Der Dritte im Zivilrecht

Während über Max Webers Religionssoziologie ganze Bibliotheken geschrieben worden sind, gibt es zu seiner Rechtssoziologie – ungeachtet ihrer von Talcott Parsons herausgestellten Zentralität in Webers Werk – vergleichsweise wenige Veröffentlichungen. Insbesondere ist sein Verhältnis zur juristischen Methodenlehre nahezu unberücksichtigt geblieben, obwohl er als promovierter und habilitierter Jurist im weitesten Sinne von ihr ausgegangen ist. Max Webers Rechtssoziologie ist für die Rechtsdogmatik nicht zuletzt deshalb so interessant, weil Weber das Recht und die juristische Methode inwendig kannte und von daher deutend verstehen konnte.
Für die Neuauflage hat Jens Petersen alle Nachweise auf die Max-Weber-Gesamtausgabe umgestellt und nicht nur die in den vergangenen fünf Jahren erschienene Literatur zu seiner Rechtssoziologie berücksichtigt, sondern auch älteres Schrifttum.
Die vorliegende Abhandlung bereitet erstmals systematisch das Verhältnis von Rechtsordnung und Wirtschaftsordnung nach der Theorie der Interdependenz der Ordnungen von Walter Eucken auf.
Die meisten Juristen werden Walter Eucke noch mit dem Ordoliberalismus in Verbindung bringen, manche der Freiburger Schule zuordnen, die wenigsten jedoch seine 'Grundsätze der Wirtschaftspolitik' oder gar seine juristisch nicht minder gehaltvollen 'Grundlagen der Nationalökonomie' gelesen haben. Gerade die ersteren jedoch – sein nachgelassenes Hauptwerk – bilden nicht nur für Ökonomen, sondern auch für Juristen eine überaus anregende Lektüre.
Jedem Juristen, vor allem jedem Wirtschaftsrechtler, sollte eine beiläufige Beobachtung zu denken geben, die Walter Eucken in seinen 'Grundlagen der Nationalökonomie' angestellt hat: „Werden der Wissenschaft in zwei Jahrtausenden nur unsere wichtigsten Rechtsnormen bekannt sein, so wird sie von unserer Wirtschaftsordnung kein wirkliches Bild gewinnen".
Blaise Pascal (1623-1662) gehört zu den größten Geistern, die je auf Erden gelebt haben. Der vorliegende Band versucht eine Verbindungslinie zwischen seiner Rechtsphilosophie und seiner Religionsphilosophie herzustellen, indem er Pascals Gedanken über die Gerechtigkeit zu seiner berühmten Lehre von den drei Ordnungen ins Verhältnis setzt.

Et corruptissima re publica plurimae leges: Ein Schriftsteller, der vor fast zweitausend Jahren mit einem halben Dutzend Worten die grassierende Verrechtlichung zum Gradmesser der Verdorbenheit eines Gemeinwesens zu machen vermochte, verdient nicht nur einer der größten Stilisten der Weltliteratur genannt zu werden, sondern sollte als hellsichtiger Zeitdiagnostiker auch der gegenwärtigen Jurisprudenz nicht gleichgültig sein.

Gerade in den vergangenen Jahren ist die Problematik der Gerechtigkeit bei Nietzsche im Schrifttum weiter in den Vordergrund gerückt. Die Neuauflage unternimmt vor diesem Hintergrund den Versuch einer erneuten Bewertung.

Dieses Examens-Repetitorium zum Allgemeinen Schuldrecht bietet eine vertiefende, wissenschaftlichen Ansprüchen genügende Darstellung zentraler Fragen des Rechtsgebietes zur Vorbereitung auf die Juristischen Staatsprüfungen. Die Fähigkeit zu eigenständiger Problemlösung wird in besonderem Maße gefördert. Es ist ein wichtiges Anliegen, die Bezüge des Allgemeinen Schuldrechts zum Besonderen Teil und zu den anderen Büchern des BGB und den ""Nebengesetzen"" darzustellen. Auch spielen handelsrechtliche und zivilprozessuale Folgefragen eine wichtige Rolle im Zusammenhang mit Regressfällen. Die Darstellung wurde in allen Teilen aktualisiert, neueste Rechtsprechung und Literatur sind bis Januar 2021 berücksichtigt.
Marcel Proust und Tacitus

Marcel Proust zitiert und erwähnt Tacitus nicht nur in Briefen und seinem unvollendet gebliebenen 'Jean Santeuil', sondern vor allem auch in seinem Hauptwerks 'A la recherche du temps perdu'. Der Autor versucht zu zeigen, dass diese Erwähnungen in die Mitte des Proustschen Werkes führen.

Die Vorrede der Hegelschen Rechtsphilosophie endet mit einem denkwürdigen Bild: "Wenn die Philosophie ihr Grau in Grau malt, dann ist eine Gestalt des Lebens alt geworden, und mit Grau in Grau lässt sie sich nicht verjüngen, sondern nur erkennen; die Eule der Minerva beginnt erst mit der einbrechenden Dämmerung ihren Flug." Was ist mit diesem Rätselwort gemeint? Und was bedeutet es für die Rechtsphilosophie?
Wilhelm von Humboldts 'Ideen zu einem Versuch die Grenzen der Wirksamkeit des Staats zu bestimmen' sind hierzulande erst in jüngerer Zeit verstärkt rezipiert worden, obwohl sie seit jeher zu den klassischen Schriften des politischen Liberalismus zählen. Humboldts Ideen haben insbesondere John Stuart Mill bei seinem Essay über die Freiheit maßgeblich beeinflusst. Die vorliegende Schrift unternimmt daher nicht nur den Versuch einer rechtsphilosophischen Einordnung, sondern stellt auch Bezüge zur angloamerikanischen Rechtsphilosophie dar.
