Seit 2002 wird das Standardkosten-Modell (SKM) als Ansatz zur Messung von Bürokratiekosten in einer Vielzahl von OECD-Ländern, darunter Deutschland und Großbritannien, angewendet. Im Zentrum dieser Arbeit steht die Frage, warum im Regulierungsreform-Nachzüglerland Deutschland die Ausweitung des Ansatzes auf den Bereich Bürger seit Jahren auf der politischen Agenda steht und bereits erste Schritte zur Umsetzung unternommen wurden, während SKM Bürger im Regulierungsreform-Vorreiterland Großbritannien scheinbar nie auf der Agenda stand. In Anlehnung an einen von Kingdon entwickelten Agenda-Setting-Ansatz werden Unterschiede im Bereich der Problemwahrnehmung, in der Bewertung der Policy SKM sowie im politischen Entstehungsprozess untersucht. Hierbei zeigt sich, dass hinsichtlich der Wahrnehmung des Problems der Bürokratiebelastung signifikante Unterschiede zwischen Deutschland und Großbritannien bestehen, die sich vor allem auf die in Deutschland höhere Intensität der Problemwahrnehmung beziehen. Weitere Unterschiede bestehen bezüglich der Bewertung der Policy SKM, die in Deutschland eine höhere Medienaufmerksamkeit erhält und allgemein positiver bewertet wird. Auch der Entstehungsprozess des SKM, der in Deutschland wesentlich stärker politisiert war als in Großbritannien, trägt zur Erklärung der beobachteten Unterschiede im Agenda-Setting bei.
Nachdem die deutsche Ministerialverwaltung seit nunmehr zwei Jahrzehnten die Anwendung von Folgenabschätzungen weitestgehend ignoriert hat, beschloss das Bundeskabinett im April 2006 ein neues Instrument der better regulation einzuführen: das Standardkosten-Modell (SKM). Ziel der vorliegenden Studie ist es, die Wirksamkeit dieses Instruments zu untersuchen. Dazu wird ein qualitativer Bewertungsmaßstab deduktiv hergeleitet, operationalisiert und empirisch getestet. Das SKM wird demzufolge dann als wirksam erachtet, wenn es 1.) das Kräfteverhältnis zwischen Regulierungsbefürwortern und Regulierungsskeptikern zu Gunsten Letzterer verschiebt und 2.) mit der Einführung des Instruments die Weichen für einen Wandel der Regulierungskultur in der Ministerialverwaltung gestellt werden. Es zeigt sich, dass das Instrument gemäß Annahme 1 als Erfolg bewertet werden kann. Allerdings relativiert sich das Ergebnis, da Annahme 2 nicht erfüllt wird.
Gesetzliche Informationspflichten wie Meldungen, Anträge, Erklärungen und Berichte übernehmen in einem modernen sozialen Rechtsstaat eine wichtige Kontroll- und Entscheidungsfunktion. So bildet die jährliche Steuererklärung für Finanzbehörden ein unverzichtbares Mittel zum Vollzug von Steuergesetzen. Statistiken wiederum geben Regierung und Parlament wichtige Anhaltspunkte für wirtschaftspolitisches Handeln. Die Bereitstellung und Übermittlung solcher Informationen ist jedoch nicht umsonst. In den Niederlanden werden Kosten, die Unternehmen aus der Befolgung gesetzlicher Informationspflichten entstehen, als administrative Lasten bezeichnet. Zur Berechnung administrativer Lasten in Euro wurde Anfang der 1990er Jahre vom niederländischen Forschungsinstitut EIM das Messinstrument Mistral (heute: SKM) entwickelt, welches den Ausgangspunkt für ein umfassendes niederländisches Reformprojekt zur Reduzierung administrativer Lasten bildete. Mittlerweile wird das SKM nicht nur in den Niederlanden angewendet. Vielmehr diente das niederländische Projekt einer Vielzahl europäischer Staaten und der Europäischen Union selbst als Blaupause für eigene Projekte zur Reduzierung von Bürokratiekosten. So übernahm beispielsweise die deutsche Bundesregierung 2006 das SKM als Grundlage für ihr