Die Locarno-Verträge haben in der völkerrechtlichen Literatur der 1920er und 1930er Jahre viel Aufmerksamkeit erfahren. Auch die zeitgenössische Publizistik beschäftigte sich ausführlich mit diesem Thema, wobei das Verhältnis von Verständigung mit den Nachbarn und Revision der Grenzregelungen im Mittelpunkt der Debatte stand.
Später gehörte Locarno zur Geschichte der Zwischenkriegszeit und wurde im Rahmen der Völkerbundsgeschichte, der Völkerrechts- und Diplomatiegeschichte und der Geschichte der Weimarer Republik behandelt. Für die politikwissenschaftliche Literatur spielte Locarno fast ausschließlich auf dem Gebiet der Sicherheits- und Abrüstungspolitik eine Rolle; eine (system)theoretische Erörterung steht bislang aus.
In diesem Beitrag sollen nach einem kurzen Überblick über das Vertragswerk zunächst die geschichtliche Ausgangslage knapp umrissen und Vorgeschichte und Ergebnis der Konferenz von Locarno skizziert werden. Anschließend werden Inhalte und Lösungsansätze des Vertragswerkes beleuchtet, bevor zum Schluß eine kurze Einordnung in das System des Völkerbundes erfolgt.

This publication deals with the topic of transitional justice. In six case studies, the authors link theoretical and practical implications in order to develop some innovative approaches. Their proposals might help to deal more effectively with the transition of societies, legal orders and political systems.
Young academics from various backgrounds provide fresh insights and demonstrate the relevance of the topic. The chapters analyse transitions and conflicts in Sierra Leone, Argentina, Nicaragua, Nepal, and South Sudan as well as Germany’s colonial genocide in Namibia. Thus, the book provides the reader with new insights and contributes to the ongoing debate about transitional justice.

Der Band enthält die Vorträge einer Konferenz vom November 2009 in Potsdam. Die Texte untersuchen anhand ausgewählter Beispiele die Entwicklungen der zurückliegenden zwanzig Jahre im Zivilrecht, Strafrecht und öffentlichen Recht. Die Bundesrepublik Deutschland sieht sich seit der Wiedervereinigung und dem Ende des Kalten Krieges in einer ganz neuen Situation. Dies gilt für den völkerrechtlichen Rahmen ihrer Außenpolitik, für den Wettbewerb der Rechtsordnungen, für die mit erhöhter Dynamik fortschreitende europäische Einigung und ihre Konsequenzen. Die bei der Grundrechtsinterpretation im Mehrebenensystem auftauchenden Divergenzen und die Auswirkungen technischer Neuerungen auf das Sozialverhalten prägen Rechtswirklichkeit und Rechtsdogmatik.

In welcher Beziehung steht die praktische Philosophie zur Wirklichkeit der Menschenrechtsfragen in Recht und Politik? Wie kann und soll sie sich ihrem komplexen Gegenstand nähern? Inwieweit kommt ihr die Aufgabe zu, politisches Geschehen konkret zu kommentieren und Vorschläge für die Implementierung menschenrechtstheoretischer Annahmen zu machen? Editorial: Die Palette menschenrechtlicher Themen ist denkbar breit, wird aber durch die jeweiligen Disziplinen konturiert und von den einzelnen Autoren präzisiert. Aus philosophischer Perspektive behandelt Malte Fabian Büchs die Verknüpfung der Geschichte der Menschenrechte mit derjenigen der Moderne, die unlängst von Etienne Balibar hergestellt wurde. Die Rezeption der Allgemeinen Erklärung der Menschenrechte in den Beratungen des Parlamentarischen Rates über das Grundgesetz für die Bundesrepublik Deutschland nimmt Daniel Eberhardt in den Blick. Während in Heft 2/2008 die Allgemeine Erklärung als Klassikertext in einen breiten Zusammenhang gestellt wurde, erfolgt hier die Einbettung in einen konkreten Akt der Verfassunggebung. Der Beitrag „Konfliktparteien vor dem Europäischen Gerichtshof für Menschenrechte“ von Cornelius Wiesener behandelt das Verhältnis von humanitärem Völkerrecht und Menschenrechten am konkreten Beispiel des Krieges zwischen Rußland und Georgien im Jahr 2008. In Ergänzung des Themenschwerpunktes „Medizin und Menschenrechte“ aus Heft 2/2008 beschäftigt sich Maren Mylius mit der Beteiligung von Medizinern an Menschenrechtsverletzungen in Argentinien und fragt: „Folter unter ärztlicher Aufsicht?“ Unter dem Titel „Aufarbeitung oder Versöhnung in Kambodscha? Eine Justiz für die Roten Khmer“ befassen sich Philippe Gréciano und Birte Kaspers mit dem gemischten Tribunal in Kambodscha, das bestimmte Verbrechen aus der Zeit Pol Pots ahnden soll. Anne Dieter, Marianna Hillmer und Julia Szilat erinnern in der historischen Miszelle an den 140. Geburtstag von Mahatma Gandhi. Der Dokumentationsteil enthält den traditionellen Bericht über die Arbeit des Menschenrechtsausschusses der Vereinten Nationen im Jahre 2008. Der zweite Teil, verfasst von Anne Foith, behandelt das Individualbeschwerdeverfahren. Buchbesprechungen runden das Heft ab, bei dessen Herstellung uns Birte Kaspers redaktionell tatkräftig unterstützt hat. Im Oktober 2009 endet die Amtszeit unserer Direktoren Prof. Dr. Eckart Klein und Prof. Dr. Christoph Menke. Prof. Menke ist an die Johann Wolfgang Goethe-Universität Frankfurt am Main gewechselt und Prof. Klein ist bereits im letzten Jahr in den Ruhestand getreten. Als sein Nachfolger ist Prof. Dr. Andreas Zimmermann an die Juristische Fakultät der Universität Potsdam berufen worden. Er wird zunächst alleiniger Direktor des MRZ werden. Wir wünschen unseren Lesern eine anregende Lektüre.
