Überblick über die Schutzmechanismen nichtstaatlicher Art für die Gewährleistung der Grundrechte

Der kommunale Finanzausgleich betrachtet zwar Einwohner, Aufgaben und Finanzkraft der Kommunen, lässt ökologische Gesichtspunkte bislang aber weitgehend außen vor. Ein umfassender ökologischer Lastenausgleich fehlt. In diesem Beitrag wird zunächst das Problem mangelnder ökologischer Anreize im kommunalen Finanzausgleich aufgeworfen (I.), obgleich völker- (II.), europa- (III.) und verfassungsrechtliche Vorgaben (IV.) deren Integration nahelegen. Nach einer Einordnung ökologischer Aspekte in die anerkannten Funktionen des Finanzausgleichs (V.) werden mögliche gesetzgeberische Ansätze zur Berücksichtigung ökologischer Belange im kommunalen Finanzausgleich erörtert (VI.). Zuletzt werden die wesentlichen Ergebnisse zusammengefasst und Folgerungen für die weitere Ausgestaltung der Finanzausgleichssysteme gezogen (VII.).
In its “Windenergie”-decision, the BVerfG declared the legal obligation of wind turbine operators to involve citizens and communities in the vicinity of new wind farms in the projects essentially to be constitutional. The intention of the discussed provisions to promote acceptance for the expansion of wind energy serves the climate protection requirement under Article 20a Grundgesetz. The decision continues the line of the “Klimaschutz”-decision. The legal obligation of private persons is based on the factual necessity of the participation of all social actors to prevent climate change. The ecological long-term responsibility in Article 20a Grundgesetz is moved into the private sphere and thus, to a certain extent, subjectivized. These decisions pave the way for a constitutional change. They open up new perspectives for taking account of Article 20a Grundgesetz when weighing up the interests of freedom. Following the logic of the BVerfG, not only companies but also individuals would have to be obliged. In light of the decision, this article examines the possibilities of an emerging constitutional change toward a basic obligation (Grundpflicht) to use freedom in a sustainable manner. Thus, the discussed decision has a fundamental significance that has been too little appreciated and underestimated so far.

In seinem Lehrbuch behandelt Thorsten Ingo Schmidt das Finanzverfassungs-, Haushalts- und Vermögensrecht von Bund, Ländern, Kommunen, Sozialversicherungen und Europäischer Union. Ausgehend von den historischen und systematischen Grundlagen stellt er zunächst das Finanzverfassungsrecht im Bundesstaat unter besonderer Berücksichtigung des Finanzausgleichs dar. Sodann erläutert er die Schuldenbremse für Bund und Länder, die weiteren Haushaltsgrundsätze und das Haushaltsverfahren. Zudem erklärt er das staatliche Vermögensrecht einschließlich der Sondervermögen, der öffentlichen Sachen und der öffentlichen Unternehmen. Diesen staatlichen Regelungen stehen das Recht der Kommunalfinanzen und die finanziellen Bestimmungen für die Sozialversicherungen gegenüber. Der Vergleich mit dem Finanzrecht der Europäischen Union schärft den Blick für die Vor- und Nachteile der deutschen Vorschriften. Nach einer Darstellung des Rechtsschutzes im öffentlichen Finanzrecht wagt der Autor einen Ausblick auf die Zukunft des öffentlichen Finanzrechts.

