Der Beitrag erinnert an das wechselvolle Leben des Friedensnobelpreisträgers Henry Dunant, sucht nach biografischen Wurzeln seines von Menschlichkeit und Würde getragenen Verhaltens und macht auf seine Leistungen aufmerksam. Er will aber auch die Frage nach der Bedeutung des humanitären Völkerrechts im Verhältnis von Krieg und Frieden nicht außer Acht lassen.
Editorial: Die Palette menschenrechtlicher Themen ist denkbar breit, wird aber durch die jeweiligen Disziplinen konturiert und von den einzelnen Autoren präzisiert. Aus philosophischer Perspektive behandelt Malte Fabian Büchs die Verknüpfung der Geschichte der Menschenrechte mit derjenigen der Moderne, die unlängst von Etienne Balibar hergestellt wurde. Die Rezeption der Allgemeinen Erklärung der Menschenrechte in den Beratungen des Parlamentarischen Rates über das Grundgesetz für die Bundesrepublik Deutschland nimmt Daniel Eberhardt in den Blick. Während in Heft 2/2008 die Allgemeine Erklärung als Klassikertext in einen breiten Zusammenhang gestellt wurde, erfolgt hier die Einbettung in einen konkreten Akt der Verfassunggebung. Der Beitrag „Konfliktparteien vor dem Europäischen Gerichtshof für Menschenrechte“ von Cornelius Wiesener behandelt das Verhältnis von humanitärem Völkerrecht und Menschenrechten am konkreten Beispiel des Krieges zwischen Rußland und Georgien im Jahr 2008. In Ergänzung des Themenschwerpunktes „Medizin und Menschenrechte“ aus Heft 2/2008 beschäftigt sich Maren Mylius mit der Beteiligung von Medizinern an Menschenrechtsverletzungen in Argentinien und fragt: „Folter unter ärztlicher Aufsicht?“ Unter dem Titel „Aufarbeitung oder Versöhnung in Kambodscha? Eine Justiz für die Roten Khmer“ befassen sich Philippe Gréciano und Birte Kaspers mit dem gemischten Tribunal in Kambodscha, das bestimmte Verbrechen aus der Zeit Pol Pots ahnden soll. Anne Dieter, Marianna Hillmer und Julia Szilat erinnern in der historischen Miszelle an den 140. Geburtstag von Mahatma Gandhi. Der Dokumentationsteil enthält den traditionellen Bericht über die Arbeit des Menschenrechtsausschusses der Vereinten Nationen im Jahre 2008. Der zweite Teil, verfasst von Anne Foith, behandelt das Individualbeschwerdeverfahren. Buchbesprechungen runden das Heft ab, bei dessen Herstellung uns Birte Kaspers redaktionell tatkräftig unterstützt hat. Im Oktober 2009 endet die Amtszeit unserer Direktoren Prof. Dr. Eckart Klein und Prof. Dr. Christoph Menke. Prof. Menke ist an die Johann Wolfgang Goethe-Universität Frankfurt am Main gewechselt und Prof. Klein ist bereits im letzten Jahr in den Ruhestand getreten. Als sein Nachfolger ist Prof. Dr. Andreas Zimmermann an die Juristische Fakultät der Universität Potsdam berufen worden. Er wird zunächst alleiniger Direktor des MRZ werden. Wir wünschen unseren Lesern eine anregende Lektüre.
Was haben Menschenrechte und Mediation miteinander zu tun? Was bezwecken sie, und welche Rolle spielt das Wissen der Natur- und Verhaltenswissenschaften über zwischenmenschliche Kommunikation? Der Beitrag versucht, ausgehend von den Begriffen Menschenrechte und Mediation deren Beziehungsgefüge aus interdisziplinärer Sicht aufzudecken.
Vor einhundert Jahren eröffnete die Wissenschaftlerin und Sozialreformerin Dr. med. Maria Montessori in Rom ihre erste Kindertagesstätte, das „Casa dei Bambini”. Inzwischen gibt es allein in Deutschland ca. eintausend Kindergärten und auch Schulen, die nach ihrem Konzept arbeiten. Der Beitrag will auf die Zusammenhänge zwischen dem Menschenrecht auf Bildung, dem pädagogischen Konzept der Maria Montessori und ihrem natur- und verhaltenswissenschaftlich begründeten Ansatz der Lernforschung hinweisen.