Regierungsprogramm „Bürokratieabbau und bessere Rechtsetzung“. Die vorliegende Diplomarbeit richtet den Fokus auf den niederländischen Policyprozess zur Reduzierung administrativer Lasten. Analysiert werden dabei die einzelnen Phasen, angefangen von der zunehmenden Problemwahrnehmung Anfang der Mitte 1980er Jahre bis zur Umsetzung des Reformansatzes der zweiten Balkenende-Regierung 2004. Die Analyse unterstreicht, dass dem Reformprogramm der zweiten Balkenende-Regierung ein langjähriger Lernprozess vorangegangen ist. Ein SKM steht den Niederlanden zumindest theoretisch schon seit 1993 zur Verfügung. Damit war aber nicht gleichzeitig auch eine flächendeckende Anwendung verbunden. Die dafür notwendigen Voraussetzungen wurden sukzessive geschaffen. Insbesondere galt es, politikfeldübergreifend eine adäquate Infrastruktur aufzubauen. Das Instrument SKM übernahm im niederländischen Reformprozess folgende Funktionen: 1. Katalysatorfunktion Mit der ersten Bürokratiekostenmessung 1994 gelang es, das Bewusstsein der Politiker so zu stärken, dass die Kok-Regierung ein Reduzierungsziel von 25% formulierte. Für den Übergang zwischen Agenda Setting und Politikformulierung kann der Quantifizierung administrativer Lasten damit eine wichtige Katalysatorfunktion zugeschrieben werden. 2. Transparenzfunktion Am Beispiel des niederländischen Landwirtschaftsministeriums wird aufgezeigt, dass das SKM in den Niederlanden eine wichtige Transparenzfunktion bei der Aufdeckung von Reduzierungsmöglichkeiten übernommen hat. 3. Stärkung des Kostenarguments Eine adäquate Gesetzesfolgenabschätzung sollte eine gründliche Abwägung zwischen Kosten und Nutzen einer Informationspflicht beinhalten. Für den Nutzen einer Regelung können Befürworter einer Regelung stets gute Argumente aufweisen. Demgegenüber beschränkt sich die Argumentationsgrundlage bei den administrativen Lasten nicht selten auf die qualitative Äußerung, dass diese bestehen. Zusätzliches Gewicht bekommt die Kostenseite allerdings durch die systematische monetäre Ausweisung administrativer Lasten. Die bestehende Asymmetrie zwischen Nutzen und Kosten in einer Gesetzesfolgenabschätzung wird somit mit Hilfe des SKM verringert. 4. Monitoringfunktion Die Formulierung quantitativer Abbauziele setzt eine quantitative Evaluierung voraus. In den Niederlanden findet ein entsprechendes Monitoring seit 1999 statt. Dies war jedoch erst durch die systematische Erfassung administrativer Lasten mittels quantitativer Verfahren möglich geworden. 5. Planungsfunktion Mit Beginn der Regierung Balkenende II erstreckt sich die quantitative Zielstellung nicht mehr nur auf die Reduzierung bestehender Lasten, sondern erfasst auch die Zunahme infolge neuer gesetzlicher Regelungen. Die Formulierung eines solchen Nettoziels macht auch die Planung von neuen administrativen Lasten notwendig (ex ante Abschätzung über die Folgen neuer Gesetzgebung mit dem SKM). 6. Kontrollfunktion Um das Ziel einer Nettoreduzierung erreichen zu können, sieht der Ansatz der Regierung Balkenende II die Anwendung administrativer Lastenplafonds vor. Die Voraussetzungen, administrative Lasten wie eine Art Haushaltstitel zu behandeln, wurden jedoch erst durch die Anwendung von SKM geschaffen. Dem SKM kann damit zumindest indirekt eine Kontrollfunktion zugewiesen werden. 7. Symbolfunktion Dem Reformprojekt kann eine Symbolfunktion zugewiesen werden. Denn in der niederländischen Öffentlichkeit und im Ausland entsteht, zumindest oberflächlich betrachtet, der Eindruck, dass die Niederlande rein rechnerisch erhebliche Erfolge beim Bürokratieabbau erreicht haben.
