In 2009, 'Palestine' lodged a declaration recognizing the jurisdiction of the ICC under Article 12(3). However, in April 2012, the OTP determined that this declaration had not brought about the result, of providing for the ICC's jurisdiction, pending clarification from the political organs of the UN concerning the legal status of Palestine within the organization. On 29 November 2012, the General Assembly granted Palestine the status of a non-member observer state within the UN framework, thereby fulfilling the condition mentioned by the OTP in April 2012. It is against this background that the article considers the current legal effects of the 2009 Palestinian declaration. In particular, it addresses the issue of whether the declaration, when read in conjunction with the 29 November 2012 decision, possesses retroactive effect, i.e. whether it provides, as claimed, for the Court's temporal jurisdiction from 1 July 2002 onwards or rather starting only from 29 November 2012.

Changes in rainfall interception along a secondary forest succession gradient in lowland Panama

Secondary forests are rapidly expanding in tropical regions. Yet, despite the importance of understanding the hydrological consequences of land-cover dynamics, the relationship between forest succession and canopy interception is poorly understood. This lack of knowledge is unfortunate because rainfall interception plays an important role in regional water cycles and needs to be quantified for many modeling purposes. To help close this knowledge gap, we designed a throughfall monitoring study along a secondary succession gradient in a tropical forest region of Panama. The investigated gradient comprised 20 forest patches 3 to 130 yr old. We sampled each patch with a minimum of 20 funnel-type throughfall collectors over a continuous 2month period that had nearly 900 mm of rain. During the same period, we acquired forest inventory data and derived several forest structural attributes. We then applied simple and multiple regression models (Bayesian model averaging, BMA) and identified those vegetation parameters that had the strongest influence on the variation of canopy interception. Our analyses yielded three main findings. First, canopy interception changed rapidly during forest succession. After only a decade, throughfall volumes approached levels that are typical for mature forests. Second, a parsimonious (simple linear regression) model based on the ratio of the basal area of small stems to the total basal area outperformed more complex multivariate models (BMA approach). Third, based on complementary forest inventory data, we show that the influence of young secondary forests on interception in realworld fragmented landscapes might be detectable only in regions with a substantial fraction of young forests. Our re-sults suggest that where entire catchments undergo forest regrowth, initial stages of succession may be associated with a substantial decrease of streamflow generation. Our results further highlight the need to study hydrological processes in all forest succession stages, including early ones.
The sidi Mohamed peridotites (Edough Massif, NE Algeria) - evidence for an upper mantle origin

The Hercynian Edough massif is the easternmost crystalline massif of the Algerian coast. It consists of two tectonically superposed units composed of micaschists, gneisses, and peridotite. This study concentrates on the small and isolated Sidi Mohamed peridotite outcrop area (0.03 km(2)). The Sidi Mohamed peridotite is composed mainly of harzburgites (Mg-rich olivine and orthopyroxene as major minerals). The Ni (2051-2920 ppm), Cr (2368-5514 ppm) and MgO (similar to 28-35 wt.%) whole-rock composition and the relative depletion in Nb make these harzburgites comparable to depleted peridotites related to a subduction zone. We suggest that the Sidi Mohamed ultramafic body was derived directly from the upper mantle and tectonically incorporated into the gneiss units of the Edough metamorphic core complex in a subduction environment.
The main morphological features of variations of the total electron content (TEC) of the ionosphere before the earthquakes on March 11, 2011 (Japan) and October 23, 2011 (Turkey) are examined. The revealed features are compared to those of ionospheric TEC disturbances observed prior to several other large seismic events, as well as to those included in a list of the most frequently observed ionospheric TEC disturbances interpreted as possible ionospheric precursors of earthquakes. It is shown that, in the periods of preparation of the earthquakes under consideration, on March 8-11 and October 20-23, abnormal ionospheric TEC disturbances were observed as long-lived structures in a near-epicentral region and in the region magnetically conjugated to it.
Convergence of the frequency-magnitude distribution of global earthquakes - maybe in 200 years

