Alexander von Humboldt betätigte sich in unterschiedlichsten Wissensbereichen und vielen Disziplinen. Obwohl er natürlich kein Jurist war, hat er sich vielfach mit Problemen befasst, die zu seinen Lebzeiten und danach zu grundlegenden Fragen des in der Entstehung begriffenen Völkerrechts avancierten. So beschäftigte er sich mit dem Verbot der Sklaverei und der Abschaffung der Rassendiskriminierung, mit der Fixierung von territorialen Grenzen von Staaten, mit Seegrenzen, der Förderung des Welthandels und der Hoheitsgewalt im Luft- und im Weltraum. Viele dieser Fragen wurden später in internationalen Verträgen kodifiziert, weshalb man Humboldt als Vordenker des Völkerrechts bezeichnen kann. Diese von der internationalen Humboldt-Forschung bislang nicht als Forschungsfeld erkannte Dimension seines Wirkens wird nachfolgend erstmals vertiefend beleuchtet.
Das ungefragte Zitieren aus Anwaltsschriftsätzen durch Presseorgane berührt verschiedene Grundrechte des Anwalts. Vertrauliche Strategien der Vertretung von Mandanten können so in die Öffentlichkeit geraten, was weder im Interesse des Anwalts noch des Mandanten liegt. Besonders betroffen von diesem Vorgehen der Presse sind Medienanwälte, die Persönlichkeitsrechtsverletzungen ihrer Mandanten verhindern wollen, sich aber dann mit ihren eigenen Äußerungen in den Zeitschriften zitiert sehen. Diese von den Gerichten durchaus unterschiedlich entschiedene Rechtsfrage soll zum Anlass genommen werden, um auf deren erhebliche Grundrechtsrelevanz für Anwälte aufmerksam zu machen und die juristischen Wertungseinheiten offenzulegen. Denn diese Frage betrifft einen zentralen Punkt nicht nur der Medienanwälte: Die effektive Vertretung des Mandanten.
Das neue Hinweisgeberschutzgesetz verlangt neben der Einrichtung unternehmens- bzw. behördeneigener interner Meldestellen auch den Aufbau externer Meldestellen. Diese wurden zur Vermeidung zusätzlicher Bürokratie bei bestehenden Bundesbehörden angesiedelt. System und Wirkungsweise der externen Meldestellen sollen nachfolgend erörtert werden. Zugleich bieten die Ausführungen Anlass, gesetzgeberische Verbesserungen zu erwägen.

Influencer-Marketing ist ein Phänomen der Werbebranche, dessen immense wirtschaftliche Bedeutung in reziproker Relation zu seiner rechtlichen Durchdringung steht. Während die Umsätze kontinuierlich steigen,1 steht die juristische Strukturierung erst am Anfang.2 Die rechtliche Einordnung dieser etwa seit 2007 existierenden Werbestrategie hat jedoch kürzlich durch drei parallele BGH-Urteile vom 09.09.2021 deutlichere Flankierungen erfahren.3 Hierdurch gewinnt die Thematik eine erhebliche Aktualität, die durch die nachfolgenden Ausführungen illustriert werden soll.
So richtig schlüssig finden die Medienrechtler Marcus Schladebach und Hans-Christian Gräfe den Vorschlag der EU-Kommission für den Europäischen Media Freedom Act nicht. Unter einer überpathetischen Überschrift regelt er fiktive Fragen, die eigentlich keiner Regelung bedürfen. Zudem ohne Kompetenz auf dem Gebiet der Medienpolitik.

Die Privatsphäre prominenter Personen wird häufig durch eine auf Sensationsgier ausgerichtete Presseberichterstattung gefährdet. Während sich die Presse dabei vordergründig auf ein öffentliches Interesse an solchen Berichten beruft, kann die Reputation der Betroffenen in der Öffentlichkeit stark und dauerhaft beeinträchtigt werden. Jedoch folgen aus dem Allgemeinen Persönlichkeitsrecht mehrere Ansprüche, mit denen diese Rechtsverletzungen abgewehrt und mögliche Schäden kompensiert werden können.

Auflage wurde komplett aktualisiert. Insbesondere das EU-Recht und das nationale Recht wurden überarbeitet. Neuere Entwicklungen gibt es vor allem bei der nunmehr geregelten Nutzung von Drohnen und den Sicherheitsvorkehrungen an Flughäfen und im Flugzeug selbst.
Privatisierung der Raumfahrt

Während Raumfahrt lange Zeit eine staatliche Angelegenheit war, nehmen in jüngerer Zeit die Weltraumaktivitäten privater Raumfahrtunternehmen kontinuierlich zu. Die Positionierung von Satelliten, das Angebot von Weltraumflügen für Private und der Abbau von Rohstoffen auf Himmelskörpern werden mittlerweile von privaten Akteuren geplant bzw. durchgeführt. Diese wirtschaftlichen Initiativen werfen die Frage auf, ob das in den 1960er Jahren entstandene Weltraumrecht hierauf adäquat vorbereitet ist und sachgerechte Antworten auf die neuen Herausforderungen zu geben vermag. Der Beitrag möchte aufzeigen, in welcher Weise private Raumfahrtunternehmen im existierenden Weltraumrecht bereits verortet sind und bei welchen Themen Handlungsbedarf für die internationale Gemeinschaft besteht.
