The background of civil service reform in Indonesia reveals the emergence of the reformation movement in 1998, following the fall of the authoritarian New Order regime. The reformation movement has seen the introduction of reforms in Indonesia's various governmental institutions, including the civil service. The civil service reforms were marked by the revision of Act 8/ 74 with Act 43 of 1999 on Civil Service Administration. The implementation of the civil service reform program, which was carried out by both central and local governments, required cooperation between the actors (in particular, Ministries, agencies and local governments), known as coordination.
Currently, the coordination that occurs between actors tends to be rigid and hierarchical. As a result, targets are not efficiently and effectively met. Hierarchical coordination, without a strong public sector infrastructure, tends to have a negative impact on achieving the desired outcomes of the civil service reform program. As an intrinsic part of the New Order regime, hierarchical coordination resulted in inefficiency and lack of efficacy. Despite these inefficiencies, the administration and the political environment have changed significantly as a result of the reform process.
Obvious examples of the reforms are changes in recruitment patterns, placement and remuneration policies. However, in the case of Indonesia, it appears that every state institution has its own policy. Thus, it appears that there has not been policy coherence in the civil service reform program, resulting in the lack of a sustainable program. The important thing to examine is how the coordination mechanisms of the civil service reform program in the central government have developed during the reform era in Indonesia
The purpose of this study is to analyse the linkages between coordination mechanisms and the actual implementation of civil service reform programs. This is undertaken as a basis for intervention based on the structures and patterns of coordination mechanisms in the implementation of civil service reform programs. The next step is to formulate the development coordination mechanisms, particularly to create structures and patterns of civil service reforms which are more sustainable to the specific characteristics of public sector organisations in Indonesia.
The benefits of this research are a stronger understanding of the linkages between the mechanisms of coordination and implementation of civil service reform programs. Through this analysis, the findings can then be applied as a basic consideration in planning a sustainable civil service reform program. In the basis of theoretical issues concerning the linkages between coordination mechanisms and implementation of civil service reform program sustainability, this book explores the type of coordination, which is needed to test the proportional and sustainable concept of the intended civil service reform program in Indonesia.
Research conducted through studies, surveys and donors has shown that poor coordination is the major hindrance to the civil service program reform in Indonesia. This research employs a qualitative approach. In this study, the coordination mechanisms and implementations of civil service reform programs are demonstrated by means of case studies of the State Ministry for Administrative Reform, the National Civil Service Agency and the National Public Administration Institute. The coordination mechanisms in these Ministries and agencies were analysed using indicators of effective and efficient coordination. The analysis of the coordination mechanisms shows a tendency towards rigid hierarchical coordination. This raises concerns about fragmentation among departments and agencies at the central government level and calls for integrated civil service reform both at central and local governmental levels. In the context of implementation programs, a hierarchical mechanism of coordination leverages on various aspects, such as the program formulation, implementation flow of the program, the impact of policies, and achievement targets. In particular, there was a shift process of the mainstream civil service reform in the Ministries and agencies which are marked by the emergence of sectoral interest and inefficiencies in the civil service reform program. The primary result of successful civil service reform is increased professionalism in the civil service.
The findings on hierarchical mechanisms and the prescriptions which will follow show that the professionalism of Indonesia’s civil service is at stake. The implementation of the program through coordination mechanisms in Ministries and agencies is measured in various dimensions: the centre of coordination, integration of coordination, sustainability of coordination and multidimensionality of coordination.
The results of this analysis show that coordination mechanisms and the implementation of civil service reform are more successful when they are integration rather than hierarchical mechanisms. For a successful implementation of the reform program, it is crucial to intervene and change the type of coordination at the central government through the integration approach (hierarchy, market, and network). Furthermore, in order to move towards the integration type mechanism of coordination the separation of the administration and politics in the practice of good governance needs to be carried out immediately and simultaneously. Based on this analysis, it can be concluded that the integration type mechanism of coordination is a suitable for Indonesia for a sustainable civil service reform program. Finally, to achieve coherent civil service reforms, national policies developed according to the central government's priorities are indispensable, establishing a coordination mechanism that can be adhered to throughout all reform sectors.
International organizations in a complex world- borders and Aadded value of a pluralistic research

International public administrations are increasingly perceived as autonomous actors prompting states to adopt policies without resorting to coercion or legal obligations. Starting from these observations, I determine abilities and characteristics of international public administrations that contribute to their autonomy as agents of non-hierarchical policy transfers. To this end, I draw on theoretical considerations and empirical results from policy transfer research. I find that the various abilities that contribute to this autonomy of international public administrations are essentially rooted in two structural characteristics: in as many states as possible their staff should (a) be present and (b) analyze the state, development and reform need of national policies on a regular basis.

