"Vorübergehende" Leiharbeit

Leiharbeit ist aus dem modernen Arbeitsleben nicht mehr wegzudenken. Von besonderer Bedeutung für Entleiher und Leiharbeitnehmer waren und sind seit jeher die zeitliche Limitierung von Leiharbeit. Die Unbestimmtheit des durch die Leiharbeitsrichtlinie eingeführten Merkmals der »vorübergehenden« Dauer von Leiharbeit hat in Literatur und Rechtsprechung viele Meinungen hervorgerufen. Rechtssicherheit haben all diese nicht gebracht. Der Autor widmet sich der Herkunft und Bedeutung des Begriffs der vorübergehenden Dauer und bietet ein grundrechts- und unionsrechtskonformes Lösungsmodell zum Verständnis und Umgang mit diesem Merkmal. Die gefundenen Ergebnisse überträgt er auf die AÜG-Novelle von 2017.
Anhand des religiösen Selbstverständnisses der Kirchen und des darauf beruhenden Begriffs der »Dienstgemeinschaft« untersucht der Autor Zulässigkeit und Grenzen der Leiharbeit in kirchlichen Einrichtungen. Er empfiehlt die Schaffung von Regelwerken zur Einhaltung kirchlicher Loyalitätspflichten.
Die landesgeschichtliche Forschung hat den Werdegang des märkischen Zweiges der Familie von Trott und seiner einzelnen Mitglieder bisher weitestgehend ignoriert. Mit der nun vorliegenden Arbeit soll der defizitären Informationslage abgeholfen und vor allem die Etablierung des Geschlechts in brandenburgischen Landen in den Fokus gerückt werden. Woher kamen dessen frühen Vertreter, wann und wo konnten sie in der Mark Fuß fassen? Welche reichs- und territorialpolitischen Prozesse liefen zeitgleich ab, und wie beeinflussten diese eventuell den Werdegang dieser Familie? Konnte die Familie im Gegenzug eine Einflussnahme auf die Geschicke der Reichs- und Territorialpolitik entwickeln? Welche Spuren hinterließ sie in der märkischen Region?
Während eines umfangreichen Literatur- und Quellenstudiums kristallisierte sich bei dem Versuch, diese Fragen eingehend zu beantworten, die Persönlichkeit Adam von Trott des Älteren († 1564) heraus. Um das Jahr 1500 in der Landgrafschaft Hessen geboren, führten ihn sein Ehrgeiz und seine Zielstrebigkeit in den wechselhaften geschichtlichen Zeitläufen der Reformation bald an den Hof des brandenburgischen Kurfürsten Joachim II., wo er eine nahezu beispiellose Karriere absolvierte. Nebenher akkumulierte er durch die Übernahme weitläufiger Ländereien der säkularisierten Mönchszisterze Himmelpfort enormen Erblehnsbesitz in der Uckermark, dessen Konsolidierung sich die nachfolgende Generation der märkischen Trott verschrieb. Welche Schwierigkeiten und Fährnisse Adam und seine Nachkommen dabei zu bewältigen hatten, möchte der vorliegende Band klären.
In recent years, the ever-growing amount of documents on the Web as well as in closed systems for private or business contexts led to a considerable increase of valuable textual information about topics, events, and entities. It is a truism that the majority of information (i.e., business-relevant data) is only available in unstructured textual form. The text mining research field comprises various practice areas that have the common goal of harvesting high-quality information from textual data. These information help addressing users' information needs.
In this thesis, we utilize the knowledge represented in user-generated content (UGC) originating from various social media services to improve text mining results. These social media platforms provide a plethora of information with varying focuses. In many cases, an essential feature of such platforms is to share relevant content with a peer group. Thus, the data exchanged in these communities tend to be focused on the interests of the user base. The popularity of social media services is growing continuously and the inherent knowledge is available to be utilized. We show that this knowledge can be used for three different tasks.
Initially, we demonstrate that when searching persons with ambiguous names, the information from Wikipedia can be bootstrapped to group web search results according to the individuals occurring in the documents. We introduce two models and different means to handle persons missing in the UGC source. We show that the proposed approaches outperform traditional algorithms for search result clustering. Secondly, we discuss how the categorization of texts according to continuously changing community-generated folksonomies helps users to identify new information related to their interests. We specifically target temporal changes in the UGC and show how they influence the quality of different tag recommendation approaches. Finally, we introduce an algorithm to attempt the entity linking problem, a necessity for harvesting entity knowledge from large text collections. The goal is the linkage of mentions within the documents with their real-world entities. A major focus lies on the efficient derivation of coherent links.
For each of the contributions, we provide a wide range of experiments on various text corpora as well as different sources of UGC.
The evaluation shows the added value that the usage of these sources provides and confirms the appropriateness of leveraging user-generated content to serve different information needs.
