Der Gegendarstellungsanspruch ist der älteste gesetzlich geregeltepresserechtliche Anspruch. Er entstammt dem französischenRecht, welches ein droit de réponse nach der Einführung derPresse- und Medienfreiheit in der Proklamation der Menschen-rechte vom 28.8.1789 schuf. Tatsächlich erweist es sich im deut-schen Recht für den Betroffenen als schwieriges und ggf. auchteures Unterfangen, eine Gegendarstellung durchzusetzen. Dasliegt einerseits an den besonders hohen Hürden, die bereits derGesetzgeber für einen Gegendarstellungsanspruch vorsieht, an-dererseits aber auch daran, dass die Medien zumeist nicht frei-willig eine Gegendarstellung veröffentlichen, so dass der Betroffe-ne regelmäßig die Gerichte bemühen muss. Das„Alles-oder-nichts-Prinzip“führt dann noch dazu, dass die Pressekammernbereits bei einer Beanstandung im Gegendarstellungstext denAntrag auf Erlass einer einstweiligen Verfügung zurückweisenmüssen und der Betroffene zunächst eine Neufassung der Gegen-darstellung zuleiten und sodann einen zweiten Zivilprozess be-treiben muss. Diese Situation gibt Anlass darüber nachzuden-ken, das„Alles-oder-nichts-Prinzip“, welches sich als reiner For-malismus erweist, aufzugeben und Änderungen des Gegendar-stellungstexts im Verfahrensverlauf zu ermöglichen.Erschwerend tritt jedoch hinzu, dass die meisten Landespressege-setze eine Anmerkung der Redaktion gestatten, die sich zwar auftatsächliche Angaben beschränken muss, aber auf die Gegendar-stellung erwidern darf. Nicht selten entwertet aber genau diesersog. Redaktionsschwanz die Gegendarstellung des Betroffenen ineiner Weise, dass beim Leser der Eindruck entsteht, dass der Be-troffene in seiner Entgegnung die Unwahrheit behauptet. Selbstwenn der Betroffene also die rechtlichen Hürden genommen hat,hat er damit immer noch das Risiko, zumindest medial als Ver-lierer dazustehen. Damit das Recht auf Gegendarstellung über-haupt noch eine tatsächliche Bedeutung im Sinne eines Bürger-rechts auf Entgegnung hat, ist darüber nachzudenken, ob ins-gesamt eine unmittelbare Verknüpfung der Erwiderung der Re-daktion mit der Gegendarstellung bzw. jedwede„Zusätze“zuuntersagen sind, wie es bereits in zahlreichen Rundfunkgesetzenoder für den Bereich der Telemedien auch durch den MStV vor-gesehen ist. Der Grundsatz der Waffengleichheit gebietet es, dassbeide Parteien auch im Recht der Gegendarstellung zu Wortkommen. Genau dieses geschieht aber, wenn die Gegendarstel-lung die Erstmitteilung der Redaktion im gebotenen Umfangwiedergibt und der Betroffene hierauf erwidert. Jede Partei mussangehört werden und zu Wort kommen, aber eben nicht zwei-mal. Jedenfalls sind auch in den Fällen, in denen tatsächlicheAngaben bei der Erwiderung der Redaktion erlaubt sind, dieseVorschriften jeweils eng auszulegen, um dem Betroffenen über-haupt noch hinreichend Gehör zu verschaffen.
Politikerinnen und Politiker sind zunehmend nicht nur einer ständigen Kritik durch Medien ausgesetzt, die es kaum noch möglich macht, Entscheidungen zu treffen, ohne sogleich die medialen Folgen mit einzuwiegen. Nicht selten müssen sie auch nach der Rechtsprechung von BGH und BVerfG aufgrund ihrer besonderen Stellung mehr Eingriffe in ihre Privatsphäre hinnehmen, als andere öffentliche Personen. Hinzutreten in den letzten Jahren die massiven verbalen Anfeindungen und damit einhergehenden tatsächlichen Bedrohungslagen. Die Rechtsprechung hat lange wie zuletzt im »Künast«-Fall dieses nicht hinreichend erkannt und berücksichtigt. Der Beitrag fordert eine Neujustierung der Rechtsprechung, die im Interesse der Allgemeinheit einen Schutz von Politkern vor öffentlicher Vorführung und Beleidigung sicherstellt.