The present article shows, in a case study, how basic problems of interactions in Job Centres are shaped by expectations deriving from the social levels of organization and interaction and can be solved by a specific modification of the person category of the good customer. This client is categorized as a customer with the will to be willing: By wanting what the Job Center staff wants him or her to want and by accommodating to the contingent goals of political discourse and public administration as much as possible she or he enables the interaction to transform organizational and interactional expectations into addressable expectations. In this way he or she constitutes a vital link within the managerial guidance system of a modern labor administration.
Giving less by doing more? Dynamics of social policy expansion and dismantling in 18 OECD countries

Protection against social risks is generally popular among voters and should enjoy the benefits of institutional inertia. Yet retrenchment occurs rather frequently in advanced welfare states without this systematically leading to electoral punishment. We solve this paradox by, first, arguing that governments can avoid the blame of retrenchment by pursuing a strategy of expansionary dismantling' where new policies and instruments are used to compensate reform losers and to obfuscate cutbacks. Second, we test our argument with a huge new dataset consisting of changes in unemployment legislation and replacement rates in 18 OECD countries from 1976 to 2000. The statistical tests provide robust support for our argument, suggesting that the introduction of new policies and instruments leads to cutbacks in replacement rates. We also find that left-leaning governments are least likely to engage in expansionary dismantling.
Two decades after the introduction of the punctuated equilibrium model, information processing theory now offers one of the most comprehensive analytical perspectives on decision making in public administration and policy research. This article applies information processing analysis to the decision making process in the European Union (EU). Towards this end, the article inquires into the organizational foundations of information processing at successive levels of administrative and legislative decision making and shows how this analytical perspective can be used to gain a better understanding of policy dynamics at the supranational level. The article argues that information processing in the EU is likely to produce distinct policy dynamics in key respects. It identifies promising avenues for future research and discusses some of the issues this evolving theoretical framework should address in order to allow for a more comprehensive exploration of this analytical perspective in the context of the EU.
The article analyses a certain type of bicameralism not merely as a form of legislative organisation, but as a form of government-as a hybrid between parliamentarism and presidentialism. A new typology of pure and hybrid forms of government is proposed, which classifies bicameralism in Australia and Japan as chamber-independent government. This type is systematically compared with other forms of government, including hybrids like semi-presidentialism, elected prime-ministerial government in Israel (from 1996 to 2002) and assembly-independent government in Switzerland. The article highlights how chamber-independent government has the potential to combine different visions of democracy without leading to presidentialisation of political parties.
In December 2013, the Court at first instance in Bonn ruled on whether Germany is required to pay compensation to victims of the International Security Assistance Force airstrike ordered by a German colonel in 2009 in Kunduz. Whereas the traditional approach rejects liability of the government for sovereign acts in armed conflicts, the Court held that the rules of German governmental liability (Amtshaftung) do-in principle-apply to illegal sovereign acts in contemporary armed conflicts. However, the Court did not admit the claim on its merits. This judgment can, nonetheless, be placed within the line of questions regarding international relations to be resolved by law and not politics. This article examines the history of German jurisprudence regarding victims' compensation for harm suffered resulting from violations of international humanitarian law. It summarizes and assesses the Kunduz judgment and explains why applying legal liability to the government for sovereign acts in bello is a logical step in the development of the rule of law.
City rankings that aim to measure the environmental sustainability of European cities may contribute to the evaluation and development of environmental policy of European cities. The objective of this study is to identify and evaluate the methodological characteristics of these city rankings. First, a methodology was developed to systematically identify methodological characteristics of city rankings within different steps of the ranking development process. Second, six city rankings (European Energy Award, European Green Capital Award, European Green City Index, European Soot-free City Ranking, RES Champions League, Urban Ecosystem Europe) were examined. Official websites and any methodological documents found on those websites were content analyzed using the developed methodology. Interviews with representatives of the city rankings were conducted to acquire any additional information. Results showed that the city rankings varied greatly with respect to their methodological characteristics and that all city rankings had methodological weaknesses. Developers of city rankings are advised to use the methodology developed in this study to find methodological weaknesses and improve their ranking. In addition, developers ought to be more transparent about the methodological characteristics of their city rankings. End-users of city rankings are advised to use the developed methodology to identify and evaluate the methodological characteristics of city rankings before deciding to act on ranking results. The increased emphasis on labour market activation in many European countries has led to new forms of governance in recent decades. Primarily through qualitative data and document analysis, this article compares the restructuring of labour market service delivery in the UK and Germany. The comparison suggests the emergence of complex governance arrangements that seek to balance public regulation and accountability with the creation of room for market competition. As a result, we can observe in both countries a greater use of markets, but also of rules. While in both countries the relationships between different providers of labour market services can best be described as a mixture of cooperation and competition, differences exist in terms of instruments and the comprehensiveness of coordination initiatives. The findings suggest that the distinctions between governance models may be more important in theory than in practice, although the combinations of theoretical forms vary in different circumstances.

