Nach Art. 7 Abs. 1 S. 1 des Vertrages zur abschließenden Regelung in Bezug aufDeutschland vom 12. September 1990 (Zwei-plus-Vier-Vertrag)1beendeten die Fran-zösische Republik, die Union der Sozialistischen Sowjetrepubliken, das VereinigteKönigreich Großbritannien und Nordirland und die Vereinigten Staaten von Ameri-ka„ihre Rechte und Verantwortlichkeiten in Bezug auf Berlin und Deutschland alsGanzes“. Dies hatte, wie in dessen Art. 7 Abs. 1 S. 2 ausdrücklich niedergelegt, zurFolge, dass„die entsprechenden, damit zusammenhängenden vierseitigen Verein-barungen, Beschlüsse und Praktiken beendet und alle entsprechenden Einrichtun-gen der vier Mächte aufgelöst“wurden.2Art. 7 Abs. 2 Zwei-plus-Vier-Vertrag stelltdemgemäß fest, dass das vereinte Deutschland volle Souveränität über seine inne-ren und äußeren Angelegenheiten erhalten habe. La Convention de Vienne de 1978 traite d’un problème intemporel dans la vie internationale des États, à savoir leurs mutations territoriales. Il s’agit là d’une réalité internationale qui survit au phénomène de la décolonisation, mutation territoriale hautement typée et délimitée historiquement. Les exemples sont innombrables. L’on peut mentionner la réunification de l’Allemagne, l’éclatement de l’Union soviétique, le démembrement de la Yougoslavie, la séparation entre la Tchéquie et la Slovaquie, la sécession de l’Erythrée de l’Ethiopie, la séparation du Timor oriental de l’Indonésie, la sécession du Pakistan oriental (Bangladesh) du Pakistan. La pratique récente, relative au Kosovo notamment, qui a déclaré son indépendance le 17 février 2008, met en exergue l’actualité juridique du sujet. Des cas de succession d’États dans un futur proche ou lointain ne sont donc pas à exclure. Les régions sécessionnistes et les pulsions séparatistes sont nombreuses, même si très généralement non reconnues par la communauté internationale. Pourtant, la succession d’États n’est toujours pas dotée d’un régime juridique cohérent complet. Il convient dès lors de s’intéresser à cette lacune juridique en partant du traité-clef en la matière qu’est la Convention de 1978. Un commentaire exhaustif, article par article, de cette Convention se révèle donc être nécessaire. Cet ouvrage contient une analyse serrée des apports et des lacunes de cette Convention à la lumière des travaux préparatoires ainsi que de la pratique récente. Il permet ainsi d’identifier les éléments de codification de la Convention de Vienne de 1978, mais aussi de voir en quoi celle-ci a pu donner naissance à des principes et règles coutumières en la matière. Il a pour ambition de remettre au goût du jour cette Convention et d’offrir aux chercheurs intéressés, mais également aux États et sujets concernés et à la communauté internationale une vue d’ensemble détaillée, analytique et systématique du droit actuel en matière de succession d’États et de découvrir ainsi les éléments de continuité et de rupture qui la caractérisent.
Would the world be a better place if one were to adopt a European approach to state immunity?

This chapter argues not only that there is no European Sonderweg (or ‘special way’) when it comes to the law of state immunity but that there ought not to be one. Debates within The Hague Conference on Private International Law in the late 1990s and those leading to the adoption of the 2002 UN Convention on Jurisdictional Immunities of States, as well as the development of the EU Brussels Regulation on Jurisdiction and Enforcement, as amended in 2015, all demonstrate that state immunity was not meant to be limited by such treaties but ‘safeguarded’. Likewise, there is no proof that regional European customary law limits state immunity when it comes to ius cogens violations, as Italy and (partly) Greece are the only European states denying state immunity in such cases while the European Court of Human Rights has, time and again, upheld a broad concept of state immunity. It therefore seems unlikely that in the foreseeable future a specific European customary law norm on state immunity will develop, especially given the lack of participation in such practice by those states most concerned by the matter, including Germany. This chapter considers the possible legal implications of the jurisprudence of the Italian Constitutional Court for European military operations (if such operations went beyond peacekeeping). These implications would mainly depend on the question of attribution: if one where to assume that acts undertaken within the framework of military operations led by the EU were to be, at least also, attributable to the troop-contributing member states, the respective troop-contributing state would be entitled to enjoy state immunity exactly to the same degree as in any kind of unilateral military operations. Additionally, some possible perspectives beyond Sentenza 238/2014 are examined, in particular concerning the redress awarded by domestic courts ‘as long as’ neither the German nor the international system grant equivalent protection to the victims of serious violations of international humanitarian law committed during World War II. In the author’s opinion, strengthening the jurisdiction of international courts and tribunals, bringing interstate cases for damages before the International Court of Justice, as well as providing for claims commissions where individual compensation might be sought for violations of international humanitarian law would be more useful and appropriate mechanisms than denying state immunity.

