Currently a political debate is ongoing in Germany as to whether Germany should, following the example of several other European countries such as France and the Netherlands, adopt a Supply Chain Act (Lieferkettengesetz). If adopted, the act in question would impose due diligence obligations on German corporations to prevent human rights violations taking place in their respective global supply chains. It is against this background that the article examines the preconditions that must be met in order for such act to be eventually compatible with both, German constitutional and international law. The authors further deal with the question whether Germany might even be obliged under international, as well as under German constitutional law, to enact such a supply chain law in order to protect the human rights of workers employed by companies forming part of the global supply chains of German companies. As far as German constitutional law is concerned the article notably deals with the question whether it is the Federal parliament that may adopt such a law also taking into account the competencies of the European Union in the field, and what are the requirements of legal specificity and proportionality in order for the draft law to stand constitutional scrutiny. The authors further offer detailed suggestions how corporate due diligence standards might be best provided for in the envisaged law and propose a risk analysis approach that varies not only according to specific countries and sector-specific characteristics, but that by the same token also takes into account the ability of the respective German company to exercise an appropriate due diligence standard when it comes to human rigths issues arising within the framewok of their supply chain. As far as the substantive human rights standards are concerned that should serve as benchmarks for the envisaged Supply Chain Act the authors propose to rely on, and refer to, those instruments such as the ICCPR and the CESCR, as well as the ILO treaties containing core labour standards, that enjoy almost universal acceptance and reflect customary international law.
Nach der vornehmlich auf bayerischen Druck hin erfolgten Öffnung des GG für eigene Landesgesetze im Bereich der Grundsteuer plant die Bayerische Staatsregierung, eine Grundsteuer als Flächensteuer einzuführen. Im vorliegenden Beitrag werden zunächst die bayerischen Pläne vorgestellt (1.), bevor eine in solcher Weise ausgestaltete Grundsteuer am GG (2.) und an der Bayerischen Landesverfassung (3.) gemessen wird. Schließlich werden die gefundenen Ergebnisse zusammengefasst (4.).
Twinning stellt trotz jahrelanger Praxis für viele Beamte immer noch eine terra incognita dar. Im Folgenden werden zunächst der Begriff und die Bedeutung des Twinnings geklärt (I.), bevor geeignete Rechtsformen für den Einsatz als Kurz- oder Langzeitexperte (II.) sowie als Projektleiter erörtert werden (III.), wobei besondere Fragen entstehen, wenn twinnende Behörde und Entsendebehörde nicht identisch sind (IV.). Sodann werden die finanziellen Vorteile für den twinnenden Beamten (V.), sein Versicherungsschutz (VI.) sowie die pensionsrechtlichen Folgen (VII.) betrachtet. Eine Zusammenfassung rundet die Darstellung ab (VIII.).
Treckerdemos und Klimastreik

Der Beitrag zeigt die Entwicklung des Versammlungsrechts in der Rechtsprechung seit 2016 auf. Angesichts legislatorischer Ruhe steht die Judikatur des BVerfG und der Verwaltungsgerichte im Fokus der Betrachtung. In vielen Entscheidungen spiegeln sich aktuelle versammlungsrechtliche Problemstellungen wider. Art. 8 GG erweist sich als ein äußerst lebendiges Grundrecht, welches auch im digitalen Zeitalter nichts an seiner urdemokratischen Attraktivität und politischen Wirkkraft eingebüßt hat.
Der anthropogene Einfluss auf die Erderwärmung und sein Ausmaß polarisieren Politik und Gesellschaft. Sie haben in den Rechtswissenschaften zu einer Auseinandersetzung darüber geführt, ob eine Juridifizierung der Diskussionen durch vertikale Klima(schutz)klagen wünschenswert ist. Zur Klärung und Rationalisierung des Streits beitragen können bewährte materiell-rechtliche und prozessrechtliche Grundbegriffe: subjektiv-öffentliches Recht, Schutznormtheorie und gerichtliche Kontrolldichte.
Der rechtliche Rahmen für die Straßenbeleuchtung – das Thema erscheint auf den ersten Blick als juristisch banal. Praktisch ist das Interesse von Gemeinden an einem rechtsfehlerfreien Straßenbeleuchtungskonzept jedoch groß. Die rechtliche Auseinandersetzung mit dem Themenkomplex der Straßenbeleuchtung hat damit hohe Praxisrelevanz und verdient eine ausführlichere Darlegung.
Staat und Staatsbedienstete sind unterschiedliche Rechtssubjekte und Religionsausübung durch Amtsträger ist Grundrechtsgebrauch. Die Schranke für die Religionsausübung für Staatsbedienstete findet sich im verfassungsrechtlichen Mäßigungsgebot, das ein generelles Kopftuchverbot jedoch nicht rechtfertigen kann.
