Kompetenz im handlichen Format in über 1.400 Stichwörtern, 26 Tabellen und Schaubildern zu allen wichtigen Rechtsgebieten: Zivilrecht (z. B. Familien- und Erbrecht, Versicherungsrecht), Arbeitsrecht, Öffentliches Recht (z. B. Baurecht, Staats- und Verfassungsrecht, Umweltrecht, Verwaltungsrecht), Sozialrecht (z. B. Arbeitslosen- und Rentenversicherung), Strafrecht (einschließlich Jugendstrafrecht und Ordnungswidrigkeiten) sowie ihren europa- und völkerrechtlichen Bezügen.
Das Rechtslexikon ist in seiner 2. Auflage ergänzt worden um zahlreiche neue und aktuelle Begriffe wie Impfpflicht, Quarantäne, Radwegbenutzung, Schutzpflicht, Crowdworking, Homeoffice/mobiles Arbeiten, Datenschutzgrundverordnung, Mediation, Smart Contract u.v.a.m. Das Lexikon erklärt außerdem Normen und Grundsätze des deutschen und europäischen Rechts, knapp, zuverlässig und verständlich. Grundlegende Fragen und Zusammenhänge werden in besonderen Überblicksartikeln erläutert. Querverweise machen auf verwandte Themen im Lexikon aufmerksam.

Rechtsgeschichte

Dieses Lehrbuch richtet sich vor allem an Studierende der Rechtswissenschaft. Es dient der Vorlesungsbegleitung im Grundlagenfach Rechtsgeschichte, kann darüber hinaus jedoch ebenso gewinnbringend zur Vertiefung im Rahmen des einschlägigen Schwerpunktbereichs herangezogen werden. In der Tradition der Vorauflagen wird der Bogen, ausgehend von der römischen Antike, über das Mittelalter und die frühe Neuzeit bis hin zur Wiedervereinigung von DDR und Bundesrepublik gespannt. Der Strafrechtsgeschichte ist dabei ebenso ein eigenes Kapitel gewidmet wie der Verfassungsgeschichte im 19. Jahrhundert, der Weimarer Republik und dem NS-Unrechtsstaat. Für den ersten Einstieg werden neben der Erläuterung von Grundbegriffen auch Hinweise zum Lösen rechtsgeschichtlicher Klausuren oder Verfassen von Hausarbeiten gegeben. Tabellarische Gegenüberstellungen von allgemein historischen und rechtsgeschichtlich besonders bedeutsamen Vorgängen geben einen schnellen Überblick über die jeweils folgenden Kapitel. Die Einarbeitung historischer Quellen – sofern nötig mit Übersetzung – erleichtert das Verständnis für die Epochen und ihre spezifischen Rechtsprobleme. Zahlreiche Querverweise geben Orientierung und verdeutlichen wichtige Zusammenhänge.

Das grundsätzliche Verbot des Erfolgshonorars gilt nicht für Inkassounternehmen. Anwältinnen und Anwälte dürfen dagegen nur in Ausnahmefällen ein Erfolgshonorar vereinbaren. In der Lexfox- bzw. Wenigermiete.de-Entscheidung des BGH hat dieser Widerspruch keine Rolle gespielt (BGH, AnwBl Online 2020, 63). Die Begründung für eine Diff erenzierung vermisst man allerdings. Das könnte schlicht daran liegen, dass es keine (verfassungsrechtlich ausreichende) gibt. So wird der Beitrag der Autorin und des Autors zum Plädoyer, über eine Neuordnung des Erfolgshonorars nachzudenken.
Konfliktlösung durch Frauen

Der Beitrag behandelt die finale Beteiligung von Frauen am Rechtsfindungsprozess als Urteilerin, Richterin, Schöffin, Schlichterin, Mediatorin, nicht aber Frauen als Partei oder Zeuginnen. Das Thema weist ohnehin neben der für das Mittelalter typischen weiten zeitlichen Komponente eine in sozialer Hinsicht große, weil mehrschichtige Dimension auf. Denn Konflikte gab es auch im Mittelalter auf allen gesellschaftlichen Ebenen und in allen denkbaren Kontexten und Formen. Sie möglichst allseits anerkannt zu lösen, war zwar per se kein Auftrag an das eine wie das andere Geschlecht. Dennoch ist im Mittelalter diese Macht eine Handlungsmöglichkeit, die – wenig überraschend – eine stark männlich geprägte Domäne darstellte. Kaiserinnen, Königinnen und Fürstinnen vermittelten jedoch in einigen nachgewiesenen Fällen in Konflikten. Nachweisbar sind solche Vermittlungen sowohl im innerfamiliären, als auch im außenpolitischen Zusammenhang. Einige Regentinnen und Frauen im kirchlichen Bereich hatten noch weiter gehenden Einfluss auf Konfliktlösungen. Es gibt jedoch wenig Forschung, die die Bedeutung dieser Frauen zusammenhängend behandelt.
Legal Tech

Der Beitrag befasst sich mit dem Einsatz von Legal Tech zur Verbesserung der menschlichen Rechtsanwendung. Die Verfasser weisen zunächst darauf hin, dass die Anwendung des Rechts Aufgabe des Menschen sei, woran sich auch künftig wenig ändern werde. Es wird erörtert, dass anlässlich der fortschreitenden Digitalisierung die Befürchtung bestehen würde, dass menschliche Juristen durch Legal Tech ersetzt werden könnten. Im Folgenden wird hinterfragt, welche Effizienzgewinne Legal Tech bewirken könne und welche Gefahren hiermit in Verbindung stehen würden. Weiter nennen die Autoren Stärken der Menschen gegenüber aktuellen technischen Möglichkeiten. So könnten repetitive und standardisierte juristische Arbeit durch Digitalisierung sicherer sowie effizienter werden. Abschließend beschäftigt sich der Beitrag mit Möglichkeiten der Verwaltungsautomatisierung. Die Verfasser kommen zu dem Ergebnis, dass Legal Tech erhebliche Effizienzgewinne erreichen könne, wobei es hierzu programmierte rechtliche Regelungen sowie vergleichbare Sachverhalte bedürfe.