Lernen von den Besten? Steuerung und Nutzung von Leistungsvergleichen in europäischen Verwaltungen

Der Begriff Altruismus geht auf Auguste Comte, den Gründer der Soziologie zurück. Es bezeichnet zugleich Uneigennütziges als auch selbstloses Verhalten von Individuen und wird daher oft dem egoistischen Verhalten gegenübergestellt. Die zahlreichen Anhänger des rationalen-egoistischem Paradigma lehnen die Idee der altruistischen Natur des Menschen meist ab, wohingegen die Anhänger des Altruismus nicht nur schwerer zu finden sind, sondern vor allem die Idee einer rein egoistischen Natur ablehnen. Diese Arbeit untersucht die Altruismus-Begriffe der Soziologen Emile Durkheim und James Coleman, welche die Kontroverse zwischen den unterschiedlichen Paradigmen wiederspiegeln. Ziel dieser Arbeit wird es sein, die unterschiedlichen Altruismus-Konzepte von Durkheim und Coleman zunächst vorzustellen, anschließend einander gegenüberzustellen und darauf folgend zu untersuchen, welche Auswirkung ihre unterschiedlichen Weltanschauungen, Prämissen und Methodologien auf ihr Verständnis von der Logik des selbstlosen Gebens haben. Durch den Vergleich soll versucht werden die Grenzen beider Theorien aufzuzeigen und damit auch ein Ausweg aus dem methodologischem Disput, welcher folglich zur Überwindung der Altruismus-Egoismus Kontroverse beitragen soll.
Entwicklung von Strategien zur Attraktivitätssteigerung von Fortbildungen im Gesundheitsmanagement

Die Herausforderungen des 21. Jahrhunderts bewirken sowohl im Bundesministerium der Finanzen BMF als auch im französischen Wirtschafts- und Finanzministerium MINEFI, der Gesunderhaltung der Beschäftigten besondere Aufmerksamkeit zu schenken. Beide Verwaltungen sehen dabei die Referatsleiter/innen (RL) in der Pflicht und bieten deshalb Fortbildungen im Gesundheitsmanagement an. Das Interesse der RL für dieses Angebot ist bisher gering. Die vorliegende Masterarbeit untersucht die Ursachen für das in der deutschen und französischen Finanzverwaltung unterschiedlich geringe Interesse und kommt zu dem Schluss, dass die Hemmnisse im MINEFI stärker durch soziokulturelle und institutionelle Faktoren (republikanische Elitenbildung und Positionsmacht der jeweiligen Hierarchiestufe) bedingt sind, während im BMF institutionelle und persönlichkeitsspezifische Gründe zusammentreffen. Die Behördenkultur beider Ministerien fokussiert die Arbeitsergebnisse der RL und lässt ihr Verhältnis zu den Referatsangehörigen weitestgehend außer Acht. Eine Attraktivitätssteigerung des Fortbildungsangebots im Gesundheitsmanagement setzt in beiden Verwaltungen voraus, Marketingstrategien innerhalb der Behörde zu etablieren, die die Wertigkeit des Gesundheitsmanagements im Organisationsgefüge erhöhen und dadurch die RL stärker motivieren. Dieser Change-Prozess erfordert Ausdauer und Geduld.
Gleichstellungspolitik als „Querschnittspolitik“ ist eine der oft genannten politische Metapher unserer Zeit. Ob in der Arbeitsmarkt-, Steuer-, Familien- oder Bildungspolitik, Gleichstellung ist in allen diesen Bereichen von hoher Relevanz. Der „Querschnittscharakter“ der Gleichstellungspolitik trägt dazu bei, dass in diesem Politikbereich viele unterschiedliche Akteure mit ebenso unterschiedlichen Handlungslogiken sowie Zielen aufeinandertreffen. Um Gleichstellungprogramme planen und darüber Gleichstellungspolitiken gestalten zu können, müssen die Handlungen dieser Akteure koordiniert werden.