In this chapter, we conduct bibliometric performance analyses and a co-citation analysis on all articles relating to family firms indexed in Scopus and Web of Science and all articles published in the Family Business Review, Journal of Family Business Management, and the Journal of Family Business Strategy. Based on the literature sample of 4,056 articles published between 1960 and 2020 by 3,600 authors in 783 journals and their 175,163 references, we identify the most productive and most cited journals, the most cited authors, and the 25 most cited articles. Our science mapping reveals the agency theory, definitions, entrepreneurship, internationalization, ownership, resources, socioemotional wealth, and succession as the predominant research themes in family firm research. Whereas entrepreneurship explicitly appears in one of the clusters, innovation does not yet. Based on our findings, we propose a research framework and point to several research gaps to be addressed by future research.
Die schrumpfende Mittelschicht ist nicht nur in der Öffentlichkeit ein vieldiskutierter Themenbereich. Eine Vielzahl an wissenschaftlichen Fachdisziplinen setzt sich aus unterschiedlichen Perspektiven mit der Mittelschicht im Kontext des Wandels von Schichtungsgefügen auseinander. Während die gesellschaftliche Mitte in Deutschland ein etabliertes Forschungsgebiet ist, liegen für Österreich hingegen bislang kaum Studien vor. Vor diesem Hintergrund vereint der Sammelband konzeptionelle und empirische Beiträge zur österreichischen Mittelschicht aus Soziologie, Politikwissenschaften, Staatswissenschaft, und Zeitgeschichte. Ziel ist die umfassende multidisziplinäre Darstellung des Status Quo der Mittelschicht in Österreich. Die Beiträge in diesem Sammelband bieten einen Überblick über historische Perspektiven, unterschiedliche Theorietraditionen, sowie gegenwärtige empirische Befunde und sozialpolitische Analysen.
This paper reads ‘The Detainee’s Tale as told to Ali Smith’ (2016) as an exemplary demonstration of the work of world literature. Smith’s story articulates an ethics of reading that is grounded in the recipient’s openness to the singular, unpredictable, and unverifiable text of the other. More specifically, Smith’s account enables the very event that it painstakingly stages: the encounter with alterity and newness, which is both the theme of the narrative and the effect of the text on the reader. At the same time, however, the text urges to move from an ethics of literature understood as the responsible reception of the other by an individual reader to a more explicitly convivial and political ethics of commitment beyond the scene of reading.
In diesem Beitrag möchten wir einen Gedanken des amerikanischen Mathematikers Paul Halmos aufgreifen und konkretisieren. Wir möchten verdeutlichen, dass ökonomisches Denken nicht abstrakt gelehrt, sondern „erfahren“ werden muss, wenn es nachhaltig und in seiner ganzen Breite gefördert werden soll. Dazu dienen kognitiv aktivierende Aufgaben. Was man darunter versteht und welche Funktionen und Qualitätsmerkmale Aufgaben in der ökonomischen Bildung besitzen, verdeutlichen wir in den Abschnitten 1 und 2. Im Praxisteil (Abschnitte 3 bis 8) werden konkrete, unterrichtlich erprobte Beispielaufgaben vorgestellt, mit denen ökonomisches Denken erfolgreich gefördert werden kann. Unser Beitrag schließt mit einer kurzen Skizze wirtschaftsdidaktischer Implikationen (Abschnitt 9).
Back in 1949, and thus only one year after the 1948 Universal Declaration of Human Rights, the four Geneva Conventions were adopted, providing a strong signal for a new world order created after 1945 with the United Nations at their centre and combining as their goals both the maintenance of peace and security and the protection of human rights, but also recognising, realistically, that succeeding generations had so far not yet been saved from the scourge of war. Hence, the continued need for rules governing, and limiting, the means and methods of warfare once an armed conflict has erupted. At the same time, the international community has unfortunately not been able so far to fully safeguard individual human rights, its efforts to that effect and the continuous development of international human rights law over the years notwithstanding.
Human rights can be understood as a multi-faceted concept which needs a strong legal basis, namely, a set of legal guarantees in human rights treaties and an increasing number of monitoring mechanisms. Following the Universal Declaration of Human Rights (UDHR) of December 10, 1948, various multi-lateral treaties for the protection of human rights have been negotiated and entered into force. They are not restricted to civil and political rights and take a much broader approach. All have monitoring mechanisms acting on a legal basis. The important European system with its strong, judicial monitoring mechanism is providing an effective human rights protection focused on civil and political rights. In the Görgülü case (2004), the German Federal Constitutional Court underlined the importance of the European Court’s judgments and of the ECHR as a legally binding instrument for the protection of human rights.
The nineteenth century witnessed restoration and reformation, the heyday of the nation state in Europe and inter-state cooperation at the same time. Driven by technical progress, communication across borders became an everyday phenomenon demanding transnational cooperation and regulation. Whereas in the political field irregular conferences turned out to be an appropriate instrument for governing transnational cooperation, a more constant and institutionalised matter proved to be adequate for technical cooperation.
In 1865, the International Telegraph Convention set up a relevant administrative union which merged in 1932 with the International Radiotelegraph Union from 1906 to form the newly labelled International Telecommunication Union (ITU). The parties to the ITU met regularly in so-called plenipotentiary conferences every 3 years. Already in 1875 the International Telegraph Convention was completely redrafted and the organisation’s structure changed. The contracting parties created an instrument that paved the way for a modern form of international standard setting. The new, simplified convention contained only general provisions of a policy nature that would remain in effect for an “indeterminate length of time” (Art. 20), detailed rules of a transitory and specific nature that might be subject to frequent changes with the progress of technology were put into the “Regulations for international service” (also known as the Telegraph Regulations). The newly established “administrative conferences” attended by technical experts from the member states were responsible for revising the regulations when necessary.
This was an early example of the transferral of power from sovereign nation states to an international organisation in order to govern transnational communication effectively. The administrative unions, as the first examples in modern history, show the ability of self-interested rational agents to overcome collective action dilemmas, i.e. situations where cooperation avoids sub-optimal outcomes for cooperators. The newly created institutions shaped a spirit of cooperation and the practice of standard setting proved that cooperation is effective. Furthermore, they show the spill-over effects of cooperation: increased cooperation in one area leads to increased cooperation in other areas.

