Der Beitrag befasst sich mit der Frage, ob und inwieweit es bei der Insolvenz von Reiseveranstaltern eine Begrenzung der Insolvenzabsicherungspflicht geben sollte – eine Problematik, die sich durch die Insolvenz von Thomas Cook zuletzt deutlich verschärft hat und die im Zuge der „Coronakrise“ erneut virulent geraten könnte. Die Verfasser argumentieren vor dem Hintergrund der Richtlinienwidrigkeit der deutschen lex lata für eine ersatzlose Streichung der Haftungshöchstsumme.
Die Vollstreckung eines Titels, gerichtet auf die Herausgabe von Daten "an sich", hat regelmäßig über § 887 I ZPO zu erfolgen. § 857 I ZPO ist unter Zugrundelegung der Domain-Rechtsprechung auf Daten anwendbar. § 811 ZPO nimmt den Aspekt der Personenbezogenheit von Daten nur unzureichend auf. Datenschutzrechtliche Erwägungen lassen sich jedoch unter Anknüpfung an die Übertragbarkeit iSd § 851 I ZPO berücksichtigen. Daten fallen gem. § 35 I InsO in die Insolvenzmasse. Jedoch ist die Ausdehnung des Massebegriffs aus § 36 II InsO teleologisch zu reduzieren, wenn und soweit die Personenbezogenheit von Daten der Verwertung entgegensteht. Zum Zwecke der Inbesitznahme, Verwaltung und Information gilt § 36 II InsO jedoch ohne Einschränkung auch für Daten.