In dieser Arbeit wird unter Verwendung des Governance-Ansatzes der Frage nachgegangen, wie die Handlungskoordination zwischen unterschiedlichen Akteuren im System der deutschen Gleichstellungspolitik erfolgt. Analysiert und rekonstruiert werden die gleichstellungspolitischen Entwicklungen in der BRD seit den 1990er Jahren, anhand der Auswertung relevanter Regierungsdokumente und wissenschaftlicher Sekundärliteratur. Hierarchien, Netzwerke und Verhandlungen – Ausprägungen der Governance-Formen – stehen bei der Rekonstruktion und Analyse der Akteurskonstellationen im Mittelpunkt.
Im Ergebnis konnten im Falle Deutschlands zwei verschiedene „Gleichstellungsgovernance-Regime“ identifiziert werden. Diese sind gekennzeichnet durch die in den Regimen je dominierenden Handlugskoordinationsmechanismen der „wirtschaftlichen-Selbstkoordination“ (2001) und der „wechselseitigen-Beobachtung“ (2003-2012). Der Vergleich dieser beiden Regime zeigt, dass sie sich vor allem in Hinblick auf ihre Akteurskonstellationen unterscheiden. In ihnen herrschen je eigene Handlungslogiken und als Folge daraus unterschiedliche gleichstellungspolitische Ergebnisse.
Civil society is either considered as a motor of democratization or stabilizer of authoritarian rule. This dichotomy is partly due to the dominance of domains-based definitions of the concept that reduce civil society to a small range of formally organized, independent and democratically oriented NGOs. Additionally, research often treats civil society as a ‘black box’ without differentiating between potential variations in impact of different types of civil society actors on existing regime structures. In this thesis, I present an alternative conceptualization of civil society based on the interactions of societal actors to arrive at a more inclusive understanding of the term which is more suited for analysis in non-democratic settings. The operationalization of the action-based approach I develop allows for an empirical assessment of a large range of societal activities that can accordingly be categorized from little to very civil society-like depending on their specific modes of interactions within four dimensions. I employ this operationalization in a qualitative case study including different actors in the authoritarian monarchy of Jordan which suggests that Jordanian societal actors mostly exhibit tolerant and democratically oriented modes of interaction and do not reproduce authoritarian patterns. However, even democratically oriented actors do not necessarily take on an oppositional positions vis-à-vis the authoritarian regime. Thus, the Jordanian civil society might not feature a high potential to challenge existing power structures in the country.
Im Folgenden schlage ich ein System gesellschaftlicher Dauerbeobachtung für den internationalen Vergleich von Gesellschaften vor, indem aufgrund einer Auseinandersetzung mit der sozialphilosophischen Diskussion acht Performanzkriterien für den Vergleich von Lebensbedingungen bzw. der „Wohlfahrt der Nationen“ entwickelt werden: Wohlstand und Wachstum; ökologische Nachhaltigkeit; Innovation; soziale Sicherung durch Unterstützungsleistungen im Risikofall sowie vorsorgend durch Bildungsinvestitionen; Anerkennung der Besonderheiten (Frauenfreundlichkeit und Migrantenfreundlichkeit); Gleichheit der Teilhabe; soziale Integration; Autonomie („freedom of choice and capabilities”). – Der Wandel von Wohlstand und Wohlfahrt wird im Kontext der Weltfinanzkrise und der folgenden großen Rezession betrachtet.
In meinem Lehrforschungsprojekt haben wir in einem ersten Schritt ab 2004 die Operationalisierung der gesellschaftlich wünschenswerten Ziele entwickelt und erste Auswertungen für 28 Länder vorgenommen (Holtmann, Dieter u. a.: Zur Performanz von Wohlfahrtsregimen und zu den Unterstützungspotentialen für die verschiedenen Wohlfahrtskonzepte. Potsdam 2006: Universitätsverlag). Im nächsten Schritt haben wir die Operationalisierungen weiterentwickelt und ab 2007 36 Länder in den Vergleich einbezogen (Holtmann, Dieter u.a.: Die Sozialstruktur der Bundesrepublik Deutschland im internationalen Vergleich. Potsdam 20127: Universitätsverlag). Im dritten Schritt haben wir diesen systematischen Ländervergleich durch Fallstudien zu den einzelnen Ländern ergänzt (Holtmann, Dieter u.a.: Die Wohlfahrt der Nationen: 40 Länder-Fallstudien zu den Institutionen und ihrer Performanz. Aachen 2012: Shaker).
