dass Ausgleichs- und Ersatzaßnahmen zwar oft qualitativ hochwertig realisiert werden, die Qualität ihrer Pflege in vielen Fällen jedoch nur als mittel oder unzureichend einzustufen war. Daran anknüpfend werden Folgerungen für die Praxis der Eingriffsregelung diskutiert; sie betreffen die Qualität der Planunterlagen, Anforderungen an die Erstellung der landschaftspflegerischen Ausführungsplanung sowie die Prioritätensetzung bei der Durchführung von Kontrollen. Zusammenfassung Eine Diskussion um das künftige Verhältnis von Landschaftsplanung und Strategischer Umweltprüfung (SUP) hat von den unterschiedlichen Aufgabenstellungen beider Instrumente auszugehen (Umweltfolgenprüfung durch die SUP und konzeptionell-planungsbezogener Ansatz der Landschaftsplanung). Um Überschneidungsbereiche von SUP und Landschaftsplanung zu identifizieren, werden in dem Beitrag verfahrensmäßige und inhaltliche Aspekte getrennt betrachtet. Deutlich wird, dass die Landschaftsplanung für den Bereich Natur und Landschaft eine zentrale Daten- und Informationsgrundlage für die SUP sein kann. Es bleibt zu hoffen, dass vor diesem Hintergrund die im Entwurf zu einem SUP-Stammgesetz vom Juli 2003 vorgesehene SUP- Pflicht für Landschaftsplanungen noch einmal überdacht wird. Bei der Zuarbeit zur SUP besteht für die Landschaftsplanung sowohl die Gefahr einer Überfrachtung als auch die Chance für eine substanzielle inhaltliche Weiterentwicklung: Insbesondere können von der SUP Impulse für mehr Prozesshaftigkeit der Landschaftsplanungen, eine größere Aktualität sowie häufigere und zielgenauere Fortschreibungen ihrer Planwerke ausgehen. Eine zu starke Fixierung der Landschaftsplanung auf die SUP würde allerdings zu einer zu starken fachlichen Einengung auf die Folgenprüfung führen. Um dem zu begegnen, scheint eine flexible Kombination beider Instrumente zielführend. Diese kann erreicht werden, indem die Landschaftsplanung einzelne problembezogen angelegte Module zur SUP erarbeitet und damit für sie den wesentlichen Baustein für die Aufarbeitung der Naturschutzaspekte liefert. A discussion abuot the future relation of Landscape Planning and Strategic Environmental Assessment (SEA) has to base on the different tasks of both instruments (analysis of environmental consequences by the SEA and conceptional approach related to planning by Landscape Planning). In order to identify overlapping parts of SEA and Landscape Planning the study separately investigates aspects of procedure and content. The results show that landscape planning can provide a central base of data and information for the SEA. Against this setting the draft of a SEA core law of July 2003 requiring the conduction of SEA for Landscape Planning will hopefully be reconsidered. The contribution of SEA to Landscape Planning on the one hand holds the risk of overloading but also offers the chance for a substantial further development: The SEA can improve the process aspect of Landscape Planning as well as stimulate more topicality and more frequent and exact updating of planning projects. On the other hand, however, a very strong specification of Landscape Planning towards SEA would lead to a restriction on the analysis of environmental consequences. A flexible combination of both instruments appears to fulfil the target. This means that Landscape Planning develops individual problem-related modules of SEA providing the fundamental component to deal with the nature conservation aspects.
In Poland, EIA and SEA have been integrated into the planning system in a different way compared to Germany. There, EIA is performed within an independent procedure. For projects mandatorily requiring EIA, the respective county decides on the outcome of an EIA, whereas for projects with case-by-case screening the regional authority's council is responsible for this task. There are still significant uncertainties in the application of SEA which sometimes leads to conflicts with the EU provisions. In Poland, provisions for SEA were already made in the year 2000. Different SEA procedures are established for regional plans and for other environmental plans. Furthermore, in April 2004, provisions for the EA according to the Habitats Directive were made in the Polish nature protection act. EA according to the Habitats Directive is strongly linked to EIA and SEA. Poland is already experienced in the practice of EIA and SEA. However, there still is a lack of methodological guidelines. Furthermore, the different legal provisions and procedures need to be further adjusted to each other.