Anne-Katrin Wolf beschäftigt sich mit der Aktivlegitimation im Individualbeschwerdeverfahren der UN-Menschenrechtskonventionen. Sie gibt einerseits eine leitfadenartige Übersicht zum Zulässigkeitskriterium der Aktivlegitimation. Andererseits zeigt sie, dass die Auslegungspraxis der UN-Ausschüsse zu dessen Voraussetzungen derzeit an einigen Stellen zu eng gefasst ist, um einen effektiven Menschenrechtsschutz zu gewährleisten. Im Zentrum steht dabei die Kategorisierung der UN-Menschenrechtskonventionen anhand der jeweiligen Regelungsmaterie und die daran anknüpfende, unterschiedlich weit reichenden Beschwerdemöglichkeiten von Individuen und Kollektiven wie Verbänden oder Nichtregierungsorganisationen. Sofern eine Ausgestaltung durch die Ausschüsse selbst noch nicht erfolgt ist oder die Autorin bisher angewendeten Kriterien als defizitär bewertet, entwickelt sie Vorschläge zu einer möglichen Ausformung des Kriteriums der Aktivlegitimation in der Zusammenschau mit dem jeweiligen Schutzgehalt der Konvention.
Anhand einer inhaltlichen Untersuchung der französischen fünfbändigen Oktavausgabe seines Essai politique sur le royaume de la Nouvelle-Espagne (1811), unter besonderer Berücksichtigung der intertextuellen Bezüge, wird Alexander von Humboldt auf multiplen Ebenen als Denker zwischen Europa und Amerika ausgewiesen. In seinem Werk über Neuspanien durchbricht er die Inferiorisierung amerikanischer bzw. kreolischer Wissenschaftler und schafft ein Bewusstsein fernab eurozentrischer Denkmuster. Dies äußert sich unter anderem in Humboldts unvoreingenommener intertextueller Einbeziehung von Vertretern verschiedener Strömungen der Aufklärung, insbesondere des kreolischen aufklärerischen Denkens.
Alte Kämpfer der NSDAP

Als „Alte Kämpfer“ galten im Nationalsozialismus alle Personen, die bereits weit vor 1933 der NSDAP beigetreten waren. Sie wurden bislang überwiegend als soziale Randexistenzen und Verlierer der Machtergreifung beschrieben. Anja Stanciu zeigt in ihrer Studie am Beispiel der Berliner NSDAP-Stadtverordneten und –Kreisleiter nun, dass etliche Altparteimitglieder nicht nur Wegbereiter, sondern auch wichtige Mitgestalter der NS-Diktatur waren und zur lokalen NS-Funktionselite gehörten. Untersucht werden die Lebensläufe und Netzwerke dieser Männer zwischen 1926 und 1949. Dabei geht es vor allem um die Frage, wie die Karrieren der „Alten Kämpfer“ und die politische Mobilisierung der Stadtgesellschaft einander bedingten.
Am 14. August 1980 begannen die Arbeiter*innen auf der Danziger Leninwerft einen Besetzungsstreik, in deren Folge die erste unabhängige Gewerkschaft Solidarność gegründet wurde. Einen Monat später am 17. September 1980 gingen auf der anderen Seite des „Eisernen Vorhangs“ die Arbeiter*innen der „AG Weser“ Werft in Bremen auf die Straße, um gegen den Verlust ihrer Arbeitsplätze zu protestieren. Die vorliegende Studie zeigt aus einer Perspektive „von unten“, wie seit den 1970er Jahren Betriebe in zwei unterschiedlichen politisch-ökonomischen Systeme auf technische Veränderungen und die verschärfte Konkurrenz auf dem Weltmarkt reagierten und verweist darauf, dass die Krisen in Ost und West Ende der 1970er Jahre eng miteinander verbunden waren.
Arnold und Stefan Zweig sahen sich als „geistige Führer", gelten aber, bis auf ihr Interesse an der Psychoanalyse, als sehr verschieden. Die Auswertung ihrer Publizistik – darunter viele unbekannte Texte – zeigt erstmals systematisch, wie sie sich an Debatten der Zwischenkriegszeit beteiligten. Die Autorin prüft Aussagen über Demokratie, Sozialismus, Nationalismus, Europa, Pazifismus, die UdSSR, ihr jüdisches Erbe, Zionismus und Antisemitismus. Die Zweigs erscheinen als unabhängige Zeitkritiker, die oft übereinstimmend und wegweisend urteilten. Ihre unveröffentlichten Briefe (1919–1940) bieten Einblick in diese kaum bekannte Beziehung. Die Studie stellt in der Germanistik verbreitete Zweig-Bilder infrage, die wesentlich durch den Kalten Krieg beeinflusst wurden.