In meinem Ansatz gehe ich nicht von einem einheitlichen Pfad der Modernisierung in Richtung Wachstum, Partizipation und Inklusion aus, sondern unterscheide – in Erweiterung der „drei Welten des Wohlfahrtskapitalismus“ von Esping-Andersen (1990) – für die berücksichtigten Länder (u.a. alle EU-Mitglieder) insbesondere folgende sechs verschiedene institutionelle Entwicklungspfade der Modernisierung: Der sozialdemokratisch-universalistische Pfad, der wirtschaftsliberale Pfad, der Status-konservierende Pfad, der „familistische“ Pfad, die Entwicklung der Gruppe der post-sozialistischen Länder, die sich in einem Prozess der Ausdifferenzierung befinden, und den produktivistischen, aufstiegsorientierten Modernisierungspfad Ostasiens. Als Erweiterung über die 36 entwickelten Länder unserer Sozialstrukturvergleiche hinaus berücksichtige ich die fünf Aufsteiger Südkorea, Brasilien, Südafrika, China und Indien sowie mit Kroatien und Serbien ein neues bzw. prospektives EU-Mitglied.
Als gesellschaftliche Teilbereiche zur Analyse der Sozialstrukturen nach der Weltfinanzkrise werden behandelt: Bildung und Bildungsregime; Dienstleistungs-gesellschaften und Erwerbstätigkeit; Wohlfahrtsregime und soziale Sicherung (Bildung und nachsorgende soziale Sicherung); Wohlstand, Einkommen, Vermögen und Armut; Individualisierung und ihre Gegenbewegungen; soziale Ungleichheiten zwischen Frauen und Männern; Bevölkerungsstruktur und Lebensformen; zusammenfassender Vergleich von Lebensbedingungen in den verschiedenen Ländern und Wohlfahrtsregimen.
Historisch wie aktuell werden durch gewalttätige soziale Auseinandersetzungen bestehende gesellschaftliche Ordnungen infrage gestellt. In der Geschichtswissenschaft wie in der Soziologie waren Tumulte, Aufstände oder soziale Erhebungen immer wieder Gegenstand von Untersuchungen. Während der historische Zugriff auf diese Phänomene gewöhnlich durch detaillierte Beschreibungen historische Abläufe genau zu rekonstruieren versucht hat, um diese verstehen zu können, geht es soziologischen Arbeiten zumeist um einen viel stärker generalisierenden und erklärenden Zugriff. Zwar gab es immer wieder Anläufe, diese scheinbar unüberbrückbare Differenz zwischen den Disziplinen zu überwinden, doch alle die Versuche müssen als mehr oder weniger gescheitert angesehen werden. Nach wie vor gilt deshalb, dass mit der ausschließlichen Konzentration auf die je eigene disziplinäre Herangehensweise viel Erkenntnispotenzial verschenkt wird. Aus diesem Grund unterbreitet die vorliegende Studie einen neuen Vorschlag, Geschichtswissenschaft und Soziologie zusammenzubringen. Der Verfasser unternimmt hier den Versuch, die beiden vermeintlich so gegensätzlichen Auffassungen von Wissenschaftlichkeit über eine gemeinsame methodologische Perspektive zusammenzuführen und auf dieser Grundlage einen vereinten, erklärenden Zugriff von Geschichtswissenschaft und Soziologie zu skizzieren, der nach dem „Wie“ eines Ereignisses fragt, zugleich aber auch erklären will, „warum“ es dazu gekommen ist. Das vorliegende Buch untersucht auf dieser methodologischen Grundlage und mittels eines historisch-soziologischen Zugangs sozialen Protest im Vormärz, es schließt an Arbeiten der historischen Soziologie und Sozialgeschichte an und entwickelt dazu einen stringenten historisch-soziologischen Erklärungsansatz.
