Das Buch enthält eingangs eine Einführung in den Menschenrechtsschutz auf der europäischen Ebene, die die erschiedenen Institutionen, Garantieen und Überwachungsmechanismen vorstellt. Der zweite Beitrag beschreibt die historische Entwicklung des Minder-heitenschutzes und seine heutige Ausformung. Im dritten Beitrag wird der Schutz vor Folter auf internationaler und europäischer Ebene behandelt und auf Fragen eingegangen, die sich in diesem Zusammenhang für die Bundesrepublik Deutschland stellen. Der vierte Abschnitt erörtert die sprachenrechtliche Situation von Minderheiten, wobei besonderes Augenmerk auf die Rechtsentwicklung in Europa gelegt wird. Im letzten Beitrag diskutiert der Autor den Zusammenhang von Rassismus und Menschenrechten.
Die Reform des Amtsrechts der Staatsanwaltschaft : europarechtliche und völkerrechtliche Impulse

Die Untersuchung legt zunächst das geltende Amtsrecht der Staatsanwaltschaft dar und gibt dann einen Überblick über die verschiedenen Stadien der seit vielen Jahrzehnten geführten Reformdiskussion. Dieser sollen durch Impulse aus dem Europarecht und dem Völkerrecht neue Argumente zugeführt werden. Die Europäischen Gemeinschaften betreiben die Einführung eines Europäischen Staatsanwaltes. Dieser soll im Rahmen der Betrugsbekämpfung zu Lasten des Gemeinschaftshaushaltes Ermittlungen durchführen. Seine Rechtsstellung unterscheidet sich signifikant von der des deutschen Staatsanwalts. Hinzu kommen bedenkenswerte Hinweise für die Rechtsstellung von Anklägern aus dem Völkerrecht. So sind die Ankläger vor dem Internationalen Strafgerichtshof und den Ad-hoc-Straftribunalen für das ehemalige Jugoslawien und für Ruanda selbständige Organe dieser Gerichte und ausdrücklich weisungsfrei. Dieses Buch untersucht, inwieweit Europa- und -in geringerem Ausmaß- Völkerrecht die Diskussion über die Reformbedürftigkeit des Amtsrechts der Staatsanwälte in Deutschland zu beeinflussen vermögen.
Die Studien analysiert die seit dem Beitritt mittel- und osteuropäischer Staaten nach dem Fall der Mauer ergangene Rechtsprechung der Europäischen Kommission für Menschen-rechte und des Europäischen Gerichtshofs für Menschenrechte. Die Hauptgegenstände der entschiedenen Fälle werden gruppiert und die Ergebnisse der Entscheidungen kommentiert. Als Ergebnis wird festgestellt, daß die Unterschiede zwischen Beschwerden aus den alten und neuen Mitgliedstaaten recht gering sind. Dies zeigt, daß nach der - mehrere Jahre in Anspruch nehmenden - Aufarbeitung der aus den Transformationsprozessen resultie-renden Probleme die europäische Rechtsgemeinschaft, wie sie in der Satzung des Europa-rates und der Präambel der Europäischen Menschenrechtskonvention beschworen wird, Realität sein wird. Unsicherheitsfaktoren wie der Beitritt Rußlands und die Zunahme von Beschwerdeverfahren trotz der zwischenzeitlich eingetretenen Reform des Überwachungsmechanismus werden für die Zukunft zu berücksichtigen sein.
Diese Studie will aufzeigen, welche Rolle der Achtung und Förderung der Menschenrechte in den Außenbeziehungen der Europäischen Union zukommt, und prüfen, welche Folgerungen daraus im innergemeinschaftlichen Bereich gezogen werden können. Dazu wird zunächst ein Überblick über die Entwicklung des Schutzes der Menschenrechte in den Außenbeziehungen, insbesondere im Rahmen der Entwicklungszusammenarbeit der Gemeinschaft gegeben. Daran schließt sich eine Darstellung der Rechtfertigung dieser Politik an. Die sodann vorzunehmende Würdigung ihrer heutigen Bedeutung schließt auch Fragen der Überwachung und Rechtsfolgen von Verstößen ein. Abschließend werden mögliche Rückwirkungen auf die innergemeinschaftliche Menschenrechtspolitik diskutiert.
Der Aufsatz stellt die geschichtliche Entwicklung der Menschenrechtsidee überblickartig dar, beschreibt Stationen ihrer Verwirklung und erläutert den gegenwärtigen völkerrechtlichen Menschenrechtsschutz. Die normativen Grundlagen und Möglichkeiten der Überwachung der so gesetzten Standards werden beschrieben. Abschließend nimmt der Aufsatz aktuelle Herausforderungen an den Menschenrechtsschutz zu Beginn des neuen Jahrtausends in den Blick. Es handelt sich um die gekürzte Fassung eines Beitrages, der im Sommer 2001 in einem Sammelband veröffentlicht wird.
This volume discusses the impact of human rights law on other fields of international law. Does international human rights law modify other fields of international law? Contributions focus on possible spillover effects of human rights on international economic or international criminal law. Does international human rights law have a streamlining effect on international law as a whole? This might be identified as a process of constitutionalisation. In this book, human rights can be understood as one of the core principles of international legal order and thus have an effect on the general law of treaties or on the settlement of disputes.
Although human rights law is a relatively young field of international law, its content and core values today are of major importance for the interpretation of international law as a whole. As we witness a redefinition of sovereignty as a responsibility of states towards the people and a shift to greater relevance of the individual in international law in general, it is a logical consequence that human rights have an impact on other areas of international law.