Für das Land Brandenburg war unter Verwendung vorhandener Datengrundlagen ein regionalisiertes Verfahren zur Bewertung der natürlichen Funktionen des Bodens in Planungs- und Zulassungsverfahren zu entwickeln. Das Verfahren fusst auf einer landesweiten Auswertung der Profilbechreibungen der Musterstücke der Reichesbodenschätzung für die Offenlandbereiche sowie einer Zuordnung von bewertungsrelevanten Bodenmerkmalen zu den Lokalbodenformen der Forstlichen Standortserkundung. Ergebnis sind leicht handhabbare Bewertungstabellen mit einer Zuweisung von Wertsufen zu den Klassenflächen der Reichsbodenschätzung sowie den Lokalbodenformen der Forstlichen Standortskartierung.
Der rasante EDV-technische Fortschritt ermöglicht eine zunehmende Integration von Landschaftsbildvisualisierungen in Planungs- und Verfahrensabläufe, etwa um optisch wahrnehmbare Landschaftsbeeinträchtigungen oder die Entwicklung möglicher Ausgleichs- und Ersatzmaßnahmen zu veranschaulichen. Um der Gefahr einer möglichen Manipulation oder einer unsachgemäßen Anwendung von Visualsierungen entgegenzuwirken, gilt es, Mindestanforderungen an derartige Visualisierungen im Rahmen der Eingriffsregelung zu formulieren. Der Beitrag entwickelt Ansatzpunkte für eine Diskussion zu derartigen fachlichen Normen und veranschaulicht anhand von Beispielen die zielgerichtete Einsetzbarkeit verschiedener Visualisierungstechniken.
The implementation of the European Water Framework Directive (WFD) will address land use issues in river catchments in order to reduce diffuse pollution and work towards the aim of achieving good ecological status, or good ecological potential in surface water bodies. The WFD also requires the active involvement of all interested parties in developing the best approach to achieve its objectives. The paper demonstrates how scenario analysis can be applied to investigate the impacts of land use changes and how stakeholder interviews can be used to evaluate the results of the scenarios. The study was carried out in the Havel Basin in the northeast of Germany. "Landscape-ecological spatial units" were derived from similar characteristics of soil and groundwater conditions, ground relief and inundation to enable spatial allocation of potential land use and link different scales when describing possible changes in land use. As a first step, in three sub-catchments of the Havel river (distinguished by different physical characteristics) detailed surveys were carried out to investigate the various interests of the stakeholders. The interviews were used to identify the key problems of each area with respect to water quality and quantity and facilitated stakeholder engagement with the catchment planning issues in the Havel river basin. The information from the stakeholder interviews was used to determine the initial conditions for the land use scenarios which were developed to demonstrate possible changes to land use for achieving better water quality. The land use scenarios also were required as an input into the hydrological modelling of their effects on water quality and to calculate their socio-economic effects. In a second survey the results of the scenarios and the hydrological modelling were presented to the stakeholders. The consultation process identified the priorities of the stakeholders which could then be taken into account when developing management options. Das Referat Bodenschutz in brandenburgischen Ministerium für Landwirtschaft, Umweltschutz und Raumordnung hat im Oktober ein Vorhaben mit dem Titel "Bodenbewertung für Planungs- und Zulassungsverfahren im Land Brandenburg" an den Lehrstuhl für Landschaftsplanung an der Universität Potsdam vergeben. Ziel ist, auf der Grundlage des Bundes-Bodenschutzgesetzes die Belange des Bodenschutzes künftig über einheitliche und nachvollziehbare Bewertungsmethoden in Planungs- und Zulassungsverfahren einzubringen. Das entwickelte Bewertungsverfahren bezieht sich auf die aus dem BBodSchG ableitbaren natürlichen Bodenfunktionen Lebensraum- und Regulationsfunktionen sowie auf seine Funktion als Archiv der Natur- und Kulturgeschichte und soll helfen, die spezifisch brandenburgischen Gegebenheiten bei planerischen Bewertungen zu berücksichtigen. Der Beitrag enthält eine Synopse des Herleitungsvorganges und gibt die wesentlichen Bewertungsergebnisse für die einzelnen Teilfunktionen wieder.