I study the ability to estimate the tail of the frequency-magnitude distribution of global earthquakes. While power-law scaling for small earthquakes is accepted by support of data, the tail remains speculative. In a recent study, Bell et al. (2013) claim that the frequency-magnitude distribution of global earthquakes converges to a tapered Pareto distribution. I show that this finding results from data fitting errors, namely from the biased maximum likelihood estimation of the corner magnitude theta in strongly undersampled models. In particular, the estimation of theta depends solely on the few largest events in the catalog. Taking this into account, I compare various state-of-the-art models for the global frequency-magnitude distribution. After discarding undersampled models, the remaining ones, including the unbounded Gutenberg-Richter distribution, perform all equally well and are, therefore, indistinguishable. Convergence to a specific distribution, if it ever takes place, requires about 200 years homogeneous recording of global seismicity, at least.
We show how the maximum magnitude within a predefined future time horizon may be estimated from an earthquake catalog within the context of Gutenberg-Richter statistics. The aim is to carry out a rigorous uncertainty assessment, and calculate precise confidence intervals based on an imposed level of confidence a. In detail, we present a model for the estimation of the maximum magnitude to occur in a time interval T-f in the future, given a complete earthquake catalog for a time period T in the past and, if available, paleoseismic events. For this goal, we solely assume that earthquakes follow a stationary Poisson process in time with unknown productivity Lambda and obey the Gutenberg-Richter law in magnitude domain with unknown b-value. The random variables. and b are estimated by means of Bayes theorem with noninformative prior distributions. Results based on synthetic catalogs and on retrospective calculations of historic catalogs from the highly active area of Japan and the low-seismicity, but high-risk region lower Rhine embayment (LRE) in Germany indicate that the estimated magnitudes are close to the true values. Finally, we discuss whether the techniques can be extended to meet the safety requirements for critical facilities such as nuclear power plants. For this aim, the maximum magnitude for all times has to be considered. In agreement with earlier work, we find that this parameter is not a useful quantity from the viewpoint of statistical inference.

Dieser Band untersucht anhand ausgewählter Beispiele die religiöse Alltagswelt der Spätantike. Unter Zugrundelegung pragmatischer Definitionen der Kernbegriffe "Religion" und "Alltag" zeigt er über mehrere Regionen des Imperium Romanum hinweg und in verschiedenen Kontexten, ob und wie die vielfältigen Veränderungsprozesse politischer, religiöser, aber auch ökonomischer Art, die die Epoche prägten, im alltäglichen religiösen Handeln der Menschen einen Ausdruck fanden.