The COVID-19 crisis has caused an extreme situation for higher education institutions around the world, where exclusively virtual teaching and learning has become obligatory rather than an additional supporting feature. This has created opportunities to explore the potential and limitations of virtual learning formats. This paper presents four theses on virtual classroom teaching and learning that are discussed critically. We use existing theoretical insights extended by empirical evidence from a survey of more than 850 students on acceptance, expectations, and attitudes regarding the positive and negative aspects of virtual teaching. The survey responses were gathered from students at different universities during the first completely digital semester (Spring-Summer 2020) in Germany. We discuss similarities and differences between the subjects being studied and highlight the advantages and disadvantages of virtual teaching and learning. Against the background of existing theory and the gathered data, we emphasize the importance of social interaction, the combination of different learning formats, and thus context-sensitive hybrid learning as the learning form of the future.
Der Einsatz Künstlicher Intelligenz (KI) wird zunehmend relevant – sowohl in Berufen mit formalisierbaren Aufgaben als auch in Berufsfeldern, für deren Aufgaben Erfahrungswissen notwendig ist und situationsabhängig Entscheidungen getroffen werden, die mit folgenschweren Konsequenzen verbunden sein können. Um das Potenzial der Zusammenarbeit zwischen Mensch und KI auszuschöpfen, muss sich der Mensch entsprechend wappnen. Somit verändern sich die Kompetenzanforderungen an Mitarbeiter:innen auf allen Ebenen und an ihre Führungskräfte. Relevante Konzepte des lebenslangen Lernens und der betrieblichen Weiterbildung gewinnen durch den Einfluss der Technologie auch unter teilweise veränderten Lernbedingungen vermehrt an Bedeutung. Neben neuen technischen und Fachkompetenzen, sind für die Nutzung von und die Zusammenarbeit mit der neuen Technologie weitere Kompetenzen notwendig, um z. B. einschätzen zu können, wann die Arbeit der Maschine ethisch vertretbar, effektiv, verantwortungsvoll, fair, transparent und nachvollziehbar ist. Auch neue Tätigkeitsprofile entstehen und die beruflichen Rollen verändern sich entsprechend. Neben den Anforderungen, die die KI an Bildung und Kompetenzentwicklung stellt, wird sie weiterhin zunehmend zur Gestaltung von Lernumgebungen und für den Kompetenzaufbau im Beruf eingesetzt. Sie ist somit nicht nur der Auslöser von Veränderungen, sondern auch das Instrument, welches genutzt wird, um die Lehre zu unterstützen und individueller, abwechslungsreicher sowie zeit- und ortunabhängiger zu gestalten. Im Beitrag werden Chancen und Herausforderungen durch den Einsatz von KI für zwei Dimensionen diskutiert: die Transformationsprozesse in der Berufswelt und die Gestaltung von Lernprozessen.
Ausgehend von der nötigen Implementierung und strukturellen Verankerung der Ergebnisse und Erkenntnisse der Modellversuche des Bundesinstituts für Berufsbildung (BIBB) in die Berufsbildungspraxis kommt dem Ausbildungspersonal eine Schlüsselfunktion zu. Nur eine ganzheitliche Qualifizierung des Berufsbildungspersonals ermöglicht eine Vorbereitung auf den digitalen Wandel sowie eine Verankerung von nachhaltiger Entwicklung in die berufliche Ausbildungspraxis und dadurch die Befähigung der Auszubildenden zur Mitgestaltung der Gesellschaft und Wirtschaft durch nachhaltiges Denken und Handeln. Hierfür bietet der Deutsche Qualifikationsrahmen (DQR) sowohl einen berufs- als auch bildungsbereichsübergreifenden Orientierungsrahmen, welcher für die Ordnungsarbeit und Berufsbildungspraxis nutzbar gemacht werden kann.
Der abschließende Beitrag des multidisziplinären Sammelbands zielt darauf ab Perspektiven und Befunde zur Mittelschicht in Österreich aus der Soziologie, der Ökonomie, den Politikwissenschaften und der Zeitgeschichte zusammenzufassen und Verknüpfungen zwischen unterschiedlichen Analysen und Disziplinen zu benennen. Im Ergebnis liefert diese systematisierende Analyse der Beiträge einen umfassenden status quo der österreichischen Mitte in Hinblick auf Bildungserträge, Religionsausübung, Solidaritäts- und Abgrenzungsprozesse, Wahlverhalten, Vertrauen in Institutionen, psychische Gesundheit, Geschlechterungleichheit und vieles mehr. Vor dem Hintergrund dieser Diskussion und werden neun Thesen zur jüngsten und zukünftigen Entwicklung der unter Druck stehenden gesellschaftlichen Mitte formulieren. Diese Thesen können als Beitrag zu einer laufenden gesellschaftspolitischen Debatte aber auch als Anregung für weitere sozialwissenschaftliche Forschung verstanden werden.
Vienna's resilience

