Heute wird selbstverständlich von einer aktiven Zivilgesellschaft als relevanter Akteurin des politischen Prozesses ausgegangen. Dies gilt für den innerstaatlichen Rahmen ebenso wie für die völkerrechtliche Ebene. Das Engagement zivilgesellschaftlicher Akteure im verfassungsrechtlich eingehegten Rahmen des politischen Prozesses ist mit Fragen verbunden, denen sich dieser Aufsatz nähern wird. Zunächst wird der Begriff der Zivilgesellschaft hergeleitet (I) und danach wird auf die Funktionen der Öffentlichkeit in einem rechtsstaatlich verfaßten republikanischen Gemeinwesen eingegangen (II), bevor zum Schluß aktuelle Themen, die sich in den letzten Jahren entwickelt haben, vorgestellt und als erste Forschungsfragen formuliert werden (III).

Eine wertorientierte Rechtsordnung ist vor die Aufgabe gestellt, gegebenenfalls konfligierende Werte untereinander in Ausgleich zu bringen: Freiheit der Meinungsäußerung einerseits, das Verbot bestimmter Inhalte, um Ehre und Leben von Menschen zu schützen, andererseits. Der Aufsatz stellt den Umfang der Meinungsäußerungsfreiheit nach dem Internationalen Pakt über bürgerliche und politische Rechte dar und beschreibt die Möglichkeiten zulässiger Beschränkungen. Er geht weiterhin auf die Strafbarkeit der sogenannten Holocaustlüge in der Bundesrepublik Deutschland ein.

Diese Studie will aufzeigen, welche Rolle der Achtung und Förderung der Menschenrechte in den Außenbeziehungen der Europäischen Union zukommt, und prüfen, welche Folgerungen daraus im innergemeinschaftlichen Bereich gezogen werden können. Dazu wird zunächst ein Überblick über die Entwicklung des Schutzes der Menschenrechte in den Außenbeziehungen, insbesondere im Rahmen der Entwicklungszusammenarbeit der Gemeinschaft gegeben. Daran schließt sich eine Darstellung der Rechtfertigung dieser Politik an. Die sodann vorzunehmende Würdigung ihrer heutigen Bedeutung schließt auch Fragen der Überwachung und Rechtsfolgen von Verstößen ein. Abschließend werden mögliche Rückwirkungen auf die innergemeinschaftliche Menschenrechtspolitik diskutiert.

Vorwort: Im vorliegenden Heft der Studien zu Grund- und Menschenrechten wird der Vortrag dokumentiert, den Prof. Dr. Georg Lohmann von der Ottovon- Guericke-Universität Magdeburg am 12. Mai 2004 im Rahmen der neu eingerichteten Reihe „Philosophie der Grund- und Menschenrechte“ an der Universität Potsdam gehalten hat. Die Veranstaltung bot Gelegenheit, die Frage zu erörtern, ob die unterschiedlichen Menschenrechte tatsächlich gleichgestellt sind oder doch eine Hierarchisierung von Menschenrechten stattfindet. Nach mehrjähriger Befassung mit dem Thema „Menschen mit Behinderungen“ hatte die Generalversammlung der Vereinten Nationen im Jahre 2001 die Resolution zur Ausarbeitung einer umfassenden internationalen Konvention zum Schutze und zur Förderung der Rechte von behinderten Menschen verabschiedet und einen Ad-hoc-Ausschuß zur Ausarbeitung dieser Konvention eingesetzt. Dieser nahm seine Arbeit im August 2002 auf und konnte schließlich im Jahre 2006 einen Entwurf vorlegen, der von der Generalversammlung am 13. Dezember 2006 im Konsens angenommen wurde. Mehr als 600 Millionen Menschen sind weltweit infolge geistiger und/oder körperlicher Beeinträchtigungen in ihrer Lebensführung durch physische oder gesellschaftliche Grenzen eingeschränkt. Rund 80% von ihnen leben in Entwicklungsländern. Menschen mit Behinderungen sehen sich mit Diskriminierungen und einem erschwerten Zugang zu wesentlichen Leistungen konfrontiert; beides hält sie oftmals davon ab, ihre Rechte und Freiheiten auszuüben. Ihnen wird so die vollständige und umfassende Teilhabe am gesellschaftlichen Leben sowie an gesellschaftlichen Aktivitäten erschwert. Es gibt deshalb eine Vielzahl von Bemühungen zur Gleichstellung behinderter mit nicht behinderten Menschen in bezug auf die Ausübung ihrer bürgerlichen, politischen, wirtschaftlichen, sozialen und kulturellen Rechte. Ziel der jetzt verabschiedeten Konvention soll es sein, den vollständigen und gleichberechtigten Genuß aller Menschenrechte und Grundfreiheiten für Menschen mit Behinderungen zu fördern, zu schützen und zu sichern sowie den Respekt vor ihrer angeborenen Würde zu fördern (Art. 1). Der Entwurf enthält sowohl bürgerliche und politische als auch wirtschaftliche, soziale und kulturelle Rechte. Der Aufsatz erläutert die Hintergründe der Konvention und gibt einen Überblick über ihre Inhalte.
Die Studien analysiert die seit dem Beitritt mittel- und osteuropäischer Staaten nach dem Fall der Mauer ergangene Rechtsprechung der Europäischen Kommission für Menschen-rechte und des Europäischen Gerichtshofs für Menschenrechte. Die Hauptgegenstände der entschiedenen Fälle werden gruppiert und die Ergebnisse der Entscheidungen kommentiert. Als Ergebnis wird festgestellt, daß die Unterschiede zwischen Beschwerden aus den alten und neuen Mitgliedstaaten recht gering sind. Dies zeigt, daß nach der - mehrere Jahre in Anspruch nehmenden - Aufarbeitung der aus den Transformationsprozessen resultie-renden Probleme die europäische Rechtsgemeinschaft, wie sie in der Satzung des Europa-rates und der Präambel der Europäischen Menschenrechtskonvention beschworen wird, Realität sein wird. Unsicherheitsfaktoren wie der Beitritt Rußlands und die Zunahme von Beschwerdeverfahren trotz der zwischenzeitlich eingetretenen Reform des Überwachungsmechanismus werden für die Zukunft zu berücksichtigen sein.

