Digitales Versammlungsrecht?

Das Grundrecht der Versammlungsfreiheit ist bekanntermaßen entwicklungsoffen. Geschützt werden also nicht nur historisch gewachsene „klassische“ Versammlungstypen. Immer wieder zeigen sich neuartige Erscheinungsformen, die es in den Schutzbereich des Art. GG Artikel 8 GG einzuordnen gilt. Aus jüngerer Zeit sind etwa Flashmobs oder Demonstrationen auf Schienen zur Fussnote 1 und mit Wohnmobilen zur Fussnote 2 zu nennen. Diskutiert werden auch Online-Versammlungen, bei denen die Teilnehmenden vollständig auf ein körperliches Zusammentreffen verzichten und sich nur virtuell via Computer oder Smartphone zusammenschalten. Angesichts absoluter und relativer Versammlungsverbote in coronabedingten Lockdowns zur Fussnote 3 steht mehr denn je die verfassungsrechtliche Dimension dieserart nichtphysischer Zusammentreffen im Streit. Der Beitrag befasst sich daher mit der Frage, ob die Versammlungsfreiheit des Art. GG Artikel 8 GG im digitalen Zeitalter auch eine virtuelle Seite hat.
Die erste Welle der Corona-Pandemie klingt langsam ab. Der Shutdown ist einstweilen beendet, Lockerungen erfolgen allenthalben. Doch alles steht unter dem Vorbehalt einer möglichen zweiten Infektionswelle mit dann zu erwartenden neuerlichen Beschränkungen. Es ist ein richtiger Zeitpunkt für eine Zwischenbilanz, wie das deutsche Versammlungsrecht bisher durch die virale Gesundheitskrise gekommen ist und welche Folgerungen zukünftig zu beachten sein werden. Ein besonderes Augenmerk sei dabei auf die Rechtsprechung gerichtet, die in bemerkenswerter Weise das staatliche Pandemie-Krisenrecht begleitete.

Der Beitrag zeigt die Entwicklung des Versammlungsrechts in der Rechtsprechung seit 2016 auf. Angesichts legislatorischer Ruhe steht die Judikatur des BVerfG und der Verwaltungsgerichte im Fokus der Betrachtung. In vielen Entscheidungen spiegeln sich aktuelle versammlungsrechtliche Problemstellungen wider. Art. 8 GG erweist sich als ein äußerst lebendiges Grundrecht, welches auch im digitalen Zeitalter nichts an seiner urdemokratischen Attraktivität und politischen Wirkkraft eingebüßt hat.

Die Versammlungsfreiheit des Art. 8 GG stellt sich – auch und gerade in jüngster Zeit – immer wieder aufs Neue als ein höchst lebendiges und streitbares Grundrecht dar. Unverändert analog bietet es den Bürgerinnen und Bürgern räumlich die Möglichkeit, ihre Anliegen öffentlichkeits- und medienwirksam zur Sprache zu bringen. Der Klimaschutz und der Ukrainekrieg sind aktuell zwei zentrale Themenstellungen. Auch die Covid-19-Pandemie beschert den Rechtsanwendern neue und oftmals fundamentale Fragestellungen, auf die Antworten gegeben werden müssen. So sieht sich das Versammlungsrecht mit seinem Art. 8 GG als Basisnorm mit einer Vielzahl neuartiger Probleme konfrontiert. Zu Beginn standen der Pandemie vor allem die teilweise absoluten und flächendeckenden Versammlungsverbote im Streit. Seit kurzem sind Verbote von „Corona-Spaziergängen“ durch Allgemeinverfügungen in der Diskussion, und zwar für den Zeitraum einiger Wochen und begrenzt für das Gebiet einer Gemeinde oder eines Landkreises. Der nachfolgende Beitrag beschäftigt sich mit dieser Thematik.
Nach einer kurzen Einführung in das Thema (I.) setzen sich die Verfasser mit der Entstehung des neuen Fraktionsgesetzes auseinander (II.). Im Anschluss geben sie einen Überblick über den Gesetzesinhalt und zeigen bedeutsame Änderungen auf (III.). Weiter gehen sie auf die finanzielle Ausstattung der Fraktionen im Brandenburger Landtag ein (IV.). Bevor sie dann zur Zusammenfassung und zum Ausblick kommen (VI.), erfolgt ein Rückblick auf den ersten Gesetzesentwurf zum neuen Fraktionsgesetz (V.).

Der anzuzeigende Band dokumentiert die Referate der traditionsreichen Staatswissenschaftlichen Fortbildungstagung, welche im Frühjahr 2004 bereits zum 72. Mal an der Hochschule für Verwaltungswissenschaften in Speyer stattfand. Als Herausgeber zeichnet Hermann Hill verantwortlich. Es zeigt sich ein überaus facettenreiches Fresko der anstehenden kommunalen Herausforderungen. Auch wenn sich in jüngster Zeit das Bild der Gemeindefinanzen etwas aufzuhellen scheint, so muß sich doch die deutsche kommunale Selbstverwaltung immer wieder aufs Neue behaupten. An entsprechenden Ideen mangelt es nicht. Der Band vermittelt dafür nützliche Fingerzeige.
Mit Urteil vom 28.3.2006 hat das BVerfG ein staatliches Monopol für Sportwetten nur dann mit der Berufsfreiheitsgarantie des Art. 12 I GG für vereinbar erklärt, wenn es konsequent am Ziel der Bekämpfung von Suchtgefahren ausgerichtet ist. Aktuelle Rechtslage und Staatspraxis werden hingegen als verfassungswidrig benannt. Der Beitrag stellt die Entscheidung in ihren Grundzügen dar und unterzieht sie einer kritischen Würdigung.