This chapter provides a synthesis of the volume, bringing together the aspects that characterise each of the single policy domains analysed throughout and highlighting their synergic effects on the output. In particular, it addresses the dualisation tendencies between ‘winners’ and ‘losers’ in Vienna’s urban transformation in the changing dimensions of social stratification, on the one hand; and the mechanisms of institutional resilience, on the other hand. Despite the inclusive welfare system, emerging vulnerabilities currently pose new challenges for Vienna’s redistributive capacity in the key policy areas. Existing institutional arrangements and their regulatory capacities are a good starting point to answer the question: is Vienna still a just city?

Social institutions are a system of behavioral and relationship patterns that are densely interwoven and enduring and function across an entire society. They order and structure the behavior of individuals in core areas of society and thus have a strong impact on the quality of life of individuals. Institutions regulate the following: (a) family and relationship networks carry out social reproduction and socialization; (b) institutions in the realm of education and training ensure the transmission and cultivation of knowledge, abilities, and specialized skills; (c) institutions in the labor market and economy provide for the production and distribution of goods and services; (d) institutions in the realm of law, governance, and politics provide for the maintenance of the social order; (e) while cultural, media, and religious institutions further the development of contexts of meaning, value orientations, and symbolic codes.
When does life end?

If you look at the question of the end-of-life legislation, one – or rather THE basic question – is particularly interesting: What is the "end of life"? What is death? Ofcourse, one can approach this question theologically or philosophically, but alsolegally and especially medically. Since the 1960 s, medical progress has made itpossible to distinguish between different individual points of time within the na-tural dying process. However, this raises the question as to which of these pointsof time is relevant for criminal law. This question, which is usually onsideredvery emotionally, will be examined in more detail in the paper.