Im September 2009 fand der 5. Potsdamer Lateintag statt. Er war Bestandteil des auf drei Jahre angelegten Brandenburger Antike-Denkwerks (BrAnD), das von der Robert Bosch Stiftung gefördert wurde. Thema war dieses Mal: Macht und Ohnmacht der Worte – Gesellschaft und Rhetorik. Aus der Antike stammen nicht nur die heute noch benutzten Rhetoriktheorien und -anweisungen. Auch das reziproke Verhältnis von Gesellschaft und Rhetorik wurde hier vorgelebt und vorgedacht. Es sollte mit antiken Rhetoriklehren vertraut gemacht werden, antike Reden auf deren Umsetzung und auf ihre Wirkung betrachtet und die Möglichkeit einer heutigen Umsetzung überprüft werden. Der Band versammelt die Vorträge des Lateintags von Herrn Prof. Dr. P. Riemer und Herrn Prof. A. Fritsch, die Darstellung zum Ablauf des gesamten Projekts sowie eine Auswahl der Berichte zu den Schulprojekten.
Dispositive zeichnen sich aus durch einen phantasmatischen und affektorientierten Bezug, den das Subjekt zu ihnen herstellt und in dem es sich konstituiert. Dispositive stellen das Movens zur Verfügung, das zur immer neuen Aktualisierung dieses Bezugs verführt. Paris, Berlin, Charleroi - die Beiträge dieses Bandes lassen die Stadt als Dispositiv der Literatur zutage treten. Sie verhandeln dessen Hybridität und Heterogenität, sie reflektieren es als Produktions- und Rezeptionsstätte von Literatur, Philosophie und Kritik. Schriftsteller erfinden und zerstören Städte. Ihre Texte sind auch dort städtisch, wo gar nicht von der Stadt gesprochen wird. Die Stadt als Dispositiv manifestiert sich auch als Non-Dit des literarischen und philosophischen Diskurses.
EMOTIKON-Studie benannte als Kurzform des Forschungsvorhabens zur “Interdisziplinäre(n) Evaluierung der motorischen Leistungsfähigkeit und des Gesundheitszustandes im Kontext sportlicher Eignung und Effizienz des Sportunterrichtes von GrundschülerInnen im Land Brandenburg“. Die Längsschnittstudie wurde durch den Arbeitsbereich Trainings- und Bewegungswissenschaft der Universität Potsdam, unter der Leitung von Prof. Dr. Ditmar Wick, an 29 Grundschulen der Schulämter Brandenburg/ Havel und Cottbus von 2006 bis 2010 realisiert. Mit der vorliegenden Publikation werden die Ergebnisse und deren Zusammenhänge zur Entwicklung der motorischen Leistungsfähigkeit, des Körperbaus, der Bewegungsaktivität und der Einschätzung des Sportunterrichts mit einführenden theoretischen Grundlagen und dem aktuellen nationalen Forschungsstand referiert. Die Autoren sind überzeugt, dass dieser Abschlussbericht nicht nur das Interesse der im aktuellen Forschungsprojekt „EMOTIKON-Grundschulsport 2010-2014“ involvierten Brandenburger Grundschulsportlehrer wecken wird, sondern auch den politischen Entscheidungsträgern (Schulämter, Ministerien) eine Entscheidungshilfe bieten als auch den Diskussionsprozess der im Themengebiet forschenden Wissenschaftler anregen kann. Diese Überzeugung gründet sich insbesondere auf die Ergebnisse zur körperlich-sportlichen Bewegungsaktivität der Dritt- bis Sechstklässler sowie der Analyse motorischer Leistung in Abhängigkeit von Geschlecht und soziodemografischen Gegebenheiten.
Im September 2010 fand der 6. Potsdamer Lateintag statt. Er war Bestandteil des um ein Jahr erweiterten Brandenburger Antike-Denkwerks (BrAnD), das von der Robert Bosch Stiftung gefördert wurde. Thema war dieses Mal das Römische Recht. Das Römische Recht ist ein faszinierender Forschungsbereich. Es hat die europäische Rechtsentwicklung geprägt und wirkt noch heute nach. Gleichzeitig gehört es zu den Themen, die uns bei der Lektüre lateinischer Texte immer wieder begegnen, die aber Fragen aufwerfen, da man mit der speziellen Thematik oft nicht vertraut ist. Das Projekt wollte die Lücke schließen. Es sollten nicht nur literarische Texte auf ihren rechtlichen Hintergrund hin befragt, sondern auch Fragen gestellt werden, wie der römische Alltag rechtlich geregelt war. Neben der wissenschaftlichen Beschäftigung mit diesen Fragen sollte immer auch der Vergleich mit heute gezogen werden. Der Band versammelt den Vortrag am Lateintag von Frau Prof. Dr. C. Möller, Materialsammlungen u.a. zu den Themen patria potestas, lex Aquilia, Geld bzw. Kauf-Tausch-Kontroverse, die Darstellung zum Ablauf des gesamten Projekts sowie eine Auswahl der Berichte zu den Schulprojekten.
Der Staat im Recht – getragen vom und gebunden durch das Recht, orientiert an Gemeinwohl und Individualrechten gleichermaßen – ist Gegenstand und Ziel des wissenschaftlichen Wirkens von Eckart Klein.
Eckart Klein, dessen 70. Geburtstag Anlass zu dieser Festschrift ist, hat sich als Rechtswissenschaftler dem Öffentlichen Recht in seiner ganzen Bandbreite gewidmet, wobei die Tätigkeit am Heidelberger Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht und die Zeit als wissenschaftlicher Mitarbeiter am Bundesverfassungsgericht seine Interessen nachhaltig geprägt und fokussiert haben. Wichtige Themen seiner Publikationstätigkeit während seiner gesamten wissenschaftlichen Laufbahn sind dementsprechend das Verfassungsprozessrecht, das allgemeine Völkerrecht, das Recht der internationalen Organisationen und der internationale Menschenrechtsschutz.
Nach einer Station an der Johannes Gutenberg-Universität in Mainz wechselte er an die Universität Potsdam. Hier gründete er auch das MenschenRechtsZentrum der Universität Potsdam, dem er als Direktor vorstand. Der Jurist ergänzte seine Tätigkeit als Hochschullehrer durch die Wahrnehmung von Richterämtern an den Oberverwaltungsgerichten in Koblenz und Frankfurt (Oder) sowie am Staatsgerichtshof in Bremen. Außerdem war er Mitglied des Menschenrechtsausschusses der Vereinten Nationen und wirkte mehrfach als deutscher Ad-hoc-Richter an Verfahren vor dem Europäischen Gerichtshof für Menschenrechte mit. Dass bei alldem die akademische Lehre nicht zu kurz kam, war für Eckart Klein oberstes Gebot.
Schüler und Weggefährten haben in dieser Festschrift Beiträge aus den Bereichen des Völkerrechts, des Europarechts und des nationalen Rechts versammelt, um die Position des Staates im Recht aus unterschiedlichen Blickwinkeln auszuloten, Grenzen staatlichen Handelns zu markieren und nach Maßstäben für hoheitliche Entscheidungen zu fragen.

