Monitoring of groundwater and surface water levels in the Middle Havel area - a basis for the management of landscape water resources The lowland of the middle stretch of the River Havel ("Mittlere Havel", Brandenburg, Germany) is characterised by hydrological conditions that are deeply influenced by draining for agricultural land use. In this area strategies for the sustainable management of landscape water resources are tested in a development and testing project, funded by the German Federal Agency for Nature Conservation. For monitoring of environmental change, the scientifical accompaniment of the project established a network of gauges, measuring ground water levels, water levels in ditches and in the River Havel itself. Data is gathered in areas that are potentially endangered by flood and areas that are protected by embankments. Until now, data from this network is available for more than two hydrological years since autumn 2001. It shows that water level dynamics are mainly influenced by precipitation and evaporation. Only in areas, which are under the potential influence of floods, ground water levels reach water levels in the river during winter term. In areas that are protected by embankments and additionally drained, surface and ground water levels are actually lower than water levels in the river. In addition, ground water levels are influenced by lowering the water levels in ditches. A sustainable landscape water management therefore has to be realised primarily through an altered management of water scoops in the diked areas. This requires the detailed analysis of all relevant hydrological and meteorological data including data about the water scoops.
Summary Possibilities of Co-Operation between Nature Conservation and Water Management. The EU Water Framework Directive (WFD) issued different regulations in the context of flodplains although not listing them directly as target areas to be dealt with. This makes clear that flodplains are assed as functional areas and therefore also need concrete requirements for their protection and development from a water management point of view. Additionally measures along rivers and streams necessary to reach the environmental aims of the WFD can result in changed conditions in floodplains. This is illustrated by examples of the Lower HAvel River. This may lead to conflicts with the aims and tasks of nature conservation. Particularly the definition of development aims needs an early identification of agreements and possible conflicts. Therefore the water management authorities have to consider the influence of the floodplains on the condition of the water bodies in an early stage: as soon as reference conditions are described, for the assessment of the risks to achieve the environmental aims as well as for the development of measurement programmes. Further it will be the task of nature conservation institutions to establish own target systems for the water bodies additionally to the NATURA2000- syetem of protection areas as well as for the development of measurement programmes of the WFD.
This article provides an overview of similarities and differences of local and regional indicator systems for sustainability. While there is a high degree of correspondence in basic matters (e.g., the definition of sustainable development), there are differences regarding the substance dealt with and the choice of indicators. A table presents characteristics of existing indicator systems and contains valuable information for local actors who plan to introduce such a system. Finally, it is concluded that currently indicator systems at the local level fall short of expectations and lag behind their possibilities. The article discusses reasons and presents a modular structure of indicator systems taking into account target groups and functions.
Abstract The implementation of the Water Framework Directive will also address land uses in the catchment areas (e.g. the reduction of diffuse input of material). Several disciplines with their specific methods can contribute to the evaluation of the effects on water quality. Landscape scenarios are useful to integrate different methods, to communicate the results and to highlight the need for action. This article describes such a landscape scenario by using the catchment of the River Havel as an example.
Die Hintertür seelischer Bedürfnisse : Vertrautheit und Sehnsucht als Motive des Naturschutzes
(2006)

The road construction sector in Germany already has a large number of guidelines and legal planning principles that govern the collection of landscape data and landscape evaluation for the German Impact Regulation. However, deriving measures that are both based on these guidelines and principles, and take concrete interference into account often prove problematic. In view of this fact, the German Federal Agency for Nature Conservation commissioned a research project that could be used to justify concrete precautionary measures that seek to avoid and reduce interference in the landscape, and implementation-oriented measures for landscape-friendly restauration and rearrangement. The project was based on the Federal Government's transport plans for the road and rail sector. It focussed in particular on the new legal standards set out in the Federal Nature Conservation Act that was amended on 4.4.2002. In addition, exemplary follow-up checks on the landscape were made with the aim of formulating recommendations as to how the specific needs of the landcape can be taken into account when carrying out such assessments.
Landscape planning is frequently mentioned in discussions on the implementation of the SEA Directive. However, one needs to bear in mind that SEA and landscape planning have different tasks: i.e., in the case of SEA dealing with the effects of a plan or programme on environmental factors and in the case of landscape planning a conceptual approach. This article looks at the substantial and procedural overlap of the two instruments. The main problem is the coincidence as regards space and time. One benefit to landscape planning would be a more frequent updates of the plans. However, a danger would be the overloading of landscape plans and a narrower scope. The author prefers a flexible combination of both instruments.