Berühren changiert zwischen Buchstäblichkeit und Metaphorik. Gegenüber dem Distanzsinn des Sehens wird mit dem Berühren eine größere Unmittelbarkeit assoziiert. Doch die Möglichkeit des Kontaktes ist von Beginn an prekär. Das Berühren kann sich selbst nicht berühren. In das Berühren schiebt sich ein Dazwischen, das den Entzug dieser ambivalenten Figur bedingt. Diese aporetische Bestimmung des Berührens begründet das Unternehmen des Bandes. Jeder Eintrag wiederholt eine Bewegung des Berührens: In einzelnen Text- oder Bildlektüren werden Spuren verfolgt, die das Berühren im stetigen Sich-Entziehen in seinen mannigfaltigen Nachbarschaften hinterlässt. Die einzelnen Einträge generieren sich aus diesen Lektüren. Dabei spielt die Nachbarschaft der Einträge selbst eine tragende Rolle. So wird das Berühren zum produktiven Prinzip von Philologie als einer kollektiven Lektüre- und Schreibform.
Shakespeares Meteopoetik

Shakespeare war zweifellos ›Meteopoet‹. Obwohl es die frühneuzeitliche Bühne, die ohne Kulisse, künstliches Licht und mit nur sehr beschränkten Requisiten auskam, vor allerhand Darstellungsprobleme stellen musste, bilden Wetterereignisse einen festen Bestandteil vieler seiner Dramen. Der über sechs Szenen andauernde Bühnensturm aus King Lear gehört zu den berühmtesten meteorologischen Momenten der westlichen Literatur. Schon in Julius Caesar, etwa sieben Jahre zuvor entstanden, leitet die Bühnenanweisung »Thunder and lightning« (JC 1.3; JC 2.2) ein sich über mehrere Auftritte erstreckendes Unwetter ein, das mit den damaligen Mitteln auf der Bühne inszeniert werden musste: Vermutlich kamen dabei in Holztrögen oder direkt auf dem die Bühne überspannenden Dachboden gerollte Kanonenkugeln und an Fäden geführte Feuerwerkskörper zum Einsatz, die Donner und Blitz simulierten. So auch in der Macbeth eröffnenden Hexenszene, zumindest lässt darauf die identische Bühnenanweisung schließen. Dass dieses Bühnenwetter hier nicht nur die übernatürliche Atmosphäre unterstützt, sondern tatsächlich auch meteorologisch relevant ist, verdeutlichen zwei Hinweise: Zum einen erfahren wir von Macbeth später selbst, dass er und seine Zeitgenossen den Hexen tatsächlich die Fähigkeit zuschrieben, das Wetter zu machen:
»Though you untie the winds, and let them fight / Against the churches« (Mac 4.1.52–53), ruft er den Hexen entgegen – es antworten drei Donnerschläge. Zum anderen berichten zwei Randfiguren von einem außergewöhnlichen Unwetter, das
just in der Nacht, in der Macbeth Duncan ermordet, gewütet hatte: »The night has been unruly: where we lay / The chimneys were blown down« (Mac 2.3.54–55), erzählt Lennox, eine Szene später ergänzt ein alter Mann, dass er zu seinen Lebzeiten keine vergleichbare »sore night« (Mac 2.4.3) gesehen habe. Wetterschilderungen vergleichbarer Art begegnen auch in Othello.
Time to change

Industry 4.0 leads to a radical change that is progressing incrementally. The new information and communication technologies provide many conceivable opportunities for their application in the context of sustainable corporate management. The combination of new digital technologies with the ecological and social goals of companies offers a multitude of unimagined potentials and challenges. Although companies already see the need for action, there was in the past and currently still is a lack of concrete measures that lever the potential of Industry 4.0 for sustainability management. During the course of this position paper we develop six theses (two from each sustainability perspective) against the background of the current situation in research and practice, and policy.

In diesem Beitrag wird der Versuch unternommen, anhand des Konzepts der Diffraktion die (neomaterialistischen) Arbeiten Donna Haraways und Karen Barads mit bestimmten Ansätzen der Black Studies in Kontakt zu bringen. Im Mittelpunkt stehen hier Texte von Saidiya Hartman und Christina Sharpe, die auf dem afterlife of slavery und der Grundlegung modernen Wissens und moderner Politik als antiblackness insistieren. Angestrebt ist ein nicht-integratives, wechselseitiges Beachten divergenter (Theorie-)Praktiken, um partielle Kollaborationen zu ermöglichen.
