Menschenrechte fangen nicht erst auf der Polizeiwache an, sondern bereits nach dem Frühstück (Sieghart). Der - auf einer Ringvorlesung an der Universität Magdeburg beruhende - Beitrag erläutert die Entwicklung und rechtliche Verankerung wirtschaftlicher, sozialer und kultureller Rechte. Nach einer Beschreibung der zur Verfügung stehenden Kontrollmechanismen wendet er sich aktuellen Streitfragen wie Universalität der Menschenrechte oder sozialen Grundrechten in den Verfassungen einiger deutscher Bundesländer zu.
Diese Studie will aufzeigen, welche Rolle der Achtung und Förderung der Menschenrechte in den Außenbeziehungen der Europäischen Union zukommt, und prüfen, welche Folgerungen daraus im innergemeinschaftlichen Bereich gezogen werden können. Dazu wird zunächst ein Überblick über die Entwicklung des Schutzes der Menschenrechte in den Außenbeziehungen, insbesondere im Rahmen der Entwicklungszusammenarbeit der Gemeinschaft gegeben. Daran schließt sich eine Darstellung der Rechtfertigung dieser Politik an. Die sodann vorzunehmende Würdigung ihrer heutigen Bedeutung schließt auch Fragen der Überwachung und Rechtsfolgen von Verstößen ein. Abschließend werden mögliche Rückwirkungen auf die innergemeinschaftliche Menschenrechtspolitik diskutiert.

Das erste umfassende deutschsprachige Lexikon über die Vereinten Nationen enthält einen menschenrechtlichen Schwerpunktteil. Dieser Beitrag gibt eine grundlegende Einführung in die geistesgeschichtliche Entwicklung der Menschenrechte. Außerdem erläutert er in geraffter Form die Normierung von Menschenrechten auf der universellen Ebene. Abschließend werden verschiedene, häufig diskutierte Problemfelder behandelt. Hierzu zählen Fragen der Universalität von Menschenrechten, das Recht auf Entwicklung und die Durchsetzung und Förderung von Menschenrechten.
Nach einleitenden Ausführungen über die Maßnahmen zum Schutz von Frauenrechten im Rahmen der Vereinten Nationen insgesamt konzentriert sich der Beitrag auf die Darstellung des Übereinkommens zur Beseitigung jeder Form von Diskriminierung der Frau (CEDAW). Dessen materielle Gewährleistungen werden erläutert und der zugehörige Überwachungsmechanismus vorgestellt. Ein abschließender Ausblick stellt die Neuerungen dar, die mit den Individualbeschwerdeverfahren verbunden sein werden, die durch das inzwischen in Kraft getretene Zusatzprotokoll zu erwarten sind.
Oftmals bescheinigt das Bundesverfassungsgericht den Fachgerichten objektive Willkür. Die vorliegende Untersuchung zeichnet die Herleitung dieses Topos aus Art. 3 Abs. 1 Grundgesetz nach. Die vom Bundesverfassungsgericht entschiedenen Urteilsverfassungsbeschwerden werden systematisiert und ausgewertet. Dabei wird deutlich, daß das Kriterium der objektiven Willkür in verschiedenen Bereichen recht unterschiedlich gehandhabt wird. Nach einem Abriß über das Verhältnis von Verfassungsgerichtsbarkeit und Fachgerichtsbarkeit setzt sich die Untersuchung mit den Zielen der Rechtsprechung zur objektiven Willkür auseinander. Der Dienst an der Gerechtigkeit wird durch ein gerechtes Verfahren, aus Sicht des Bundesverfassungsgerichts vor allem aber durch ein gerechtes Ergebnis im Einzelfall geleistet. Der Autor prüft nach, ob tatsächlich Defizite bestehen und ob das Bundesverfassungsgericht sie behebt.