Die Reform des Amtsrechts der Staatsanwaltschaft : europarechtliche und völkerrechtliche Impulse

Die Untersuchung legt zunächst das geltende Amtsrecht der Staatsanwaltschaft dar und gibt dann einen Überblick über die verschiedenen Stadien der seit vielen Jahrzehnten geführten Reformdiskussion. Dieser sollen durch Impulse aus dem Europarecht und dem Völkerrecht neue Argumente zugeführt werden. Die Europäischen Gemeinschaften betreiben die Einführung eines Europäischen Staatsanwaltes. Dieser soll im Rahmen der Betrugsbekämpfung zu Lasten des Gemeinschaftshaushaltes Ermittlungen durchführen. Seine Rechtsstellung unterscheidet sich signifikant von der des deutschen Staatsanwalts. Hinzu kommen bedenkenswerte Hinweise für die Rechtsstellung von Anklägern aus dem Völkerrecht. So sind die Ankläger vor dem Internationalen Strafgerichtshof und den Ad-hoc-Straftribunalen für das ehemalige Jugoslawien und für Ruanda selbständige Organe dieser Gerichte und ausdrücklich weisungsfrei. Dieses Buch untersucht, inwieweit Europa- und -in geringerem Ausmaß- Völkerrecht die Diskussion über die Reformbedürftigkeit des Amtsrechts der Staatsanwälte in Deutschland zu beeinflussen vermögen.
Der Forschungskreis Vereinte Nationen veranstaltete am 25. Juni 2016 seine dreizehnte Konferenz in Kooperation mit dem „Forum internationale Ordnung“ des Auswärtigen Amtes. Die Potsdamer UNO-Konferenzen stellen in ihrem Programm traditionell eine Verbindung von Wissenschaft und Praxis her unter Beteiligung unterschiedlicher Disziplinen.
Die Konferenz 2016 widmete sich dem Thema „Die Rolle der Vereinten Nationen in der multilateralen Entwicklungszusammenarbeit“.
Entwicklung als wichtiges Ziel der Vereinten Nationen und ihrer Mitgliedstaaten ist auch für andere Handlungs- und Politikfelder wichtig. Bilanz und Ausblick, die auf der Konferenz unternommen wurden, betrafen deshalb nicht nur die Entwicklungspolitik im eigentlichen Sinne – hier standen die 2015 beschlossenen Nachhaltigkeitsziele (SDGs) zur Debatte –, sondern bezogen auch umweltpolitische und menschenrechtliche Aspekte mit ein.
Die Referate zum Thema Entwicklung wurden eingerahmt von zwei Vorträgen zu aktuellen UN-politischen Fragen: der Wahl des neuen Generalsekretärs der Vereinten Nationen in New York nach einem reformierten Wahlverfahren, das mehr Transparenz und für UN-Mitgliedstaaten und NGOs mehr Beteiligungsmöglichkeiten bietet, und die Neuorganisation innerhalb des Auswärtigen Amtes, was die Vereinten Nationen betrifft.

Der Beitrag zeichnet die völkerrechtlichen Normierungen des Verbotes der Todesstrafe nach und erläutert, welche Beschränkungen der staatlichen Souveränität im Bereich der Todesstrafe auferlegt sind. Als Ergebnis kann festgestellt werden, daß es kein generelles, jeden Staat bindendes Verbot der Todesstrafe gibt. Noch ist es so, daß ein Staat sich direkt und ausdrücklich zur Abschaffung der Todesstrafe bekennen muß solange er dies nicht tut, ist die Verhängung und Vollstreckung der Todesstrafe bei Beachtung bestimmter rechtsstaatlicher Kautelen völkerrechtlich gesehen zulässig.