Zahlreiche Kommunen vor allem in westdeutschen Flächenländern weisen eine sehr starke Verschuldung auf, die mittlerweile die Erfüllung nicht nur ihrer freiwilligen, sondern auch ihrer pflichtigen Aufgaben erheblich beeinträchtigt (I.). Dies hat die Diskussion angestoßen, ob von Verfassung wegen ein Staatsziel der Gleichwertigkeit der Lebensverhältnisse besteht (II.) und sich daraus ein Recht oder gar eine Pflicht des Bundes zur finanziellen Entlastung dieser Kommunen ergibt. In diesem Zusammenhang sind nach geltender Verfassungslage direkte Leistungen des Bundes an die Kommunen (III.) von Zuweisungen des Bundes über die Länder an die Kommunen (IV.) sowie die Möglichkeiten des Bundes, die Länder zur Hilfeleistung an ihre Kommunen zu bewegen (V.), zu unterscheiden. Davon zu trennen ist die Frage, ob im Wege einer Grundgesetzänderung auch noch weitergehende finanzielle Hilfen des Bundes zur Entschuldung der Kommunen vorgesehen werden könnten (VI.). Schließlich werden die gefundenen Ergebnisse zusammengefasst (VII.).
Die erste Welle der Corona-Pandemie klingt langsam ab. Der Shutdown ist einstweilen beendet, Lockerungen erfolgen allenthalben. Doch alles steht unter dem Vorbehalt einer möglichen zweiten Infektionswelle mit dann zu erwartenden neuerlichen Beschränkungen. Es ist ein richtiger Zeitpunkt für eine Zwischenbilanz, wie das deutsche Versammlungsrecht bisher durch die virale Gesundheitskrise gekommen ist und welche Folgerungen zukünftig zu beachten sein werden. Ein besonderes Augenmerk sei dabei auf die Rechtsprechung gerichtet, die in bemerkenswerter Weise das staatliche Pandemie-Krisenrecht begleitete.
Filling in for Governments?

The 2015 Paris Agreement on climate change abandons the Kyoto Protocol's paradigm of binding emissions targets and relies instead on countries' voluntary contributions. However, the Paris Agreement encourages not only governments but also sub-national governments, corporations and civil society to contribute to reaching ambitious climate goals. In a transition from the regulated architecture of the Kyoto Protocol to the open system of the Paris Agreement, the Agreement seeks to integrate non-state actors into the treaty-based climate regime. In 2014 the secretariat of the United Nations Framework Convention on Climate Change Peru and France created the Non-State Actor Zone for Climate Action (and launched the Global Climate Action portal). In December 2019, this portal recorded more than twenty thousand climate-commitments of private and public non-state entities, making the non-state venues of international climate meetings decisively more exciting than the formal negotiation space. This level engagement and governments' response to it raises a flurry of questions in relation to the evolving nature of the climate regime and climate change governance, including the role of private actors as standard setters and the lack of accountability mechanisms for non-state actions. This paper takes these developments as occasion to discuss the changing role of private actors in the climate regime.
Das Konnexitätsprinzip gewährleistet einen Anspruch der Kommunen gegen das Land auf Ausgleich von Mehrbelastungen, die ihnen dadurch entstehen, dass sie anstelle des Landes staatliche Aufgaben wahrnehmen. Das Land treffen in diesem Zusammenhang unterschiedliche Verpflichtungen. Abgesehen davon, dass es bei Vorliegen der verfassungsrechtlichen Voraussetzungen gehalten ist, eine Ausgleichsbestimmung zu erlassen, obliegt es ihm auch, Art und Weise, vor allem die Höhe des Ausgleichs zu bestimmen. Im Regelfall macht dies eine Prognose der entstehenden Kosten erforderlich: Die Anforderungen, die hiermit verbunden sind, stehen im Mittelpunkt der nachstehenden Darstellung.
Die Umdeutung von Verwaltungsakten gemäß § 47 VwVfG steht ungeachtet ihrer Examensrelevanz nicht im Zentrum der Aufmerksamkeit aller Studierender. Um auch vor dem Hintergrund jüngerer höchstrichterlicher Entscheidungen den Blick für dieses Rechtsinstitut zu schärfen, kennzeichnet der Verfasser zunächst das nicht ohne Weiteres aus dem Gesetz ablesbare Wesen der Umdeutung und grenzt diese von anderen Instrumenten zur Interpretation, Korrektur und Aufrechterhaltung von Verwaltungsakten ab. Sodann stellt er im Einzelnen die Voraussetzungen und Ausschlussgründe des § 47 VwVfG vor.