Controlling of Nature Conservation Measures according to the Impact Regulation - Requirements and Methodology Controlling comprises a complex field of (screening, vetting, verification) checking and evaluation measures in terms of process, techniques, implementation, efficiency and of the reaching of goals defined. The significance of controlling will increase with the new $ 18 of the amend nature conservation law, stating that the federal states need to promulgate regulations on the "safeguarding of the implementation" of measures for the avoidance and compensation of interventions. The study explains requirements for the individual controlling steps relevant for the impact regulation and provides examples of practical controls. Starting point for the controls are the planning documents and their determinations. Particular attention should be given to the continuation of the statements of the Landscape conservation support plan (LBP) (in practice not always kept up) and of the Implementation Plan of Landscape measures (LAP). On this basis the implementation controls check if the measures have been carried out properly anf if necessary maintenance measures have been conducted. Functional controls happen on two levels: (a) by checking if avoidance and compensation measures have been selected in coherence with the aims (potential functional fulfilment) and (b) by identifying their efficiency (actual functional fulfilment). Due to the long development period of many measures the functional fulfilment of measures can often only be predicted by estimations. For these prognoses relevant parameters have to be identified and, if necessary, illustrated in scenarios. Additionally, efficiency controls are conducted checking if the measures determined have been selected in coherence with the aims; they belong, however, rather to the preventative-scientific field and not to the controlling of projects. Together the individual steps of controlling can contribute to a quality assurance of the impact regulation.
(2002)
The definition of "impact" has been widened in the amendment of the Federal Nature Conservation Act. Above all, the decision-making steps and the polluter's obligations have been amended. The issue of "Ersatz" (i.e. compensation measures of the same value) has now to be dealt with before weighting the issues concerning nature conservation. It is foreseeable that the step og weighting will be less important in future and that there will be more flexibility as regards the timing and location of compensation measures. It will be important to formulate requirements for "Ersatzmaßnahmen" (when is a measure of the same value?. Furthermore, landscape planning will gain in importance.
Summary Discussions on innovations in law are often focussed on a legal perspective or on legal systematics. The example of two issues that are focal points of the debate on the amendment of the Brandenburg Nature Conservation Act shows that legal regulations have also to be seen with respect to their substantive effect upon administrative action.
Why Reality overtakes Planning - Landscape Planning in the Light of System Theory and Functional Control. There is not only a common reality but different perspectives of reality and any perception is provisional and revisable. This opinion is a component of different approaches in science theory and perception theory. There are effects on ecological planning in various respects. They concern for example the comprehension of methods, the prognosis of complex systems and the part the landscape planner plays in this process. Concerning this attitude, methods as well as planning methods develop to means. Not to means of identification of true or false perception but to means of establishing deductive communication. Reality - also that of landscapes - changes steadily. Due to this creatures as well as their environment find themselves in a complex network process of adaption which is called co-evolution. This process can be seen in various changes in land use history. Accidental influences, for example the sudden application of an innovation, may have an unpredictable impact on the development of landscapes. How can the planner deal with changes caused by accidental processes? The category of compensation measures (bases on the regulation of impacts) in the German planning system is a good example for this. These aspects plead against an extensive meaning of the term "landscape"-planning, because this would lead the subject ad absurdum. Planning as an unalterable component of human being can efficiently only change parts of our natural surroundings. It cannot control the complexity of landscape, but must explain the interaction of its components. Elements, characteristics and character : information functions of landscapes in terms of indicators
(2006)
When monitoring landscape changes, the visual landscape should also be considered. This pertains to the information function of ecosystems and landscapes that refers to environmental structure and its function for satisfying needs. These needs of human perception include a certain equipment of landscape with stimuli, spatial orientation, as well as aesthetical-emotional needs. However, previous approaches of environment monitoring and registration of landscape changes exclusively focus on the ecosystem; aesthetic and structural characteristics are evalu-ated, if at all, only via easily quantifiable variables in a data oriented manner that illustrates the diversity of individual landscape elements without theoretically grounding them based on general hypotheses and a theoretical concept. Based on results from perception research and information theory, therefore, a method for registering the visual landscape on different complexity levels was developed. This includes: Elements (i.e. "element level"), that is the description of the different types of land use and structure elements within a landscape unit. Furthermore, under these elements a variety of manifestations are also subsumed such as small spatial dimensional relations, as well as individual synesthetic perceptions (noise, smells);
Organic Farming as a Compensatory Measure German's agricultural land is not only being gobbled up by development; whole sections are being bought up in compensation for interventions made elsewhere, thus rapidly decimating the countrie's farming land resources. For this reason, calls are being made to take land that is converted from conventional to organic farming and add it to the pool of "compensation" areas, thus killing two birds - one of them being the establishment of more organic farming - with one stone. Various German regions have adopted the approach. Although organic farming serves both agricultural and environmental objectives, it cannot cover all the requirements of nature conservation. For example, it benefits abiotic resources such as soil and water through its use of natural fertilizers and erosion-combating cultivation, but can do little to protect highly endangered species and biotopes. Moreover, organic farms do not necessarily meet the legal requirement that compensation land must fulfil a similar function to the land it is "compensating" for. In other words, land converted to organic farming cannot necessarily ameliorate or compensate for impact on biotopes and species elsewhere. Regarding this approach as a solution to the rapid disappearance of farming land simply diverts attnetion away from the real cause: Urban sprawl and road building.