Auch nach über 25 Jahren Anwendung der Eingriffsregelung nehmen landschaftsästhetische Aspekte häufig noch eine deutlich schwächere Stellung gegenüber den Belangen des Naturhaushalts ein. Als besonders schwierig erweist sich die Erfassung und Bewertung des Landschaftsbildes und - ausgehend von den konkreten Beeinträchtigungen, die vom Vorhaben ausgehen - die Ableitung wirkungsbezogener Kompensationsmaßnahmen. Mit der vorliegenden Veröffentlichung wird eine Handlungsanleitung zur Erfassung und Beschreibung des Landschaftsbildes vorgelegt, die insbesondere auf eine schlüssige Begründung und Herleitung von Vorkehrungen zur Vermeidung sowie von Ausgleichs- und Ersatzmaßnahmen zur landschaftsgerechten Wiederhertsellung und Neugestaltung des Landschaftsbildes abzielt. Wesentlich ist, dass dabei der notwendige Bezug auf die Charakteristik des jeweiligen Landschaftsraums im Vordergrund steht. Daneben werden die Einsetzbarkeit verschiedener Methoden der Landschaftsvisualisierung im Arbeitsablauf der Eingriffsregelung beleuchtet, Hinweise für entsprechende Standards begründet sowie Empfehlungen für Nachkontrollen von Kompensationsmaßnahmen begründet.
Zusammenfassung In der naturschutzrechtlichen Eingriffsregelung wird das Landschaftsbild gegenüber den Belangen des Naturhaushalts oft nachrangig behandelt, obwohl es von den Voraussetzungen des Bundesnaturschutzgesetzes her gleichermaßen in alle Schritte der Folgenbewältigung einzubeziehen ist. Für diese Schritte werden exemplarisch rechtliche Rahmenbedingungen und fachliche Anforderungen aufgezeigt. Ingesamt wird so eine strukturierte Herangehensweise deutlich, die über die einzelnen Arbeitsschritte der Erfassung des Ist-Zustandes, der Aufstellung eines Zielkonzeptes, der Ableitung von Vorkehrungen zur Vermeidung sowie der Begründung von Maßnahmen zur landschaftsgerechten Wiederherstellung und Neugestaltung des Landschaftsbildes hinweg durchgängig auf denselben Beschreibungsmerkmalen aufbaut und damit einen durchgängigen Ableitungszusammenhang von den ermittelten Beeinträchtigungen des Landschaftsbildes zu darauf Bezug nehmenden Maßnahmen begründet. Wesentlich ist, dass dabei die Charakteristik des jeweiligen Landschaftsraumes im Vordergrund steht und dass nicht nur einzelne Beeinträchtigungen betrachtet, sondern diese jeweils in ihrem Zusammenwirken auf den wahrgenommenen Raumeindruck beleuchtet werden. Legal framework conditions and special requirements The impact regulation of nature conservation only gives inferior treatment to the visual landscape compared to other natural resources although nature conservation legislation requires its equal integration into all steps of consequential dealing. For these steps the study shows exemplary legal framework conditions and specialist requirements. They should make clearer a structural approach including individual working steps, such as recording of present site conditions, establishment of a target concept, derivation of measures of avoidance and justification of measures for a sensitive regeneration and design of the visual landcape. The approach continuously bases on the same features of description, leading to a consistent connection between identified disturbances of the visual landscape and related measures. The focus of attemtion should be given to the characteristics of the respective landscape and the analysis should not only consider disturbances or compensation measures individually but also in combination with the general spatial perception. Another important aspect is the legal security; therefore the text closely follows the terminology of the Federal Nature Conservation Legislation.