Dieses Papier thematisiert die völkerstrafrechtliche Einordnung rein störender, also nicht zerstörender Cyberoperationen. Nach der erforderlichen Begriffsklärung werden die einzelnen Fragen der Anwendbarkeit des Völkerstrafrechts erörtert und geprüft, welche Tatbestände durch solche Aktionen verwirklicht werden können.
Das nationale Recht wird mehr und mehr durch EG-Recht beeinflussst. In diesem Zusammenhang ergeben sich bei denjenigen EG-Rechtsakten, die anders als EG-Verordnungen nicht unmittelbar in den Mitgliedstaaten gelten, sondern von diesen in nationales Recht umgesetzt werden müssen, vielfältige Probleme. Diese Probleme behandelt der Verfasser aus der Sicht des Anwalts in einer Weise, dass diejenigen, die sich in der Praxis mit derartigen Umsetzungsfragen zu beschäftigen haben, wertvolle Hinweise für eine konkret zu lösende Umsetzungsproblematik erhalten. Ergänzt und damit noch transparenter werden seine Lösungsvorschläge dadurch, dass der Verfasser sie im zweiten Teil der Untersuchung auf die konkrete Fragestellung anwendet, inwieweit es zu einer Umsetzung bzw. ordnungsgemäßen Umsetzung der in den Jahren 1988 bis 2001 erlassenen Fleischhygienegebührenrechtsakte der EG gekommen ist. Diese Arbeit wurde betreut von Professor Dr. D.C. Umbach an der Universität Potsdam. Aus dem Inhalt: Abgrenzung der Umsetzungszuständigkeit zwischen Bund und Ländern. Gegenstand der anspruchsvollen Examensübungsklausur ist im ersten Teil ein aufsehenerregendes Urteil des OLG Hamm zu einer sog. cold-water-Challenge (NJOZ 2018, 1289). Eine große Herausforderung besteht zunächst in der Wahl eines übersichtlichen Aufbaus, der vollständig ist und zugleich Redundanzen vermeidet. Darüber hinaus eignet sich die Aufgabenstellung angesichts ihrer Stofffülle hervorragend zum Einüben der Schwerpunktsetzung. Im Detail bietet sich immer wieder die Möglichkeit, sich »nach oben abzusetzen«. Für eine gute Bewertung müssen nicht alle Einzelfragen diskutiert werden. Inhaltlich ist mit den Verkehrspflichten ein deliktsrechtlicher Klassiker zu bewerkstelligen, und eher unbekanntere Anspruchsgrundlagen aus dem Deliktsrecht wollen erkannt und subsumiert werden. Insoweit sind Auslegungs‑ und Argumentationsvermögen unter Beweis zu stellen. Sodann erfolgt ein Streifzug durch das Schadensrecht, wenn es um die Erstattung von Besuchskosten geht. Abschließend geht es im zweiten Teil um eine Entscheidung des BGH zu den umstrittenen Anforderungen an einen Kündigungsgrund nach dem Eintritt von Haushaltsangehörigen in den Mietvertrag infolge des Todes der Mieterpartei (BGHZ 217, 263 = NJW 2018, 2397), deren Kenntnis von Studierenden nicht erwartet werden kann. Die Grundzüge des Mietrechts müssen beherrscht und mit einem geschickten Argumentationsvermögen verbunden werden.
Die Klausur wurde für den früheren Teil- schwerpunkt Kulturrecht am Fachbereich Rechts- und Wirtschaftswissenschaft der Johannes Gutenberg-Universität Mainz konzipiert, eignet sich aber auch für die Vorbereitung auf die staatliche Pflichtfach- prüfung sowie für den Schwerpunkt Wirtschaft-Staat-Kommunales (SPB 7).
Would the world be a better place if one were to adopt a European approach to state immunity?

This chapter argues not only that there is no European Sonderweg (or ‘special way’) when it comes to the law of state immunity but that there ought not to be one. Debates within The Hague Conference on Private International Law in the late 1990s and those leading to the adoption of the 2002 UN Convention on Jurisdictional Immunities of States, as well as the development of the EU Brussels Regulation on Jurisdiction and Enforcement, as amended in 2015, all demonstrate that state immunity was not meant to be limited by such treaties but ‘safeguarded’. Likewise, there is no proof that regional European customary law limits state immunity when it comes to ius cogens violations, as Italy and (partly) Greece are the only European states denying state immunity in such cases while the European Court of Human Rights has, time and again, upheld a broad concept of state immunity. It therefore seems unlikely that in the foreseeable future a specific European customary law norm on state immunity will develop, especially given the lack of participation in such practice by those states most concerned by the matter, including Germany. This chapter considers the possible legal implications of the jurisprudence of the Italian Constitutional Court for European military operations (if such operations went beyond peacekeeping). These implications would mainly depend on the question of attribution: if one where to assume that acts undertaken within the framework of military operations led by the EU were to be, at least also, attributable to the troop-contributing member states, the respective troop-contributing state would be entitled to enjoy state immunity exactly to the same degree as in any kind of unilateral military operations. Additionally, some possible perspectives beyond Sentenza 238/2014 are examined, in particular concerning the redress awarded by domestic courts ‘as long as’ neither the German nor the international system grant equivalent protection to the victims of serious violations of international humanitarian law committed during World War II. In the author’s opinion, strengthening the jurisdiction of international courts and tribunals, bringing interstate cases for damages before the International Court of Justice, as well as providing for claims commissions where individual compensation might be sought for violations of international humanitarian law would be more useful and appropriate mechanisms than denying state immunity.