Das „Berliner Journal für Soziologie“ beginnt seinen 23. Jahrgang mit einem Heft zum Schwerpunktthema „Ordnung und Gewalt“. Damit geben zwei Begriffe und Konzepte die Perspektive vor, die auf die Konstitutionsproblematik von Gesellschaften verweisen. Das wechselseitige Verhältnis von sozialer Ordnung und Gewalt steht im Mittelpunkt der Beiträge. Einerseits untersuchen sie dieses Wechselverhältnis anhand unterschiedlicher Gewalt- und Ordnungsformen und ihres Zusammenspiels, andererseits thematisieren sie Gewalt sowohl als individuelles, aber gesellschaftlich gerahmtes als auch als kollektives und damit organisiertes soziales Phänomen.
On July 20/21 in 2012, an international workshop was held on the subject of the global impact of the Euro-Financial-Crisis at the University of Potsdam. Prof. Dr. Detlev Hummel, faculty Finance and Banking, was the host of the event. Academic colleagues from Beijing, Moscow and Connecticut (USA) as well as domestic capital market and banking experts presented their analyses. Different aspects of national and international finance markets were examined, with a focus on the European region, China and Russia. Mistakes and failures of the banking regulations were identified as one, but note the sole cause of the economic problems. A lack of budget discipline of some politicians and the loss of business competitiveness of certain European nations were mentioned, too. Some members of the European Union did not succeed in mastering the challenges of the global economy. There have been structural issues in some states that impede their competitiveness in the global market, for example with China. The participants pointed out a number of other reasons for the crisis, like dubious distribution types as well as a lack of transparency of certain financial products. Furthermore, remuneration and incentive schemas of investment banks and especially the reckless risk management policy of large banks were identified as other factors for the crisis. The participants of the international workshop in Potsdam agree that the birth of the Euro-currency was a political event and will remain a challenge. The reform of the banking supervision and further steps towards an economic and fiscal union are new research tasks.

This volume provides an overview of current research priorities in the analysis of face-to-face-interaction in Slavic speaking language communities. The core of this volume ranges from discourse analysis in the tradition of interactional linguistics and conversation analysis to newer methods of politeness research. A further field includes empirical and interpretive methods of modern sociolinguistics and statistical analysis of spoken language in casual and institutional talks. Several papers focus on a semantic or syntactic analysis of talk-in-interaction by trying to show how interlocutors use certain lexical, grammatical, syntactic and multimodal or prosodic means for the management of interaction in performing specific actions, genres and displaying negotiations of epistemic, evidential or evaluative stances. The volume is rounded out by contributions to the theory of politeness where strategies of face-work in casual as well as institutional discourse are analyzed, or in which social tasks entertained by code-switching and language alternation within the interaction of bilinguals are discussed.
This volume offers a coherent and detailed picture of the diachronic development of verbal categories of Old English, Old High German, and other Germanic languages. Starting from the observation that German and English show diverging paths in the development of verbal categories, even though they descended from a common ancestor language, the contributions present in-depth, empirically founded studies on the stages and directions of these changes combining historical comparative methods with grammaticalisation theory. This collection of papers provides the reader with an indispensable source of information on the early traces of distinct developments, thus laying the foundation for a broad-scale scenario of the grammaticalisation of verbal categories. The volume will be of particular interest to scholars of language change, grammaticalisation, and diachronic sociolinguistics; it offers important new insights for typologists and for everybody interested in the make-up of verbal categories.
