Die feindliche Besetzung eines Landes im Zuge eines verlorenen Krieges stellt immer einen tiefen und mit Ungewissheiten verbundenen Einschnitt dar. So erlebte auch die preußische Bevölkerung während des französischen Besatzungsregimes zwischen 1806 und 1808 große finanzielle und materielle Herausforderungen, indem sie für die Versorgung der Besatzungstruppen aufkommen musste.
Diese Erfahrungen trugen dazu bei, das politische Verantwortungsgefühl innerhalb der Bürgerschaft noch stärker zu beleben und mehr Mitspracherechte zu fordern. Darüber hinaus sah auch die Staatsführung endgültig die Notwendigkeit für Reformen ein. Im Zuge dieser Veränderungen erfolgte in Preußen der Übertritt ins moderne Zeitalter.
Im vorliegenden Band werden diese Entwicklungen am Beispiel der brandenburgischen Stadt Eberswalde dargestellt. Durch die Auswertung von bisher erstmals erschlossenem Aktenmaterial wird ein eindrucksvolles Bild der damaligen Lebensumstände in einer Zeit des Umbruchs vermittelt.
Frank Göse, Hochschullehrer und apl. Professor für Landesgeschichte an der Universität Potsdam, dem der vorliegende Band anlässlich seines 65. Geburtstages gewidmet ist, setzt sich seit Jahrzehnten epochenübergreifend und vergleichend mit der Geschichte seines Heimatlandes Brandenburg und der daran geknüpften Mythen auseinander. Mit seiner dezidiert quellengesättigten, thematisch und methodisch stets offenen Forschung legt er neue Perspektiven auf »Land und Leute« frei. Denn nicht nur die Betrachtung Brandenburgs und Preußens, sondern ebenso der Blick auf das benachbarte Sachsen und die Herstellung internationaler Kontexte zeichnen Frank Göse aus, sodass die hier versammelten Beiträge seiner Schülerinnen und Schüler sowie Wegbegleiterinnen und Wegbegleiter die vielfältigen Interessen des Jubilars spiegeln.
Warum spricht der Papagei? Weiß er, was er sagt? Und warum ist sein Sprechen, das wie menschliche Rede klingt, und doch etwas ganz anderes ist, so irritierend? Dieser Irritation folgt Sula Textor durch die komplexe Geschichte des Papageis als Figur in Kunst und Literatur und entwirft dabei den Begriff des (narrativen) Psittazismus. In ihrer komparatistisch angelegten narratologischen Studie wird Sprechen selbst zum Thema – und die Stimme (im individuellen, politischen wie narratologischen Sinn) zum Problem. Sie hinterfragt nicht nur, was Sprechen ist und wem es möglich und erlaubt ist, sondern nimmt die Komplexität des Erzählens grundsätzlich in den Blick.
This volume presents an innovative picture of the ancient Mediterranean world. Approaching poverty as a multifaceted condition, it examines how different groups were affected by the lack of access to symbolic, cultural and social – as well as economic – capital.
Collecting a wide range of studies by an international team of experts, it presents a diverse and complex analysis of life in antiquity, from the archaic to the late antique period. The sections on Greece, Rome, and Late Antiquity offer in-depth studies of ancient life, integrating analysis of socio-economic dynamics and cultural and discursive strategies that shaped this crucial element of ancient (and modern) societies. Polizei- und Ordnungsrecht

Den Schwerpunkt des Buches bildet das allgemeine Polizei- und Ordnungsrecht, wobei dessen Verzahnung mit dem Versammlungsrecht ein besonderes Augenmerk geschenkt wird. Wert wird außerdem stets auf die Herausarbeitung der Grundgedanken und Strukturen der jeweiligen Vorschriften gelegt, weniger auf reine Detailregelungen. Dabei werden an geeigneter Stelle auch Parallelen zum Zivil- und zum Strafrecht gezogen. Die Gesetzesstellen werden nach dem Musterentwurf eines einheitlichen Polizeigesetzes des Bundes und der Länder (MEPolG) zitiert. Aus der Synopse am Ende des Buches lassen sich dann schnell die jeweiligen landesrechtlichen Parallelfundstellen ermitteln.
Jenseits überkommener Deutungsmuster schildert Dominik Geppert in diesem anschaulich geschriebenen Band die Geschichte der Bundesrepublik Deutschland von den Anfängen bis zur Gegenwart. Er zeichnet den Weg vom Frontstaat im Kalten Krieg bis zur heutigen Macht in der Mitte Europas nach und legt dabei ein besonderes Augenmerk auf die sich verstärkt seit der Wiedervereinigung stellende Frage nach der staatlichen und gesellschaftlichen Identität Deutschlands. Where contemporary developments have significantly altered the implementation methods of, and relationship between, human rights law and international humanitarian law, this timely book looks at the future challenges of protecting human rights during and after armed conflicts. Leading scholars use critical case studies to shed light on new approaches used by international courts and experts to balance these two bodies of law. Divided into four thematic parts, chapters explore the protection of specific groups and actors during conflicts, including organised armed groups, armed non-state actors, and refugees, as well as using divergent methodological approaches to analyse the extra-territorial application of human rights treaties. Shifting to post-conflict, the book further examines the tools and practices involved in building lasting peace and sustainable post-conflict order while avoiding future resurrection of armed conflict. It concludes by considering whether the traditional interpretation of international law is still apt for the twenty-first century. Underlining the necessity of a more coherent application of international humanitarian law and human rights law, this incisive book will be invaluable to students and scholars from the two areas of law. Europäisches Steuerrecht