Wirtschafts- und Sozialverträglichkeit des Klimaschutzes als Verfassungsgebot und Staatsräson

Das Spannungsfeld zwischen dem Ausbau erneuerbarer Energien einerseits und Akzeptanzproblemen andererseits adressiert der Landesgesetzgeber Mecklenburg-Vorpommerns mit einem Beteiligungsgesetz zur verpflichtenden wirtschaftlichen Teilhabemöglichkeit. Dabei stellt sich die Frage nach der Vereinbarkeit mit geltendem Recht, insbesondere ob der Landesgesetzgeber gesetzgebungsbefugt ist. Darüber hinaus zeigt der Autor den Rahmen für eine Regelung auf und positioniert sich zu möglichen Grundrechtseingriffen durch eine solche Regelung. Die Aktualität der Untersuchung zeigt die gegen das Gesetz anhängige Verfassungsbeschwerde ebenso wie die dynamische Gesetzgebung – so statuiert § 36g Abs. 5 EEG nunmehr eine Länderöffnungsklausel.

Werbeblocker berühren zahlreiche, bislang ungeklärte Rechtsfragen. Während Werbeblocker bisher vor allem anhand des Lauterkeitsrechts beurteilt worden sind, zeigt diese Arbeit, dass vielmehr urheberrechtliche Wertungen entscheidend sind. Diese werden mit Blick auf die aktuelle Rechtsprechung des EuGH ausführlich hergeleitet.
Weiterhin wird der Begriff des Mitbewerbers im Lauterkeitsrecht fortentwickelt und mit der Bezugnahme auf die geschäftlichen Entscheidung auf ein neues Fundament gestellt.
Die Arbeit analysiert zudem umfassend die Rechtmäßigkeit der Handlungsalternativen der Webseitenbetreiber und der Reaktionsmöglichkeiten der Werbeblocker aus lauterkeitsrechtlicher und urheberrechtlicher Sicht unter Berücksichtigung der DS GVO.
Wer ist neu an der Fakultät?

Wir freuen uns Herr Prof. Dr. Meinert und Herr Prof. Dr. Ismer an der Universität Potsdam begrüßen zu dürfen. Beide eint nicht nur, dass sie neu an der Fakultät sind, sondern auch ihre Vorliebe für das Steuerrecht. Wir durften beide interviewen und möchten sie Ihnen nun näher vorstellen.
Herr RiFG PD Dr. Carsten Meinert, Dipl.- Finw. (FH) arbeitet seit dem 1. Oktober 2023 als Professor für Bürgerliches Recht, Unternehmens- und Steuerrecht, als Nachfolger von Herrn Prof. Bezzenberger, an der Universität Potsdam. Wir freuen uns sehr, dass Herr Prof. Meinert den Ruf der Universität Potsdam auf die Professur angenommen hat.
Herr. Prof. Dr. Roland Ismer, ist seit dem 1. April 2024 neuer Inhaber der Professur für Öffentliches Recht und Steuerrecht und tritt damit die Nachfolge des im Sommer 2022 verstorbenen Herrn. Prof. Musil an. Weiterhin übernimmt Herr Prof. Ismer die Masterstudiengänge „Unternehmens- und Steuerrecht (LL.M.)“ sowie „Steurerrecht (LL.M.)“. Wir freuen uns sehr, dass Herr Prof. Ismer nun die Universität Potsdam bereichert.