Im Rahmen der Dissertation wird die Anwendung und Wirkung von Kernelementen des New Public Management (NPM) am Beispiel der Bürgerdienste der sechs europäischen Hauptstädte Berlin, Brüssel, Kopenhagen, Madrid, Prag und Warschau analysiert. Hierbei steht der Vergleich von Hauptstädten der MOE-Staaten mit Hauptstädten alter EU-Mitgliedsstaaten im Vordergrund. Es wird die folgende Forschungshypothese untersucht: Die Verwaltungen in den Hauptstädten der östlichen Mitgliedsstaaten der EU haben in Folge der grundsätzlichen gesellschaftlichen und politischen Umbrüche in den 1990er Jahren bedeutend mehr Kernelemente des NPM beim Neuaufbau ihrer öffentlichen Verwaltungen eingeführt. Durch den folgerichtigen Aufbau kundenorientierter und moderner Verwaltungen sowie der strikten Anwendung der Kernelemente des New Public Management arbeiten die Bürgerdienste in den Hauptstädten östlicher EU-Mitgliedsstaaten effizienter und wirkungsvoller als vergleichbare Bürgerdienste in den Hauptstädten westlicher EU-Mitgliedsstaaten. Zur Überprüfung der Forschungshypothese werden die Vergleichsstädte zunächst den entsprechenden Rechts- und Verwaltungstraditionen (kontinentaleuropäisch deutsch, napoleonisch und skandinavisch) zugeordnet und bezüglich ihrer Ausgangslage zum Aufbau einer modernen Verwaltung (Westeuropäische Verwaltung, Wiedervereinigungsverwaltung und Transformations-verwaltung) kategorisiert. Im Anschluss werden die institutionellen Voraussetzungen hinterfragt, was die deskriptive Darstellung der Stadt- und Verwaltungsgeschichte sowie die Untersuchung von organisatorischen Strukturen der Bürgerdienste, die Anwendung der NPM-Instrumente als auch die Innen- und Außenperspektive des NPM umfasst. Es wird festgestellt, ob und in welcher Form die Bürgerdienste der Vergleichsstädte die Kernelemente des NPM anwenden. Im Anschluss werden die Vergleichsstädte bezüglich der Anwendung der Kernelemente miteinander verglichen, wobei der Fokus auf dem persönlichen Vertriebsweg und der Kundenorientierung liegt. Der folgende Teil der Dissertation befasst sich mit dem Output der Bürgerdienste, der auf operative Resultate untersucht und verglichen wird. Hierbei stellt sich insbesondere die Frage nach den Leistungsmengen und der Produktivität des Outputs. Es werden aber auch die Ergebnisse von Verwaltungsprozessen untersucht, insbesondere in Bezug auf die Kundenorientierung. Hierfür wird ein Effizienzvergleich der Bürgerdienste in den Vergleichsstädten anhand einer relativen Effizienzmessung und der Free Disposal Hull (FDH)-Methode nach Bouckaert durchgeführt. Es ist eine Konzentration auf populäre Dienstleistungen aus dem Portfolio der Bürgerdienste notwendig. Daher werden die vergleichbaren Dienstleistungen Melde-, Personalausweis-, Führerschein- und Reisepass-angelegenheiten unter Einbeziehung des Vollzeitäquivalents zur Berechnung der Effizienz der Bürgerdienste herangezogen. Hierfür werden Daten aus den Jahren 2009 bis 2011 genutzt, die teilweise aus verwaltungsinternen Datenbanken stammen. Anschließend wird der Versuch unternommen, den Outcome in die Effizienzanalyse der Bürgerdienste einfließen zu lassen. In diesem Zusammenhang wird die Anwendbarkeit von verschiedenen erweiterten Best-Practice-Verfahren und auch eine Erweiterung der relativen Effizienzmessung und der FDH-Methode geprüft. Als Gesamtfazit der Dissertation kann festgehalten werden, dass die Bürgerdienste in den untersuchten Hauptstädten der MOE-Staaten nicht mehr Kernelemente des NPM anwenden, als die Hauptstädte der westlichen Mitgliedsstaaten der EU. Im Gegenteil wendet Prag deutlich weniger NPM-Instrumente als andere Vergleichsstädte an, wohingegen Warschau zwar viele NPM-Instrumente anwendet, jedoch immer von einer westeuropäischen Vergleichsstadt übertroffen wird. Auch die Hypothese, dass die Bürgerdienste in den Hauptstädten der MOE-Staaten effizienter arbeiten als vergleichbare Bürgerdienste in den Hauptstädten westlicher EU-Mitgliedsstaaten wurde durch die Dissertation entkräftet. Das Gegenteil ist der Fall, da Prag und Warschau im Rahmen des Effizienzvergleichs lediglich durchschnittliche oder schlechte Performances aufweisen. Die aufgestellte Hypothese ist durch die Forschungsergebnisse widerlegt, lediglich das gute Abschneiden der Vergleichsstadt Warschau bei der Anwendungsanalyse kann einen Teil der These im gewissen Umfang bestätigen.