Die Besteuerung der öffentlichen Hand erfreut sich in Praxis und Wissenschaft derzeit stark steigender Aufmerksamkeit. Dafür gibt es eine Reihe von Gründen. Zum einen hat sich die organisatorische Struktur der Aufgabenerfüllung durch die öffentliche Hand in den vergangenen Jahrzehnten stark verändert. Privatisierung und Kooperation mit Privaten bzw. Outsourcing sind hier zentrale Stichworte. Diese neuen, teilweise hybriden Strukturen der Aufgabenerfüllungen ziehen steuerliche Folgefragen nach sich. So kann die früher häufig geäußerte Formel, dass der Staat von sich selbst keine Steuern erheben solle, heute so nicht mehr gelten. Vielmehr muss eine Besteuerung immer dann erfolgen, wenn die öffentliche Hand zu privaten Mitbewerbern in ein – wenn auch nur potentielles – Konkurrenzverhältnis tritt.
Zum anderen haben sich auch die rechtlichen Rahmenbedingungen verändert. Durch die Rechtsprechung des Europäischen Gerichtshofs, etwa zur Umsatzsteuer, wurde beispielsweise der steuerliche Nexus auf Bereiche der öffentlichen Hand ausgeweitet, die früher nicht als steuerpflichtig galten. Umgekehrt hat der Gesetzgeber versucht, die ertragsteuerliche Lage von Dauerverlustbetrieben der öffentlichen Hand im KStG abschließend zu regeln. Es wird in der Wissenschaft bezweifelt, ob das gelungen ist. So könnten noch viele Beispiele ergänzt werden. Dieses Handbuch systematisiert die auftretenden Fragen wobei alle Lebens- und Wirtschaftsbereiche Berücksichtigung finden, die mit dem Staat und seinen Untergliederungen in unmittelbarem oder mittelbarem Zusammenhang stehen und für die Besteuerung relevant sind und somit ein umfassendes Kompendium der Besteuerung der öffentlichen Hand bietet.
Dieses Buch widmet sich dem Landesrecht des Stadtstaats Berlin, insbesondere mit Blick auf dessen organisatorische Strukturen. Berlin weist hier gegenüber den Flächenländern grundlegende Besonderheiten auf, da es keine Gemeinden gibt, sondern nur Bezirke ohne eigene Rechtspersönlichkeit. Die Besonderheiten Berlins werden anhand eines Vergleichs mit dem Kommunalrecht der Flächenländer aufgezeigt. Dabei findet die aktuelle Rechtsprechung und Literatur mit Bezug zur Berliner Verwaltung eine vollständige Berücksichtigung. Der weiteren Vertiefung dienen Übungsfälle aus der Rechtsprechung der Berliner Gerichte. Das Buch richtet sich an Studierende der Rechtswissenschaft, Rechtsreferendare und Praktiker in Gerichten, Verwaltungen und Beraterschaft.
Classical liberal democratic theory has provided crucial ideas for a still dominant and hegemonic discourse that rests on ideological conceptions of freedom, equality, peacefulness, inclusive democratic participation, and tolerance. While this may have held some truth for citizens in Western liberal-capitalist societies, such liberal ideals have never been realized in colonial, postcolonial and settler colonial contexts. Liberal democracies are not simply forms of rule in domestic national contexts but also geo-political actors. As such, they have been the drivers of processes of global oppression, colonizing and occupying countries and people, appropriating indigenous land, annihilating people with eliminatory politics right up to genocides. There can be no doubt that the West – with its civilizational Judeo-Christian idea and divine mission ‘to subdue the world’ – has destroyed other civilizations, countries, trading systems, and traditional ways of life and is responsible for the death of hundreds of millions of human beings in the course of colonizing the world from its Empires of trade through colonialism to settler colonialism and today’s politics of regime change. The book discusses the settler colonial regime that Israel has established in Palestine while still claiming to be a democracy. It discusses the failures of liberal democracy to overcome the structural and racist inequalities in post-Apartheid South Africa, and it presents hopeful outlooks on new ideas and forms of democracy in social movements in the MENA region.
Contesting citizenship