Erfolgskontrolle in der Eingriffsregelung : Handlungsanleitung zur Sicherung des Maßnahmenerfolgs
(2000)

EIA (Envoronmental Impact Assessment) and FFH Impact Assessment are two independent legal instruments which serve the assessment and evaluation of environmental impacts. The paper discusses the esentail differences between them with rspect to their areas of application, legal consequences and examination scope. In preparing an impact assessment study attention has to be given to the particular focus of the FFH guidelines and its associates legal provisions. This focus is concerned with the protection of certain specis and habitats, the safeguarding of the coherency of the network "Natura 2000" (a Europe-wide system of protected areas) as well as the consideration of criterai as derived from the retention goals for the respective European protected area, as criteria for recording and evaluation.

How to deal with Disturbance of the Visual Landscape by Traffic Projects? Legal framework conditions and special requirements The impact regulation of nature conservation only gives inferior treatment to the visual landscape compared to other natural resources although nature conservation legislation requires its equal integration into all steps of consequential dealing. For these steps the study shows exemplary legal framework conditions and specialist requirements. They should make clearer a structural approach including individual working steps, such as recording of present site conditions, establishment of a target concept, derivation of measures of avoidance and justification of measures for a sensitive regeneration and design of the visual landcape. The approach continuously bases on the same features of description, leading to a consistent connection between identified disturbances of the visual landscape and related measures. The focus of attemtion should be given to the characteristics of the respective landscape and the analysis should not only consider disturbances or compensation measures individually but also in combination with the general spatial perception. Another important aspect is the legal security; therefore the text closely follows the terminology of the Federal Nature Conservation Legislation.
The implementation of the European Water Framework Directive (WFD) will address land use issues in river catchments in order to reduce diffuse pollution and work towards the aim of achieving good ecological status, or good ecological potential in surface water bodies. The WFD also requires the active involvement of all interested parties in developing the best approach to achieve its objectives. The paper demonstrates how scenario analysis can be applied to investigate the impacts of land use changes and how stakeholder interviews can be used to evaluate the results of the scenarios. The study was carried out in the Havel Basin in the northeast of Germany. "Landscape-ecological spatial units" were derived from similar characteristics of soil and groundwater conditions, ground relief and inundation to enable spatial allocation of potential land use and link different scales when describing possible changes in land use. As a first step, in three sub-catchments of the Havel river (distinguished by different physical characteristics) detailed surveys were carried out to investigate the various interests of the stakeholders. The interviews were used to identify the key problems of each area with respect to water quality and quantity and facilitated stakeholder engagement with the catchment planning issues in the Havel river basin. The information from the stakeholder interviews was used to determine the initial conditions for the land use scenarios which were developed to demonstrate possible changes to land use for achieving better water quality. The land use scenarios also were required as an input into the hydrological modelling of their effects on water quality and to calculate their socio-economic effects. In a second survey the results of the scenarios and the hydrological modelling were presented to the stakeholders. The consultation process identified the priorities of the stakeholders which could then be taken into account when developing management options. Key words: European Water Framework Directive - river basin management - Havel River - scenarios - public participation - diffuse pollution - water quality - landscape ecology
In Poland, EIA and SEA have been integrated into the planning system in a different way compared to Germany. There, EIA is performed within an independent procedure. For projects mandatorily requiring EIA, the respective county decides on the outcome of an EIA, whereas for projects with case-by-case screening the regional authority's council is responsible for this task. There are still significant uncertainties in the application of SEA which sometimes leads to conflicts with the EU provisions. In Poland, provisions for SEA were already made in the year 2000. Different SEA procedures are established for regional plans and for other environmental plans. Furthermore, in April 2004, provisions for the EA according to the Habitats Directive were made in the Polish nature protection act. EA according to the Habitats Directive is strongly linked to EIA and SEA. Poland is already experienced in the practice of EIA and SEA. However, there still is a lack of methodological guidelines. Furthermore, the different legal provisions and procedures need to be further adjusted to each other.
A discussion abuot the future relation of Landscape Planning and Strategic Environmental Assessment (SEA) has to base on the different tasks of both instruments (analysis of environmental consequences by the SEA and conceptional approach related to planning by Landscape Planning). In order to identify overlapping parts of SEA and Landscape Planning the study separately investigates aspects of procedure and content. The results show that landscape planning can provide a central base of data and information for the SEA. Against this setting the draft of a SEA core law of July 2003 requiring the conduction of SEA for Landscape Planning will hopefully be reconsidered. The contribution of SEA to Landscape Planning on the one hand holds the risk of overloading but also offers the chance for a substantial further development: The SEA can improve the process aspect of Landscape Planning as well as stimulate more topicality and more frequent and exact updating of planning projects. On the other hand, however, a very strong specification of Landscape Planning towards SEA would lead to a restriction on the analysis of environmental consequences. A flexible combination of both instruments appears to fulfil the target. This means that Landscape Planning develops individual problem-related modules of SEA providing the fundamental component to deal with the nature conservation aspects.

Nachkontrollen in der Eingriffsregelung: Erfahrungen aus 4 Jahren Kontrollpraxis in Brandenburg
(2003)