Der russische Angriffskrieg auf die Ukraine hat auch die Europäische Menschenrechtsarchitektur ins Wanken gebracht. Der Europarat reagierte schnell und beendete die Mitgliedschaft der Russischen Föderation. Aus diesem Anlass blickt der Beitrag zurück auf die wechselvolle Geschichte der Mitgliedschaft Russlands im Europarat. Seit dem Beitritt vor 26 Jahren haben Konfrontationen die – oftmals kurzen– Phasen der Kooperation überschattet. Das wirft die Frage auf, inwieweit die „Politik des Dialogs“ gegenüber der Russischen Föderation geeignet war, die Menschenrechtslage in Russland zu verbessern. Der Beitrag legt zudem die rechtlichen Grundlagen von Beitritt und Ende der Mitgliedschaft dar und untersucht, wie sich der Ausschluss auf die Anwendbarkeit der Europäischen Menschenrechtskonvention (EMRK) auswirkt. Der Ausschluss Russlands stellt einen Wendepunkt dar. Zwar wird damit ein potenziell gefährlicher Präzedenzfall geschaffen. Jedoch entsteht durch die geschlossene Reaktion der restlichen Mitgliedstaaten auch ein Momentum für Reformen und eine Rückbesinnung auf das Gründungsziel des Europarates – die kollektive Durchsetzung der Menschenrechte.

Das Heft dokumentiert die siebte Konferenz des Forschungskreises Vereinte Nationen, die am 23. und 24. Juni 2006 an der Universität Potsdam stattfand. Unter dem Titel „Ein Jahr nach dem UN-Weltgipfel 2005 – Eine Bilanz der Reformbemühungen “ widmete sich die Konferenz wichtigen strukturellen Fragen und nahm einzelne Tätigkeitsfelder der Weltorganisation in den Blick. Die aus unterschiedlichen Disziplinen und aus Wissenschaft und Praxis kommenden Referentinnen und Referenten ziehen in den Referaten eine kritische Bilanz und untersuchen, was den Erklärungen des feierlichen Weltgipfels vom September 2005 an konkreten Reformschritten gefolgt ist. In für die „Potsdamer UNO-Konferenzen“ typischer Weise wird allen Interessierten die Möglichkeit gegeben, wichtige Aspekte der aktuellen Diskussion kennenzulernen, welche vor allem die Reform der UN-Hauptorgane, Reformen im Entwicklungssystem der Vereinten Nationen und im Bereich der Überwachung von Menschenrechtsverträgen betreffen sowie Fragen der Friedenssicherung und die Beteiligung von Zivilgesellschaft und Parlamentariern. Außerdem würdigt die Broschüre schweizerische Reforminitiativen in den UN und dokumentiert die aktuelle Diskussion über die deutschsprachige UN-Forschung.

Der internationale Menschenrechtsschutz setzt heute zunehmend auch auf die Initiative des einzelnen Menschen, der über seine Rechte wacht und Verletzungen vor internationalen Gremien oder Gerichten rügt. Zu den Menschenrechtsverträgen, die noch kein Beschwerdeverfahren anbieten, gehört der Sozialpakt. Das wird vor allem mit der mangelnden Justitiabilität wirtschaftlicher, sozialer und kultureller Rechte begründet. Dieses Argument ist in dieser Absolutheit nicht stichhaltig; auch wirtschaftliche, soziale und kulturelle Rechte enthalten justitiable Elemente. Ein Beschwerdeverfahren könnte dazu beitragen, diese Gehalte zu konkretisieren, und würde so das Gewicht der in Rede stehenden Rechte stärken.

Die erste Konferenz im Dezember 1999, die Gründungskonferenz, mündete nach einer intensiven Diskussion über die Situation in der deutschen UN-Forschung in die Gründung des Forschungskreises Vereinte Nationen. Dieser hat sich vor allem die bessere Kommunikation untereinander, die Förderung des interdisziplinären Dialogs und des wissenschaftlichen Nachwuchses in der UN-Forschung zum Ziel gesetzt. Die zweite Konferenz des Forschungskreises fand am 30. Juni und 1. Juli 2000, ebenfalls in den Räumen der Juristischen Fakultät der Universität Potsdam, im Vorfeld einer wichtigen UN-Konferenz, nämlich des Milleni-um-Gipfels im September 2000 in New York statt. Sie widmete sich einer kritischen Bilanz der Rolle der Vereinten Nationen bei der Suche nach Lösungen für die globalen Probleme, in ihren Hauptaufgabengebieten Friedenssicherung, Demokratisierung, Schutz der Menschenrechte und Förderung der wirtschaftlichen und sozialen Entwicklung. Die in dieser Broschüre veröffentlichten Referate der zweiten Konferenz spiegeln zusammen mit den Diskussionen, die zusammenfassend dargestellt werden, die großen Herausforderungen, aber auch die Chancen der Vereinten Nationen bei der Lösung der globalen Probleme, vor die sich die Völker der Welt zum Beginn des neuen Jahrtausend gestellt sehen.