Die monokratische Regierung

Nach der Landtagswahl in Thüringen vom 27. Oktober 2019 gestaltete sich die Regierungsbildung schwierig. Zunächst wurde am 5. Februar 2020 der FDP-Politiker Kemmerich zum Ministerpräsidenten gewählt, der bereits am 8. Februar 2020 wieder seinen Rücktritt erklärte, ohne in der Zwischenzeit Minister ernannt zu haben. Mittlerweile wurde am 4. März 2020 der frühere Ministerpräsident Ramelow erneut in dieses Amt gewählt (I.). Dies wirft zum einen die Frage auf, ob die bisherigen Minister des Kabinetts Ramelow unter Kemmerich noch weiterhin geschäftsführend im Amt waren (II.), zum anderen, ob eine Regierung auch ohne Minister möglich ist (III.). Besteht hingegen eine Pflicht des Regierungschefs zur personellen Ergänzung der Regierung, sind die Folgen der Missachtung dieser Pflicht zu klären (IV.). Zudem sind die verfassungsprozessualen Möglichkeiten, den Regierungschef zur Ernennung zu zwingen, auszuloten (V.). Die Ausführungen sind dabei nicht nur für Thüringen, sondern auch für den Bund und die übrigen Länder von Bedeutung.
Auf den ersten Blick scheinen die Stichworte der Überschrift schwer miteinander in Verbindung zu bringen: Die Kreisumlage ist eine Abgabe im Sinne des § VWGO § 80 VWGO § 80 Absatz I Nr. 1 VwGO zur Fussnote 1, da für sie damit das im allgemeinen Abgabenrecht geltende Vertragsformverbot zu beachten sein dürfte, wird eine Kreisumlage regelmäßig durch Verwaltungsakt zu erheben sein, nicht aber Regelungsgegenstand vertraglicher Gestaltung sein können. zur Fussnote 2 Wenn damit also zu konstatieren ist, dass die Durchsetzung der Kreisumlage kein geeigneter Anwendungsbereich des öffentlich-rechtlichen Vertrages ist, ist damit noch nicht gesagt, dass diese konsensuale Handlungsform damit keinerlei Anwendungsbereich bei der Verteilung der Finanzmittel im kreisangehörigen Raum hätte. Tatsächlich gewinnt der Anwendungsbereich des öffentlich-rechtlichen Vertrages gerade im Zusammenhang mit der Bestimmung der Kreisumlage immer mehr an Bedeutung. Dies ist Folge der höchstrichterlichen Rechtsprechung. Was sich hieraus ergibt, warum der öffentlich-rechtliche Vertrag zwischen Landkreis und kreisangehörigen Kommunen durchaus ein Mittel zur rechtssicheren Bestimmung der Kreisumlage sein kann und eine Möglichkeit darstellt, Rechtssicherheit zu schaffen und damit Konflikte zu vermeiden, soll nachstehend dargelegt werden.
Pyramiden gibt es nicht nur in Ägypten, sondern auch in der
deutschen Rechtsordnung. Dieser Beitrag soll die Feinheiten
des Pyramidenbaus näher beleuchten und ihre Geheimnisse
lüften. Zu diesem Zweck werden zunächst der in der Praxis
besonders bedeutsame klassische Stufenbau des Bundes-
rechts (I.) und dessen Erweiterungen (II.) vorgestellt, bevor
einerseits das Landesrecht (III.) und andererseits das Recht
der Europäischen Union (IV.) betrachtet werden. Sodann
wird untersucht, ob auch ein vergleichbarer Stufenbau des
Innenrechts besteht (V.). Nachdem die Veränderungen des
formellen Rangs von Regelungen (VI.) betrachtet wurden,
schließt der Beitrag mit einer Zusammenfassung (VII.).
Der brandenburgische Landtag beschloss im Dezember 2019 kurz vor Beginn der uneingeschränkten Geltung der grundgesetzlichen Schuldenbremse für die Länder ab dem 01.01.2020 mit den Stimmen der neuen Regierungskoalition aus SPD, CDU und BÜNDNIS 90/DIE GRÜNEN die Errichtung eines vollständig kreditfinanzierten Sondervermögens »Zukunftsinvestitionsfonds des Landes Brandenburg«, dessen Mittel in Höhe von einer Mrd. Euro in den kommenden Jahren zur Verbesserung der Infrastruktur eingesetzt werden sollen (I.). Dies wirft die Frage auf, ob die verfassungsrechtlichen Haushaltsgrundsätze der stetigen Aufgabenerfüllung (II.), der Einheit und Vollständigkeit des Haushalts (III.), der Haushaltsklarheit und Haushaltsöffentlichkeit (IV.), der Sparsamkeit und Wirtschaftlichkeit (V.), des Jährlichkeitsprinzips (VI.) und nicht zuletzt des Haushaltsausgleichs (VII.) gewahrt worden sind. Letztlich steht das Budgetrecht des Parlaments selbst in Frage (VIII.). Hinzu treten etwaige europarechtliche Verwerfungen (IX.). Nach einer Darstellung der prozessualen Möglichkeiten, gegen dieses Sondervermögen vorzugehen (X.), rundet eine Zusammenfassung die Darstellung ab (XI.).