Diese Arbeit untersucht, was passiert, wenn in Non-Profit-Organisation (NPO) der Anspruch des Bürgerschaftlichen Engagements auf Praktiken des Freiwilligenmanagements trifft. Ausgangspunkt dieser Fragestellung ist eine doppelte Diagnose: Zum einen setzen NPOs aufgrund mehrerer Faktoren - u.a. Ressourcenknappheit, Wettbewerb und Nachahmungseffekten – vermehrt auf Freiwilligenmanagement. Mit dieser von der BWL inspirierten, aber für NPO entwickelten Personalführungsmethode wollen sie mehr und bessere Freiwillige gewinnen und deren Einsatz effizienter strukturieren. Zum anderen haben sich gleichzeitig viele NPO dem Ziel des bürgerschaftlichen Engagements verschrieben. Damit reagieren sie auf den aus Politik und Wissenschaft zu vernehmenden Anspruch, die Zivilgesellschaft möge die knappen Kassen der öffentlichen Hand kompensieren und das wachsende Partizipationsbedürfnis weiter Teile der Bevölkerung durch eine neue Kultur der Teilhabe der Bürgerinnen und Bürger befriedigen. Bei näherer Betrachtung zeigt sich jedoch: Während Freiwilligenmanagement einer ökonomischen Handlungslogik folgt, ist bürgerschaftliches Engagement Ausdruck einer Handlungslogik der Zivilgesellschaft. Beide sind unter gegenwärtigen Bedingungen weder theoretisch noch praktisch miteinander vereinbar. Um beide Entwicklungen miteinander zu versöhnen, muss Freiwilligenmanagement unter dem Banner des Bürgerschaftlichen neu gedacht werden. Dieses Argument unterfüttert die Arbeit sowohl theoretisch und empirisch. Der Theorieteil gliedert sich in drei Teile. Zunächst wird der Begriff der NPO näher eingegrenzt. Dazu wird die bestehende Literatur zum Dritten Sektor und Non-Profit-Organisationen zu einem operationalisierbaren Begriff von NPO kondensiert. Daran anschließend werden aktuelle Trends im Feld der NPO identifiziert, die zeigen, dass NPO tatsächlich oft von widerstreitenden Handlungslogiken gekennzeichnet sind, darunter eine ökonomische und eine bürgerschaftliche. Die beiden folgenden Kapitel untersuchen dann jeweils eine der beiden Logiken. Zunächst wird das Leitbild des bürgerschaftlichen Engagements als Ausdruck einer zivilgesellschaftlichen Handlungslogik näher definiert. Dabei zeigt sich, dass dieser Begriff oft sehr unscharf verwendet wird. Daher greift die Arbeit auf die politiktheoretische Diskussion um Zivil- und Bürgergesellschaft auf und schmiedet daraus eine qualifizierte Definition von bürgerschaftlichem Engagement, die sich maßgeblich am Ideal von gesellschaftlich-politischer Partizipation und bürgerschaftlicher Kompetenz orientiert. Dem wird im dritten und letzten Kapitel des Theorieteils die ökonomische Handlungslogik in Form der Theorie des Freiwilligenmanagements gegenübergestellt. Bei der Darstellung zeigt sich schnell, dass dessen Grundprinzipien – anders als oft vorgebracht – mit den qualifizierten Idealen von Partizipation und Konkurrenz im Konflikt stehen. In der empirischen Analyse wird dann in den 8 Interviews den Widersprüchen zwischen bürgerschaftlichem Engagement und Freiwilligenmanagement in der Praxis nachgegangen. Die Ergebnisse dieser Untersuchung lassen sich in 5 Punkten zusammenfassen: 1. Freiwilligenmanagement orientiert sich erstens im wesentlichen an einer Zahl: Dem Zugewinn oder Verlust von freiwilliger Arbeit. 2. Freiwilligenmanagement installiert ein umfassendes System der Selektion von „passenden“ Freiwilligen. 3. Positiv hervorzuheben ist die institutionalisierte Ansprechbarkeit, die im Rahmen von Freiwilligenmanagement in NPO Einzug erhält. 4. Freiwilligenmanagement ist eng mit dem Anspruch verbunden, die Arbeit der Freiwilligen zu kontrollieren. Der Eigensinn des Engagements, die Notwendigkeit von Spielräumen, die Möglichkeit des Ausprobierens oder der Anspruch der Freiwilligen, an Entscheidungen zu partizipieren bzw. gar selbstorganisiert und -verantwortlich zu handeln, rückt dabei in den Hintergrund. 