This paper examines the attempts of implement-ing components of the concept called Civiliza-tional Hexagon as a pathway to civilizing conflict in the Sub-Saharan Africa in the post-Cold War period. Despite significant decline in the violent conflict and substantial progress socio-economic aspects in the period, most states in the region have been facing challenges in their way to civilize conflict related to absence of inclusive political system, weak state unable to monopolize the use of violence in its territory, and social injustice. On the other hand, states like Botswana and Mauritius managed to civilize conflict through significant improvement in democratic consolidation. Besides their relative success in implementing six elements, these states enabled to integrate traditional institutions with modern state apparatus that helped them to fill the gap created as result of exogenous state formation process and the resulting unfinished nation-building project. Additionally, traditional institutions contributed to managing diversity.
Cyber warfare is a timely and relevant issue and one of the most controversial in international humanitarian law (IHL). The aim of IHL is to set rules and limits in terms of means and methods of warfare. In this context, a key question arises: Has digital warfare rules or limits, and if so, how are these applicable? Traditional principles, developed over a long period, are facing a new dimension of challenges due to the rise of cyber warfare. This paper argues that to overcome this new issue, it is critical that new humanity-oriented approaches is developed with regard to cyber warfare. The challenge is to establish a legal regime for cyber-attacks, successfully addressing human rights norms and standards. While clarifying this from a legal perspective, the authors can redesign the sensitive equilibrium between humanity and military necessity, weighing the humanitarian aims of IHL and the protection of civilians-in combination with international human rights law and other relevant legal regimes-in a different manner than before.
Digitalisierung ist das Schlagwort unserer Zeit und kaum ein Lebensbereich bleibt davon unberührt. Für den Einzelnen, die Gesellschaft, die Unternehmen und den Staat bietet sie immense Chancen. Die weiterhin nicht überstandene COVID-19-Pandemie führt dazu, dass dem digitalen Wandel in bisher ungeahnter Geschwindigkeit eine enorme praktische Bedeutung zukommt. Vor diesem Hintergrund erfolgt mit der Untersuchung ein Rechtsvergleich der Besteuerungsverfahren Österreichs und Deutschlands. Ziel ist es, über das Verfahren im Nachbarland zu informieren und die Unterschiede zum deutschen Recht pointiert herauszuarbeiten. Für Deutschland resultiert daraus die Chance, Konzepte und Lösungen der österreichischen Finanzverwaltung bei der Fortentwicklung von E-Government auszuwerten und sowohl von den positiven wie auch negativen Erfahrungen zu profitieren. So können konkrete Reformvorschläge für das deutsche Besteuerungsverfahren erarbeitet und die daraus resultierenden Chancen dargestellt werden.
Das Parlament stellt den zentralen Ort politischer Entscheidungsbildung dar.1 Die Erfüllung seiner Aufgaben der Gesetzgebung, der Wahl und Kontrolle der Regierung und anderer Verfassungsorgane, des Haushaltsbeschlusses und schließlich auch der Mitwirkung an der Verfassungsänderung sind unabdingbar für das Gelingen des demokratischen Rechtsstaates. Auch unter den Gefahren einer Pandemie ist daher unter allen Umständen die Funktionsfähigkeit des Parlaments aufrecht zu erhalten (I.). Dabei bieten sich neben technischen (II.) auch rechtliche (III.) Lösungen an, was zur Forderung nach einem parlamentarischen Notausschuss führt (IV.). In February 2020, the Inter-American Court of Human Rights (IACtHR) delivered a landmark decision in which it held Argentina responsible for the violation of several rights of 132 indigenous communities inhabiting a certain area in the province of Salta. In the Case of the Indigenous Communities of the Lhaka Honhat (Our Land) Association v. Argentina the IACtHR declared for the first time an autonomous violation of the right to a healthy environment and other DESCA (Economic, Social, Cultural and Environmental rights). Thereby, it further developed its case law on the direct justiciability of DESCA on the basis of Article 26 of the American Convention on Human Rights (ACHR) that was first established in Lagos del Campo in 2017. Focusing on the right to a healthy environment and the right to water the authors critically examine how the Court derived the direct justiciability of DESCA. In the following, the contribution examines to what extent the right to a healthy environment has been specified in the current judgment compared to the initial outline of this right by the Court in its Advisory Opinion No. 23. The analysis also deals with the question whether the facts of the case were at all suitable for such a specification and what general value could be added by an autonomous examination of DESCA. Finally, the contribution ends with a mixed conclusion on the significance of the judgment and a thoughtful outlook on the future development of the case law on Art. 26 ACHR.