Democracy and citizenship are conceptually and empirically contested. Against the backdrop of recent and current profound transformations in and of democratic societies, this volume presents and discusses acute contestations, within and beyond national borders and boundaries. Democracy’s crucial relationships, between state and citizenry as well as amongst citizens, are rearranged and re-ordered in various spheres and arenas, impacting on core democratic principles such as accountability, legitimacy, participation and trust. This volume addresses these refigurations by bringing together empirical analyses and conceptual considerations regarding the access to and exclusion from citizenship rights in the face of migration regulation and institutional transformation, and the role of violence in maintaining or undermining social order. With its critical reflection on the consequences and repercussions of such processes for citizens’ everyday lives and for the meaning of citizenship altogether, this book transgresses disciplinary boundaries and puts into dialogue the perspectives of political theory and sociology.
Seit Jahrzehnten kämpft die New People’s Army in den Philippinen gegen Ausbeutung und Armut. In den 1980ern Jahren schlossen sich mehrere katholische Priester ihr an und prägten sie. Eine Fraktion, zu der Conrado Balweg (1944-99) gehörte, betonte die Bewahrung der indigenen Kultur. Balweg war Mitglied des Tinguianvolkes, wurde Pater in einem katholischen Orden, stieg in der Guerilla zum Kommandeur auf, war der meistgesuchte „Terrorist“ unter Marcos und initiierte die Errichtung einer Autonomieregion für die Bergvölker. 1999 exekutierte ihn die kommunistische Partei.
Das Buch wertet Zeitzeugenberichte, Korrespondenzen und Archive zu einer exemplarischen Biographie aus. Der Autor hat in den Philippinen gelebt und mehrere Interviewreisen dorthin unternommen.

Das Recht jedes einzelnen Landes wird dabei jeweils in den Fußnoten nachgewiesen. So ist es nicht schwer, das "eigene" Recht wieder zu finden und zudem auch Parallelen zum Recht anderer Länder zu ziehen. Die zahlreichen Hinweise auf länderübergreifende Lehrbücher und die weiteren umfangreichen Literaturangaben erleichtern die Nacharbeit.

2021 wurde die Universität Potsdam 30 Jahre alt. Zeit für eine kurze Hochschulgeschichte in Bildern! Auf 168 Seiten finden sich rund 400 Fotos aus der Geschichte der Potsdamer Alma Mater – von der Pressekonferenz, auf der Brandenburgs Wissenschaftsminister Dr. Hinrich Enderlein die Gründung der Universität bekannt gibt, bis zu den traurig-schönen menschenleeren Campusimpressionen mitten in der Corona-Pandemie Anfang 2021. Die Auswahl aus Zehntausenden Bildern, die im Laufe der Jahre entstanden sind, dokumentiert die rasante Entwicklung der drei Uni-Standorte Golm, Am Neuen Palais und Griebnitzsee, begleitet Studierende und Forschende verschiedener Generationen und zeigt Eindrücke von wichtigen großen und kleinen Veranstaltungen und Ereignissen sowie – vor allem – vom Alltag einer Universität.

Klausurenkurs im Europarecht

Jetzt mit neuem Fall! Die 6. Auflage enhält einen ganz neuen Fall zum PSPP-Beschluss des BVerfG. Die Konzeption: Dieser Klausurenkurs ist die optimale Ergänzung zum Standardlehrbuch zum Europarecht von Streinz. Angesprochen werden neben den Studierenden des Schwerpunktbereichs Internationales Recht/Europarecht, (deren Bedürfnisse durch das Buch in vollem Umfang abgedeckt werden) auch und insbesondere Pflichtfachstudierende. Sie erhalten das nötige Rüstzeug für examensrelevante Fragestellungen im Europarecht und erhalten einen Eindruck von der Vielfalt von Aufgabenstellungen, den unterschiedlichen Schwierigkeitsgraden sowie den damit verbundenen Erwartungshaltungen an den Klausurschreiber. Der Inhalt im Einzelnen: Der Band ist in drei Kapitel untergliedert. Zu Beginn werden die Arbeitsmöglichkeiten für die beiden angesprochenen Zielgruppen aufgezeigt. Im 2. Kapitel werden sodann auf abstrakter Ebene diejenigen Klausurkonstellationen dargestellt, die im Gemeinschaftsrecht relevant werden können. Hier findet der Leser den allgemeinen Zugang zu klausurrelevanten Fallgestaltungen. Den Kern des Buches bildet der Klausurenteil im 3. Kapitel. Er enthält 23 Fälle, welchen jeweils Leitentscheidungen des EuGH und anderer Gerichte zugrunde liegen. Die entschiedenen Fälle werden klausurtechnisch aufbereitet und um angrenzende Problempunkte ergänzt, so dass jeweils komplette Klausuraufgaben entstehen. Die Verwendungsmöglichkeit als Prüfungsleistung (Schwerpunkt- oder Pflichtfachklausur) wird im Rahmen der Vorüberlegungen zu jedem Fall erläutert.
