Aufgrund des Einstimmigkeitserfordernisses für familienrechtliche Rechtsakte in der ziviljustiziellen Zusammenarbeit (Art. 81 III AEUV) stellt sich die Vereinheitlichung des Internationalen Privatrechts im Familienrecht als große Herausforderung dar. Zwar befasst sich die Europäische Kommission derzeit mit grenzüberschreitenden Fragen der Abstammung. Auf absehbare Zeit ist aber kaum mit Gesetzgebungsvorschlägen aus Brüssel zur Vereinheitlichung des anwendbaren Rechts für Eheschließungen zu rechnen. Der Blick richtet sich daher insoweit auf das jeweilige nationale Recht der EU-Mitgliedstaaten.
Gegenstand der folgenden Überlegungen ist der kürzlich vorgelegte, gleichermaßen überraschende wie interessante Vorschlag von Dagmar Coester-Waltjen, Eheschließungen ohne Rücksicht auf das Geschlecht (im Sinne einer Gesamtverweisung und vorbehaltlich einer ordre public-Prüfung) dem Recht am Eheschließungsort zu unterstellen.
Ein Schwerpunkt des Kinderehenbekämpfungsgesetzes liegt in der Beurteilung von Ehen, die im Ausland mit Minderjährigen geschlossen worden sind. Die Entscheidungen der deutschen Gerichte hierzu sind im Regelfall einzeln kommentiert worden. Ein Gesamtüberblick fehlt. Der folgende Beitrag will diese Lücke schließen.