Nach einer kurzen Einführung in das Thema (I.) setzen sich die Verfasser mit der Entstehung des neuen Fraktionsgesetzes auseinander (II.). Im Anschluss geben sie einen Überblick über den Gesetzesinhalt und zeigen bedeutsame Änderungen auf (III.). Weiter gehen sie auf die finanzielle Ausstattung der Fraktionen im Brandenburger Landtag ein (IV.). Bevor sie dann zur Zusammenfassung und zum Ausblick kommen (VI.), erfolgt ein Rückblick auf den ersten Gesetzesentwurf zum neuen Fraktionsgesetz (V.).
Gegenstand des Beitrags ist schwerpunktmäßig das im Jahr 2016 mit den §§ 155b , 155c FamFG geschaffene Rechtsbehelfssystem der Beschleunigungsrüge und Beschleunigungsbeschwerde. Bevor Grund und Grenze der Verfahrensbeschleunigung in Kindschaftssachen unter besonderer Berücksichtigung des Gedankens der Verfahrensökonomie ausgelotet werden, geht der Verfasser auf das Verhältnis zwischen Beschleunigungsgrundsatz und Prozessökonomie in gebotener Kürze ein. Anschließend liegt der Fokus auf dem Beschleunigungsgrundsatz; zunächst in familiengerichtlichen Verfahren im Allgemeinen und sodann im kindschaftsrechtlichen Verfahren im Speziellen. In Bezug auf Letzteres wird ferner aufzuzeigen sein, dass Verfahrensökonomie die kindeswohldienliche Anwendung des Beschleunigungsgrundsatzes bedeutet. Dieser Anwendungsbefehl soll abschließend am Beispiel des einleitend angesprochenen, relativ neuen Rechtsbehelfsverfahrens exemplifiziert werden, um der Frage nachzugehen, ob das Kindschaftsverfahrensrecht mehr Effektivität verträgt.
Black Lives Matter

In den USA und auch in Deutschland fordern Schwarze Menschen ihr verfassungsmäßiges Recht ein, nicht durch den Staat diskriminiert, verfolgt und ermordet zu werden. Sie wollen, dass Schwarze Leben in weiß dominierten Gesellschaften zählen. In der öffentlichen Diskussion jedoch scheint daran gezweifelt zu werden, dass Rasse als Rechtsbegriff und Marker von Zugehörigkeit von Bedeutung ist – was sich auch in den Forderungen widerspiegelt, den Begriff aus dem Grundgesetz zu streichen.
Alexander von Humboldt betätigte sich in unterschiedlichsten Wissensbereichen und vielen Disziplinen. Obwohl er natürlich kein Jurist war, hat er sich vielfach mit Problemen befasst, die zu seinen Lebzeiten und danach zu grundlegenden Fragen des in der Entstehung begriffenen Völkerrechts avancierten. So beschäftigte er sich mit dem Verbot der Sklaverei und der Abschaffung der Rassendiskriminierung, mit der Fixierung von territorialen Grenzen von Staaten, mit Seegrenzen, der Förderung des Welthandels und der Hoheitsgewalt im Luft- und im Weltraum. Viele dieser Fragen wurden später in internationalen Verträgen kodifiziert, weshalb man Humboldt als Vordenker des Völkerrechts bezeichnen kann. Diese von der internationalen Humboldt-Forschung bislang nicht als Forschungsfeld erkannte Dimension seines Wirkens wird nachfolgend erstmals vertiefend beleuchtet.
Das Jahr 2019 markiert nicht nur 100 Jahre Weimarer Reichsverfassung, sondern zugleich 100 Jahre Staatskirchenrecht sowie 100 Jahre des nicht erfüllten Verfassungsauftrags der Ablösung der Staatsleistungen an die Kirchen gem. Art. WRV Artikel 138 Abs. WRV Artikel 138 Absatz 1 WRV (I.). Im Folgenden sollen der genaue Inhalt dieses Auftrags geklärt (II.) und die Rechtsfolgen seiner möglichen Umsetzung beleuchtet werden (III.). Zudem ist zu untersuchen, ob sich aus diesem Verfassungsauftrag ein Verbot neuer Staatsleistungen an die Kirchen und Religionsgesellschaften ergibt (IV.) und auf welche Weise dieser Auftrag ggf. verfassungsprozessual durchgesetzt werden kann (V.). Abschließend werden die Kernaussagen zusammengefasst (VI.).