Sechzig Jahre nach dem Beginn der Raumfahrt hat sich mit dem Weltraumrecht kontinuierlich ein völkerrechtliches Teilrechtsgebiet entwickelt, dessen Grundlagen und aktuelle Herausforderungen in diesem Lehrbuch behandelt und diskutiert werden. Ähnlich wie das Seerecht für die Meere oder das Luftrecht für den Luftraum versucht das Weltraumrecht, eine internationale Rechtsordnung für den verkehrlich neu erschlossenen Interaktionsraum, den Weltraum, zu schaffen. Dabei gilt es einerseits den Weltraum als Gemeinschaftsraum ohne einzelstaatliche Hoheitsgewalt zu bewahren, andererseits aber die vielfältigen staatlichen und neuerdings privaten Nutzungsinteressen im Weltraum zu berücksichtigen und in einen rechtlichen Ausgleich zu bringen. Der dem Menschen eigene Forscherdrang wird dafür sorgen, dass sich in Zukunft vermehrt weltraumrechtliche Fragen stellen werden.
Die Präsentation von Werbung im TV setzt auf technisch immer ausgefeiltere Methoden, um dem Zuschauer die jeweilige Werbebotschaft zu vermitteln. Zu diesem Zweck wird gelegentlich darauf hingewirkt, den Zuschauer nicht erkennen zu lassen, ob gerade noch das redaktionell-gestaltete Programm oder aber die ausschließlich kommerziellen Interessen dienende Werbung läuft. Diese bewusste Aufweichung der gebotenen Trennung von Programm und Werbung überschreitet klare medienrechtliche Grenzen, die der nachfolgende Beitrag thematisiert.
Die Wasserknappheit in einigen Regionen Asiens, Afrikas und Südamerikas geht nicht nur auf den Klimawandel und die damit verbundene Erderwärmung zurück, sondern ist oft auch Folge der Ansiedlungspolitik global agierender Konzerne, die für ihre Produktionsstandorte in den Entwicklungsländern große Mengen an Nutzwasser brauchen. Nicht immer wird dabei auf die wasserwirtschaftlichen Interessen der einheimischen Bevölkerung Rücksicht genommen. Zur Rechtfertigung verweisen die Konzerne gern auf die positiven wirtschaftlichen Effekte für den Gaststaat. Dieses als „Water Grabbing“ bezeichnete Verhalten ist aus rechtlicher Perspektive bislang noch nicht problematisiert worden, wozu es jedoch großen Anlass gibt.
In der modernen Kampfführung ist ein steigender Trend zu unbemannten und autonomen Systemen zu beobachten. Doch inwieweit gelingt es dem Recht, mit den technischen Entwicklungen Schritt zu halten? Ist der Einsatz vollautonomer Systeme noch mit dem geltenden Völkerrecht vereinbar? Die Autorin untersucht zunächst die rechtlichen Rahmenbedingungen einer Programmierung von vollautonomen Systemen und geht, sofern möglich, hierbei bereits auf technische Umsetzungsmöglichkeiten ein. Zugleich werden Grenzen der autonomen Entscheidungsfindung, wie z. B. bei der Bestimmung der Verhältnismäßigkeit eines Angriffs, aufgezeigt. In einem zweiten Teil untersucht die Autorin die Problematik der Entscheidungs- und Legitimitätskette bei Einsätzen autonomer Systeme. Waren bisher stets einzelne Soldaten bzw. ihre Befehlshaber für Kriegsverbrechen verantwortlich, so stellt sich bei vollautonomen Systemen die Frage der Verantwortlichkeit im Falle eines rechtswidrigen Einsatzes. Inwieweit kann ein technischer Defekt oder die Fehlprogrammierung eines Systems noch zu einer strafrechtlichen Verantwortlichkeit von Befehlshabern und militärischem Personal führen? Hierbei werden die Lücken des geltenden Völkerstrafrechts deutlich, welches bisher nur begrenzt eine Strafbarkeit für Fahrlässigkeit und Unterlassen vorsieht.