5. In den Interviews wird eine starke Ökonomisierung des Engagements sichtbar. Freiwillige werden als Ressource betrachtet, ihr Engagement als „Zeitspende“ statistisch erfasst, ihre (Dienst-)Leistung monetär bewertet. Im Zuge dessen erhält auch der Managerialism verstärkt Einfluss auf die Arbeit in NPO und begründet ein stark hierarchisches Verhältnis: Während die Freiwilligenmangerin aktiv handelt, wird die freiwillig Engagierte zum Objekt von Management-Techniken. Dass dies dem Anspruch der Partizipation entgegenläuft, ergibt sich dabei von selbst. Angesichts dieser Diagnose, dass real-existierendes Freiwilligenmanagement nicht mit dem Ideal des bürgerschaftlichen Engagement im engeren Sinne zusammenpasst, formuliert das Fazit Vorschläge für ein bürgerschaftlich orientiertes, engagement-sensibles Freiwilligenmanagement.
Der Band enthält die Tagungsmaterialien des deutsch-russichen Symposiums zum Thema "Verfassungsentwicklung in Russland und Deutschland", welches am 25. und 26. September 2013 in Potsdam stattfand. Die Tagung wurde anlässlich des 20. Jahrestages der russischen Verfassung vom Dezember 2013 durchgeführt. Die inhaltlichen Schwerpunkte bilden die Themen: Verfassungsentstehung, Verfassungsänderung, Verfassungsprinzipien, Landesverfassungen, Fortentwicklung der Verfassung durch die Verfassungsgerichtsbarkeit und Grundrechte, die jeweils aus russischer und deutscher Sicht behandelt werden. Ergänzend befasst sich jeweils ein Betrag mit aktuellen Problemen der Menschenrechtsverwirklichung in Russland und der Ausländerintegration in Deutschland und Russland im Vergleich.
Das Europäische Parlament ist zweifelsohne die mächtigste parlamentarische Versammlung auf supranationaler Ebene. Das provoziert die Frage, wie Entscheidungen in diesem Parlament gefällt werden und wie sie begründet werden können. Darin liegt das Hauptanliegen dieser Arbeit, die zur Beantwortung dieser Frage auf soziologische Ansätze der Erklärung sozialen Handelns zurückgreift und damit einen neuen Zugang zur Beobachtung parlamentarischen Handelns schafft. Dabei arbeitet sie heraus, wie wichtig es ist, bei der Analyse politischer Entscheidungsprozesse zu beachten, wie politische Probleme von Akteuren interpretiert und gegenüber Verhandlungspartnern dargestellt werden. An den Fallbeispielen der Entscheidungsprozesse zur Dienstleistungsrichtlinie, zur Chemikalien-Verordnung REACH und dem TDIP (CIA)-Ausschuss in der Legislaturperiode 2004–2009, wird der soziale Mechanismus dargestellt, der hinter Einigungen im Europäischen Parlament steckt. Kultur als Interpretation der Welt wird so zum Schlüssel des Verständnisses politischer Entscheidungen auf supranationaler Ebene.
World market governance

Democratic capitalism or liberal democracy, as the successful marriage of convenience between market liberalism and democracy sometimes is called, is in trouble. The market economy system has become global and there is a growing mismatch with the territoriality of the nation-states. The functional global networks and inter-governmental order can no longer keep pace with the rapid development of the global market economy and regulatory capture is all too common. Concepts like de-globalization, self-regulation, and global government are floated in the debate. The alternatives are analysed and found to be improper, inadequate or plainly impossible. The proposed route is instead to accept that the global market economy has developed into an independent fundamental societal system that needs its own governance. The suggestion is World Market Governance based on the Rule of Law in order to shape the fitness environment for the global market economy and strengthen the nation-states so that they can regain the sovereignty to decide upon the social and cultural conditions in each country. Elements in the proposed Rule of Law are international legislation decided by an Assembly supported by a Council, and an independent Judiciary. Existing international organisations would function as executors. The need for broad sustained demand for regulations in the common interest is identified.