Das ungefragte Zitieren aus Anwaltsschriftsätzen durch Presseorgane berührt verschiedene Grundrechte des Anwalts. Vertrauliche Strategien der Vertretung von Mandanten können so in die Öffentlichkeit geraten, was weder im Interesse des Anwalts noch des Mandanten liegt. Besonders betroffen von diesem Vorgehen der Presse sind Medienanwälte, die Persönlichkeitsrechtsverletzungen ihrer Mandanten verhindern wollen, sich aber dann mit ihren eigenen Äußerungen in den Zeitschriften zitiert sehen. Diese von den Gerichten durchaus unterschiedlich entschiedene Rechtsfrage soll zum Anlass genommen werden, um auf deren erhebliche Grundrechtsrelevanz für Anwälte aufmerksam zu machen und die juristischen Wertungseinheiten offenzulegen. Denn diese Frage betrifft einen zentralen Punkt nicht nur der Medienanwälte: Die effektive Vertretung des Mandanten.
Der doppelte Abgeordnete

Das Abgeordnetenmandat hat sich in den letzten Jahrzehnten von einer Honoratiorentätigkeit zu einem Beruf gewandelt, was zu der Frage führt, ob Abgeordnete zugleich Mitglied in mehreren Parlamenten sein können (I), welche das BVerfG im Jahre 1976 noch bejahte (II). Im Lichte neuerer Entwicklungen ist diese Rechtsprechung jedoch kritisch zu beleuchten (III), woraus Folgerungen für eine ausdrückliche verfassungsrechtliche Regelung zu ziehen sind (IV).
Wenngleich die Abgabenordnung zwei Verfahren zur Inanspruchnahme von Steuerentrichtungs- und Haftungsschuldner vorsieht, führt die im Rahmen der AO-Reform im Jahr 1990 erfolgte Aufnahme des Haftungsschuldners in den Wortlaut des § 167 AO zur Vermischung beider Verfahrensarten. Kann das von Rechtsprechung und Finanzverwaltung diesbezüglich praktizierte Wahlrecht sowie die Vermengung der Voraussetzungen beider Verfahren im Rahmen der Eingriffsverwaltung zulässig sein? Zweifel hieran ergeben sich insbesondere, wenn in bestimmten Fällen der Fremdentrichtungsschuldner final mit der Steuerschuld eines anderen belastet wird und damit faktisch zum Steuerschuldner erhoben wird. Nach Vergleich der Verfahren sowie der verfahrensrechtlichen Auswirkungen wird untersucht, ob eine Anpassung des maßgeblichen § 167 AO eine »gerechtere« Lösung herbeiführen könnte. Daraufhin wird die Arbeit mit einem Reformvorschlag abgeschlossen.
Der Verfasser beschäftigt sich mit der Frage des Glaubensübertritts in einem Asylverfahren. Dabei nimmt er Zeitpunkt, Art und Umstände des Religionswechsels in den Blick. Ferner untersucht er, wie die sogenannte Konversion von den zuständigen Behörden und Gerichten zu behandeln und zu bewerten ist. Einführend gibt er einen Überblick zum völkerrechtlichen Schutz der Religions- und Weltanschauungsfreiheit sowie typischen Gefährdungslagen. Überdies befasst er sich mit den Rechtsgrundlagen des Asyl- und Flüchtlingsschutzrechts und stellt Verbindungen zum Flucht- und Verfolgungsgrund der Religion her.
Schwerpunkt bildet die Untersuchung der Verfahrensstadien, in denen die Konversion relevant wird. Dabei berücksichtigt der Verfasser die nationale und europäische Rechtsprechung. Von besonderer Bedeutung sind die Ausführungen zum Zusammenspiel von staatlichen Ermittlungspflichten und Mitwirkungsgeboten von Asylantragstellenden, wobei den Besonderheiten des grund- und menschenrechtlichen Mehrebenensystems Rechnung getragen wird.
Zentral sind ferner die Ausführungen zum Umgang mit Taufurkunden und sonstigen Bescheinigungen über die religiöse Überzeugung. Besonderes Gewicht liegt auf der verfassungsrechtlichen Stellung der Religionsgemeinschaften und der Frage, ob die Entscheidung einer Religionsgemeinschaft, ein neues Mitglied aufzunehmen, die Behörde im Asylverfahren bindet. Diesem Problem widmet sich der Verfasser unter Heranziehung der relevanten Literaturstimmen und einschlägigen Rechtsprechung.
Der rechtswissenschaftliche Beitrag bietet den beteiligten Akteuren nicht nur eine Einführung in das Themengebiet des Glaubensübertritts im Asylverfahren, sondern gibt den Lesenden auch eine praxistaugliche Handlungsunterstützung rund um die wichtigsten Fragen einer Konversion im Asylverfahren an die Hand. Praktische Bezüge entstehen beispielsweise dadurch, dass wichtige Impulse und Empfehlungen für eine gleichermaßen moderne, rechtsstaatliche und grundrechtsorientierte Verfahrensführung entwickelt werden.
